TO YOUR ATTENTION! The present document is by itself not enough for applicants to prepare their projects. Applicants are invited to carefully read all documents in the application package, as well as the Programme Document (Operational Programme, OP) in order to be able to prepare their applications in compliance with the rules governing this Programme, including relevant national and community legislation. In all those cases when there are discrepancies or contradiction between the English version and the Hungarian or Romanian translations, the English version of the documents will prevail. 1. Reference number of the Call for Proposals: HURO/1101


The Managing Authority based on the decision of the Joint Steering Committee and in co-operation with the Hungarian and Romanian National Authorities, is launching the fifth Call for Proposals in the framework of the Hungary-Romania Cross-border Co-operation Programme 2007-2013 (hereinafter referred to as HU-RO CBP or Programme). The present Call for Proposals is opened in the frame of the one step periodical application model for full project applications and is launched in an open competition.

2. Duration of publication: 29th August 2011 31st January, 2012 3. Programme: The call is based on HU-RO CBP adopted by the Commission Decision no. CCI 2007 CB 163 PO 067 of the European Commission, as well as on the rules of implementation adopted by the Joint Monitoring Committee for the period of 2007-2013. 4. Published Actions and indicative funds available:
The present Call is opened for both Priority axes of the programme. Financial sources (ERDF contribution) total 51 398 714,- EUR, that shall be increased with the relevant Hungarian and Romanian state co-financing. 5. Eligibility rules
Please note that the detailed description of the eligibility rules is available in Chapter I. Eligibility rules of Applicants Handbook. Projects submitted must meet all eligibility criteria! 5.1 General eligibility rules for projects Projects will be considered eligible in case: They are in line with the objectives and the Priority axes of the HURO CBP; They are in line with one of the Key areas of intervention and Actions of the present Call for Proposal; Have a provable cross border character and impact; Fulfil at least two of the following joint criteria: joint development, joint implementation, joint staffing, joint financing; Are in accordance with the Lead Partner principle; Respect the requirements and limitations presented in this Call, the Applicants Handbook and the HURO CBP.

5.2 Territorial eligibility In order to be eligible, all projects have to be implemented in the eligible border area meaning Szabolcs Szatmr Bereg, Hajd-Bihar, Bks and Csongrd counties in Hungary and Satu Mare, Bihor, Arad and Timi counties in Romania. 5.3 Eligibility of applicants Applicants (Lead Partners and Partners) have to comply with the following conditions in order to be able to get financing in the framework of the present Call: - Have to be organizations falling into one of the following categories: Public authorities

Bodies governed by public law Non-profit organizations governed by private law EGTCs - Have their seats or a regional/local branch registered in the programme area1 specified at 5.2.; - Have stable and sufficient human, professional and financial sources, capacities to manage their share of the project and implement the undertaken activities financially and professionally. 5.4 Eligibility of partnerships Partnerships are eligible, if they comprise a Lead Partner and at least one Cross-Border Partner. Furthermore, partnerships must be balanced in terms of professional expertise, activities and budget, no one-sided partnerships being supported. 5.5 Eligibility of activities The present Call has a set of framework activities, applicants being invited to propose their own project activities that fit into the framework proposed. For the list of indicative activities, please consult Annex 1 of the Applicants Handbook, Tables of indicative eligible activities broken down by actions. Furthermore, applicants shall demonstrate in the submitted project proposal the long term viability of their project and they will have to sustain its results for at least 5 years following project closure. Non compliance with the later condition may result in the obligation of the applicant to return ERDF funds. 5.6 Eligibility of costs Costs shall meet the criteria described in Chapter I.6, Eligibility of costs and budgets, of the Applicants Handbook, in general: a) eligibility in time, i.e. costs shall be incurred following the date of submission of the application until 31st of December 2014, except for the preparation costs. b) geographical eligibility, i.e. costs shall be incurred by activities implemented in the programme area.

c) eligibility by expenditure categories, i.e. costs shall comply with the type of expenditures listed in
the Applicants Handbook.

6. Project size and duration

1 In case the organisations headquarter is registered outside the eligible programme area but the regional/local branch office is a legal entity, then the local branch shall apply for funding and in case of contracting, it shall be the beneficiary.

