LONG BEACH, Calif. (AP) A federal agent accused of shooting a supervisor engaged in a serious struggle for his gun with another colleague who subsequently shot and killed him, an official said. "They were physically struggling over the gun." The agent eventually drew his

own gun and shot Garcia, Kice said. ICE is not releasing the agent's name. The supervisor, Kevin Kozak, continued his recovery Saturday from at least six bullet wounds, including to the hand, knee and torso, Kice said. Kozak, 51, is the agency's deputy special agent in charge of investigations in the Los Angeles region. Los Angeles police officers who work in the building on a joint task force for Internet crimes responded to a call for help and aided the bleeding Kozak, Kice said. "The fact that they were literally right there probably was another thing that was instrumental in his survival," she said. Garcia joined the former Immigration and Naturalization Service in 1988 and was named criminal investigator three years later. Shortly after the Department of Homeland Security was created in 2003, he was promoted to supervisor for a documents and benefits fraud task force. He had told his wife of problems at work but, when she called him at the office Thursday, everything

seemed normal, according to the Los Angeles Times. They talked about having Korean barbecue for dinner, but he said he first had to meet with a high-ranking supervisor about his performance. "He never made it home," said Garcia's wife, Balbina. She told the Times the couple were going through a divorce but trying to work things out. Former neighbors in Murrieta, southeast of Los Angeles, said Saturday that Garcia worked long hours and mostly kept to himself. "He was friendly enough to wave and say hi, but he didn't have too much time for conversation," said Tim Shepard, 49, who lived across the street. Neighbors said Garcia moved to the quiet, residential street with his wife and two young boys about eight years ago. About four years ago, he began visiting only on weekends. The family moved about two years ago, though Garcia's wife still regularly returns to visit a friend. "He worked a lot," said Andrea Tjaden, 45, who lived next door. "He would come home late at night and be gone for days."

Garcia was a plaintiff in a lawsuit against the Los Angeles Police Department after he and another immigration agent claimed they were roughed up by officers while doing undercover work. A federal jury found in the police officers' favor in 2005, saying they did not use excessive force. The lawsuit alleges that officers handcuffed and threatened to shoot the other agent, and put Garcia in a headlock, handcuffed him and forced him into the back of a police car, despite his cries of agony because of an old shoulder injury. Garcia was hospitalized for cuts, bruises and treatment of his shoulder. "If this could happen to me, then ordinary citizens have even more reason to fear for their own safety," Garcia told the Times when the lawsuit was filed in 2000. "The situation within the LAPD is clearly out of control." Doug Walters, an attorney who represented Garcia, said he was shocked by his death. "During the time I worked with Zeke, his supervisors were very supportive of him and the case," Walters said. "Some of his

supervisors traveled some distances to testify." Kice said she didn't know what job performance issues Garcia was counseled about before the shooting, and couldn't disclose them if she did. A federal official with knowledge of the investigation has told the Associated Press that Kozak denied Garcia's request for an internal transfer. The official spoke on condition of anonymity because he was not authorized to discuss the investigation publicly. "I think it's significantly harder for someone to walk on the convention stage out of nowhere, given the makeup of the delegates they may be facing. WON'T THROW OUT GREECE Greece adopted a new wave of austerity measures last week, setting out 3.3 billion euros in wage, pension and job cuts, as well as savings on defense and health spending. Speaking on Sunday, Austrian Finance Minister Maria Fekter said it appeared a deal was finally taking shape. "I don't think there is a majority to go a different way because a different way is enormously arduous and costs lots and lots of money," she said in a television interview. "The euro finance ministers and, I believe, the heads of government agree that we will not leave Greece in the lurch in the euro zone and also won't throw it out," Fekter said. However, Jean-Claude Juncker, who will chair Monday's meeting of the Eurogroup in Brussels, had earlier made clear urgent work was still needed over the weekend

One official said while there were still gaps to be filled, they were not so large that they risked derailing the agreement. "I don't see anybody wanting to be responsible for pulling the plug on the deal at this late stage," he said. Critics argue the austerity measures are driving Greece further into recession, with the contraction accelerating to 7 percent in the last quarter of 2011, making it even harder for Greece to pay back its debts. They are the latest in a long line of missteps by large Internet companies that have faced little punishment for pushing privacy boundaries, which are already more expansive than most consumers understand. Despite all the chatter about online privacy and the regular introductions of proposed data protection laws in Congress, Silicon Valley is in the midst of a veritable arms race of personal data collection that is intensifying. Many innovative companies, most prominently Facebook, base virtually all of their services on the ability to personalize, which requires them to know their users well. Their business models likewise depend to an increasing degree on the ability to target a

banner advertisement or other marketing pitch to an individual. Millions of times each day, the right to advertise to a specific user is auctioned off in a fraction of a second by computers talking to one another. Last week Twitter, Path and other firms were found to be vacuuming users' iPhone contact lists even though Apple Inc's policies forbade it. On Friday, a Wall Street Journal report showed that Google was tweaking ads on Apple's Safari Web browser to install tracking cookies which, while commonplace on other browsers, are blocked on Safari unless the user specifically allows them. Reps. Edward J. Markey (DMass.) and Joe Barton (R-Texas), co-chairmen of the Congressional Privacy Caucus asked for a Google probe by the Federal Trade Commission, which declined to comment. Google said Friday that its intentions were innocuous but it nontheless dropped the practice. Twitter and Path said they would seek explicit permission before grabbing address-book contents, and Apple said it would update its software to prevent further leaks. PROMISES, PROMISES The developments fit what is by now a well-established pattern that has thus far kept major new laws off the books, longtime policy specialists said. A company over-reaches, gets

