Kharupetiahat Dist: Darrang(Assam) Dear Sir, Sub: Staff Grievances While refer the subject cited above I wish to intimate you the following. That there was a staff meeting of Borgora staff unit on 12/06/2011 and accordingly the unit secretary,ACKS,Borgora T E submitted a complain to me stating the following for its proper action. Office: Head clerk: The post is lying vacant since a long. 2nd Clerk: No 2nd clerk is available. Typist: No typist is available. Store Clerk: No store is available. Only P. F. clerk is available and surprisingly the whole office is running with the help one staff. Field: Head garden Mohorer: The post is lying vacant. 2nd garden mohorer: Not available. Women mohoer: Not available. Only one staff in Grade C ( Mukunda Baruah) is working alone. Factory: The post of Head tea house, 2nd tea house, 3rd tea house and excise clerk are not available and whole factory is running without staff. Hospital: In the hospital one pharmacist in grade III and one nurse in grade III is available. The hospital is running with 2 nos lower graded staff in absence of health assistant.

Technical staff: There is no electrician in the factory, One Fitter is available in B-II grade and only one Driver is available in Grade-III. School: No school teacher is appointed.

Based on the above report as submitted by the unit concern there was a discussion thoroughly over the above matter at your office on 26/06/2011 the management is urgently requested to fill up the undernoted post with proper grade as per agreement arrived in between the employer & the ACKS in time to time. The details are given below: Office: Head clerk: Sri S.Goswamee to be up graded to clerical grade A as Head clerk. 2ns clerk: To be appointed in clerical grade B. Store clerk: To be appointed in clerical grade B Typist: To be appointed in clerical grade C. Field: Head garden Mohorer(J.B): Sri Mukunda Baruah to be upgraded to Clerical grade A as J.B. 2nd garden mohorer: To be appointed newly in clerical grade B. Women Mohorer: To be appointed newly in clerical grade C. Factory: Head tea house: To be appointed immediately in clerical grade A. 2nd tea house: To be appointed immediately in clerical grade B. 3rd tea house: To be appointed immediately in clerical grade C. Excise clerk: To be appointed immediately in clerical grade C. Hospital: The pharmacist and the Nurse should be up graded to next higher grade as their service already crossed 12 (twelve) years. The Health Asst. is daily rated. It is an unfair labour practice. The Health Asst. should be given proper scale of pay in medical grade III. Technical staff: It is observed that after resignation of Sri Deka no electrician is appointed. The management is requested to appoint an electrician in technical grade B immediately. The fitter is presently available in factory in Grade B-II. He should be up graded to technical grade A with immediate effect. Only one Driver is available at present. The management should appoint driver as per the vehicle available and the senior most driver should be up graded accordingly. Sri Ram Singh Tanti & Sri Rabi kant Singh should be promoted to Artisan grade C with immediate effect as they are holding driving license.

School There are 2 (Two) nos employees are working in the estate as school teacher. Both of them are daily rated .It is an unfair labour practice. No school teacher should be a learner or apprentice category. If school teacher himself is a learner how he will teach the other? They should be given proper scale of pay as per agreement and senior one should be given 10% extra on his basic pay as charge allowance.

The management sharp attention on the above matter is requested so that no staff member is suffering for a long time again. On the stated position you are requested to confirm your views in a point to point basis at an early date.

Allowances: Cycle allowance: Reference memorandum of settlement dated Dibrugarh the 3rd November, 2010 in between the Assam chah karmachari sangha & Assam valley branch CCPA. Terms of settlement: With effect from 01/12/2010 staff members who are in receipt of cycle allowance at present and or are required to use their cycles in performing their duties will receive uniform cycle allowance @ Rs. 100/- per month. Charge allowance to school teacher: Reference memorandum of settlement dated, Dibrugarh the 19th November, 1993 in between the Assam chah karmachari sangha & the Tea Industry of Assam valley Branch CCPA. 1. (d) Further agreed that where there is only one teacher in any tea garden school he/she shall be eligible for charge allowance @ 10% of his/her basic salary. The terms of agreement in clauses 1(a), 1(b) , 1(c) & 1(d) will be effective from 1st April, 1993.

Quarter allowance: Reference Industrial Tribunal Award Dt. 13/08/1959( Ramlabhaya Award) Quarter allowance: Free unfurnished quarter to be provided where possible or 10 per cent of the basic salary in lieu thereof.