In case the organisations headquarter is registered outside the eligible programme area and its regional/local branch office is not a legal entity, then the main organisation shall apply and in case of contracting, it shall be the beneficiary. In this special case, the organisation shall meet the following criteria: a) The regional/local branch office needs to be registered in at least one of the following documents: Copy of the Register and/or Deed of Foundation and/or Statutes and/Articles of Association; b) The leader of the branch office shall be duly authorised by the legal representative of the main organisation to act in the scope of project implementation;

The projects financed in the framework of the present Call shall extend from a minimum of 6 months to a maximum of 24 months and shall respect the minimum and maximum grant amounts. The maximum timeframes of project implementation and the grant sizes for each action opened in the frame of the present Call can be seen in the table below. NOTE! The minimum and maximum grant amounts, and the maximum timeframe indicated below for each action must be respected, otherwise projects shall be considered ineligible and rejected. The subsidy awarded cannot exceed these amounts. In case project costs are higher, applicants must plan the extra amounts as own contribution and in all cases these extra amounts have to be financed from own sources.

7. Rate of financing and financial eligibility

The grant rate awarded in the framework of the present Call makes up to 95% totalling both ERDF and state co-financing in case of Hungarian, and 98% in case of Romanian applicants. The rate of ERDF financing within a project is maximum 85% of the total eligible public project budget. Each applicant has to provide an own contribution for the project that is minimum 5% of the total eligible partner budget of the respective partner in case of Hungarian and minimum 2% in case of Romanian applicants. NOTE! Due to the fact that the programme has to observe the state aid rules, the grant rate can be less than 95%, respectively 98% of the eligible project budget! In those cases, applicants have to provide more own contribution to the project than the minimum 5% or 2% to compensate the lower financing rate. For further information on state aid rules please consult the Annex D. Guidelines on state aid. The applicants must provide their own contribution in cash, no in-kind contribution being accepted. The only exception concerns those Hungarian Project Partners that are financed out of the Hungarian state budget falling in one of the categories below: - Budgetary organ and/or their institutions established centrally according to Annex 1 and 2 of the Bulletin 9001/2002 (SK 3.) of the Central Statistical Office (i.e. having 311 or 312 as 13-15th digit of the uniform statistical code) - Other beneficiaries financed from state budget falling under the categories listed in ESA952, Partners falling into one of the above categories are not obliged to bring own contribution, therefore the rate of Community funding shall be 85% while the rate of state contribution shall be 15% of their total eligible partner budget. For comprehensive information on the rate of funding, please see Chapter II. of the Applicants Handbook. In the frame of the present programme there is no possibility for ERDF advance payments, financing will be offered based on reimbursement. However, projects approved for financing will automatically receive the related state co-financing in advance, i.e. without any additional application procedure. After the conclusion of state co-financing contracts with the relevant National Authorities, 100% of the Hungarian state contribution will be transferred to the Hungarian Project partners and maximum 90% of the Romanian state co-financing to the Romanian Project Partners. The detailed rules for granting and transferring the state co-financing shall be stipulated within the state co-financing contracts.

8. Compliance with the European Union and National Legislation


All projects submitted and financed through this Call will have to comply with all relevant national and community legislation. For a full list of the legal norms governing the programme please consult Chapter V, List of relevant legislation of Applicants Handbook. According to the General Regulation (EC) 1083/20063, in order to be eligible in the frame of the cross border programmes, projects shall consider and respect the de minimis and State Aid rules, as well as those regulating the revenue generation. A short presentation of these rules is available below. For more information please consult the Applicants Handbook. NOTE! For the present Call, in accordance with Hungarian Decree of the Ministry for National Development and Economy No. 5/2009. (III. 18.) also temporary aid can be granted.

8.1 State aid rule In order to ensure undistorted competition on the internal common market, the European Commission laid down a set of rules, called state aid rules. According to Art 107 (1) of the Treaty of Functioning of the European Union any aid granted by a Member State or through State resources in any form whatsoever which distorts or threatens to distort competition by favoring certain undertakings or the production of certain goods shall, in so far as it affects trade between Member States, be incompatible with the internal market. As a result, projects with activities falling under these rules might receive a lower funding rate, therefore Project Partners, in order to be able to conclude the Subsidy Contract, have to engage themselves to finance those activities with a higher own contribution rate. For more information on state aid rules please consult Annex 1 to the Applicants Handbook, connected to the framework activities and ANNEX D - Guidelines on State Aid. 8.2 Revenue generation As a general rule, projects financed under the present Programme should not generate any kind of revenues, since their results have to be of public benefit, and have to be made available for the general public free of charge. Net revenues (incomes less operating costs) that may be generated by projects have to be forecasted and presented as such in the projects budget table and these shall be reduced from the total eligible project costs. The net revenues that will be obtained in the next five years following project closure will also be deducted from the total eligible project expenditures, thus also from the public funds granted. 9. Horizontal principles
In developing its policies, the EU paid a constantly increasing attention to the horizontal principles of equal opportunities and sustainable development, as prerequisites for a balanced and healthy economic, social and cultural growth of the entire European society. Consequently, the aspect of promoting the principle of equal opportunities will receive a special attention when selecting for financing the applications within the Programme. Potential beneficiaries have to demonstrate that they are aware of, and promote these principles and that they are committed to bring measurable contribution to them. The fulfilment of the horizontal principles shall be closely controlled in all phases of a projects lifetime, i.e. in the evaluation, selection and in the implementation phase, as well. The OP also introduces another horizontal principle: bilingualism. According to this key documents of the projects, as well as the outputs (or related documents, for that matter) are produced both in Romanian and in Hungarian. This principle shall be included in the grant contract of the selected applicants, as well. NOTE! Commitments regarding the contribution to the horizontal principles shall be made by using the set of horizontal indicators listed in Annex C - Guidelines on Horizontal Principles!

