Steps in handling grievances handling: It is important that grievance must be handled in a systematic manner.

The following steps should be taken in handling grievances: 1. Defining, describing or expressing the nature of the grievances clearly 2. Gathering all facts that serve to explain when, how, where, to whom and why the grievance occurred; 3. Establishing tentative solutions or answers to the grievances; 4. Gathering additional information to check the validity of the solutions and thus ascertain the best possible solution; 5. Applying the solution, and 6. Following up the case to see that it has been handled satisfactorily and the trouble has been eliminated. 7. Gathering additional information to check the validity of the solutions and thus ascertain the best possible solution; 11. Applying the solution, and 12. Following up the case to see that it has been handled satisfactorily and the trouble has been eliminated.

1. Preamble:

This Charter of Demand is submitted to ALL INDIA IFFCO EMPLOYEES UNIONS. On behalf of all the categories of Workmen as defined in the Industrial Dispute Act,1947 employed in IFFCO in scale of pay hereunder on the date and day mentioned hereunder to IFFCO Management for Settlement of Wages Perquisites, Allowances and other Services condition of the workmen. The purpose of this settlement is to provide orderly and harmonious industrial relations, to increase overall productivity, competitiveness, performance, to ensure prompt and fair wages & other working conditions, to maintain and to ensure discipline, efficiency, smooth and uninterrupted operations in the society. Hence following charter of demands may be considered favourably: 1.1 Applicability: This settlement should apply to all categories of Workmen as defined in the Dispute Act,1947 employed in any of Scale of Pay mentioned in Annexure-on the date of singing of this settlement. 2. Period of Settlement: This settlement shall come into force w.e.f. 01.01.2007 and will remain in force till 31.12.2011(i.e. 5 years) and will continue to remain in force thereafter unless terminated by ALL INDIA IFFCO EMPLOYEES UNIONS. 3. Scale of Pay: 3.1 The existing Scale of pay to be revised as per following:

1. Basic Pay difference between H2 and G1 should be revised after considering average difference among the Basic Pay of all grades. Hence current wide gap between H2 and G1 can be shortened. 2. 8. Provident Fund: The employers contribution to CPF should be raised from the present 12% to 15% with matching contribution of the employees. 9. Gratuity: Gratuity should be paid for 30 days for each completed year of service. Day salary shall be computed as per last months gross salary drawn divided by 22 days. While calculating gratuity.

And how union is elected? Ans: In IFFCO secret ballot method is adopted, and each candidate is elected from each section , 2 to 3 people are register their name as candidate and the all the elected candidate forms a panel and the president of union is decided by them only , after that president allocate the other seats.

Q11. Major strikes and when took place? Ans: In 1983, the major strike is held in IFFCO by employees for the 11 days.

Q12. Any matter related to Union or case filed in High court and what is the procedure adopted by your union to get the rights against management and others?

Ans: Recently our inter union rivalry case was filed in high court in respect of to obtain the Right of being a president, because of the sudden death of the president, I was eligible For that post as I was vice president that time but the general secretary and his followers Against me and raise the matter to management and to the labour commissioner and They overwrite in the minis book and some legal documents .so then after proving these All things in court and we got the justice and they penalised and issued a charge sheet But because of the name of the organization we then compromise and solved the matter Outside the court, we followed all the procedures 1st we took the form 14(a) from labour Commissioner then filed a case in tribunal court in Rajkot; they declared the order of reElection of one department but we bring the stay order from Ahmadabad high-court. Then the opposition Party filed a IPL in high court but court rejected their application and Explained that all the documents and procedures were legal and then the court declared the decision in our favour.

Q13. What are the duties of your office barriers? Ans: 1. President: The president shall preside over the meetings of the union and the executive committee and shall have a casting vote only in one of a trade union.

2. Vice President: In the absence of the president, the V.P, senior in age or in the absence of both the presidents, any executive committee member other than the general secretary may be elected to preside over the meeting. Normally V.P shall assist the president.

3. General Secretary:

The general secretary shall be the chief executive officer of the union who will administer all the affairs of union under the control and direction of the executive committee. He shall have the power to spend no more than 50/- Rs at a time.