Google and Facebook last year both agreed to 20 years of privacy audits by the Federal Trade Commission after they made public customer information that users had considered private. But with few restrictions on data collection, the audits are not likely to have a major impact on business practices. Internet companies and their investors argue that datacollection is essential to their businesses, and enables them to provide services that would otherwise be impossible. Consumers get more accurate search results, more relevant advertising, and more intimate connections with friends and others when Internet companies know something about them. "For that value tradeoff, they're willing to provide information," said Ron Conway, a well-known Internet investor. "I don't like people tracking my location, but I want to know, 'what are some nearby Italian restaurants that my friends have liked,'" said Auren Hoffman, CEO

of Rapleaf, which compiles profiles of Internet users. The equation is different in Europe, which has long-standing data protection laws that limit some practices that are standard in the United States. The European Union is now weighing updated rules that would allow any resident to ask companies to delete the information on file about them; the United States only has equivalent rights for those under age 13. Privacy advocates in the United States say they do not expect big changes anytime soon. "Trying to pass a bill through Congress that's actually going to safeguard user records, especially when you've got huge advertiser lobbies trying to defang that law, is an incredible challenge," said Rainey Reitman, activism director with the Electronic Frontier Foundation. At best, they say, a law might allow consumers to opt out of some tracking. Second, Ive attempted to tie a Shortmail account to my Gmail, which limits emails by character size, and Im excited to really test the service when its ready for it (you can import your contact lists from Gmail and Twitter, and start to convert over). At the moment, I

never received a few test messages to my Shortmail, so I wasnt able to test this integration. Even if I could tie it back into Gmail, this tie-in may only make sense for someone who receives an insane amount of inbound email and needs to place a restriction on the email flow immediately. And, third, Ive tried to convert inbound emails, both at work and personally, into action items. It boils down to asking, upon receiving each email: What is the action item? Its really hard for me to create this new habit, but Im trying. (I know there are many options in this category too many to list here such as Clear and Workflowy, among many others. Therefore, Ill just share what Ive been using and would be curious to know what works for you.) At work, weve been using Asana for nearly all nontechnical tasks. I love the web app, the soft blue hues of the software, and how lightweight it feels. Your team members can send tasks to your Inbox (either from within the app or by forwarding an email to Asana, which is powerful), and then you get to mark if its something that will be done today, or if its upcoming, or if its for later. For each task, your teammates who are following that

task can comment within the thread, and just that slight option actually reduces the amount of and size of correspondence around a task. The single best part of Asanas design is that you can control the order of your Taskbox and experience the satisfaction of marking a task as complete and then archiving it out of sight, out of mind. Id be lying if I said that our team doesnt go back into email for certain communications, but I have noticed that the number of emails has decreased, and that everyone knows what each other is working on. Adoption in the workplace is a bit easier since we all have to collaborate to get things done. Its early in the process, but so far, the net-net is positive. (Ive also been using Asanas iPhone app, which looks nice but mimics the interaction design of the Facebook iOS app, a design that reduces my desire to use it on the go.) For personal matters, Ive converted all of my to-do lists and tasks to Orchestra, a beautifully designed iPhone app that also has a web app. I had been using Google Tasks, which is really easy because it rests within Gmail, where all of my work flow is, so I had to strong-arm myself ASANA page 24

Is a Google Phablet Next?

Samsung has done it with the Galaxy Note, LG jumped on board today with the Optimus Vu: will Google and Motorola phollow in their phablet phootsteps? We wont know how the Vu holds up until Mobile World Congress in a weeks time, but already the phone/tablet hybrid segment is getting interesting. The lingering question is whether phablets are the standout form-factor of 2012 or merely a fad, and it could be Google and imminently-acquired Motorola Mobility that swing the decision one way or another. Google has been quiet on pen control for Android devices, but that doesnt mean it hasnt been thinking about it. Android 4.0 already includes support for stylus input, natively recognizing multibutton pens, taps, tilt/distance, pressure and more. Everything, in fact, youd need to create an artand handwriting-capable Android phone or tablet. Android 4.0 includes full support for stylus input events, including tilt and distance axes, pressure, and related motion event properties. To help applications distinguish motion events from different sources, the platform adds distinct tool types for stylus, finger, mouse, and eraser. For improved input from multi-button pointing devices, the platform now provides distinct primary,

secondary, and tertiary buttons, as well as back and forward buttons. Hover-enter and hover-exit events are also added, for improved navigation and accessibility. Developers can build on these new input features to add powerful interactions to their apps, such as precise drawing and gesturing, handwriting and shape recognition, improved mouse input, and others Google Android 4.0 Highlights Samsung and LG both with

Still, the Optimus Vu presents a slightly different proposition: its display is squatter, wider than that

of the Note, using a 4:3 aspect panel like Apples iPad rather than the taller, narrower Samsung screen. In effect that means wider notepaper to write on, though its also worth remembering that Samsung still squeezes in more horizontal pixels: the LG screen is 768 pixels wide, versus the Galaxy Notes 800. Everyone is applauding Oracle and SAPs cloud acquisitions RightNow, SuccessFactors, and now Taleo. But the biggest cheers are coming from SAP and Oracles cloud competitors, salesforce.com and Workday. Because with these acquisitions, Oracle and SAP have effectively validated the cloud and sounded the death knell for ERP ( enterprise resource planning). Why? Because SAP and Oracle are acquiescing to the cloud, yet they have no strategy to get their customers there. If SAP and Oracle were serious about the cloud, where are their big cloud solutions or visions for migrating customers? Consider SAP, the leader in ERP. SAP had supposedly bought into the cloud five years ago with SAP BusinessbyDesign. But there are only 1,000 BusinessbyDesign customers to date; thats less than

half of a percent of SAPs entire install base. Salesforce has over 100,000 customers last time I looked. So wheres SAPs NetSuite killer? How are they going to fend off Workday? Similarly, Oracle is the leader in the enterprise stack, but, when it comes to the cloud, it has acted like a follower. Oracles initial response to the popularity of cloud computing was to revert to the mainframe mindset with Oracle private clouds. Oracle should be reinventing its entire stack and look to provide the next generation platform for the enterprise. That position is open and available. Instead, it bought Taleo, an HR solution, and RightNow, yet another CRM solution. Why isnt Oracle offering a relationship database in the cloud? Or an app server in the cloud? Why isnt Exadata a true competitor to Amazon? That would be a true sign of Oracle really trying to be a leader. SAP and Oracle should be pushing innovative cloud solutions that cannibalize their bases. Instead, theyre attempting to acquire themselves into innovation. Thats not a strategy. Thats a shift into survival mode.

