The accused was caught at the spot while a siphon pipe is running over the outlet No.10 of Gujjiani un-authorizely during night time. The accused admitted his offence. On14.12.2009 during night the accused was given in Police custody at Police Station Donga Bonga. The Police of Donga Bonga Station presented the accused in my court on 15.12.2009. The accused was charged under section 70 of Canal and Drainage Act to which he pleaded guilty. He has pleaded as guilty and same supported from complaint/ Istighasa. I held him guilty for charge under section 70 of Canal and Drainage Act on account of deliberate theft of canal water. He is sentenced undergo rigorous imprisonment for a period 30 days (Thirty Days) and fine for Rs.10000/ (Rupees Ten Thousands). The accused was caught at the spot while a illegal lift pump mounted with tractor is running over the outlet No.29 of Sirajwah disty to theft canal water illegally from Sirajwah Disty which was raising stage due to fresh supply. On receipt of complaints regarding theft of water, a joint raid was conducted with the help of police of concerned Police Station Sadar Bahawalnagar. As the accused was caught at the spot and by stealing the canal water through illegal lift pump and in this way, he caused damage to the other share holders of the remaining down stream outlets and also committed theft, hence the accused was given in Police custody at Police Station Sadar Bahawalnagar on the same day along with lift pump and tractor. The Police of Sadar Station Bahawalnagar presented the accused in my court on 23.04.2010. The accused was charged under section 70 of Canal and Drainage Act amended on 06, November 2010 to which he pleaded himself guilty. Two P.Ws Muhammad Ismail mate and Ansar beldars of Sirajwah Section were also recorded. He has pleaded as guilty and same supported from complaint/ Istighasa. In light of aforesaid facts I held him guilty for charge under section 70 of Canal and Drainage Act (amended 06 November 2010 on account of deliberate theft of canal water. The accused were caught at the spot while an illegal lift pump mounted with tractor is running over the outlet No.29 of Sirajwah disty for theft of canal water illegally from Sirajwah Disty which was raising stage due to fresh supply. On receipt of complaints regarding theft of water, a joint raid was conducted with the help of police of concerned Police Station Sadar Bahawalnagar. As the two accused Mr. Muhammad Rafique son of Muhammad Haneef and Muhammad Haneef son of Remat were caught at the spot and by stealing the canal water through illegal lift pump, he caused damage to the other share holders of the remaining down stream outlets and also committed theft, hence these two accused were given in Police custody at Police Station Sadar Bahawalnagar on the same day along with lift pump and tractor. The third accused Fauji Nabi Bakhash ran away from the spot but presented in my court voluntarily and confessed his offence of stealing canal water. The Police of Sadar Station Bahawalnagar presented the accused in my court on 23.04.2010. The accused were charged under section 70 of Canal and Drainage Act amended on 06, November 2010 to which they pleaded themself guilty. Two P.Ws Muhammad Ismail mate and Ansar beldars of Sirajwah Section were also recorded.They have pleaded as guilty and same supported from complaint/ Istighasa. In light of aforesaid facts I held them guilty for charge under section 70 of Canal and Drainage Act (amended 06 November 2010 on account of deliberate theft of canal water. Mr. Muhammad Zulfqar S/O Muhammad Ashrif Caste Kharal resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar. 2. Mr. Muhammad Azam S/O Muhammad Asghar caste Kharal resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar. 3. Mr. Mumtaz Ahmed S/O Muhammad Ishaque caste Arain resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar. 4. Mr. Muhammad Ahmad S/O Bilal caste Arain resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar. 5. Mr. Gulzar Ahmad S/O Muhammad Ashrif caste Kharal resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar. 6. Mr. Muhammad Illyas S/O Muhammad Anwar caste Kharal resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar. on account of altering/ enlarging and snatching iron machine of outlet No. 11 at RD 18641/R of Takkat Mahal Minor and further consequently theft of irrigation water through enlarged and tempered with outlet for unauthorised irrigation. The brief facts of the complaint/ Istighasa are as under. During the night of 5-6/05/2010, the shareholders of outlet changed the iron machine of the outlet with a new enlarged size of iron machine to increase the discharge of outlet illegally. The supervisory staff i.e mate and beldar informed to the concerned sub-engineer regarding enlargement of said outlet. On 06-05-2010, after site inspection, the sub-engineer Mr. Muhammad Anwar informed to the Sub-Divisional Officer Malik Canal about this event vide his Canal Wire No 309 dated 06-05-2010. The Sub-divisional Officer Malik Canal Sub-

Page 1 of 3 division ordered to Sub-Engineer Kot Sher Section for immediate repair / set right the tempered with/ enlarged outlet as per its sanctioned size and data. During the day time of 06.05-2010 at 1400, when Sub-engineer Kot Sher Muhammad Section Mr. Muhammad Anwar and its supervisory staff were buy to repair/set right this outlet, the above mentioned accused persons armed with gun and sticks came at outlet site/spot and forcibly snatched the outlet iron machine from the staff and asked them that you run away from the site of outlet. They threatened to die and also abused to sub-engineer and supervisory staff. The Sub-Engineer Kot Sher again conveyed the current situation to Sub-divisional Officer Malik Canal Sub-division vide his CW # 311 dated 06-05-2010. After site investigation, the Sub-divisional Officer Malik Canal Subdivision again visited the site and confirmed the report of sub-engineer as correct. On receipt of Isitighasa / complaint vide No 02 dated 06.05.2010 under 70 (1) Canal and Drainage Act 1873(amended 06 November, 2006), the warrants to arrest the above accused persons were issued from my court vide No. 264-66 dated 06-05-2010. The concerned SHO of Police Station Madirisa was also directed to present the above accused persons in my court on 10.05-2010 for further proceeding of the case. The concerned police presented only two accused persons namely Mr. Mr. Muhammad Ahmad S/O Bilal caste Arain resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar and Mr. Muhammad Illyas S/O Muhammad Anwar caste Kharal resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar. As SHO Maddrisa failed to arrest and present the remaining four accused persons in my court and the Police of Madrisa Station Bahawalnagar presented only two accused persons in my court on 10.05-2010. The accused persons were charged under section 70 (1) of Canal and Drainage Act amended on 06, November 2010 to which they denied to accept the charges of Istighasa. Two P.Ws Mr.Hassan mate and Mr. Liaqat beldar of Takhat Mahal Minor were also recorded. In light of witnesses, they have pleaded as guilty and same supported from complaint/ Istighasa. In light of aforesaid facts I held them guilty for charge under section 70 (1) of Canal and Drainage Act (amended 06 November 2010 on account of deliberate enlarging/ tempering and snatching iron machine and taken away the iron machine of outlet No. 11 and consequently increasing discharge of outlet illegally for un-authorize irrigation. Mr. Muhammad Ahmad S/O Bilal caste Arain resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar is sentenced undergo rigorous imprisonment for a period of six (06) months and fine for Rs.15000/- (Rupees fifteen thousand only ) and also Page 2 of 3

