AnActtoprovidefortheestablishment,administrationandmanagementofa systemofconclusivepropertytitleswithtitleguaranteeandindemnificationagainst losses due to inaccuracies in property titles, through registration of immovable properties andfurther toamendtherelevant Acts asstated in theSchedule and mattersconnectedtherewithorincidentalthereto. Whereas the Union Cabinet has given its approval for introducing the conclusivepropertytitlingsystemwithtitleguaranteeandindemnificationagainst lossesduetoinaccuraciesinpropertytitles,itisherebyexpedienttoformulatea ModelLawforfavourableconsiderationbyallStatesandtheUnionterritorieswith legislaturesinviewoftheneedforuniformityofthelawapplicabletoconclusive propertytitling; Andwhereas itisconsiderednecessary toenactsuchalawfortheUnion territorieswithoutlegislature; BeitenactedbyParliamentintheSixtyfirstyearoftheRepublicofIndiaas follows: CHAPTERI PRELIMINARY 1.Shorttitle,extentandcommencement (1)ThisActmaybecalledtheLandTitlingAct,2010.

(2)ItshallextendtotheUnionterritorieswithoutlegislature. (3)ItshallcomeintoforceonsuchdateastheGovernmentmaynotify: ProvidedthattheGovernmentmaynotifydifferentdatesfordifferentareas. 2.Definitions InthisAct,unlessthecontextotherwiserequires:


i.

Airrights meanstherighttouseanddeveloptheemptyspace aboveanimmovableproperty.

ii.

Appurtenantrightsmeansanyrightorrestrictionwhichgoeswith animmovableproperty,suchasaneasementoracovenant.

iii.

Assign means the person who receives a piece of property by purchase,giftorbywill.

iv.

Authority means the Land Titling Authority constituted under section3ofthisAct.

v.

Biometricauthenticationmeansamethodforuniquelyrecognizing ahumanbeingbasedonsuchphysicaltraitsasfingerprints,face recognition,irisrecognitionforthepurposeofestablishingidentity.

vi.

Certificateofrecordingmeansacertificateissuedonthebasisof entriesmadeintheRegistersmaintainedbytheAuthority.

vii.

CitizenfacilitationcentremeansafacilitycreatedbytheAuthority forreceiving applicationsandother documents fromthecitizens residing within the notified jurisdiction of such a centre and forwardingthemtothecentralTitleRegistryforprocessing.

viii.

Community development scheme means a form of immovable propertyownershipinwhichthetitleholdersowntheirindividual

units,plusashareofthecommonareasofthesite,orcommon property.
ix.

Government refers to the Central Government or the State Government or the Government of a Union territory with legislature,asthecasemaybe.

x.

Land Titling Tribunal means the Tribunal established under ChapterVIIofthisAct.

xi.

Indefeasible title means a title to an immovable property or an interestthereinenteredintheRegisterofTitlesandwhichcannot bealteredorvoided.

xii.

Indemnification of entries means guaranteeing the correctness of the indefeasible title of ownership of an immovable property as recorded in the Register of Titles of the Authority and compensatinganylossoccurringduetoanyfaultonthepartofthe Authorityinrecordingsuchentries.

xiii.

Index of maps means a catalogue of cadastral maps of all immovablepropertiessituatedwithinthenotifiedarea.

xiv.

Indicativemapmeansamapthatshowstherelativelocationofa property with its correct unique property identification number, butdoesnotnecessarilyindicatethesizeandshapeoftheproperty exactlytoscale.

xv.

Letter of administration means the permission granted by a SurrogateCourt or probateregistry toappointappropriatepeople todealwithadeceasedperson's estate wherepropertywillpass under IntestacyRules orwherethereareno executors livingand

willingandabletoact,havingbeenvalidlyappointedunderthe deceased'swill.
xvi.

Marketabletitlemeans thetitletoanimmovablepropertywhich has no encumbrances, such as, mortgage, deed of trust, lien or claim,andwhichisfreeofanyreasonableobjection.

xvii.

Mortgage means a mortgage as defined under the Transfer of PropertyAct,1882.

xviii.

Powerofattorney shall have the meaning as defined under the PowersofAttorneyAct,1882(ActNo.VIIof1882asamendedby ActNo.55of1982),butshallhavetoberegisteredwiththeLand TitlingAuthority.

xix. xx.

PrescribedmeansprescribedbyRulesunderthisAct. Probate means the process of proving a will as valid and thereafteradministeringtheestateofadeadpersonaccordingto thetermsofthewill.

xxi.

RecordmeansarecordasdefinedundertheRighttoInformation Act,2005.

xxii. xxiii.

RulesmeanstheRulesframedandnotifiedunderthisAct. Strata title means aform of ownership ofimmovable property devised for multilevel apartment blocks and horizontal subdivisionswithsharedareas.The'strata'partofthetermrefersto apartmentsbeingondifferentlevels,or"strata".

xxiv.

Terracerightsmeanstherighttouseanddevelopthespaceonthe roofofabuilding.

xxv.

Title means ownership of an immovable property and stands againsttherightofanyoneelsetoclaimtheproperty.

xxvi.

Titleguaranteefundmeansacorpusoffundcreated,maintained andoperatedaspersection38ofthisAct.

xxvii.

Titleinsurancemeansguaranteeingthatthetitletoanimmovable property is clear and properly recorded in the name of the titleholderandthatthetitleholderhastherighttoconveyorsellthe propertytoanother,andshouldaproblemlaterarisewiththetitle, theinsurershallpaythedamagestothenewtitleholderorsecured lender.

xxviii.

Unique property identification number means an exclusive identification number assigned to an immovable property under section4ofthisAct. CHAPTERII THELANDTITLINGAUTHORITY

3.EstablishmentoftheAuthority (1) Upon the promulgation of this Act, the Government shall, by notification, constitutetheLandTitlingAuthorityforthepurposesofthisAct. (2)TheLandTitlingAuthorityshallexercisesuchpowersasmaybeconferredonit anddischargesuchfunctionsasmaybeprescribedbyorunderthisActoranyother lawforthetimebeinginforce. 4.ThefunctionsoftheAuthority TheAuthorityshallperformthefollowingfunctionsaspertheprovisionsof thisActandtheRulesframedthereunder: 1. Frame regulations and detailed guidelines and issue executive instructionsforitsproperfunctioning.

Prepare, maintain and update the Register of Titles, Register of Disputes,RegisterofChargesandCovenantsandIndexofMaps.

3.

Record, update and maintain survey entries in respect of the immovablepropertiesinthenotifiedarea.

4.

Assign unique property identification number to each immovable propertyinthenotifiedarea.

5.

Undertakepropertyvaluationinrespectoftheimmovablepropertiesin thenotifiedarea.

Providevaluationdetailsuponrequest. Ensure that the facilities of autocalculation of due stamp duty, registrationfeesandotherapplicableleviesorfeesinrespectofeach immovableproperty situatedinthenotifiedareaareavailabletothe citizen,inthepublicdomain.

MakeentriesofprovisionaltitlesintheRegisterofTitles. Publishnotifications. Maintainasystemofindicativemapsinthepublicdomaininrespectof immovablepropertiesinthenotifiedareas.

5.ThepowersoftheAuthority (1)TheAuthorityshall,whiledischargingitsfunctionsunderthisAct,havethesame powersasarevestedinacivilcourtwhiletryingasuitundertheCodeofCivil Procedure,1908,inrespectofthefollowingmatters,namely: i. summoningandenforcingtheattendanceofpersonsandcompelthemtogive oralorwrittenevidenceonoathandtoproducethedocumentsorthings; ii. iii. iv. v. requiringthediscoveryandinspectionofdocuments; receivingevidenceonaffidavit; requisitioninganypublicrecordorcopiesthereoffromanycourtoroffice; issuingsummonsorcommissionsforexaminationofwitnessesordocuments; and
vi.

anyothermatterwhichmaybeprescribed.