These kinds of deals have a history of backfiring on the deal makers. Weve seen this story before: an industry giant makes a strategic acquisition that causes a critical shift in perception of a nascent space. It happened when Siebel acquired Upshot and in turn validated salesforce.com. It happened when Yahoo acquired Broadcast.com and validated YouTube. It happened when Cisco acquired Pure Digital, propelling video as a standard feature on smart phones. I would argue that it happened when Time Warner acquired AOL and in turn validated the entire Internet economy. In each case, an industry leader first denies the relevance of a technology, then frets over losing marketshare to it, then finally spends big money to acquire it under the pretense that its the key to expanding innovation. Overnight, that technology is now worth far more in the eyes of customers and investors. But more importantly, the acquisition strategy failed in each case. Instead of leading the way, the deal makers never committed to the technology, and their actions usually helped open the door to a

whole new class of companies to take over. The bottom line is this: A series of cloud acquisitions wont help lumbering old ERP one bit. Acquiring cloud companies doesnt make you a cloud company any more than buying a Giants jersey makes you Eli Manning. Its not a strategy for an on-premise solutions company. Its an attempt to distract customers and hope they will forget about the ERP boat anchor theyre stuck with. The big ERP players had their day, but now its coming to an end. This is the classic Innovators Dilemma. For too long SAP and Oracle have watched the enterprise market innovate around them, stuck to their knitting and failed to adapt. The cloud technology wave has passed them by, and now its too late. Its time for SAP and Oracle to either accept that they need to adapt and go all cloud, or accept that they are going to go the way of the mainframe stuffed in the back closet. They wont die completely. Theyll just become irrelevant.

The team came to this conclusion by producing microscopic copies of moon rock collected by the Apollo missions and melting them at extremely high pressures and temperatures, similar to those found inside the moon. Single-atom transistor built with precise control

Seeking to keep Moore's Law on pace, researchers have developed a repeatable technique for assembling a single-atom version of the transistor--the building block of semiconductors and computers. Researchers were able to make a single-atom transistor with a scanning tunneling microscope that includes the single red phosphorous atom and electrical leads for control gates and electrodes. Researchers are getting down to the atomic level in the pursuit of smaller and more powerful computers. The University of South Wales in Australia today announced it has made a single-atom transistor using a repeatable method, a development that could lead to computing devices that use these tiny building blocks. About two years ago, a team of researchers from the Helsinki University of Technology, the University of South Wales, and the University of Melbourne in Australia announced the creation of a single-atom transistor designed around a single phosphorus atom in silicon. Now a new paper published in the journal "Nature

Nanotechnology" describes a technique for making this type of transistor with very precise control. That opens up the possibility that the method can be automated and single-atom transistors could be manufactured, according to the group at the University of New South Wales. "The thing that's unique about the work that we've done is that we have, with atomic precision, positioned this single atom within our device," said Martin Fuechsle from the lab. That level of control is important in order to fabricate

the other components, including control gates and electrodes, needed for a working transistor, the building block of microprocessors and computers. The lab members used a scanning tunneling microscope to manipulate atoms at the surface of a silicon crystal. Then with a lithographic process, they laid phosphorous atoms onto the silicon substrate. "Our group has proved that it is really possible to position one phosphorus atom in a silicon environment--exactly as we need

it--with near-atomic precision, and at the same time register gates," Fuechsle said in a statement. Work on alternatives to traditional microprocessor designs has been going on for years to maintain the pace of Moore's Law, which predicts that the number of transistors on a semiconductor doubles every 18 months. Intel last year announced it would start using threedimensional transistors for its 22nanometer process, a move designed to avoid the leakage of

current that occurs at this very small scale. Other groups have pursued carbon nanotubes or graphene rather than silicon in the pursuit of miniaturization. Some companies are very fond of sending customers birthday emails. Virgin Atlantic, however, sent me one that called me a very sad name and questioned whether my parents had ever wanted me at all. Recently, I experienced a birthday. Thank you, you shouldn't have. Oh, wait, you didn't. Birthdays mean bracing yourself for cards and e-mails from your family, ex-lovers, and people who want something from you. Companies who want you to buy things, for example. Starbucks always anticipates my birthday early. The company sends me a postcard two weeks before, so that I can be sure to claim my exciting free birthday drink. Virgin Atlantic, on the other hand, believes it should send me an e-mail. It is all part of Virgin's

"we're nicer and cooler than the others" attitude, although it does seem slightly dated. Some of these corporate birthday e-mails I don't even bother opening. But I like Virgin Atlantic. The Volcker Rule: A User's Manual

Although the Dodd-Frank Act is now law, the Volcker Rule is not slated to be implemented until July 21, 2012, on the two-year anniversary of the original bill. This entry provides a brief overview of the Volcker Rule and its key statutes, including what entities are impacted, which bank trading activities will be prohibited, the measures that will be required for compliance, and the implementation timeline. The Volcker Rule (VR) is an addendum to the Dodd-Frank Wall Street Reform and Consumer Protection Act. The VR runs 298 pages. Its intent is to prohibit commercial banks from engaging in proprietary trading according to a limited, prescribed definition (see below). The VR does not prohibit banks from

trading altogether, although it will require banks to document all trades that are not exempted, and to demonstrate that these trades follow procedures as mandated. The VR will be overseen by five separate government entities, including the Federal Reserve, SEC, CFTC, FDIC, and OCC (Office of the Comptroller of the Currency.) What is the Dodd-Frank Act? The Dodd-Frank Act (DFA) was enacted to carry out financial reform measures in response to the financial crisis and recession of 2007-2009. The intent of the bill was to reform the financial system, including some consolidation of regulatory agencies, consumer protection measures, broader supervision of the financial system by the Federal Reserve, and increased supervision of hedge funds. The Volcker Rule was added to the DFA at the request of President Barrack Obama. What institutions are affected by the VR? All banking institutions in the United States and their affiliates, including overseas bank branches, would be bound by the VR. In addition, the VR would cover all foreign banks maintaining operations in the United States. Non-bank financial institutions such as hedge funds or insurance companies would not be affected. Brokerages and investment banks would also not be subject to the VR, although the largest of the

investment banks such as Goldman Sachs and Morgan Stanley agreed to become banking institutions during the financial crisis and would now be covered. What is the VR definition of proprietary trading? The VR definition is as follows: Proprietary trading means engaging as principal for the trading account of the covered banking entity in any purchase or sale of one or more covered financial positions. Proprietary trading does not include acting solely as agent, broker, or custodian for an affiliated third party. (p. 390) The VR goes on to provide a specific definition of trading account, namely an account that trades for short-term resale; benefitting fromshort-term price movements; realizing shortterm arbitrage profits; and hedgingpositions. The VR adds that positions held for 60 days or less will be generally deemed to be trading positions. This definition effectively allows banks to maintain investment accounts for longer-term investments. However, the VR permits regulators to designate any account as a trading account as they see fit. The VR also defines covered position in a very specific manner, namely (A) a security, including an option on a security; (B) a derivative, including an option on a derivative; (C) a contract of sale of a commodity