10. Submission of the applications, deadlines


Language Application Forms and annexes have to be completed electronically in English language. Supporting documents can be submitted in the original language (Hungarian or Romanian). All applications that are typewritten or completed by hand, as well as completed in another language than those indicated will be automatically rejected. NOTE! All official communication related to the evaluation process, such as requests for formal completion/clarification, respectively notification letters shall be in English language, therefore applicants should ensure the necessary human resources for this task. The language of project implementation will be in all cases English, meaning that the ERDF Subsidy Contract will be signed between the LP and MA in English, also the language of narrative and financial reporting on both partner level (towards the FLC) and project level (towards the JTS) shall be in English! Submission Applications must be prepared on the specific Application Form annexed to this Call and respecting those presented in the application package. The paper based application, as well as its copies must contain all compulsory parts of the application (i.e. Application Form, annexes, declarations, other supporting documents, etc.). Each copy shall be bound, continuously numbered, with the table of contents bound to the application and containing the relevant page numbers for all headings. Compulsory supporting documents of larger volume (e.g. technical design documentation) do not have to be bound to the application, but a clear reference should be made to them in the table of contents, including the number of pages of the volumes not bound to the application. Applications must be submitted in one package, containing: - one original; - two copies; - one electronic version on an electronic data carrier device (CD, DVD, USB pen-drive) containing the following: Application Form together with project budget in .xls format; Annexes 1-5 and 7-9 in .doc format; Annex 6 in .xls format Joint Feasibility Study in English language Supporting document no. 6: o for Hungarian partners: Breakdown of the costs of construction prepared by the designer o for Romanian partners: Feasibility study / Technical expertise Before submitting the application, please make sure, by using the checklist, that all necessary documents and electronic copies are attached to the Application Form and that all saved documents are readable.
As a sign of respect to the environment and to reduce printing costs, the Hungary-Romania Cross Border Cooperation Programme encourages applicants to submit their documentation, if possible, printed double-sided. Please note that this is not an obligation. Submitting one-sided documentation will have no negative effect on your application!

Applications can be submitted continuously by courier or postal service (only registered mail with confirmation of receipt is accepted) starting from the opening of the Call until no later than 31st January. 2012 (date of postal stamp). Applications submitted in other ways than the above options (e.g. e-mail, fax, personally, etc.) will be automatically rejected. Applications posted after the deadline or applications that arrive more than two weeks after the deadline of the Call meaning 14th February, 2012 - shall be automatically rejected. All envelopes or boxes containing submitted applications must be sealed, bearing the name and address of the Lead Partner submitting the project, as well as the Key area of intervention and Action envisioned by the project and the title of the project proposal. Only intact boxes or envelopes will be admitted to the opening session. In case of weight restrictions applied by the postal service provider that impede the submission of the application in one single package, the application can be submitted in more than one package, but in this case clear reference should be made on the package cover to the number of volumes. However, please note that in this case the JTS does not assume any responsibility for lost or incomplete documentation, the risk of loss of documents is borne exclusively by the applicant. Approval of data management / Privacy Policy The applicant by submitting the application for the present Call for proposals duly consents to the fact that the Contractor (Data Manager, i.e. Managing Authority) and VTI Nonprofit Kft., hosting the JTS (Technical Data Processor) will manage all the personal data included in the application package and provided in the contracting or project implementation phase, in particular with regard to the data managed in the INTERREG Monitoring and Information System 2007-2013 (IMIS 2007-2013).

11. Evaluation of project proposals


The project evaluation and selection process is described in Chapter III. 1. of the Applicants Handbook. In order to support the proper development of project implementation schedule, please consider that the whole process should last around 136-146 working days depending on the number of projects submitted, the amount of missing documents and the number of projects that will be finally assessed from the point of view of their quality. NOTE! Please consult the evaluation grids when developing and preparing your application for submission! Applicable evaluation forms can be found in the Annex A of the present Call. The applicants shall receive written notice about the results of the evaluation and on the final decision of the Joint Steering Committee regarding the selection of the projects.

