PRESIDENTIAL INSTRUCTION OF THE REPUBLIC OF INDONESIA

THE PROTECTION OF FISHERMEN

THE PRESIDENT OF THE REPUBLIC OF INDONESIA,

In order to provide protection to fishermen, hereby instructs:

To :

FIRST :

Take necessary steps according to their respective task, function and authority in a

coordinated and

integrated manner in providing welfare, certainty and legal protection for fishermen operating fishing vessels of up to 60 Gross Tonnage (GT).

SECOND:

In conducting steps as stipulated in the FIRST dictum, to:

The Coordinating Minister for Legal, Political and Security Affairs: a. coordinate relevant policies that provide an asserted guarantee, and legal protection for the fishermen; b. coordinate the steps required in preventing Illegal, Unreported and Unregulated Fishing and Destructive Fishing in the State Fishery Management Areas of The Republic of Indonesia.

The Coordinating Minister for The Economy shall coordinate and facilitate a partnership between the banks and the fishermen. The Coordinating Minister for Peoples Welfare shall coordinate the assertion of policies on the social welfare and health of fishermen.

The Minister of Marine Affairs and Fisheries: a. b. c. d. e. f. optimize the management of fishery resources; guarantee the provision of raw materials for the fish processing industry; increase the provision and consumption of fish protein sources; promote the expansion of employment opportunities in the fishery field; prioritize preventive efforts in supervision of fishery resources; take firm action against perpetrators of Illegal, Unreported and Unregulated Fishing and Destructive Fishing in the State Fishery Management Areas of The Republic of Indonesia; g. provide protection to fishermen engaged in their fishing activities specifically in the border regions; h. prepare fishing vessels of up to 60 GT for the purpose of restructuring the armada.

The Minister of Home Affairs shall provide guidance and supervision on the implementation of policies by the local government which are relevant to the welfare, certainty and protection of law for the fishermen.

The Minister of Transportation shall facilitate the fishing vessel crew certification process and issuance of the Grosse Akte of the fishing vessel.

7.

The Minister of Public Works shall establish the development of basic infrastructure for the fishing ports and fishermen settlements.

The Minister of Education and Culture: a. build formal, non-formal and informal educational facilities and infrastructure in the fishermen settlements; b. facilitate increased access to education for families of fishermen.

9.

The Minister of Health: a. b. c. develop health facilities and infrastructure in fishermen settlements; facilitate increased access to health services for fishermen families; facilitate health insurance for fishermen.

The Minister of Labor and Transmigration: a. b. c. facilitate skill enhancement for the fishermen; promote increased work safety and health (K3) for fishermen on vessels; develop fishermen schemed migration.

The Minister of Energy and Mineral Resources shall facilitate the provision of subsidized fuel for fishermen.

The Minister of Trade: a. b. facilitate and increase efforts in diversifying the fisheries produce commodity market; facilitate the procurement of used truck engines for the purpose of fishing vessels operations.

13.

The Minister of Industry: a. facilitate the development of a fish processing industry specifically for micro, small and middle enterprises; b. facilitate the development and application of practical technology in the field of fishing.

14.

The State Minister for Cooperatives and Small and Medium Enterprises: a. provide easy access to capital for micro, small and middle fishing enterprises through the cooperatives institution; b. c. promote and facilitate fishing business partnerships; promote and facilitate the establishment of cooperatives by fishermen and their families.

15.

The State Minister for Public Housing shall facilitate the provision of low cost housing for the fishermen.

16.

The State Minister for Development of Disadvantaged Regions shall facilitate the development of fishermen settlements in order to increase the welfare of fishermen in disadvantaged regions.

The State Minister for The Environment: a. provide support in the protection of State Fishery Management Areas of The Republic of Indonesia from contamination; b. promote and facilitate the participation of fishermen in the preservation fishery resources and the environment.

The State Minister for National Development Planning/Head of National Development Planning Agency: a. b. formulate program, monitoring and evaluation plans for the protection of fishermen; coordinate relevant programs and budgets for the protection of fishermen.

Commander of Defense Force: a. b. prioritize preventive efforts in law enforcement in the fisheries field; enforcing the law against foreign fishermen engaging in Illegal, Unreported and Unregulated Fishing and Destructive Fishing in the State Fishery Management Areas of The Republic of Indonesia; c. d. protect fishermen conducting fishing specifically in the border areas; assign the Chief of Staff of the Defense Force for the Navy to discharge the instructions as stipulated in (a), (b) and (c).

Head of State Police: a. prioritize pre-emptive, preventive and educational efforts in law enforcement in the fisheries field for fishermen; b. enforcing the law against foreign fishermen engaging in Illegal, Unreported and Unregulated Fishing and Destructive Fishing in the State Fishery Management Areas of The Republic of Indonesia; c. protect and safeguard fishermen conducting fishing activities.

21.

Head of National Land Agency shall accelerate the legalization of fishermen land assets pursuant to statutory regulations.

22.

Head of Central Statistics Agency shall provide fishermen household data for the purpose of delivering assistance to the fishermen.

23.

The Governors and The Regents/Mayors in accordance with their respective authority:

a.

establish a Spatial Planning/Zoning Plan for Coastal Areas and Small Islands for business activities and fishermen settlements;

b. c. d. e.

accelerate infrastructure development in fishing ports and fishermen settlements; build educational and health facilities and infrastructure in fishermen settlements; increase access to education and health services for fishermen families; facilitate and increase access to fishermen protection whenever unable to venture seaward due to bad weather or natural disasters;

f. THIRD:

facilitate the resolution of fishermen conflict.

To formulate plans and establish coordination between Central and Local Government agencies to issue required policies that are relevant to the protection of fishermen that is in accordance with their respective duties and responsibilities and in coordination with the Minister of Marine Affairs and Fisheries.

FOURTH:

In order to execute this Presidential Instruction, and in so far as to relevant with the authority of the Bank of Indonesia, the related Ministers/Institution Heads shall coordinate with the Governor of the Bank of Indonesia.

FIFTH:

The respective Ministers shall report the implementation of this Presidential Instruction to the President through the Coordinating Minister for Legal, Political and Security Affairs, the Coordinating Minister for The Economy, and the Coordinating Minister for Peoples Welfare, in accordance with their tasks.

SIXTH:

To implement this Presidential Instruction with conviction and full responsibility.

This Presidential Instruction shall become effective as of the day of enactment.