for future delivery, or option on a contract of sale of a commodity for future delivery. The definition specifies that loans, commodities, and foreign exchange are excluded from the VR (p. 394). What activities are not covered financial positions and are therefore acceptable? In addition to loan, commodity, and foreign exchange transactions, the VR also permits trading in government securities (including agencies, securities issued by individual states and cities, etc.), underwriting and market-making provided the transactions are affiliated with specific customer needs, and any trade in which the bank is acting as agent (broker) rather than as principal. Does the VR impose other restrictions besides proprietary trading? Yes, under the VR, US banks will not be allowed to own interests in hedge funds exceeding 3% of the total value of the equity, and will not be allowed to sponsor hedge or private equity funds. The VR also prohibits transactions that represent a material conflict of interest between the bank and its clients, bank exposure to high-risk assets or trading strategies, or activities that jeopardize the safety and soundness of the covered banking entity, or the financial stability of the United States. (p.411)

None of backstop restrictions are defined in detail and are subject to the judgment of federal banking agencies. How will banks comply with the VR? Banks will be responsible for monitoring of and compliance with the VR. As stated in the VR, the banks written policies and procedures must clearly articulate and document a comprehensive explanation of how the mission and strategy of each trading unit, and its related risk levels, comply with this part. (p. 487) Additionally, banks are required to identify which activities are covered, and if so, to document in detail how covered transactions are being properly managed and monitored in accordance with the VR. Why is compliance with the VR considered to be complicated? Applying the VR in many cases is straightforward. It will be possible for banks to trade US treasury bonds for their own account, for example, but not securities such as stocks or stock options. However, due to the complexity of financial instruments and to the comprehensive nature of bank market-making activity, compliance will be challenging. To distinguish market-making from proprietary trading, for example, regulators will apply five specific factors in making VOLCKER page 32

Yet, the catwalk for both forms of propaganda is one and the same, deception wearing the most titillating togs provided by the top fashion house, the House of Public Relations. And the deceptive PR isnt limited to multinational firms or businesses in general; it is part and parcel of our daily existence, having infiltrated most if not all institutions, totally poisoning politics, and eroding away whatever little honesty might still be left in our elected officials. During the past century we have seen the transformation of the raw epithet known as propaganda, and all its implied vilification, to that of an accepted social science with full academic accreditation, unashamedly sitting at the same table with all reputable and timehonored professions. We, members of society, have swallowed lock, stock and barrel the presumed need by notable individuals and institutions to receive help from specialized

professionals to show us all the good things about them, their positive contribution to society. But much of what we get is tainted with deceit. From press releases to the practice of damage control, public relations, the pseudo-science, is there more often than not ready to deceive us all. The alchemy of spinning factoids into facts, the use of euphemisms and constant truth cherry-picking, has reached such degree of sophistication that we are, as individuals, no longer able to discern fact from fiction. Yet, the one place we should be looking for help to unravel deception from truth, the government, is often complicit with those engaged in the deception that is, when not being the source of the deception itself. Now, to further complicate matters, we have entered the age of Internet-mediated PR! Americans have been victims some might argue, beneficiaries of three grand deceptions during the past three generations, in all cases having the government as either the deceiver or co-deceiver; the very instrument for the capitalist entrenched power. One of the three grand deceptions has to do with the very defense of predatory capitalism, a system we are told to equate with democracy and our very constitutional

freedoms. That supreme deception has allowed the buildup of an imperial military, and permitted Americas unchallenged interference in the affairs of other sovereign nations. But the deception involved in the creation of this imperial might is something that for now we might as well set aside and concentrate on the other two, housing and jobs, where maybe we still have a chance to confront deceit head-on, debunking old myths; one which will force the long term planning of education and employment without punishing and impoverishing three-quarters of the nations population. Of the two, the most visual, one playing a key role in the economic predicament in which we find ourselves today is real estate, and the much touted American Dream an invention of those holding the money and power to convince the working men and women in America of both capitalisms virtues and the sanctity of private property over anything the commons we as a people might demand in an equitable society. What has been viewed as shelter traditionally, a roof over our heads for the most part, has changed via deceit to the need for a sacrosanct mortgagedownership which became not just symbolically but de facto a

magical investment instrument, a source of non-existent wealth. Bricks and mortar placed over a few feet of land made us all smart and enterprising capitalists. Renting was relegated to the very poor, those who would yet have to earn their diplomas to enter the house-owning capitalist class. All of this was done through deceit and the creation of inane tax subsidies which only went to help an inefficient and blotted industry, Any comprehensive analysis to determine what makes sense for an individual, whether to rent or to own the shelter they occupy, should yield a clear result if for no other reason than the fixed nature of the asset. Renting is, has always been, and is likely to be, the most logical decision when properly assigning a value, a negative value, to its immobility. What many of us have been saying for decades, definitely not a mainstream chant, is now gaining converts to reason, and that is for other than psychic reasons affordable if you have the income or wealth to waste it does make financial sense to rent instead of own the house where you live. I was just reading about a Johnny -come-lately convert to this point of view, an adjunct professor in

personal finance at Berkeley, Rich Arzaga, founder and CEO of Cornerstone Wealth Management, who appears not to feel professional embarrassment when admitting he lost 35 percent in the value of his home he bought 7 years ago. Nice to have a convert, but one would think that most people would think twice before taking a class from him, or have him manage their money! As for the other grand deception, the impoverishment of most Americans as a consequence of globalization, it is a subject that neither the government nor the capitalist curia running the United States is willing to tackle, keeping their dirty secrets behind chambers. Three big deceptions or lies have been perpetrated on the American citizenry: the need for an imperial military; the fantasy of the American Dream; and the need to immerse the country in overnight globalization without acknowledging or planning for possible consequences. FATF is a policy setting body that is comprised of thirty-six countries, including the EU, Switzerland, Russia, China and the USA. Its difficult to find fault with this new effort. Its directed at terrorist financing and other illegal activities. Most interesting to me, the new rules bring tax evasion within the scope of global money laundering: Expanding the scope of money laundering predicate offenses by including tax crimes. By accepting the new standards, the US has significantly upped the consequences for tax evasion. Tax evasion brings with it a range of penalties and fines that include jail time for some. The rules on money laundering are much harsher. FATF will give the authorities a big excuse to go looking for taxcheats. They will also have expanded capacities (surveillance/ monitoring of accounts) to seek out and find those cheats: More effective international cooperation including exchange