Applicants are requested to contact one of the offices above in order to arrange an appointment for personal consultation. Applicants can require clarification or raise questions towards the JTS and/or IP not later then 20 days before the deadline of the Call. Final answers shall be released not later then 10 days before the submission deadline. Usually, answers will be given in maximum 5 working days. The Joint Technical Secretariat, in co-operation with Info Point, will organize a set of information events in order to publicise the Call for Proposals and to give support to the potential applicants in the preparation of their applications, as well as to contribute to the establishment of valuable partnerships and projects. More information will be published in due time on the relevant web sites and in Hungarian and Romanian national and regional newspapers.

13.1 Documents to be annexed to the Application Form The types of the annexes/supporting documents to the Application Form are the following: Compulsory annexes meaning that they shall be prepared and submitted by all applicants (Lead Partner and, in some cases, by Partners as well); Annexes to be submitted if relevant meaning that they only need to be presented if the applicant/one of the Partners finds themselves in the relevant situation.

All documents need to be signed by the legal representative(s) of the partner organisation or the person(s) authorised by them, unless specified otherwise. Copies of official documents must be certified as to be in conformity with the original by the legal representative of the Partner organisation! Supporting documents shall be submitted in the original language of issuance (Hungarian or Romanian). NOTE! SUPPORTING DOCUMENTS TO THE APPLICATION FORM 1. with a similar juridical value which proves the . ownership of the respective territory.4 In case the land is in concession/rental, it must be proved that the duration of the concession/rental of the land is in line with the provisions of article 57, paragraph 1 from Regulation (EC) 1083/20065 and that the landowner has given his written agreement that the applicant is free to perform the investment. In case the real estate/land is not in the property of the Lead Partner/Partners, a rental contract and agreement of the owners shall be submitted. The rental contract shall be made on a long term (i.e. min. 10 years) with the possibility of renewal between the same contracting parties. In case the land/part of land affected by the investment is not in the ownership of the Lead Partner/Partners at the time of submission of the project application and it will be obtained/partly obtained during the implementation of the project in the frame of an expropriation procedure, besides the title deed(s) an expropriation plan

For investment projects and for projects consisting in drawing any type of documents preparing an investment, the applicants must prove they are the owner of the land and/or building or the fact that the land is in concession by the following documents: the applicant is the owner of the land/or building:

a)

1. for public authorities - the legal act (e.g. government decision, law, government ordinance, decision of local counties etc) stating the public property on the land and/or building; - documents related to the registration of property of the respective applicant on the land and/or building in the relevant public registers. 2. for NGOs - property act on the land and/or building; documents related to the registration of the land and/or building in the relevant public registers. b) the applicant has received the land and/or building is in concession: 1. for public authorities: -the legal act (e.g. government decision, law, government ordinance, decision of local counties etc) stating the fact that the land and/or building is in concession; it must be proved that the duration of the concession of the land is in line with the provisions of article 57, paragraph 1 from Regulation 1083/2006 and that the landowner has given its written agreement saying that the applicant may perform the investment. declaration from the land and/or building owner that the land and/or building is: o free of any encumbrances; o not the object of an pending litigation; o not the object of a claim according to the relevant national legislation. - documents related to the registration of the land and/or building in the relevant public registers. 2. for NGOs concession act on the land and/or building; it must be proved that the duration of the concession of the land and/or building is in line with the provisions of article 57, paragraph 1 from Regulation 1083/2006 and that the owner of the land and/or building has given his written agreement saying that the applicant may perform the investment. However, this/these documents(s) should be submitted as supporting documents to the Application Form and should be accompanied by the legal agreements and approvals. For the projects involving the construction/rehabilitation/modernization of transport infrastructure, a traffic study must be presented containing data on the current and the estimated traffic. In case of Romanian partners: Urban planning permit (certificat de urbanism) together with all the permits and authorizations listed in it. In case of both Hungarian and Romanian partners: In case according to the relevant legislation the investment/construction activity does not require building permit, a certificate/declaration of the competent authority shall be attached regarding the non-relevance of the permit. Environmental impact study and Compulsory annex permit/agreement In case of Hungarian partners: Summary of the environmental impact study and environmental permit or a proof that the process for obtaining the environmental permit has started. NOTE! In case the project is selected for financing, as a precondition of signing the ERDF subsidy contract, the applicants will have to present the environmental authorization/permit as well as the legally binding building permit. Applicants will be obliged to present the complete documentation required for contracting within maximum 90 calendar days (including eventual completions) from the date of receipt of the notification letter about the financing of their project proposal. In case they fail to do so, the subsidy contract will not be signed and the applicants will lose the awarded financing. Only in duly justified cases, when the delay of obtaining the required documents does not lie within the responsibility of the Applicant, the Managing Authority may extend this period.
