January 11, 2012 Re: Proposition 39 Offers to Charter Schools for 2012-2013 School Year Dear Principal, Thank you for assisting the District in its obligations to comply with charter schools Proposition 39 facilities requests for the 2012-2013 school year. I am writing to inform you that, after carefully weighing various educational, safety, and space-related factors, and benefiting from the valuable engagement and recommendations of Local District Leadership and Board offices, I personally approved a preliminary proposal for a charter school to potentially co-locate on your campus in the upcoming school year (list attached). This is a painstaking process and while there will be impacts to campuses, we have worked diligently to minimize the impact on campuses, and most importantly, to students. I understand that, in many situations across the District, set asides critical to important District and local educational initiatives may be reduced or eliminated in order to allow for some preliminary proposals. Throughout this process, decisions were based on efforts to ensure full compliance with the law while also attempting to incur the least disruption possible to students in District-operated schools. These preliminary proposals fully satisfy Proposition 39s requirements, but do not voluntarily offer more than the Districts legal obligation. It is important to note that per regulations governing Proposition 39, the district may not know for certain whether a charter school will actually accept the Districts offer and occupy space on your campus until at least May 1. In addition, should a charter school that accepts an offer to co-locate on a District campus not realize its enrollment projections, the District maintains the right to obtain a monetary over-allocation reimbursement or reclaim the over-allocated space. The next steps in the Proposition 39 process, as predicated by law, are as follows: February 1: The District will make a preliminary proposal to the charter school to co-locate on your campus during the 2012-13 school year. March 1: The charter school must submit its counter-proposal to the District if it is not satisfied with the Districts preliminary proposal. April 1: The District must send a final offer to the charter school. May 1: The charter school must notify the District in writing whether or not it intends to occupy the offered space or else the final offer expires.

Within the next several days, the Districts Proposition 39 staff will send you a Co-Location Operations Plan (COP) that will need to be completed and returned in order to assist the District

facilitate effective operations and provide specific data needed to ensure full compliance with Proposition 39s regulations.