of information between relevant authorities, conduct of joint investigations, and tracing, freezing and confiscation of assets. Better operational tools and a wider range of techniques and powers, both for the financial intelligence units, and for law enforcement to investigate and prosecute money laundering. It can be argued that were all better off when Big Brother can easily dig through financial records. It would be foolish to think that it doesnt also come with an enormous cost. Note: FATF has provided an estimate of the global illegal activity. They think it could be as high as 5% of total GDP. Ahhh. 5% means $3 Trillion in the $60T global economy. I literally want you to follow me Jesus." Lin's outspokenness about his Christian faith and his astounding skills have caused people to compare him to Denver Broncos quarterback Tim Tebow. But unlike Tebow, who was a Heisman Trophy winner in college and a first-round NFL draft pick, Lin struggled to get noticed in his basketball career. He attended Harvard University, but not on a basketball scholarship, studying economics, instead. He went undrafted after college, and was offered a twoyear deal with his hometown Golden state Warriors. Lin was assigned to the Warriors' DLeague affiliate, the Reno Bighorns. After about a year, the Warriors released him. He went on to the Houston Rockets, who also released him after less than a month. The New York Knicks claimed Lin in late December as a substitute and he did not have a

guaranteed contract until just before winning his fifth straight game. It is during this unstable time that he is famously known for sleeping on his brother's couch, not having a place of his own. He had his breakthrough game on Feb. 4, when the injury of other players caused Coach Mike D'Antoni to put Lin in the game. During Lin's fifth game with the Knicks, he solidified his position as a winner and dispelled doubts that his previous wins were just flukes by outscoring the LA Lakers' Kobe Bryant, who had 34 points compared to Lin's 38. The Knicks had a narrow victory over the Lakers, 92-85. After the Knicks' win over the Lakers, Lin tweeted, "Gutsy win 5 in a row! This team is so unselfish and has so much heart. Love playing with them! God is good!" Lin's pastor, Stephen Chen, noted in the radio interview that "obviously, he's (Lin) overwhelmed by a lot of people demanding his time, pulling him in a lot of different directions. "As an adoptive father, my children are irrevocably mine. They may disown me, stop talking to me and sin against me, but that does not change the fact that they are mine and always will be. I believe the same is true of God with His adopted children," he stated. During Thursday's interview, Gervais also discussed his use of Twitter with Morgan. He said that, while he sometimes gets into heated arguments through the social networking site, he is

always smiling on his end of the conversation. "When someone's arguing with me that the earth is 5,000 years old, yes I'm smiling ... the fundamentalist view of the creation of the earth is rather like an episode of 'The Flintstones,' so ... Dead Sea Scrolls Prophesy Confirmed by Hubble Telescope, Author Says

the Earth in 1990 and still remains in operation, often capturing intense images of stars, constellations and distant galaxies. In a recent article, The Business Insider listed 10 things Hubble has discovered that science was previously unaware of. The Dead Sea Scrolls, on the other hand, which were found in caves on the shores of the Dead Sea between 1947 and 1956, represent 825 to 870 separate scrolls written mostly on animal skin. They are written in Hebrew, Aramaic and Greek, and are divided into two categories biblical and non-biblical, and contain prophecies by Ezekiel, Jeremiah and Daniel not found in the Bible. Among the non-biblical writings are the order of commentaries on the Old Testament, paraphrases that expand on the Torah, rule books of the community, war conduct, thanksgiving psalms, hymnic compositions, benedictions, liturgical texts, and sapiential (wisdom) writings.

The Isaiah Scroll, which, unlike many of the other scrolls, was found mostly intact, and is 1,000 years older than any previously known copy of Isaiah. In fact, the scrolls, also referred to as the Qumran scrolls, are the oldest group of Old Testament manuscripts ever found. According to author J. Paul Hutchins's book, Hubble Reveals Creation by an Awe-Inspiring Power, which will be released at New York City's BookExpo America this summer, the ancient prophet Isaiah recorded what appears to be a "divine invitation from God to mankind," inviting people to explore divinely questions through the stars. Like us on Facebook Hutchins' book takes a look at the history of the Hubble telescope and the discoveries made in the last two decades, which according to scientists, have revealed how the universe unfolded, calling it " the greatest cinematic drama in human history." He claims that these discoveries are directly related to observations Isaiah

recorded in 732 BCE about the unimaginable energy source behind the universe. The passage in question, Isaiah 40:25-26, reads: "To whom will you compare me? Who is my equal?" asks the Holy One. "Look up into the heavens. Who created all the stars? He brings them out like an army, one after another, calling each by its name. Because of his great power and incomparable strength, not a single one is missing." Hutchins asserts that when Isaiah wrote about the power behind the universe, he did not have the benefit of a powerful space telescope, yet his description matches the discoveries made by Hubble in recent years of powerful galaxies like the Sombrero Galaxy. The Sombrero with its ominous glow at its center exhibits unimaginable energy. The glow is made up of eight hundred billion stars like the Earths' sun, which gives the galaxy the appearance of a Mexican sombrero hat. Late last year, New York's

Discovery Times Square premiered its new exhibit, "Dead Sea Scrolls: Life and Faith in Biblical Times." The new exhibition is said to feature the "largest and most comprehensive collection of Holy Land artifacts" and also the "largest collection of the 2000year-old scrolls ever displayed in the United States." Discovery Times Square has 20 scrolls on display, four of which will be making world debuts. The scrolls include the biblical books of Genesis, Leviticus, as well as Exodus and Kings, among several others. Intel Chefs Bake WiFi Into Mobile Chips

