Medway Council Resident Permit Terms and Conditions

Each household situated within one of Medways Controlled Parking Zones is entitled to purchase yearly Resident(s) permit to enable them to park within that controlled parking zone. An application form must be completed for each permit and supporting documentation will be required to prove residency and vehicle ownership. The permit will be issued subject to the provisions and conditions of the Medway Residents Parking Places (Special Parking Area) Order 2000. The permit is not transferable and must be surrendered to Medway Council in the event of; The holder ceasing to be a resident as defined in the order The holder ceasing to be the owner of the vehicle for which the permit was issued The permit becomes illegible, mutilated or defaced The permit is only valid if displayed in a conspicuous position on the front windscreen of the vehicle for which it was issued. A Penalty Charge Notice will be issued for not displaying a valid permit or not displaying it clearly to enable verification. The permit may only be used in the prescribed parking place subject to space being available, which cannot be guaranteed. It does not confer the right to park in any parking place. A permit cannot be used to park on single or double yellow lines within your controlled parking zone. Your vehicle must be road worthy and display a valid road fund licence at all times. You must ensure that your permit is valid at all times. Although renewal notices will be issued to you one month before expiry, this notice should not be relied upon.

Qualification for a Resident Permit You must be a resident of Medway and live within a Controlled Parking Zone. You must be either; the keeper/ owner of a vehicle kept at your Medway address or, be a named driver on the insurance certificate for the vehicle that is kept at the permit address. You must be able to demonstrate the above by providing the documented proof requested by the Council which at the time of submission must be dated within the last 3 months. The information submitted as part of the application process must be true and be proved, if so required by the Council. A parking permit will only be released to you on receipt of all correct documentation and full payment.

Lost/Stolen Permits Should your permit be lost or stolen you must report this to Parking Services immediately. This must be done in writing, either via email to parking@medway.gov.uk or by writing to Parking Services, Gun Wharf, Dock Road, Chatham, Kent ME24 4TR.

If your permit has been stolen, it will assist your request for a replacement permit if you provide a crime reference number, which will then be verified with the Crime Management Unit for Medway. A 15.00 administration charge will apply to replace any permit.

Refund Policy Refunds will not be issued for Resident Parking permits. However, should the permit holder move to an address within a different controlled parking zone, the permit may be transferred over to the new zone free of charge. The existing permit must be returned to us and additional residency and vehicle proof will be required.

Cancellation Policy The Council reserve the right to cancel a parking permit should the information provided on the application form be proved to be false. The Council reserve the right to cancel a parking permit without refund should they deem that the permit is being misused. The council will write to the permit applicant before the permit is withdrawn. If any vehicle is seen to be displaying a cancelled permit, a Civil Enforcement Officer will issue a Penalty Charge Notice, as the permit will be deemed to be invalid.

Declaration of Correct Information It is an offence to give false or misleading information when applying for a parking permit. If you do so, you may be prosecuted and could face a fine of up to 2500. It is also an offence to mishandle or fake a parking permit. This is a triable offence and if prosecuted you could face a maximum of 5000 (Magistrates Court) or an unlimited fine and/or 2 years imprisonment (Crown Court).

Data Protection Medway Council will process your information primarily for the purpose of providing parking services to residents. We may also use your information to detect and prevent fraud and to protect public funds. This will include the recording of vehicle information and verifying residency status. We may therefore disclose or request your information to or from the Driver and Vehicle Licensing Authority (DVLA), Law Enforcement agencies or other organisations such as other local authorities. We will use a number of means to ensure the lawfulness of the use of our parking service. This may include the use surveillance equipment, Civil Enforcement Officers, auditors, and dedicated investigators to record data. We will use this information to recover unpaid Penalty Charge Notices issued in Medway. In line with its duty to protect public funds, the council and its agents will undertake investigations involving the random auditing of vehicles and users who hold a valid parking permit if the council suspects fraudulent use of its parking services.

Caution Information submitted as part of this application may be used by the council or its authorised agents to satisfy itself that you are eligible for a permit and/or to detect fraud. We will only issue a resident parking permit to a resident whose sole or main residency is within one of Medways controlled parking zones. The council takes fraud and misuse of a resident parking permit very seriously and will be carrying out checks on the information you provide. Do not complete a permit application form unless you are eligible to apply for an onstreet resident parking permit. You must return the permit if asked to do so by a Council Officer or authorised agent.