He shall be the ex-officio member of the sub-committee formed under article 11(f). He is the only person who kept the minis book in which all the records of meetings and issues of union is registered by him only.

He shall exercises general control over the funds of the union along with treasurer. He shall receive applications for membership in prescribed forms and arrange for the admission of the union members as per rules.

He shall have the power to nominate one of the secretaries to function on his behalf during his behalf.

He shall conduct all correspondence on behalf of the union. He shall maintain register of membership. In addition to the aforesaid duties, he shall exercise general supervision and control over the affairs of the union.

Q14. Rights, responsibilities and duties of president of union?

Ans: The president shall preside over the meetings of the union and the executive committee and shall have a casting vote only in one of a trade union.

Q15. How the union dissolves? Ans: The union gets dissolved in 2 years and only after declared by the union president.

Q16. How many general and compulsory meeting of union takes place during a year and with H.O management? Ans: 2 general meeting and 2 coordinate meeting is compulsory in 1 year.

Q17. Is your Union calls a general body meeting and is it compulsory in your organisation? Ans: Yes it is compulsory and we do a general body meeting.

Q18. Is your union is capable to interfere or affect the managements decision related to Disciplinary action against workers? Ans: Yes, we are capable as we are organised union all the rules are labour law favours us but even our management is also very cooperative and harmonious to the employees and even the union relation is to good with the management and they accept our all demands and request.

Q19. Is your union is attached with other union or not? And if there is a strike in fertilised sector, would the union also join that strike or not? Ans: No our union is not attached with any other union but IFFCO has 5 branches and all are organised union and we all are having a same agenda and from these 5 unions we president and G.S are selected as union coordinator of all 5 unions and posted in Delhi Head office to deal regularly with directors. And Kandla unit or any other unit cannot do a strike for any unit and we dont bother for others in fertilizer sector. We will not join the strike.

Q20. When your coordinate meeting is held and who are the participants of that meeting. Ans: It held in every 3 months and the participants are 5 union president and G.S, Managing-Director, H.R Director, Finance Director, H.O Chief Manager P&A.

Q21. What is the procedure to call strike? Ans: y The union shall not go on strike unless a decision to this affect has been taken in a General Bodys Meeting and 3/4th members attending the meeting vote in favour of such move. A notice to the authorities and appropriate government shall send 15 days in advance. y y The union shall abide by the code of discipline. In case of any dispute before union, the Union/Office bearers, decisions of the executive committee would final. y The circulars of the meeting would be circulated and in token of that receipt would be taken. y The vital issues affecting the employees in a particular branch the opinion of the nit executive committee shall first be obtained before taking any final decision by the executive committee.

Q22. What is the purpose behind your collection of membership fees? And where this fund goes? Ans: We deposit this fund in IOB Bank in fixed account and the purpose of the membership fees is to utilise at time when any case against management occurs.

Q23. How much fund you have of this membership fees? Ans: 2, 00,000 + 2, 00,000 in fixed A/c and 1, 00,000 on hand in office.

Q24. What is the procedure of termination of membership of union? Ans: Member shall cease to be a member of the union: y y y y On death, On resignation duly conveyed to end on acceptance by the executive committee. On expulsion for conduct not conductive to aims and objective of the union. On ceasing to employee of the IFFCO provided he is not an office bearer or member of executive committee of the union. In case he is an office bearer or member of the executive committee of the union, he shall continue to hold that office as an honorary member; and

On being in arrears of the subscription for more than 3 months or on falling to pay any special contribution or levy imposed by the executive committee a member is liable to be removed from the membership of the union by the executive committee.

Q25. Dissolution on Procedure of union? Ans: y The union shall not be dissolved unless by a decision arrived at a general body meeting specially convened for purpose after 15 days clear notice has been given to the members. y The union shall be dissolved if 3/4th majority of the members of the union at the said meeting agree to do so. y In the event of the union being dissolved he property and funds of the union shall be disposed in accordance to law. y At the time of crisis, the president in the interest of the union shall be empowered to dissolve the executive committee and appoint an ad-hoc till the crisis.