Its a chip called Rosepoint, and although its just a research project today, it could show up in mobile phones and laptop computers by the middle of the decade. Rosepoint represents a breakthrough that Intel engineers have been hammering away at for years. Theyve been able to digitize little blocks of radio components in the past things like amplifiers and synthesizers but now theyve managed to put a digital 2.4 GHz WiFi radio on a chip, right next to one of their low-power Atom central processing units (CPUs). Building analog WiFi chips is a bit of an art. Radio Frequency (RF) chip designers build complex, customized circuits that operate on a continuum of voltages. The problem is that its often tough to shrink these analog designs down to the tiny scale thats possible with todays

cutting-edge chipmaking processes. Not so with digital RF chips, such as the one Intels just built. Digital RF chips are simpler. They have just two voltage levels and can be shrunk down much more easily whenever Intels researchers come up with a way to make chip parts smaller. Thats good news for WiFi users. When Intels chips start to hit the market they will have state of the art power efficiency and superior

signal quality, says Intel Chief Technology Officer Justin Rattner. And things will only get better as Intel shrinks things down. With a digital approach to radio, you can bring the benefits of Moores law to RF and radio circuits, he says. Intel wants to build a digital cellular radio chip too, in the not too distant future, Rattner says. Thats going to move Intel into closer competition with RF chip companies such as Texas

designs. Wireless radios and CPUs arent exactly ideal roommates. Both parties emit radiation that can mess with the other, in the same way that a calculator near an AM radio can distort sound. This radiation seeps into the RF module and corrupts the data, says Hossein Alavi, director of Intels Radio Integration Lab. The closer they are, the more interference is going to go to them. Radio wave emissions can also mess with the microprocessor, Alavi adds. To fix this, Intel has had to come up with noise canceling and radiation-shielding techniques for the chips. Iran warships 'dock in Syria's Tartous port'

Iranian warships have crossed the Suez Canal and docked in Syria's port of Tartous, Iranian state media has reported. The Mehr news agency said on Sunday that Tehran's show of support has caused "extreme worry for Zionist forces". Youcef Bouandel, professor of international affairs at Qatar University, told Al Jazeera that Iran's deployment has to be viewed as part of a "broader picture", because the Iranian government feels that "Syria is the first step towards putting Iran in the corner". "Iran has been having a few standoffs with the West in general over its nuclear programme and over its oil emabrgo," said Bouandel, who added that the docking of the ships on the Syrian coast had two largely symbolic meanings. "Iran has been threatening to close the Strait of Hormuz and has been a strong ally of Syria over the last year in particular ... The two ships ... crossed the Suez Canal without being stopped or searched [which] suggests that they do not carry

any weapons," he said. Tensions over the nature of Iran's nuclear programme have led to ever-tightening sanctions on the country's oil exports, prompting Iran to threaten to close the strait, the world's most important chokepoint for oil transport. Put 'breaks' on Israeli attack Reacting to the news on Saturday, Israel's foreign ministry denounced the deployment as a "provocation" and a "power play". Israel said it will be watching the ships' movements closely to ensure they do not approach its coast. There have been increasingly frequent media reports, as has been the case in the past, citing Israeli officials who say they must bomb Iran's nuclear facilities before the government acquires the ability to construct a nuclear bomb. Tom Donilon, the US national security advisor, is due to meet Binyamin Netanyahu, the Israeli prime minister, in Jerusalam on Sunday, and he will likely warn against such a strike. There have been reports, said Al Jazeera's Nisreen el-Shamayleh, that Donilon has "made it clear that the US does not support any

kind of military action against Iran". Israel has expressed some satisfaction with recent harsh sanctions passed against Iran's financial sector but does not believe they alone will lead Tehran to re-evaluate its nuclear program, said Shamayleh, reporting from Jerusalem. Al Jazeera's John Terrett, reporting from Washington DC, said it was highly unusual for a national security advisor to travel overseas and that he was likely to bluntly tell the Israelis to "put the breaks" on its attack plans. Iran carries 'message of peace' In remarks carried by the official IRNA news agency, Iranian Admiral Habibollah Sayari did not say how many vessels had crossed the canal or what missions they were planning to carry out in the Mediterranean, but he said the flotilla had previously docked in the Saudi port city of Jeddah. Two Iranian ships, the destroyer Shahid Qandi and supply vessel Kharg, had docked in the Red Sea port on February 4, according to Iranian media. Sayari said the naval deployment to the Mediterranean would carry

a "message of peace" but also put on display "the might" of Iran's military. "It will prove to the world that despite increasing enemy sanctions over the past 33 years, our manpower, obedient to the orders of the leader Imam Khamenei, continue to add to their academic and military abilities," Sayari said. The first Iranian presence in the Mediterranean in February 2011 provoked strong reactions from Israel and the US. During the 2011 deployment, two Iranian vessels, a destroyer and a supply ship, sailed past the coast of Israel and docked at the port of Latakia in Syria before returning to Iran via the Red Sea. Russia, who has close relations with Iran and has at every turn opposed military action against Syria, also has a base in Tartous. UK warning The latest announcement comes amid heightened tensions between Iran and Israel, fuelled by a longstanding dispute over Tehran's nuclear programme and rising speculation that Israel might launch pre-emptive strikes against Iranian facilities. Iran 'stops oil exports' to UK and France

Destinations of Iran's oil exports Iran has stopped selling crude to British and French companies, the oil ministry has said, in a retaliatory measure against fresh EU sanctions on the Islamic state's lifeblood, oil. "Exporting crude to British and French companies has been stopped ... we will sell our oil to new customers," spokesman Alireza Nikzad was quoted as saying on Sunday by the ministry of petroleum website. The European Union in January decided to stop importing crude from Iran from July 1 over its disputed nuclear programme, which the West says is aimed at building bombs. Iran denies this. Iran's oil minister said on February 4 that the Islamic state would cut its oil exports to "some" European countries. The European Commission said last week that the bloc would not be short of oil if Iran stopped crude exports, as they have enough in stock to meet their needs for around 120 days. Greece exposed Industry sources told Reuters on February 16 that Iran's top oil buyers in Europe were making

substantial cuts in supply months in advance of European Union sanctions, reducing flows to the continent in March by more than one-third, or over 300,000 barrels daily. France's Total has already stopped buying Iran's crude, which is subject to fresh EU embargoes. Market sources said Royal Dutch Shell has scaled back sharply. Among European nations, debtridden Greece is most exposed to

Motor Oil Hellas of Greece was thought to have cut out Iranian crude altogether and compatriot Hellenic Petroleum along with Spain's Cepsa and Repsol were curbing imports from Iran. Iran was supplying more than 700,000 barrels per day (bpd) to the EU plus Turkey in 2011, industry sources said. By the start of this year imports had sunk to about 650,000 bpd as some customers cut back in

anticipation of an EU ban. Saudi Arabia says it is prepared to supply extra oil either by topping up existing term contracts or by making rare spot market sales. Iran has criticised Riyadh for the offer. Iran said the cut will have no impact on its crude sales, warning that any sanctions on its oil will raise international crude prices. 'Own customers' Brent crude oil prices were up $1 a barrel to $118.35 shortly after

