MATTERS OF HEALTH, SAFETY AND ENVIRONMENT The Subcontractor shall observe strictly and implement the guidelines and the procedures included in the Health and Safety Plan (HSP) of the Project, which shall be given to him immediately upon his settlement in the site, but also the special Programmes and Guidelines on Health, Safety and the Environment (HSE) that shall be issued during the Project. The Subcontractor shall submit his own Health and Safety Plan immediately but not later than 10 days from the signing of the agreement. The Subcontractor shall appoint at his own expense a HSE Responsible Person (HSRP) in accordance with the provisions of Turkish Law, who shall assume all liability and obligations as arising from the Law. The Subcontractor shall submit to POWER PROJECTS (PPR) a copy of his agreement with the HSRP as well as copies of attendance of special seminars. The Subcontractor shall appoint a Health, Safety and Environment Responsible Person (HSRP), who shall be present on the Site on a daily basis in order to immediately take care of and resolve any problems. The HSRP shall cooperate with the Power Projects Health, Safety and Environment Engineer of the project and shall participate in all regular (weekly) meetings for safety matters. The Subcontractor shall comply with the PPR HSE Engineer suggestions on health and safety and environmental issues on the Site. Moreover, he shall comply with the Guidelines on Environmental Management regarding Waste and Gas Emissions (see attached Guidelines: Monitoring and Management of Waste & Hazardous Materials and Monitoring and Management of Gas Emissions, Noise And Traffic). An environmental Impact Assessment (EIA) study has been executed by Client and environmental terms have been defined and approved. Subcontractor should take care of keeping EIAs requirements. He shall allow POWER PROJECTS and the project clients Health and Safety and Environment Officers to perform periodic inspections/audits during the works in order to ensure observation and implementation of the rules imposed. In addition to the training that the Subcontractors HSRP has provided to his staff, all his staff to be engaged in the project shall undergo induction training prior to the commencement of works. The Subcontractor shall each time give prior notification by way of a written list regarding the staff he intends to bring, so as to schedule training. Untrained persons shall be prevented from entering the site. POWER PROJECTS shall have the right to repeat training when it so judges necessary, and the Subcontractor shall allow his staff to participate. The written list shall contain the information required by the HSS Procedure for safe pass system. The Subcontractor shall inform his staff regularly on health and safety and environmental issues or for any changes in existing procedures. For any briefing, minutes shall be taken on the matters discussed and the full names of the participants, which shall be signed by all participants. In case of employment of foreign staff, the Subcontractor shall produce their legalizing documents and the work permits. In this case he shall translate the Health and Safety and the Environment (HSE) guidelines as well as any document or regulation or law concerning HSE into the language of his foreign employees. Moreover, he shall have a head foreman or engineer being present in the project on a daily basis, who also speaks (apart from Turkish) the language of the foreigners in order to have unobstructed communication with his employees.

He shall immediately notify the responsible persons at POWER PROJECTS for any accident, damage, serious illness or other incidents of his staff that may occur in the project and complete the relevant documents to the competent authorities. He shall display on his premises a notice board for the information of his employees. The board shall contain, among other things, a list with all emergency contacts. The Subcontractor shall have his staff periodically checked medically and shall keep a Medical File for his staff. Prior to the assignment of tasks and the delegation of duties to his staff, he shall, in addition to the technical qualifications, check and take into consideration the medical history of each of his employees (e.g. cases of claustrophobia, epilepsy, acrophobia, asthma, heart conditions etc should be taken into serious consideration). The Subcontractor shall provide all necessary Personal Protection Equipment to his staff (gloves, hard hats, high visibility (HV) uniforms, safety shoes, 3-point safety belts, safety goggles etc). In addition to POWER PROJECTSs toilet facilities, the Subcontractor shall provide hygiene facilities (Chemical Toilets) for his staff in case this is deemed necessary, for whose cleaning and maintenance he shall be responsible. Also, he shall provide appropriate Changing rooms for the convenience of his staff. He shall keep and complete a list of available Personal Protective Equipment for his staff, with acknowledgement of receipt (employees signature). The Subcontractor shall be liable for any accident that may happen during the execution of works to his staff or POWER PROJECTSs staff or third parties and shall take all such safety measures as may be necessary for the prevention of accidents. POWER PROJECTS shall have the right to remove without a warning and without compensation any of the Subcontractors persons that does not comply with safety measures. The Subcontractor shall be liable for any loss or failure that he may cause during the execution of his works for any reason or due to any cause, which is to the disadvantage of the property of POWER PROJECTS or third parties, being obliged to fully make good such loss or failure. He shall place fire extinguishers in his facilities as well as all his work areas, which he shall maintain, inspect and replace upon expiry. Each machine and vehicle used in the Project shall be furnished with all relevant certificates (registration, exhaust control card, suitability certificate etc). Such certificates shall always be valid under the responsibility of the Subcontractor, who shall take care of the prompt renewal thereof. The Subcontractor shall submit in advance the permits, certificates, attestations for all machines, equipments and vehicles that he will use in the project. No machinery without suitable and valid certification shall be used on the Site. All machines, equipment and vehicles shall be used solely for the purpose stated on their documents. The operators of machines, vehicles etc shall hold valid permits for their use. In case of lifting heavy objects (more than 20 tones), or lifting by using 2 cranes, approval by POWER PROJECTSs responsible officer shall be required. To this end, the Subcontractor shall submit a study and a lifting/management plan for approval.