(2)TheAuthority,may,forthepurposeofanyinquiry,examineanyrecordtowhich thisActappliesandwhichisunderthecontrolofapublicauthorityoraperson,and nosuchrecordmaybewithheldfromitonanyground. (3)TheAuthoritymay,forthepurposeofanyinquiry,directbywhomthewholeor partofthecostsofsuchinquiryshallbepaid,andsuchcostsshallberecoverableas iftheyhadbeenawardedinasuitundertheCodeofCivilProcedure,1908. (4)TheAuthoritymay,atitsdiscretion,directtheDirector,TitleRegistryorany otherofficeroftheAuthoritytoacceptanydocumentattheprivateresidenceor hospitalorjailfromapersonwhoisunabletoattendtheofficeoftheAuthorityin person, after recording the reasons thereof in writing, in the manner as may be prescribed.

(5) The Authority shall have the powers to pass such interim order in any proceedings,hearingormatterbeforeitasitmayconsiderappropriate. (6)Subjecttotheprovisionsofsections123and124oftheIndianEvidenceAct,1872, requisitioninganypublicrecordordocumentorcopyofsuchrecordordocument fromanyofficeorcourt. (7)AllproceedingsbeforetheAuthorityshallbedeemedtobejudicialproceedings within the meaning of section 193 and 228 of the Indian Penal Code and the Authorityshallbedeemedtobeacivilcourtforthepurposesofsections345and346 oftheCodeofCriminalProcedure,1973. (8)TheChairperson,MembersandofficersoftheAuthorityshallbedeemedtobe publicservantswithinthemeaningofsection21oftheIndianPenalCode. (9) No civil court shall have jurisdiction to entertain any dispute relating to an immovablepropertyinrespectofwhichtheAuthorityisempoweredbyorunder thisAct,andnoinjunctionshallbegrantedbyanycivilcourtinrespectofsuch matters. (10)ForthepurposesofthisAct,theAuthorityshallexerciseallthepowersofthe ChiefControllingRevenueAuthorityundertheIndianStampAct,1899. (11) The Authority may, for the purposes of discharging of its functions and exercisingpowersundertheIndianStampAct,1899,notifytheDirector,Property ValuationoranyotherofitsofficersasCollectorforthedifferentprovisionsofthat Act. (12)ForthepurposesofthisAct,theAuthorityshallexerciseallthepowersofthe InspectorGeneralundertheRegistrationAct,1908.Itmaydelegatethesepowersto theDirector,PropertyValuationoranyotherofitsofficers. (13)TheSubRegistrarsappointedundertheRegistrationAct,1908shallbedeemed tobeofficersoftheAuthoritywithinthenotifiedareas. TheAuthoritymayalso

notifyoneormoreofitsofficers asSubRegistrarorDistrictRegistrarunderthe differentprovisionsoftheRegistrationAct,1908. (14)TheprovisionsoftheRegistrationAct,1908andtheIndianStampAct,1899not inconsistent with the provisions of this Act shall apply mutatis mutandis to the relevantmattersdealtwithunderthisAct. (15)TheAuthorityshallhavethepowertomakeregulationswithintheframework ofthisActandtheRulesframedthereunderforitsproperfunctioning. 6.JurisdictionandofficesoftheAuthority (1)TheheadofficeoftheAuthorityshallbeatsuchplaceastheGovernmentmay notify. (2)TheAuthoritymay,bynotification,andwithpriorapprovaloftheGovernment, establishsubofficesandcitizenfacilitationcentresatsuchotherplacesasmaybe considerednecessary. (3)TheAuthorityshallhaveitssittingsattheheadofficeoranyotherplaceandat suchtimeastheChairpersonmaydirect,andshallobservesuchprocedureinregard tothetransactionofbusinessinitssittingsasitmayspecifyinitsRegulations. (4) The Authority shall have a seal and any document purporting to be an authorizeddocumentoftheAuthoritymustbearsignaturesoftheChairpersonand MembersoftheAuthorityandthesealoftheAuthority. 7.CompositionoftheAuthority (1)TheAuthorityshallconsistofaChairpersonandfourMembers,tobeappointed by the Government, in the manner as may be prescribed. For the purpose, the GovernmentshallsetupaSelectionCommitteeconsistingoftheAdministratorof theUnionterritorywithoutlegislature,anomineeoftheCentralGovernmentanda JudgeoftheHighCourttobenominatedbytheChiefJusticeoftheHighCourt(or inthecaseofaStateorUnionterritorywithlegislature,theChiefMinisterorthe

LieutenantGovernor,theLeaderoftheOppositionintheVidhanSabhaandaJudge oftheHighCourttobenominatedbytheChiefJusticeoftheHighCourt). (2)TheChairpersonshallbetheheadoftheAuthorityandtheMembersshallwork underhis/hersupervisionandguidance.TheChairpersonshallberesponsiblefor all correspondence on behalf of the Authority. He/she may delegate his/her functionstoandallocatetheworksoftheDivisionsamongtheMembersashe/she deemsfit. (3) The Chairperson shall be a person who is or has been an Additional Chief Secretary/Chief Secretary in the State Government or Union territory AdministrationorequivalentpostintheCentralGovernmentandhasexperiencein thespheresoflandrecords,propertyregistration,and/orcadastralsurvey. (4) A Member shall be a person who is or has been a Secretary to the State Government or Union territory Administration or equivalent post in the Central Governmentandhasexperienceinthespheresoflandrecords,propertyregistration, cadastralsurvey,propertyvaluationand/orlaw. 8. Terms and conditions of service of the Chairperson and Members of the Authority (1)TheChairpersonandMembersshallholdofficeforsuchtermastheGovernment mayprovide,butnotexceedingfiveyears: ProvidedthatnoChairpersonorMembershallholdofficeafterhehasattained theageofsixtysevenyears. (2)TheGovernmentmay,byorder,removetheChairpersonoraMemberfromhis officeifsuchChairpersonorMember (i) isadjudgedaninsolvent;or

(ii)

has been convicted of an offence which, in the opinion of the Administrator of the Union territory without legislature (or the GovernororLieutenantGovernorasthecasemaybe),involvesmoral turpitude;or

(iii)

engagesduringhistermofofficeinanypaidemploymentoutsidethe dutiesofhisoffice;or

(iv)

is,intheopinionoftheAdministratoroftheUnionterritorywithout legislature(ortheGovernororLieutenantGovernorasthecasemay be),unfittocontinueinofficebyreasonofinfirmityofmindorbody; or

(v)

has acquired such financial or other interest as is likely to affect prejudiciallyhisfunctioning;or

(vi)

isinanyway,concernedorinterestedinanycontractoragreement madebyoronbehalfoftheAuthorityorparticipatesinanywayinthe profit thereof or in any benefit or emolument arising therefrom otherwisethanasamemberandincommonwiththeothermembers ofanincorporatedcompany,andisheldguiltyofmisbehavior.

(3)Nopersonshallberemovedunderthissectionuntilthatpersonhasbeengiven anopportunityofbeingheardinthematter. (4)TheChairpersonoraMemberoftheAuthoritymay,bynoticeinwritingunder his/herhandaddressedtotheGovernment,resignhis/heroffice,inthemanneras maybeprescribed. (5)AnyvacancyintheofficeoftheChairpersonoraMemberoftheAuthorityshall befilledbytheGovernment,bynotificationintheOfficialGazette,assoonasmay be,aftertheoccurrenceofthevacancyotherthanacasualortemporaryvacancy.

(6) The salary, allowances and other terms and conditions of service of the ChairpersonandMembersoftheAuthorityshallbesuchasmaybeprescribedby theGovernment: Provided that their salary, allowances and other terms and conditions of serviceshallnotbevariedtotheirdisadvantageafterappointment. 9.DivisionsoftheAuthority (1) The Authority shall have four Divisions, namely, Title Registry; Survey, SettlementandLandInformationSystem;PropertyValuation;andLegalServices& TitleGuarantee. (2)EachDivisionshallbeheadedbyanofficerappointedbytheGovernment,not belowtherankofJointSecretarytotheGovernment/UTorequivalentrankinthe Central Government, to be designated as the Director of that Division who will function under the directions and superintendence of the Chairperson of the Authority. (3) The Authority may set up administrative divisions required for its proper functioning,suchasinformationtechnology,administration,financeandanyother, inthemannerasmaybeprescribed. 10.OfficersandstaffoftheAuthority (1)TheAuthorityshallhaveafulltimeSecretarycumRegistrartobeappointedby the Government from amongst officers who are or have been a Secretary to the Government or an equivalent rank in the Central Government and having experienceinthespheres oflandrecords,property registration,cadastralsurvey, propertyvaluation,informationtechnologyand/orlaw. (2) The SecretarycumRegistrar shall be the Chief Administrative Officer of the AuthorityandshallsuperviseandcoordinatetheworkofalltheDivisionsofthe

