DEED OF EXTRA-JUDICIAL SETTLEMENT OF ESTATE WITH WAIVER

KNOW ALL MEN BY THESE PRESENTS: We: MELODINA S. DEL PUERTO, of legal age, Filipino and a resident of Igualdad St., Guinobatan, Albay, married to the late Leo Y. Del Puerto Sr.; LEO S. DEL PUERTO JR., of legal age, Filipino and a resident of Igualdad St., Guinobatan, Albay, Filipino, married to Angelica A. Del Puerto; ANN D. ORLANDA, of legal age, Filipino and a resident of Morga St., Guinobatan, Albay, Filipino, married to Dennis O. Orlanda; JAN D. PAJARA, of legal age, Filipino and a resident of Travesia Guinobatan, Albay, Filipino, married to Micle O. Pajara; ZSA D. NIEVES, of legal age, Filipino and a resident of Calzada Guinobatan, Albay, Filipino, married to Michael S. Nieves; and JAZLEE S. DEL PUERTO, Filipino, single and a resident of Igualdad St., Guinobatan, Albay. after being duly sworn to in accordance with law hereby state: 1. That we are the heirs by right of representation to the intestate estate of the late Leo Y. Del Puerto Sr. , who at the time of his death sometime in June 13, 2007, was survived by his spouse Melodina S. Del Puerto and children.

2. That at the time of his death, Leo Y. Del Puerto Sr. was the recorded owner of a certain parcel of land identified as Lot 130-B of the subdivision survey Psd-05-005021 , being a portion of Lot 130, Cad-201, Guinobatan Cadastre situated in Poblacion, Municipality of Guinobatan, Province of Albay, consisting of an area of Two Hundred Seventy (275) square meters more or less and declared for taxation under TCT No. 65583 the Property) . A copy of the aforementioned TCT is herewith attached as Annex A and made an integral part of this instrument. 3. That by these presents, WE: MELODINA S. DEL PUERTO, ANN D. ORLANDA, JAN S. PAJARA, ZSA D. NIEVES AND JAZLEE S. DEL PUERTO hereby expressly and freely WAIVE, RENOUNCE and TRANSFER our right of representation and participation to the extent of respective portions over the Property subject of the intestate estate of the late Leo S. Del Puerto Sr. in favor of our co-heir, LEO S. DEL PUERTO JR.

4. That by these presents , we hereby affirm that we are the only heirs of the late Leo Y. Del Puerto Sr. and have not intentionally or inadvertently omitted to name and include in this instrument the participation of any other surviving heir.

NOW THEREFORE, for and in consideration of the foregoing premises and invoking the provision of Section 1 Rule 74 of the Rules of Court, the aforementioned heirs of the late Leo Y. Del Puerto Sr., and by virtue of their right of representation to the intestate estate of the late Leo Y. Del Puerto Sr. , hereby agree by these presents to adjudicate our respective legitimate portion in the manner herein set forth, subject only to the liabilities imposed by Section 4 Rule 74 of the Rules of Court in favor of any other possible heirs, creditors, and other persons who may be deprived of their lawful participation in the estate of the decedents for the period of two (2) years.

THAT FINALLY, we hereby affirm that we have executed this instrument out of our own free will without force , intimidation or violation upon our person, and that we have hereby received our just and proper shares and have no further claim or demand against each other in connection with the above-described parcel of land.