damage cost amounting to Rs.7312/- (Seven thousand, three hundred and twelve only) and in default of payment of fine and damages amounts, he will further undergo an imprisonment of one month additionally. Similarly, Mr. Muhammad Illyas S/O Muhammad Anwar caste Kharal resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar is also sentenced undergo rigorous imprisonment for a period of six (06) months and fine for Rs. 15000/- (Rupees fifteen thousand only ) and damages cost amounting to Rs.7312/- (Seven thousand, three hundred and twelve only) and in default of payment of fine and damages amounts, he will also further undergo an imprisonment of one month additionally. The following four remaining accused persons namely: 1. Mr. Muhammad Zulfqar S/O Muhammad Ashrif Caste Kharal resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar. 2. Mr. Muhammad Azam S/O Muhammad Asghar caste Kharal resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar. 3. Mr. Mumtaz Ahmed S/O Muhammad Ishaq caste Arain resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar. 4. Mr. Gulzar Ahmed S/O Muhammad Ashrif caste Kharal resident of Muhammad Yar Chishti Police Station Madrisa Bahawalnagar. are declared as absconders, hence SDR Malik Canal Sub-division and SHO Police Station Maderisa are directed to act upon as per law for further proceeding their cases for punishment as proclaimed offenders. Subject:- REQUEST FOR LEGAL ACTION UNDER MAINTENANCE OF PUBLIC ORDERS (MPO) AGAINST HABITUAL OFFENDERS INCONNECTION WITH WATER THEFT IN HAJIPUR CANAL SUB-DIVISION Reference: My CWs As you know that there is tremendous water theft trend in Haji pur Canal Sub-division especially on Islampur disty system, Abe-Hayat and Hajipur disty systems. This water theft trend is increase due to immigration of new Baloch Tribes from Baluchistan Province due to fall of Bukti Tribe Regime and they get populated in the surroundings of these three canal systems under political shadow of local political personalities. These people are criminals and local police is hesitating to arrest them and to register the water theft cases against them. The tempering outlets and making deliberate cuts on the irrigation channels is a very ordinary and small offence for them. They did not allow to repair tempered outlets and to close cuts. They regulate the supply of these channels themselves. They threatened to die, kidnapping, taken away and thrown on the Mountainous Range of Koh Suleman. These criminals such as Mukhtiyar Ahmed S/O Hasham, Muhammad Anwer S/O Ahmed Bakhash, Fiaz Ahmed , Amjad S/O Muhammad Shafi, Ameer Bakhash, Ghulam Shabir, Bashir and Saeed are the irrigators of these channels and their allied system i.e Malkani and Channer minors who are involve in tempering outlets and making cuts on these channels for un-authorize irrigation for their crops. They have formed a group under the shadow of political and triblal big guns. They open the channels with their on will during the approved rotational warabandi. On 18-07-2011, when Islampur disty was in closure, they opened this channel forcibly and unauthorize irrigation is done by tempering outlets, making deliberate cuts and tempering head regulators of Channer Minor and Malkani minors. These two minor are taking 37 and 50 cusecs against approved discharges of 9 and 24 cusecs. On 18.07.2011, I raided against them with the help of Police of Hajipur Police Station and caught Mr. Mukhtiyar ,

Mr. Muhammad Anwer, Mr. Amjad who broken the lock of head regulator of Islampur disty and opened this channel illegally. Further, these criminals do not permit to repair head regulators of Channer and Malkani Minors. After arresting above mentioned criminals, when I reached at Police Station HajiPur, some political personalities phoned to Police in favour of criminals, hence, Police released them without any legal action against them. This whole critical situation is conveyed to your kind gracious honor for further action to restore Government writ. Hence, it is requested to your kind gracious offices, kindly take up this matter with high ups and registered cases against these criminals under 20 MPO on account to sabotage the irrigation channels and also under section 16 MPO and 3 MPO on account of creating violence in the area and maintaining pubic order. Moreover provide us Ranger Force to repair head regulators of Channer and Malkani and repairing of outlets at these channels. Further joint raids with Ranger Force should be conducted to stop water theft on these channels as local police is under influence of big guns of Baloach Tribes and Political personalities. When these criminals temper the outlets on large scale, there is no water at tail and less water available for other down stream outlets. There is hue and cry among the tail irrigators and there is risk of armed conflict between two groups of tail irrigators and these criminals irrigators. Hence, it is recommended, these habitual and criminal offender may be arrest under 20, 16 and 3 MPO to maintain public order and water theft cases may be registered to ensure the peace of the area and smooth operation of canals.