Authorityandalsoitsadministrativeandfinancialmattersundertheguidanceofthe Chairperson in accordance with theRegulations laiddown in this regard by the Authority. (3)TheGovernmentshallspecifythenumbers,natureandcategoriesoftheofficers and staff ofthe Authority required for its proper functioning,in the notification constitutingtheAuthority,andshallprovidesuchofficersandstafftotheAuthority withintwomonthsofestablishingtheAuthority: ProvidedthatwheretheGovernmentisunabletoprovidetheofficersand staff to the Authority within this timeframe, the Authority may outsource the numbers,natureandcategoriesofofficersandstaffnotifiedbytheGovernment,ona contractualbasis,tillsuchperiodastheGovernmentprovidesthenotifiedofficers andstaff. 11.FinancesoftheAuthority (1)TheexpenditureoftheAuthoritymaybeborneoutoftheConsolidatedFundof India(ortheStateasthecasemaybe),orthroughagrant,orthroughtherevenues generatedbytheAuthorityitselfinaccordancewiththetermsoftheMemorandum ofUnderstandingenteredintobytheAuthoritywiththeGovernmentinthisregard: Provided that the Government shall permit the Authority to utilize the interestsonitsdepositsanduptotenpercentumoftherevenueraisedduringthe financialyearbytheAuthoritythroughtitlingfeesforimprovingcitizenservices andforbetterfunctioningoftheAuthority. For this purpose, the Authority shall submit utilization plans to the GovernmentforconsiderationandtheGovernmentshalldisposeofthesamewithin threemonthsoftheirreceipt.

(2)TheAuthorityshallprescribeandlevyreasonablefeesandcollectthesamefor theservicesrendered,documentsissued,licensesgrantedorinformationprovided byit: ProvidedthattheAuthoritymayprescribeadvaloremregistrationfees. (3)Thescheduleoffeesprescribedfromtimetotimeshallbepublished,placedin thepublicdomain,displayedprominentlyintheofficesoftheAuthorityandgiven widepublicity. (4)TheGovernmentoralocalbodymayauthorizetheAuthoritytocollectanyduty, fee,levyorfineonitsbehalfandrequireittoremitthesametosuchGovernmentor localbodyafterdeductingacollectionchargeforservicesrenderedandexpenses incurred. (5)TheannualbudgetoftheAuthority,forthefollowingfinancialyear,shallbe submitted fortheapprovaloftheGovernmentinsuch mannerasmay be prescribed. All the expenditure incurred by the Authority shall be in accordancewiththeapprovedbudget. (6)AllaccountsofreceiptsandexpenditureoftheAuthorityshallbemaintainedin themannerprescribedandshallbesubjecttoauditbytheComptroller&Auditor GeneralofIndiainaccordancewiththeapplicablerules. (7)TheAuthorityshallputinplaceasystemofinternalauditing. CHAPTERIII THETITLEREGISTRY 12.EstablishmentoftheTitleRegistry (1)TheLandTitlingAuthorityshallestablishonecentralTitleRegistryfortheentire Unionterritory(ortheState)forthepurposesofthisAct.

(2) The Authority may establish suboffices and citizen facilitation centres as required for processing and forwarding the applications for titling and transfer registration,however,thepropertytitlesshallbegrantedonlybythecentralTitle Registry. 13.ThedocumentsandregisterstobemaintainedbytheAuthority (1)Uponnotificationissuedundersection1,subsection3,theAuthorityshallorder theDirector,Survey&SettlementtoprepareanIndexofMapswithuniqueproperty identificationnumbersandtheDirector,TitleRegistrytoprepareaRegisterofTitles, a Register of Charges and Covenants, and a Register of Disputes regarding the immovableproperties located within thenotifiedarea, in the manner as may be prescribed. (2)AlltheRegistersshallbemaintainedinpaperaswellasinelectronicform,inthe manner andsubject tosafeguards asmaybe prescribed. Forboththeforms,the Authority shall put in place proper systems for identification of the concerned parties,suchas,photographs,biometricauthenticationoranyothermethodasmay be prescribed, for the purposes of any transaction or transfer of any immovable propertytoberecordedinitsRegisters. (3)ThecomputersystemoftheAuthorityshallbeaprotectedsystem asperthe provisionsoftheInformationTechnologyAct,2000(asamendedfromtimetotime) andthesecurityguidelinesandRulesframedthereunder. (4)Notwithstandinganythingcontainedinanyotherlawforthetimebeinginforce, sections3,17,22A,34,35,39,47A,59,65B,73A,81A,85A,85B,85C,88Aand90A andotherrelevantsectionsoftheIndianEvidenceAct,1872shallbeapplicabletoall electronicrecordsunderthisAct.

(5)TheAuthoritymayauthorizetheDirector,TitleRegistryoranyotherofficerto provide extracts of the Register of Titles, Register of Disputes, and Register of Charges andCovenants, in the paper form and/or in the electronic form, to the personsinterestedinthetransactionintheproperty.Anyothercitizenrequestingfor suchextractsmayalsobegiventhesameprovidedthattheDirector,TitleRegistryor anyotherofficerauthorizedinthisbehalfsatisfieshimself/herself aboutthebona fideofthepersonsmakingsucharequest: ProvidedthatiftheinformationsoughtappearstotheAuthoritytohavea bearing on national security, it may seek clarification in this regard from the concernedauthorities. (6)DetailedguidelinesinthisregardshallbeissuedbytheAuthority. (7)Areasonablefee,asprescribedbytheAuthority,shallbeleviedforeachtypeof informationdisseminated. 14.TheRegisterofTitles (1) TheDirector,TitleRegistry,oranyotherofficerauthorizedbytheAuthority

inthisbehalf,shallmaintainaRegisterofTitleswhichshallcontain,inrespectofthe immovablepropertieslocatedwithinthenotifiedareaforwhichanapplicationfor titlehasbeenmade,thefollowingparticulars: i. ii. uniquepropertyidentificationnumberassignedbytheAuthority; areaorextentofthepropertywithparticularsofthebuiltuparea thereon,ifany; iii. iv. marketvalueoftheproperty; names of all the persons who are titleholders with their respective extentofholding; v. details of transfers of property including transfers due to succession;

vi. vii.

detailsofstratatitlesandcommunitydevelopmentschemetitles; informationoncovenantsorcharges,ifany,standingagainstthe property;

informationonpendingdisputes,ifany,abouttheproperty;and suchotherparticularsasmaybeprescribed.

(2)NotwithstandinganythingcontainedintheRegistrationAct,1908,theRegister of Titles shall contain the records of the immovable properties in notified areas including: i. ExistingtitlesoftheGovernmentoverimmovableproperty;
ii. Titles of any immovable property acquired by the Union territory

(2)TheDirector,TitleRegistryshallensurethatentriesarerecordedinboth,the RegisterofDisputesandtheRegisterofTitles,ofthefactthatadisputeispending againstapropertyinthenotifiedarea.Thedetailsregardingthedisputeshallbe indicatedintheRegisterofDisputes,inthemannerasmaybeprescribed. 16.TheRegisterofChargesandCovenants TheDirector,TitleRegistry,oranyotherofficerauthorizedbytheAuthority in this behalf, shall maintain a Register of Charges and Covenants which shall contain,inrespectoftheimmovablepropertiesforwhichanentryhasbeenmadein theRegisterofTitles,thefollowingparticulars: i. ii. iii. iv. v. 17.