Iran's state media announced last week that Tehran had cut oil exports to six European states. The report was denied shortly afterwards by Iranian officials. "We have our own customers ... The replacements for these companies have been considered by Iran," Nikzad said. EU's new sanctions includes a range of extra restrictions on Iran that went well beyond UN sanctions agreed last month and included a ban on dealing with Iranian banks and insurance companies and steps to prevent investment in Tehran's lucrative oil and gas sector, including refining. The mounting sanctions are aimed at putting financial pressure on the world's fifth largest crude oil exporter, which has little refining capacity and has to import about 40 per cent of its gasoline needs for its domestic consumption. Mike Ryan: SNL Scorecard: Is Maya Rudolph Linsane?

So, the talk this week centered on the question of "will she or won't she" in relation to Maya Rudolph's Whitney Houston impression -- and thankfully, that didn't happen. (Though, that was nothing compared to the now two weeks of buildup until Lindsay Lohan's sure-to-be disaster of a show.) The most notable thing about last night's show was the cold open: absolutely pouncing on the Jeremy Lin story - even responding to the unfortunate ESPN headline - instead of the usual, "Hey, here's Mitt Romney talking," or whatever. In other words: it set the tone for the night. A very good Amy Poehler, Justin Timberlake and Paul Simon cameo filled night, I should add. Sketch of the Night "Cold Open: Linsanity Postgame"(Hader, Thompson, Pharoah, Killam) Please, please, please, please, please let this put an end, once and for all, to the Jeremy Lin puns. You, out there, still trying to come up with a new word to stick "Lin" in front of -SNL is openly mocking you. (OK, having said that, please ignore the headline of this piece.) Also: as mentioned before, why every show doesn't start with a great

cold open is beyond me. Actually, in the two years that SNL Scorecard has existed, I'm fairly certain (and I'm way too lazy to look this up to be sure) that this is the first time the cold open has earned "Sketch of the Night." Again: it really does set the tone. (Though, I'm afraid in 15 years, people will look back at this sketch and ask, "Wait, who are they talking about?")

Score: 8.5 The Good "Cosby Obama"(Rudolph, Armisen, Sudeikis, Killam) First thing: This was honestly the first time I've seen Armisen having fun playing Obama since the "Play it Cool" sketch from 2008 - even though it was more Cosby than Obama. Also, the sketch captures the later years Cosby Show tone of almost being a parody of itself.

And, yes, it is remarkable that Maya Rudolph has to host the show in order to air a sketch featuring the First Lady - that's sort of a problem. (Also, somewhere, Carl Payne III is calling his friends to ask, "Hey, did you see they mentioned Cockroach on SNL last night?") Score: 8.0 "Weekend Update"(Meyers, Poehler) Amy Poehler should not

allowed to appear on "Update." Every time I convince myself, "You know, Meyers does a really good job by himself. And historically the 'Update' anchor has been more of a solo gig than a duo anyway," Poehler shows up and utterly destroys this misconception of mine. The energy level on "Weekend MIKE page 46

Yeah, as far as monologues go, this was pretty great. I love it when the whole cast gets together for a choreographed number. This just had the feeling of, "Wow, a lot of work went into this one." Oh, did I mention Paul Simon was there? (Yes, and Stephon -- who I can handle as a cameo right now, but is getting dangerously close to being overexposed.) Score: 7.5 What's Up With That?(Thompson, O'Reilly, Upton, Ensemble) Oh, you thought this was retired forever, didn't you? You almost had me convinced! But I always held on to hope. Hope that, just like the phoenix, rising out of the ashes of Mahwah (or, whatever), Deandre Cole would return to me. Good God, it was great to see Jason Sudeikis dancing around in his red tracksuit again. And, Lindsey! Poor Lindsey. Someday, Lindsey.

Score: 7.0 "Maya Angelou Prank Show"(Rudolph, Pharoah, Thompson, Hader) OK, I'll be honest, I had to watch this one a few times before I fully appreciated it. I don't know why, but it grew on me. Actually, it's one of those sketches in which I laugh harder the more times that I watch it - particularly at Pharoah's Morgan Freeman. Score: 6.0 How's He Doing?(Thompson, Pharoah, Rudolph) "The show where the black voter takes a look at President Obama and asks, how's he doing?" My biggest problem with this sketch was its placement on the show. It's not quite bizarre enough to be the last sketch of the night. With its political slant, it almost felt like something that was bumped from the cold open. In other words: it's a good sketch that would have played better not closing out a high-energy show. This would have been a good ballad to slip into the middle of a set list filled with rock song after rock song. Score: 6.0 The Bad "Bronx Beat"(Rudolph, Poehler, Samberg, Timberlake) Ah, yes, the least surprising "surprise" of the evening. (OK, to be fair, I had heard through the grapevine that

this was happening over a week ago. I digress.) Look, I don't get "Bronx Beat." I never have. I know people that swear by it. Every time it airs - and it always airs in prime real estate -- I try to give it another chance. I really do. But, for me, the humor just comes down to Rudolph and Poehler doing exaggerated New York accents. Great. To those who love "Bronx Beat," I apologize in advance because I'm sure this entry was just as amazing as all of the others. I just can't join you in your praise. I just ... can't ... do ... it... Score: 4.5 "Jay-Z and Beyonce's Baby(Rudolph, Pharoah, Timberlake, Ensemble) I despise these type of sketches. Yes, I like seeing Fred Armisen's Prince has much as the next person, but what this amounts to is, "Let's just parade in the entire cast and have each do an impression. It doesn't matter what the impression is, any will do..." They always feel lazy and this was no exception. (OK, yes, I did like Timberlake's Bon Iver -- but, still...) Score: 4.0 The Ugly "Super Showcase"(Wiig, Rudolph, Hader, Bayer) Don't be fooled by how much you laughed during this sketch. You laughed

