Roommate Agreement

The following roommates have signed a roommate agreement on the __30___ day of ____December , 2010 for the following house: 519 12th Ave S St. Petersburg FL 33701 Roommate #1: Jaime Braden TERMS 1.This Agreement will remain in effect until March 1st, 2012. EXISTING RESIDENTIAL LEASE AGREEMENT 2.The roommates agree that this Roommate Agreement will exist alongside the Residential Lease Agreement. It is intended to set forth the rights and responsibilities that the roommates have with respect to each other. It does not, in any way, serve to replace or amend the rights and responsibilities arising from the Residential Lease Agreement. 3.Execution of this Roommate Agreement does not alter the joint and several liability of the tenants under the Residential Lease Agreement with the landlord. However, it may be used if a dispute among the roommates arises. RENT 4.The rent for the property at the address above is $750 per month, due and payable on the 1st day of each month to Slumlord. 5.The roommates agree that they will share the rent amount equally as indicated below: Roommate share of monthly Roommate share of initial Name rent deposit Jaime $100 - payed through Utilities $0 Braden and House duties 6.All roommates agree that Kimberly will be responsible for collecting each roommate's share of the rent and forwarding it to the landlord. 7.All roommates agree that Kimberly will be responsible for organizing and keeping records of payment information. UTILITIES 8.The roommates agree that they share a duty to pay for the utilities that are not included in rent paid to the landlord. 9.Copies of all bills will be provided for inspection to any other roommate who requests to see the bills. All bills will be kept in a safe place agreed upon by all roommates to make ensure they are available in the event of dispute. 10.The details of the utilities to be divided among the roommates are as follows. HOUSE RULES 11.All roommates agree to be reasonable and professional in their dealings with each other, and to refrain from any behavior, action, or inaction that they know or should have reason to know will significantly interfere with the other roommates' enjoyment of their tenancy. All roommates agree to discuss frankly and unemotionally all concerns before problems occur. All roommates agree to negotiate in good faith, should the need arise. All roommates will respect each others' privacy, sleep schedules, and other requests that are not unreasonably burdensome. 12.Despite the intentions of the roommates that they reside in an environment free from stress and conflict, they acknowledge that conflicts may occur from time-totime. Some areas where conflicts can arise include, but are not limited to, smoking, alcohol and other drugs, illegal activities, roommates, use of stereo and television, quiet hours for studying, parking, use of personal property, and the behavior of friends and guests.The roommates have agreed to elaborate on the areas that follow: Smoking 13.All roommates understand that smoking will not be tolerated inside the premises, but outside only. Alcohol 14.All roommates agree that alcohol will not be permitted on the premises. Illegal Activities 15.All roommates agree that they will not engage in any illegal activities while on the premises. Parties, gatherings, and celebrations 16.The roommates agree to obtain the appropriate permits and to follow the lease, rules, and regulations of the landlord, and any governing local ordinances regarding roommates, gatherings and celebratory events at the premises. Consent for such gatherings must be obtained from each roommate. In the event a roommate to the Agreement does not consent to the gathering, the other roommates may not hold such an event on the premises. Guests 17.Any roommate intending to have a guest stay overnight must obtain permission from the other roommate(s) prior to the stay. Each roommate is responsible for the behavior of his or her guests. Guests will not unreasonably disturb other roommates. Guests must stay in the bedroom of the roommate who invited them, unless all other roommates agree that the guest may stay in a shared area.