EntriesinRegisterofCharges&Covenants DuringtheprocessofthepreparationoftheRegisterofTitles,iftheDirector,

TitleRegistrycomesacrossachargeand,oracovenantinthenatureofeasement right,oraconditionwhichwillhaveabearingontheabsolutenessofthetitle,he shallseekordersoftheAuthorityforrecordingandmakinganentryofthedetailsof suchcovenantand,oracharge,orsuchacondition,intheRegisterofChargesand CovenantsandalsointheRegisterofTitlesinadditiontomakinganorderunder section26or27asthecasemaybe,inthemannerasmaybeprescribed. 18. IssueofCertificateofRecording Uponreceiptofintimationundersection51,52,53,54,55or56,theDirector, Title Registry shall enter thedetails,inthemannerasmay beprescribed, inthe RegisterofChargesandCovenantsorintheRegisterofDisputesasthecasemaybe, and also makeamentionofitintheRegisterofTitles,andissueacertificate of recording. 19.NotificationbytheDirector,TitleRegistry (1)WhenthepreparationoftheRegisterofTitlesistakenup,theAuthorityshall order the Director, Titling Registry to publish a notification inviting all persons interested in obtaining indefeasible titles in their immovable properties, to file claims. (2) An interested person, or an assign duly authorized by a powerofattorney registeredwiththeAuthority,shall berequiredtopresenthimselforherselfata

placeandtimespecifiedbytheDirector,TitleRegistryforthepurposeofregistration oftheirclaims. (3)Eachnotificationmadeundersubsection1shallbe: i. publishedinatleastthreedailynewspapers,twoofwhichshallbein

thelocalvernacularhavingcirculationinthenotifiedarea; ii. iii. placedontheofficialwebsiteoftheAuthority; affixed on the notice board of the concerned gram panchayats or

municipalitiesandotherprominentplaceorplacesinthenotifiedarea;and
iv.

givenwidepublicitybyanyothermethodasmaybeprescribedinthis

regard. (4)Anotificationpublishedundersubsection1shallbeheldtobeavalidnoticeto eachpersonhavinganinterestinthetitleofthepropertyproposedtobeincludedin theRegisterofTitles. (5)Uponissueofthenotificationundersubsection1,allpersonsclaiminganytitle, rightorinterestin,oranychargeonanimmovableproperty,shallinthemanner andtimeprescribed,furnishthefollowingdetailsformakinganentrytothateffect intheregisterwhichwillincludeany: i.

20.MaintenanceoftheRegisters The Register of Titles, Register of Charges & Covenants, and Register of DisputesshallbemaintainedbytheDirector,TitleRegistry,insuchmannerandin suchformatasmaybeprescribed. 21.UpdationofentriesintheRegisters

WithpriorapprovaloftheAuthority,theDirector,TitleRegistryoranyother officerauthorizedinthisbehalfbyaresolutionoftheAuthority,mayadd,deleteor modifyandupdateanyentryinrespectofanyimmovablepropertyintheRegister ofTitles,RegisterofDisputes,RegisterofCovenantsandCharges,insuchmanneras maybeprescribed. 22.RectificationofentriesintheRegisters (1) A personaggrievedbyanyclerical error,suchasspellingmistakes,errors in recording the addresses or any typographical mistake in the Register of Titles, RegisterofDisputesorRegisterofChargesandCovenantsmayfileanapplication foritscorrectionwiththeDirector,TitleRegistry,withinthreeyearsfromthedateof notificationofsuchentry. (2)TheDirector,TitleRegistry,aftermakinganenquiryandsatisfyinghimselfasto thegenuinenessoftheerror,shallrectifytheerrorwiththepriorapprovalofthe Authority,insuchmannerasmaybeprescribed. 23.Evidenceoftitle AnytitlerecordedintheRegisterofTitlesinaccordancewiththeprovisions ofthisAct,shallbeconsideredasevidenceofthemarketabletitleofthetitleholder subjecttotheentriespertainingtothesamepropertyintheRegisterofChargesand CovenantsandintheRegisterofDisputes. 24.ProceduretobefollowedbytheDirector,TitleRegistry (1) Documents maybepresentedtotheDirector,TitleRegistrybytheperson or persons having interest in obtaining property title, or persons executing a transaction intheproperty, orclaimingsuchtransactionpursuantto adecree or orderissuedbyacompetentcourt,tribunalorcompetentlegalauthority:

Providedthatan assign dulyauthorizedbyapowerofattorneyregistered withtheAuthority,mayappearonbehalfoftheinterestedpersonorpersons. (2)Whenapersonorpersonsapplyforgrantoftitle,theDirector,TitleRegistryshall followthefollowingprocedure: He/sheshall i. enquireandsatisfyhimself/herselfregardingthetrueidentityof

thepersonorpersonsrequestingforthetitle; ii. check whether the documents are updated and complete in all

respects; iii. checkthattheapplicationisintheprescribedformatandthatthe

subjectpropertyisdulydescribedinitsentiretybytheuniqueproperty identificationnumberassignedbytheAuthority; iv. enquire and satisfy himself/herself about the authenticity and

validityofthedocumentspresentedbeforehim/her; v. verifythatallrequisitedutiesandlevies,includingthefeesdueto

theAuthority,havebeenpaid,asrequiredbylaw; vi. vii. and viii. checkanyothermatterlikelytoaffectgrantoftitletotheproperty. conductsiteverificationwhereverrequired; makeinquirieswhetherornotthepropertyisdisputedinanyway;

(3)Uponreceiptofatransferapplicationorreportontransactionpresented, along withall prescribed formsanddocumentsrelatingtotheactortransactiononthe immovable property, the Director, Title Registry shall follow the following procedure: He/sheshall

satisfyhimself/herselfasregardstheidentityofthepresentersthrough

personal identification documents or in any other manner as may be prescribedbytheAuthority; ii. satisfyhimself/herselfthattheseller(s)hasorhaveobtainedavalid

titletothesubjectpropertyfromtheTitlingAuthority; Explanation: After a notification has been issued under section 1, sub section3,transactionsinthenotifiedareashallberecordedonlyafterthe propertyholderhasobtainedatitleinrespectofthesubjectpropertyfrom theTitleRegistry. iii. satisfyhimself/herselfthatthevaluationiscorrectaspertherecordsof

theAuthority;
iv.

verify and satisfy himself/herself whether any stamp duty, transfer

dutyandanyotherapplicabledutyorfeehasbeenpaidinrespectofthe transaction; v. enquireandsatisfyhimselfwhetherornotsuchtransactionisexecuted

bythepersonsbywhomitpurportstohavebeenexecuted; vi. satisfyhimselfthatthetransactionisnotinviolationofanylawforthe

timebeinginforce; vii.
viii.

checkwhetherthedocumentsareupdatedandcompleteinallrespects; check that the application is in the prescribed format and that the

subjectpropertyisdulydescribedinitsentiretybytheuniqueproperty identificationnumberassignedbytheAuthority; ix. x. conductsiteverificationwhereverrequired; makeinquirieswhetherornotthepropertyisdisputedinanyway;

and xi. checkanyothermatterlikelytoaffectgrantoftitletotheproperty.

(4) To ensure transparency, theDirector, TitleRegistry shall process applications withinthirtyworkingdaysoftheirreceipt,intheorderinwhichtheyarereceivedin theAuthorityandshallensurethattheyarediarizedsequentially. (5)WheretheDirector,TitleRegistrycomestoaconclusionthattheapplicationis inadequateinsomemannerforpresentingtotheAuthorityfororders,he/sheshall record his/her reasons in writing for so concluding, and place them before the SecretarycumRegistrar for orders. The SecretarycumRegistrar shall pass the requisiteorderswithinsevenworkingdaysofreceiptoftheinformationfromthe Director, Title Registry. The Director, Title Registry shall inform the applicants withinthreeworkingdaysregardingthedecisionoftheSecretarycumRegistrar. TheDirector,TitleRegistryshallexaminetheapplicationsinsuchawaythatall inadequaciesintheapplicationarerecordedatthetimeoffirstexamination.The Authority shall be kept periodically informed by the Director, Title Registry regardingtheapplicationswhichhavebeenfoundtobeinadequateinthemanner prescribed by the Authority. Where the Authority is of the opinion that an application has been incorrectly concluded to be inadequate, it may call for the recordsfromtheDirector,TitleRegistryandtheSecretarycumRegistrarandpass necessaryordersinthematter. (6)Toallowforcomputerizedtrackingofthestatusoftheapplicationsreceived,the information regarding applications received shall be placed through information technology in the public domain on the official website of the Authority. Such informationwouldincludethenameornamesoftheapplicants,theiraddress,e mailaddressandphonenumbers,thedateofreceiptoftheapplication,thesubject matter, the unique property identification number, the daytoday status of the action taken including the name and designation of the official handling the application, the inadequacies found in the application, if any, the date fixed for