because Kristen Wiig broke character - which, to her credit, is extremely rare. If that had not happened, you would not have laughed at this sketch. It's just Wiig and Rudolph doing a weird voice. Actually, this felt like an inside joke between Wiig and Randolph, which is probably why Wiig couldn't keep a straight face. Call of Duty will be launching on Vita this fall, Sony's SVP of PlayStation Brand Marketing told Game Trailers in a video interview. SVP Guy Longworth, hired by Sony in October 2011, casually dropped the news about Vita's Call of Duty title, saying his kids love first-person shooters and "in the autumn, they're really looking forward to Call of Duty on Vita, and we think that's going to be an absolute game-changer for the platform." When pressed for more details, Longworth said Sony wasn't ready to announce which title will be hitting Vita, but we bet it'll be the one with the guns during that war against those bad guys with strange accents. years, so I'd be disappointed if he doesn't find a way to put Lin in uniform. The Stern I've come to expect, who understands the value of a name worthy of a marquee, is working on that task at this very minute. Consider that since Lin's first start Feb. 6, Madison Square Garden stock has jumped 7 percent. The cost of Knicks tickets on the secondary market -such as brokers -- has soared 25 percent. Sales of Knicks merchandise suddenly is the highest in the NBA. Among commissioners of major American sports, only Bud "Turn a Blind Eye" Selig would not to notice this. No league worth its net value in billions would ignore the chance to offer such positive exposure, boost TV ratings and, of course, rake in potential megabucks. MLB's 2011 All-Star game drew record-low ratings. Ratings for the NFL's Pro Bowl, played last month, were down 8.1 percent. The NBA's 2011 All-Star game, by contrast, scored its highest rating since Michael Jordan's last appearance in 2003.

Why not raise the stakes, take it up a notch, for the game to be played Feb. 26, which will face tough competition from the Academy Awards telecast? Lin doesn't need the All-Star game, but the NBA surely would benefit from his presence. And Stern, who can do pretty much anything he wants, usually does what's best for the league. It's not as if another Jeremy Lin is going to come along this year, or this decade. It's time the mighty commish, facing a reality that only looks like a dream, improvises. Ride the wave. Crash teacher's family 'devastated'

19 Feb 2012 The family of a 59-year-old teacher who died when a coach carrying schoolchildren home from a ski trip crashed in northern France said they were "devastated" by their loss. Peter Rippington was killed and four others seriously injured when the bus flipped over and came to rest at the bottom of an embankment near the city of Reims in the ChampagneArdenne region at around 2.30am. Mr Rippington's wife Sharon was also injured in the crash, which involved 29 pupils from Alvechurch Middle School in Worcestershire. A statement from the Rippington family said: "We, as a family, are devastated at the tragic loss of Peter, a wonderful husband, father, son, brother, son-in-law, brother-in-law, uncle, friend and teacher.

"We are still extremely concerned about the health of his wife, Sharon, who was injured and is still recovering in hospital in France. Sharon is accompanied by her daughter Amy, who escaped the incident with minor injuries. Until they are safely home we ask that our privacy is respected and that we are left to grieve with our friends and family." A total of 27 people were taken to hospital following the crash, with 22 of those said to have minor injuries. It is not known how many of the seriously injured are children. Interski Snowsport School, the company that arranged the trip, said there were 21 adults on the coach when it crashed on the A26 at Chalons-en-Champagne. There were two drivers on board, along with six Interski instructors and 13 adults belonging to the school party. Mr Rippington was described as a "one of a kind teacher" by his pupils, who gathered at the school in shock.

Speaking outside, Superintendent Steve Cullen of West Mercia Police, said: "This is a very sad incident and I want to express our sympathy to all those affected by the crash. I want to offer reassurance to local people that we are doing all we can to help and support all the children." Councillor Liz Eyre, cabinet member for children and young people at Worcestershire County Council, added: "We are shocked and saddened about the accident early this morning. Our thoughts are with those involved and their families." They said the school would be open tomorrow and pupils will be offered any help and support they need. debate like this. But Obama started this argument twice in the past three weeks, and to blame Santorum for pushing back seems a little odd. Update: Commenter Reliapundit notes that there are some arguments, though true, that should be made through surrogates and not by the candidates themselves and that this is one of those. Its not a bad point, perhaps especially for Santorum. Also, some argue that this is a distraction from the main economic issues of the campaign, but as it applies to Obamas theology on taxes and ObamaCare mandates, thats not entirely true. And if the economy heats up a little bit between now and the election, we will need the Republican nominee to be arguing on both how both represent an unconscionable power grab, and not merely how they both damage the economy. A reader sends in a positive example of a paper moving past the " false equivalence" trap. It's a New York Times story this past week on the "Heartland" controversy. The story says, with emphasis added: Heartland's latest idea, the documents say, is a plan to create a curriculum for public schools intended to cast doubt on mainstream climate science and budgeted at $200,000 this year. The curriculum would claim, for instance, that "whether humans are changing the climate is a major scientific controversy." It is in fact not a scientific controversy. The vast majority of climate scientists say that emissions generated by humans are changing the climate and putting the planet at long-term risk, although they are uncertain about the exact magnitude of that risk. Whether and how to rein in emissions of greenhouse gases has become a major political controversy in the United States, however. Let's stipulate that a controversy has subsequently arisen about the FALSE page 54

On the less cheering side, a reader writes to note a veteran Congressional correspondent saying two days ago on public radio that 60 votes is what it takes to "pass" a bill in the Senate. The discussion is about the extension of the payroll tax-cut this week, by a 60-to-36 vote in the Senate. The correspondent, Gail Russell Chaddock of the Christian Science Monitor, says on Here and Now, "Sixty is the outer limit for passing a bill in the Senate. Had one Senator changed their mind, we wouldn't be having this discussion." From the reader: The host replies, "What does this say about Republican leaderships, because..." The conversation goes on, and the reporter returns to the 60 number as being the minimum, but no reference is made to this being a procedural/filibuster issue. If the listener doesn't already know this, the impression is that

the 60 vote margin is a constitutional requirement in the Senate. To be clear, I know you have affection for NPR [JF: and for this show in particular, which I like and have recently been on]. I do too. It's what I listen to and where I get most of my news (after TheAtlantic.com) This is not a pick on NPR, but a note of how things that are untrue become "facts". Of course that correspondent realizes that 60 votes is the threshold for breaking a filibuster in the Senate, not for passing a bill. (With a few narrowly stated exceptions, like treaties and impeachment, the Constitution says that the Senate will work on a simple-majority basis, with the Vice President breaking a tie if need be.)