The Subcontractor shall keep the site areas given to him clear of any obstacle; at the end of each shift, he shall remove all waste or excess materials remaining after the execution of the Subcontractors Works. All waste materials shall be separated and disposed of/ collected in designated by the site areas (i.e. into metals, excavation materials and waste, paper and domestic waste etc). Upon the completion of the Subcontractors Works, the Subcontractor shall remove from the premises of the Site his construction equipment and his machinery, his installations as well as excess materials and waste that remain after the execution of the Subcontractors Works; he shall leave the said areas clean and generally in a condition approved by the Contractor. Should the Subcontractor not honor these obligations subsequent to a notification to this effect by the Contractor, the latter may, reserving all his other rights, carry out on his own this task and set off the cost thereof with the amounts owing to the Subcontractor. The Subcontractor shall keep all passages/access to the work areas clear of obstacles, objects, rubbish, etc, taking care of them on a daily basis. All auxiliary structures and self-help housing, such as the structure of temporary access and platforms for the staffs safe work and the execution of the relevant checks, shall be undertaken at the expense and care of the Subcontractor. All open sides, trenches and opening or holes shall be secured against falling and shall be protected by temporary railing or partitions. Also, the Subcontractor shall: - inspect periodically his equipment and manual tools, taking care of the maintenance thereof and the removal of those that are not safe or are faulty; - use temporary power supplies only from the points that have been suggested. For work in areas that have been designated dangerous a work permit given by POWER PROJECTS shall be required. CONSTRUCTION REMOVAL OF SCAFFOLDING Scaffolds shall be made in accordance with the provisions of Turkish Law and the requirements of the HSP. During the construction of scaffolding and generally execution of the projects works by the Subcontractor, cutting of bottom beams, welding of beams, the projects core structure and any modification to the existing installation shall not be allowed. It shall be allowed to temporarily remove bottom beams, to temporarily support scaffolding points or any other self-help housing of the Subcontractor on beams or surface parts of the installation, provided it is allowed by the appointed engineer of POWER PROJECTS and subject to the Subcontractors taking of all necessary safety measures for the prevention of accidents to the staff and damages to the projects installations. For ascend/descent to the various work levels of the scaffold, the Subcontractor shall place ladders. Planks on the work floors shall be without gaps and joined together and with the scaffold. There shall be handrails on all work floors. Scaffolds that are half-finished, under dismantlement, or have been designated non-safe, shall bear special signs so as to prevent them from being used. Sandblasting and painting works shall be carried out in an open or enclosed space in order to avoid polluting the surrounding area. The Subcontractor shall, upon completion of the work, remove all empty containers of paint and the remaining sand. He shall submit documents for their transport and delivery to authorized waste management companies, submitting at the same time a copy of the license of the company approved by the competent Ministry. WORK CONDITIONS Due to the continuous development of the works of this project but also the other projects executed on the same site, the conditions are constantly changing and shape up a dynamic situation necessitating the continuous attendance and supervision of the Subcontractor through his appointed persons, so as to take any necessary adaptation measures of the crews to such conditions, aiming primarily at preventing accidents to his staff, the staff of the company, of a third party ,the environment or any equipment damages WORK SPECIFIC ASSESSMENT METHOD STATEMENTS AND WORK SPECIFIC RISK

For all major works to be undertaken, Subcontractors and their subcontractors, based on the specific methodology for the works they will execute, they will develop Work Specific Method Statements including the associated risk assessment (Work Specific Risk Assessment) and submit them for review and acceptance prior to commence construction activities (at least 4 weeks in advance), to Contractor and Client. The approved Method Statements, having taken into consideration all PPR and Clients remarks, will be strictly followed. The minimum HSE requirements, which are included in Level 3 of projects HSE manual, shall be the basis for the Work Specific Method Statements including the associated risk assessment to be prepared by the Sub-Contractor.

MONTHLY FOLLOW UP Subcontractor is obliged to keep track of all waste disposed. Subcontractor shall provide per month to Contractor (PPR) details per waste (in Excel lists) of the disposed waste. Contractor / Subcontractor are obliged to keep track of energy and water consumption. If needed Subcontractor will submit to Contractor relevant information.