18.No guest may stay for more than 4 consecutive days without the permission of all other roommates. 19.If at any time the guest substantially interferes with the comfort, safety or enjoyment of the other roommate(s), any roommate may revoke said guest's license by expressly informing the "host" roommate and/or the guest that the guest's permission to stay in the rental unit has been revoked, along with the reason(s) for this revocation. After said guest and/or the "host" roommate have been so informed, the guest will be expected to promptly vacate the rental unit. Use of Personal Property 20.Property deemed personal in nature includes all property kept in each roommate's bedroom which belongs to that roommate. All roommates agree to refrain from borrowing the personal goods of any other roommates, without prior approval. Exceptions to this should be clearly stated, with the roommates reserving the right to change their minds about the sharing of their items. If damage is done to personal property, the roommate responsible for the damage will be held liable. HOUSEHOLD DUTIES AND RESTRICTIONS Damages 21.Any roommate who causes damage to the premises or to the personal property of any roommate will be responsible for that damage. Damages caused by the guests, invitees, or permitees of any roommate, will be attributed to that roommate. Any damages that cannot be traced to any particular roommate with reasonable certainty will be paid equally by all roommates to this Agreement. 22.In the event of a dispute regarding responsibility for damages, the roommates agree that they will try to negotiate the matter in good faith. The roommates agree that in the event a dispute does occur, they will first obtain to resolve the matter by way of a mediator or other neutral roommate mutually chosen by all roommates. TERMINATION OF TENANCY 23.No roommate will be asked or required by another roommate to involuntarily terminate his or her tenancy unless: "a vote is held by the roommates and the majority vote in favour of terminating the roommate's tenancy; "the roommate has failed to make his or her portion of the rent to which the landlord is lawfully entitled under this or any other agreement; "the roommate has failed to make his or her agreed portion of utiltities, common household expenses, Household duties; "the roommate has committed or has permitted to exist a substantial nuisance in, or has caused significant damage to, the rental unit, or has created or has permitted to exist a substantial interference with the comfort, safety or enjoyment of the landlord and/or the other roommate(s), and the nature of such nuisance, damage or interference is specifically stated in writing by the landlord or the other roommate(s) and has not been reasonably corrected; "the roommate has violated a lawful obligation or covenant enumerated in the Residential Lease Agreement between the landlord and roommate(s) without the express permission of the other roommate(s);

roommate has substantially violated any express material agreement which may be created between him or her and the other roommate(s) under this Agreement. <Partial Rent; House Duties> 24.If any roommate vacates the premises for any reason, and fails to collect his or her property within 30 days, the property may be considered abandoned by the remaining tenants. At the end of that time, the remaining tenants may discard the abondoned property or else sell or auction the abandoned property to satisfy outstanding debts of the breaching roommate under this Agreement. FIRST ADDITIONAL TERM 25.As agreeded upon partial rent will be payed by Jaime Braden through household chores and cleaning. The following items are listed to be included in the household chores and/or cleaning of the premises listed above: General Cleaning: General cleaning is a daily event or as often as needed and includes, but not limited to, Sweaping, light dusting, Tidy rooms, cleaning countertops, table surfaces and stovetop, dinner dishes washed, trash removel ( including babies trash ) Laundry if needed*. Deep Cleaning: Deep cleaning is done one day a week at Jaime Bradens choice of day and agreeded upon by roomates a week prior includes, but not limited to, Cleaning of Ceiling Fans, Wipe doorways, baseboards and air vents, dust blind, sills and ledges, vacuume furniture for pet hair and debri (including under cushions), spot cleaning light switch plates and fingerprints, Vacuum floor surfaces and Mop as needed ( moving furniture ), Cleaning glass windows if needed to remove obvious dirt, Scrub tub and sinks for soap scum, Wash toilet, inside and out, Clean bathroom cabinet mirror, wash front of kitchen cabinets and front of kitchen island drawers, move small appliances on counters and wipe them down and clean surfaces under the small appliances, Laundry washed and folded. *It must be aggreed upon by Jaime Braden that she is able to do such and folding does not have to be included. SECOND ADDITIONAL TERM 26.As agreeded upon partial rent will be payed by Jaime Braden through cooking a family meal two nights a week. The dates to be agreeded upon by all the roomates a week prior. ENTIRE AGREEMENT 52.This Agreement, along with the Residential Lease Agreement, will constitute the entire agreement. Any prior understanding or representation of any kind preceding the date of this Agreement or the Residential Lease Agreement will not be binding on either party to the extent incorporated in both agreements.
