VOLUNTEER AGREEMENT
This Agreement is made and entered into this ____ day of ______________, 20___, by and between the CITY OF LA JUNTA on behalf of _________________________, hereinafter referred to as City, and _________________________, (Volunteer), whose address is ______________________________________________________________________________ _____________________________________________________________________________.

I.

RECITALS: A. The Volunteers Social Security Number is : SSN: ____________________ B. The Volunteer desires to provide services to the community through work with the City on a non-exclusive basis on the terms and conditions stated herein.

II.

SERVICES TO BE PROVIDED BY VOLUNTEER: A. The Volunteer agrees to provide the following services at the following location (s), dates and times: 1. The Volunteer shall perform said services in the Volunteers own way in the pursuit of his/her independent calling and not as an employee of the City of La Junta, and shall be solely responsible for the means and methods and the proper performance of the services. C. Volunteer shall be and independent volunteer and not an employee or agent of the City of La Junta. The Volunteer shall not be under the control of the City of La Junta as to the result to be accomplished, or as to the means or manner by which such result is to be accomplished. Nothing in this Agreement shall be construed as establishing a quality standard for the Volunteer, nor as

establishing any right on the part of the City of La Junta to oversee the actual work of the Volunteer or to instruct the Volunteer as to how the work will be performed; except that it shall be a condition of the Agreement that the Volunteer shall be responsible for meeting the program expectations of the City of La Junta, and the terms, requirements, and specifications established herein. D. All equipment, tools, materials, and supplies required for the performance of services under this Agreement shall be furnished by the Volunteer, except that the City of La Junta shall furnish the following: __________________________________________________________________ __________________________________________________________________ III. VOLUNTEERS COMPENSATION. A. Volunteer shall not be compensated for services provided pursuant to this Agreement. IV. GENERAL. A. The City of La Junta may terminate this Agreement on account of Volunteers violation of any of the terms or requirements or specifications of this Agreement by mailing written notice of termination to the Volunteer at the address stated above. B. THE PARTIES HERETO UNDERSTAND THAT THE VOLUNTEER IS NOT ENTITLED TO WORKERS COMPENSATION BENEFITS OR UNEMPLOYMENT COMPENSATION BENEFITS. C. The Volunteer agrees to indemnify and hold harmless the City of La Junta, from and against any and all liability, claims, demands, and expenses. Including court costs and attorney fees, on account of any injury, loss, or damage, which arise out of or are in an manner connected with the services to be provided under this Agreement, if such injury loss, or damage is caused in whole or in part by, or is claimed to be caused in whole or in part by, the act, omission, or other fault of the Volunteer. D. Volunteer further waives and releases the City of La Junta and its officers and its employees, from any and all liability, claims, demands , and expenses, including

court costs and attorney fees, on account of any injury, loss, or damage, which Volunteer may suffer and which arise out of or are in any manner connected with the services to be provided under this Agreement. E. This Agreement may be amended only by the mutual written agreement of the parties. F. This Agreement shall not be assigned by either party. G. This Agreement contains all agreements, understandings, and arrangements between the parties, and no other such agreements, understandings, and arrangements exist. H. If the Volunteer is under the age of 18, this Agreement must be executed by the Volunteer as well as the Volunteers parent(s). IN WITNESS THEREOF, this Agreement is executed by the City of La Junta, acting by and through the undersigned, and by the Volunteer.