presentationbeforetheAuthorityandanyotherinformationthattheAuthoritymay prescribe. 25.Barringrevertingtothedeedssystem (1) Noimmovablepropertyinrespectofwhichanapplicationfortitlinghasbeen filedwiththeTitleRegistryshallberegisteredundertheRegistrationAct,1908,and, notwithstandinganythingcontainedinanylawforthetimebeinginforce,anysuch registrationshallbedeemedtobevoidabinitio. (2) Once an immovable property has been registered under this Act, it shall be registeredonlyunderthisActthereafter,andanyregistrationunderanyotherAct shallbedeemedtobevoidabinitio. 26.ProceduretobefollowedbytheAuthorityinundisputedcases (1)WheretheDirector,TitleRegistrycomestotheconclusionthatanapplicationis complete in all respects, he/she shall put up all the relevant documents, within thirtyworkingdaysfromthedateofreceiptoftheapplication,totheAuthorityfora decisionregardingtitling. (2)WheretheAuthoritycomestoaconclusionthatthereisnodisputewithregardto thetitleoftheproperty,itshallgiveacleardirectiontotheDirector,TitleRegistryas towhosenameornamesshallbeprovisionallyenteredagainstthepropertyinthe RegisterofTitles,andtheDirector,TitleRegistryshallmaketheentrywithinseven working days and simultaneously issue a notification accordingly. He shall also submit the compliance report to the Authority, in respect of each order, in the mannerasmaybeprescribedbytheAuthority. (3)TheAuthorityshallensurethatundisputedcasesshallbedisposedofwithina periodofthirtyworkingdaysfromthedateofsubmissionoftheapplicationbythe Director,TitleRegistrytotheAuthority.

(4)AnappealagainstthedecisionoftheAuthorityshallliewiththeLandTitling Tribunal within three months of the date of notification of the decision of the Authority. 27.ProceduretobefollowedbytheAuthorityindisputedcases (1)WheretheAuthoritycomestoaconclusionthatthereisadisputewithregardto thetitleoftheproperty,itshallgiveacleardecisiontothiseffectandorderthe Director,TitleRegistrytomakeanentrytothateffectintheRegisterofDisputesand intheRegisterofTitles. (2)TheAuthorityshall,thereafter,proceedtoholdhearingsinthecasetoresolvethe contentiousissuesandgiveitsfinaldecisionwithinsixmonthsastowhetherornot thenameornamesshallbeprovisionallyenteredagainstthepropertyintheRegister ofTitlesandthecorrespondingendorsementsmadeintheRegisterofDisputes,and giveorderstotheDirector,TitleRegistrytothateffect. (3)WheretheAuthoritygivesdirectiontoenteranameornamesprovisionallyin theRegisterofTitles,theDirector,TitleRegistryshallmaketheentrywithinseven working days and issue a notification accordingly. He shall also submit the compliancereporttotheAuthority,inrespectofeachorder,inthemannerasmay beprescribedbytheAuthority. (4)TheAuthorityshallhavethepowertotakeupacasesuomotoifanirregularityin respectofaprovisionalentryintheRegisterofTitlescomestoitsnotice.Itshall record the reasons and grounds thereof, and issue a notice to all the parties concernedbeforetakingupthehearingandgiveitsfinaldecisionwithinsixmonths. (5)AnappealagainstthedecisionoftheAuthorityshallliewiththeLandTitling Tribunal within three months of the date of notification of the decision of the Authority.

28.PoweroftheTribunaltogivedirectionstotheAuthority IftheAuthorityfailstogiveitsfinaldecisionwithinthetimeframespecified insection26or27asthecasemaybe,anyofthepartiesconcernedshallbefreetofile anapplicationbeforetheLandTitlingTribunaltogivedirectionstotheAuthorityto disposeofthematterwithinatimeframetobespecifiedintheorderoftheTribunal. 29.Provisionalentriestoattainconclusiveness (1)AprovisionalentrymadeintheRegisterofTitlesbytheorderoftheAuthority shall be conclusive after the expiry of a period of three years from the date of notification of the grant of the provisional title, and such an entry shall be indefeasibleandconclusiveevidenceoftitleintheconcernedproperty: ProvidedthatifanappealisfiledagainsttheorderoftheAuthoritybeforethe LandTitlingTribunaloraHighCourtortheSupremeCourt,theprovisionaltitle shallbedeemedtobeconclusiveandindefeasibleonlyafterthefinaldisposalof suchanappeal. (2)Forthepurposeofmakingaprovisionaltitleconclusiveandindefeasible,the AuthorityshallmakethenecessaryendorsementintheRegisterofTitles,affixthe sealoftheAuthorityontheduedateonwhichtheprovisionaltitleshallbedeemed tobeconclusiveandindefeasibleandtheDirector,TitleRegistryshallissueatitle certificatetothateffect,inthemannerasmaybeprescribed. CHAPTERIV SURVEY,SETTLEMENTANDLANDINFORMATIONSYSTEM 30.EstablishmentoftheSurvey,Settlement&LandInformationSystemDivision

(1) The Land Titling Authority shall establish a Survey, Settlement & Land InformationSystemDivisionfortheUnionterritory(ortheState)forthepurposesof thisAct. (2)TheAuthoritymayestablishsubofficesofthisDivisionatseverallocationsas required. Explanation: For the purposes of this section, the Government may require its existingSurvey&SettlementDepartmenttobeincorporatedwithintheAuthorityas the Survey, Settlement & Land Information System Division. Where this is not feasible,aseparateSurvey,Settlement&LandInformationSystemDivisionmaybe createdundertheAuthority. 31.Uniquepropertyidentificationnumberforeachimmovablepropertysituated withinthenotifiedarea (1)Uponnotificationissuedundersection1,subsection3,theAuthorityshallorder theDirector,Survey,SettlementandLandInformationSystemtopreparearecordof boundaries, or any part of a boundary, of each immovable property within the notifiedareaandgiveitauniqueidentificationnumber,inthemannerasmaybe prescribed. (2)TheDirector,Survey,SettlementandLandInformationSystemshallmaintainan Index of Maps in which the unique property identification number for each immovablepropertyinthenotifiedareashallberecordedandtheinformationshall beplacedinthepublicdomain,inthemannerasmaybeprescribed. (3)TheDirector,Survey,SettlementandLandInformationSystemshalldevelopand maintaininthepublicdomain,inthemannerasmaybeprescribed,asystemof indicativemapswiththecorrespondinguniquepropertyidentificationnumbersin respectoftheimmovablepropertiessituatedinthenotifiedarea.

(4)Asandwhenanapplicationisreceivedfortitleortransfer,theuniqueproperty identificationnumbershallbeenteredintheRegisterofTitlesinthemannerasmay beprescribed: ProvidedthatwhereanentryismadeintheRegisterofTitlesaspersection62, subsection4,theAuthorityshalldirecttheDirector,Survey,SettlementandLand InformationSystemtocarryoutthesurveyandmappinginrespectofsuchproperty andtograntauniqueproperty identificationnumber toit. TheAuthorityshall, thereafter, seek direction from the Government regarding custodianship of such property. 32.Functionsandpowersundertheextantsurvey&settlementlaws The Director, Survey, Settlement and Land Information System in the Authorityshall,forthepurposesofthisAct,dischargeallthefunctionsandexercise allthepowersoftheHeadoftheDepartmentintheUnionterritory(ortheState),in chargeofsurveyandsettlement: Provided that if an updated record for the notified area has already been createdbyanofficeroftheGovernmentdulyauthorizedinthisregardunderthe applicablesurveyandsettlementlawoftheUnionterritory(ortheState),itshallbe providedtotheAuthorityby suchofficer,andthesamemaybeadoptedbythe Authorityasitsownrecord. 33.Standardsofsurveyingandmappingtobemaintained (1)TheGovernmentshalllaydownandplaceinthepublicdomain,inthemanneras may be prescribed, the norms and standards that the Authority shall adopt for cadastralsurveyingandmappinginrespectoftheimmovablepropertiessituatedin thenotifiedarea.

(2)TheAuthoritymay,withthepriorapprovaloftheGovernment,putinplacea system of survey through private licensed surveyors, in the manner as may be prescribed. (3)Basedupontheaccuratecadastralsurveymaps,theDirector,Survey,Settlement andLandInformationSystemshallcreate,maintainandcontinuouslyupdateaLand InformationSystemfortheentirenotifiedarea,inthemannerasmaybeprescribed. 34.Surveyinguponrequest (1)Asandwhenanapplicationisreceivedfromatitleholderforsurveyingofthe areaandboundariesofhis/herimmovablepropertysituatedinthenotifiedarea,the Director, Survey, Settlement and Land Information System shall arrange for the sameuponpaymentoffeesbytheapplicant. (2)TheAuthorityshallprescribeascheduleofreasonablefeesforthepurposeand placethesameinthepublicdomain,inthemannerasmaybeprescribed.

CHAPTERV PROPERTYVALUATION 35.EstablishmentofthePropertyValuationDivision (1)TheLandTitlingAuthorityshallestablishacentralPropertyValuationDivision fortheUnionterritory(ortheState)forthepurposesofthisAct. (2) There shall be a Director, Property Valuation who will be responsible for assessment of property values of the immovable properties situated within the notifiedareas,inthemannerasmaybeprescribed. (3) TheGovernmentshalllaydowntheperiodicityfordeterminationofproperty valuationtobemadebytheAuthority.

36.RecordstobemaintainedbythePropertyValuationDivision (1)TheDirector,PropertyValuationshallmaintainaRegisterofPropertyValuation inwhichthepropertyvaluationdetailsinrespectofeachimmovablepropertyinthe notifiedarea,includingpropertyenteredintheRegisterofTitlesasper section62, subsection4,shallberecordedandtheinformationshallbeplacedinthepublic domaininthemannerasmaybeprescribed. (2)Asandwhenanapplicationisreceivedfortitleortransfer,theupdatedproperty valuationdetailsinrespectofthepropertyshallbeenteredintheRegisterofTitles, inthemannerasmaybeprescribed. (3)TheDirector,PropertyValuationshallensurethatthecomputersoftwareand database to be maintained, shall enable autocalculation of due stamp duty, registrationfeesandotherapplicableleviesorfeesinrespectofeach immovable propertysituatedinthenotifiedarea,andthisfacilityshallbeavailabletothecitizen inthepublicdomain,inthemannerasmaybeprescribed. 37.Providingvaluationuponrequest (1) As andwhenanapplication is received fromatitleholder forprovidingthe valuationofhis/herimmovablepropertysituatedinthenotifiedarea,theDirector, Property Valuation shall arrange for the same upon payment of fees by the applicant. (2)TheAuthorityshallprescribeascheduleofreasonablefeesforthepurposeand placethesameinthepublicdomain,inthemannerasmaybeprescribed.

CHAPTERVI LEGALSERVICES&TITLEGUARANTEE

38.EstablishmentoftheLegalServices&TitleGuaranteeDivision (1) The Land Titling Authority shall establish a central Legal Services & Title GuaranteeDivisionfortheUnionterritory(ortheState)forthepurposesofthisAct. (2) The Authority may create a title guarantee fund out of the levies and fees collected by it for the services rendered, documents issued, licenses granted or informationprovided,andfromthegrantsreceivedfromtheGovernmentforthis purpose: Provided that the Authority may put in place a system for allowing title guaranteethroughprivateparties,inthemannerasmaybeprescribed. (3) There shall be a Director, Legal Services & Title Guarantee who will be responsibleformanagingandoperatingthetitleguaranteefundoftheAuthority,in themannerasmaybeprescribed. (4)WheretheAuthorityallowstitleguaranteethroughprivateparties,theDirector, LegalServices&TitleGuaranteewillberesponsibleforsupervisingandmonitoring suchtitleguaranteefund,inthemannerasmaybeprescribed. (5)WheretheAuthorityisinvolvedinlitigation,theDirector,LegalServices&Title GuaranteeshallrepresenttheAuthorityintheappropriatecourt. (6) The Authority may seek advice from the Director, Legal Services & Title Guaranteeregardingthevalidityoflegaldocumentsreceivedbyit. 39.RecordstobemaintainedbytheLegalServices&TitleGuaranteeDivision (1) Where the Authority creates its own title guarantee fund, theDirector, Legal ServicesandTitleGuaranteeshallmaintaintheaccountsandrecordsrelatingtoit andshallgiveanaccountoftheFundtotheAuthorityinthemannerasmaybe prescribed.

(2)WhentheAuthorityreceivesadecisionoftheLandTitlingTribunaloraHigh CourtortheSupremeCourttopaycompensationoutofitstitleguaranteefund,it mayhavethematterexaminedbytheDirector,LegalServicesandTitleGuarantee astowhetheranappealiswarranted.WhereadecisionistakenbytheAuthoritynot topreferanappealorwheretheappealisdisposedofinfavouroftheclaimant,the AuthorityshalldirecttheDirector,LegalServicesandTitleGuaranteetomakethe payment,inthemannerasmaybeprescribed. 40.IndemnificationofentriesintheRegisterofTitles For all entries made in the Register of Titles, the Authority shall, by notification,putinplaceasystemofguaranteeingandindemnifyingthecorrectness oftitleofownershipforeachpropertynumber,witheffectfromsuchdateandfor such area as may be notified, in the manner as may be prescribed by the Government. Explanation1:TheAuthorityshallguaranteethetitleofownershipofaproperty with unique property identification number as recorded in the Register of Titles, but it will not be obligatory for the Authority to guarantee the boundariesandareaoftheproperty. Explanation2: TheAuthoritymayitselfsetupasystemofindemnificationor mayallowindemnificationthroughprivateparties. CHAPTERVII THELANDTITLINGTRIBUNAL 41.EstablishmentoftheTribunal (1)UponthepromulgationofthisAct,theGovernmentshall,bynotification,constitute theLandTitlingTribunalforthepurposesofthisAct.

(2) TheLandTitling Tribunalshallexercisesuchpowersasmaybeconferredonit anddischargesuchfunctionsasmaybeprescribedbyorunderthisActoranyother lawforthetimebeinginforce. 42.ThefunctionsoftheTribunal (1) The Tribunal shall adjudicate on the claims preferred for payment of compensationoutofthetitleguaranteefundoftheAuthorityandoftheprivate partiesauthorizedbytheAuthoritytooperatesuchafund. (2)Uponreceiptofanapplicationundersection28,theTribunalshallgivenecessary directionstotheAuthority. (3)TheTribunalshallhearappealsagainsttheordersoftheLandTitlingAuthority. ApartyaggrievedwithanorderoftheAuthoritymayfilesuchanappealwithin threemonthsofthedateofnotificationofsuchanorder. (4)TheappealsagainsttheordersoftheTribunalshallliewiththeHighCourt. (5)TheTribunalshallensuretransparencywhiledischargingitsfunctions. 43.ThepowersoftheTribunal (1) TheTribunalshallnotbeboundbytheprocedurelaiddownbytheCode ofCivilProcedure,1908,butshallbeguidedbytheprinciplesofnatural justice. (2) SubjecttotheprovisionsofthisActandtheRulesframedthereunder,the Tribunalshallregulateitsprocedure,includingdurationoforalhearings, when granted,andtimes ofitsinquiry,as may beprescribed, soas to disposeofappealswithinaperiodofsixmonthsfromthedateoffilingof theappeal.

(3)

All proceedings before the Tribunal shall be deemed to be judicial proceedingswithinthemeaningofsections193,196and228oftheIndian PenalCode,andtheTribunalshallbedeemedtobeacivilcourtforthe purposes of section 195 and Chapter XXVI of the Code of Criminal Procedure,1973.

(4)Subjecttotheprovisionsofsections123and124oftheIndianEvidenceAct,1872, theTribunalshallhavethepowerofrequisitioninganypublicrecordordocument orcopyofsuchrecordordocumentfromanyofficeorcourt. (5) The Chairperson and Members of the Tribunal shall be deemed to be public servantswithinthemeaningofsection21oftheIndianPenalCode. 44.Barofjurisdictionofcivilcourts Nocivilcourtshallhavejurisdictiontoentertainanydisputerelatingtoan immovablepropertyinrespectofwhichtheTribunalisempoweredbyorunderthis Act,andnoinjunctionshallbegrantedbyanycourtinrespectofsuchmatter. 45.JurisdictionandbenchesoftheTribunal (1)TheprincipalseatoftheTribunalshallbeatsuchplaceastheGovernmentmay notify. (2) The Government may establish benches at such other places as may be considerednecessary. (3)TheTribunalshallhaveitssittingsatits principalseatandatitsbenches, and shallobservesuchprocedureinregardtothetransactionofbusinessinitssittingsas itmayspecifyinitsRegulations.

46.CompositionoftheTribunal TheTribunalshallconsistofaChairpersonandnotlessthanthreebutnot

morethanfiveMembers,tobeappointedbytheGovernment,inthemannerasmay beprescribed.TheChairpersonshallbearetiredJudgeofaHighCourtandthe MembersshallbepersonswhohaveservedintherankofChiefSecretaryinaState Government or Union territory Administration or in an equivalent rank in the CentralGovernment. 47. Terms and conditions of service of the Chairperson and Members of the Tribunal (1)TheChairpersonandMembersoftheTribunalshallholdofficeforsuchtermas theGovernmentmayprovide,butnotexceedingfiveyears: Provided thatno Chairperson orMember shall hold office after he/shehas attainedtheageofsixtysevenyears. (2) TheGovernmentmay,byorder,removetheChairpersonoraMemberofthe Tribunalfromhis/herofficeifsuchChairpersonorMember i.
ii.

isadjudgedaninsolvent;or has been convicted of an offence which, in the opinion of the Administrator of the Union territory without legislature (or the Governor ortheLieutenant Governoras the casemay be), involves moralturpitude;or

iii.

engagesduringhistermofofficeinanypaidemploymentoutsidethe dutiesofhisoffice;or

iv.

is,intheopinionoftheAdministratoroftheUnionterritorywithout legislature (orthe Governororthe Lieutenant Governor as thecase

maybe),unfittocontinueinofficebyreasonofinfirmityofmindor body;or v. has acquired such financial or other interest as is likely to affect prejudiciallyhisfunctioning;or vi. isinanyway,concernedorinterestedinanycontractoragreement madebyoronbehalfoftheAuthorityorparticipatesinanywayinthe profit thereof or in any benefit or emolument arising therefrom otherwisethanasamemberandincommonwiththeothermembers ofanincorporatedcompany,andisheldguiltyofmisbehavior. (3)Nopersonshallberemovedunderthissectionuntilthatpersonhasbeengiven anopportunityofbeingheardinthematter. (4)TheChairpersonoraMemberoftheTribunalmay,bynoticeinwritingunder his/herhandaddressedtotheGovernment,resignhis/heroffice,inthemanneras maybeprescribed. (5)AnyvacancyintheofficeoftheChairpersonoraMemberoftheTribunalshallbe filledbytheGovernment,bynotificationintheOfficialGazette,assoonasmaybe, aftertheoccurrenceofthevacancy. (6) The salary, allowances and other terms and conditions of service of the ChairpersonandMembers oftheTribunalshallbethesameasthatoftheChief JusticeandaJudgeofaHighCourt,respectively: Provided that their salary, allowances and other terms and conditions of serviceshallnotbevariedtotheirdisadvantageafterappointment. 48.OfficersandstaffoftheTribunal (1)TheTribunalshallhaveafulltimeRegistrartobeappointedbytheGovernment from amongst the serving officers of the Government, not below the rank of a

SecretarytotheGovernmentoftheStateortheUnionterritoryoranequivalentrank intheCentralGovernment. (2)ThefunctionsoftheRegistrarshallbesuchasmaybeprescribed. (3)TheGovernmentshallspecifythenumbers,natureandcategoriesoftheofficers and staff of the Tribunal required for its proper functioning, in the notification constitutingtheTribunal,andshallprovidesuchofficersandstafftotheTribunal withintwomonthsoftheestablishmentoftheTribunal: Provided that where the Government is unable to provide staff to the Tribunal within this time, the Tribunal may, with the prior approval of the Government,outsourcethesame. 49.FinancesoftheTribunal TheexpenditureoftheTribunalshallbeborneoutoftheConsolidatedFund ofIndia(ortheState). 50.ProceduretobefollowedbytheTribunal (1)Onreceiptofanappeal,aftergivingthepartiestotheappealanopportunityof beingheard,theLandTitlingTribunalmaypasssuchordersthereonasitthinksfit, eitherconfirmingormodifyingorsettingasidetheorderappealedagainst. (2)TheAuthority,uponreceiptoftheorderoftheLandTitlingTribunalandwithin seven working days after expiry oftheperiodofappeal thereon, shallrecord or modifyanentryintherelevantRegistersoftheAuthorityinaccordancewiththe orderoftheTribunal.

CHAPTERVIII COMPULSORYINTIMATIONTOTHELANDTITLINGAUTHORITY

It shall be compulsory for the parties applying for title or transfer under provisionsofthisActorwhohavebeengrantedprovisionalorconclusivetitleunder thisAct,tointimatetotheLandTitlingAuthoritythefollowinginformation: 51.Compulsoryintimationofcivilsuitsorappealsorrevisions (1)Notwithstandinganythingcontainedinanyotherlawforthetimebeinginforce, it will be incumbent upon the disputing party relating to any suit or appeal or revisioninrelationtoanyrightsorinterestinanimmovablepropertyrecordedin theRegisterofTitles,pendingonthedateofsuchnotificationinanycivilcourt, HighCourt,theSupremeCourt,orinanyquasijudicialauthorityestablishedunder anylaw,tointimate,inthemannerasmaybeprescribed,aboutsuchpendencyto the Authority, get it recorded, obtain a certificate of recording and file such certificatebeforethecourtortribunal. (2)Ifanysuitorappealorrevisionisfiledinanycivilcourt,HighCourtorinthe SupremeCourt,oranyquasijudicialauthorityestablishedunderanyotherlawin respect of an immovable property recorded in the Register of Titles, it shall be incumbent upon the disputing party to intimate, in the manner as may be prescribed,aboutfilingofsuchsuitorappealorrevisiontotheAuthority,getit recorded,obtainacertificateofrecordingandfilesuchcertificatebeforethecourtor tribunal. (3)Itshallbeincumbentuponthedecreeholderorplaintifforappellantoranyother interestedpersontointimatetotheAuthority,inthemannerasmaybeprescribed, theresolutionofadisputerecordedintheRegisterofDisputes,withinsevendaysof receipt of the decree or intimation of resolution of dispute. The Authority shall recordsuchresolutionandissueacertificateofrecording. 52.Compulsoryintimationoflandacquisitionproceedings

ItwillbeincumbentupontheCollectorundertheLandAcquisitionAct,1894 tointimatetotheAuthority,inthemannerasmaybeprescribed,thefactofissueof a notification under section 4, subsection 1 or a declaration under section 6, or passing of an award under section 15 of that Act in respect of any immovable propertysituatedwithinthenotifiedareaandtoobtainacertificateofitsrecording. 53.CompulsoryintimationofGovernmenttransactions AllthetransactionsbytheGovernmentinrespectofimmovableproperties within the notified area, including alienation, assignment, regularization of occupation,sale,grantorlease,shallbeintimatedtotheAuthoritybytheauthorized officialcarryingoutsuchtransaction,inthemannerasmaybeprescribed,andit shallbeincumbentuponsuchofficialtoobtainthecertificateofrecording. 54.Compulsoryintimationofequitablemortgages (1) All the financial institutions or other bodies or individuals holding equitable mortgageinrespectofanyimmovablepropertysituatedwithinthenotifiedarea shallintimatethatfacttotheAuthority,inthemannerasmaybeprescribed,and obtainacertificateofrecording.
(2) Ifanyequitablemortgageiscreatedinfavourofafinancialinstitutionorany

otherbodyorindividual,inrespectofapropertysituatedwithinthenotified area,itshallbeincumbentuponsuchfinancialinstitution,bodyorindividualto intimatethefactofcreationofsuchequitablemortgagetotheAuthority,inthe mannerasmaybeprescribed,andtoobtainacertificateofitsrecording. 55.Compulsoryintimationofstatutorycharges Itwillbeincumbentuponthepartyinwhosefavourastatutorychargeor

facttotheAuthority,inthemannerasmaybeprescribed,andtoobtainacertificate ofitsrecording. 56.Compulsoryintimationofpendingactions ItwillbeincumbentuponthepartiesconcernedtointimatetheAuthority,inthe manner as may be prescribed, all the pending actions such as appointment of a receiver in an insolvency petition, or making of a writ or an order affecting an immovable property situated within the notified area, issued by any court or a competentlegalauthorityforthepurposeofenforcingajudgmentorrecognizance ofanydeedofarrangementorarbitrationorsettlement,andtoobtainacertificateof itsrecording. 57.PowersofAttorneytobecompulsorilynotified ItwillbeincumbentuponthepartiesconcernedtointimatetheAuthority,in themannerasmaybeprescribed,allthepowersofattorneyauthorizingtheagentto sellordeveloporconstructtheimmovablepropertysituatedwithinthenotifiedarea or to deal with it in any manner having an impact over its title and all the agreementscumgeneralpowersofattorney, and to obtain a certificate of its recording. 58.Compulsoryintimationofgrantofsuccession (1)ItshallbeobligatoryfortheRegistrar,Births&Deathsoranyothercompetent authoritytointimatetotheAuthoritythedeathof: i. ii. atitleholder,whichshallbeenteredintotheRegisterofTitles; achargeholder,whichshallbeenteredintotheRegisterofChargesand Covenants;
iii.

adisputingparty,whichshallbeenteredintotheRegisterofDisputes;

inthemannerasmaybeprescribed.

(2) Where the deceased titleholder, charge holder or a disputing party has legal heirs, it shall be obligatory for such legal heirs to inform the Authority, in the mannerasmaybeprescribed,aboutthedeathofsuchpersonandthefactofthe deathshallberecordedbytheAuthorityinitsRegisters. (3)Incaseofthedeathofapersonwhosenameisenteredasatitleholderinthe RegisterofTitles,achargeholderintheRegisterofChargesandCovenantsand/ora disputingpartyinRegisterofDisputes,thelegalheirsofsuchdeceasedshallobtain adecreeofsuccessionfromthecompetentcourtandproducethesamebeforethe Authorityforreplacingthenameofthedeceasedwiththeirnamesintheaforesaid Registers. 59.Compulsoryreportingorfilingofinformation (1)NotwithstandinganythingcontainedintheTransferofPropertyAct,1882,the RegistrationAct,1908oranyotherlawforthetimebeinginforce,alltitleholdersof immovable properties situated within the notified area shall file the transfer applicationsorreportontransactionstotheAuthority,insuchmannerasmaybe prescribed,inrespectofallactsortransactionsrelatingtosuchimmovableproperty, includingthetransactionsdetailedhereunder:
a)

Anyactwhichpurportsoroperatestocreate,declare,assign,limitor

extinguish, whether atpresent orin the future, any right,title or interest, whethervestedorcontingent; b) Anycreation,declaration,assignment,limitationorextinctionofanyright, titleorinteresteffectedthroughthereceiptorpaymentofanyconsideration;
c) d)

Sale; Gift;
e) Creation ofacharge by way ofany kind ofmortgageincluding an

equitablemortgage,andreleaseofsuchcharge;

f) Lease,orreservingayearlyrent,orperiodicpremiums; g) Transferorassignmentofanydecreeororderofacourtoranyaward

whensuchdecree,orderorawardpurportsoroperatestocreate,declare, assign,limitorextinguish,whetheratpresentorinthefuture,anyright, titleorinterest,whethervestedorcontingent;


h) Any decree, order or award passed by a civil court, including any

decree, order or award passed, on consent of the defendants or on circumstantialevidence;


i) Any rectification of title done by the Director, Title Registry or the

LandTitlingTribunal;
j) Anyeasementaryrights,appurtenantrights,terracerightsorairrights; k) Saleorconstructionordevelopmentagreements; l) Powersofattorneyauthorizingtheagenttosell,construct or develop

suchproperty;
m) Agreementcumgeneralpowersofattorneyrelatingtotheproperty; n) Mergers, amalgamations or demergers of companies involving

immovableproperty;
o) Transfersofimmovablepropertyafterdissolutionofpartnershipfirms;

and
p) Anyothertransactionwithregardtotheimmovableproperty. (2) NotwithstandinganythingcontainedintheIndianStampAct,1899orany

otherlawforthetimebeing inforce,anapplicationfortitle,transferora reportonthetransactionmadeinaccordancewithChapterVIIIofthisAct shallbeconsideredtobeaninstrumentforthepurposesoflevyofstampduty underthatAct. 60.Compulsoryreportingoftransactions

Withoutprejudicetoanythingsaidhereinbefore,alltheinformationregarding alltheactsandtransactionsinrelationtoanimmovablepropertysituatedwithinthe notifiedareashallbereportedtotheAuthorityforrecordinginthemannerasmay beprescribed. Amongotheractsandtransactionspertainingtoanimmovableproperty,the followingactsshallbeincluded:

Chargescreatedbyunregisteredtransactions; Probatesandlettersofadministration; Attachments ofpropertymadethroughcourtdecrees,injunctionsor

ordersofanycourtortribunalorstatutoryauthority;and d)Anyothermatterasmaybeprescribed. 61.Presentationoftransferapplicationorreportontransaction The transfer application or report on transaction along with the prescribed formsanddocumentsrelatingtotheactortransactioninrespectoftheimmovable propertyshallbepresentedtotheAuthority:
a)

by aperson executing such transactionorclaiming such transaction

pursuanttoadecreeororderissuedbyacompetentcourtortribunalora competentlegalauthority;or
b)

by theagentofsuchpersonduly authorizedbyapowerofattorney

which has already been registered with the Authority in the Register of ChargesandCovenants: Providedthatnotransactioninrespectofapropertyshalltakeplace between such agents, and the name of the person or persons on whose behalfthetransactionhastakenplaceshallbeenteredasthenewtitleholder intheRegistersoftheAuthority.

CHAPTERIX MISCELLANEOUS 62.TitlingtobemadecompulsoryafterfiveyearsofpromulgationofthisAct (1)Aftertheexpiryofaperiodoffiveyearsfromthedateofpromulgationofthis Act,itshallbeincumbentuponthepropertyownerstoobtainatitlefromthe Authorityforeachpropertyowned,inthemannerasmaybeprescribed. (2) The title shall be obtained for the land on which the property is situate, irrespectiveofthefactwhetherornottheconstructionofthepropertyhas beencompletedornot. (3)Afterthecomingintoforceofthissection,theAuthorityshallgradeallproperties within the notified area according to their size and value into three categories, namely,small,mediumandlarge,inthemannerasmaybeprescribed.Otherthan the properties being transacted, the Authority shall proceed to give titles to the smallpropertyholdersfirstandonlythereaftertotheholdersofmediumand largeproperties. (4)Afterthecomingintoforceofthissection,anyimmovablepropertyforwhich thereisnorightfultitleholder,tobedeterminedinthemannerasmaybeprescribed, shallvestintheGovernmentwithoutanyrecompense,andanentryshallbemadeto thateffectintheRegisterofTitles. 63.Effectofnoncomplianceofrequirement (1)Notwithstandinganythingcontainedinanyotherlaworenactmentinforce,if therequirement ofregistration under thisActisnotcompliedwith,thetransfer, grantorcreationoftitleorrightorinterestshallbecomevoidabinitio.

(2)Notransactionoractrelatingtoimmovablepropertyrequiredtoberegisteredor recordedunderthisActorreportedtotheAuthorityunderthisActshallbeeffective andreceivedasevidenceofatransactionrelatingtosuchproperty,unlessithasbeen registered or recorded upon receipt of information, as the case may be, by the AuthorityundertheprovisionsofthisAct: Providedthatanunregistereddocumentaffectingimmovablepropertyand requiredbythisActortheTransferofPropertyAct,1882,toberegisteredmaybe receivedasevidenceofacontractinasuitforspecificperformanceunderChapterII of the Specific Relief Act, 1877, or as evidence of any collateral transaction not requiredtobeeffectedbyregisteredinstrument. (3) Ontheapplicationofsubsection1,incaseoftransfersforvaluableorother

consideration,bythewayofgiftorinpursuanceofanorderofanycourt,thetitleto theimmovablepropertyrevertstothetransferorwhoholdsitonabaretrustforthe transferee. (4) Ontheapplicationofsubsection1,incasesofleasesorgrants,chargesor

mortgages,theleaseorgrantorcreationofchargeormortgageshallhaveeffectasa contract made for valuable consideration to lease or grant or create such legal interest. 64.Completionofrecordingoftitlestobenotified (1) Oncetherecordingoftitlesiscompletedinthenotifiedarea,theAuthority

shallnotifythefact.Thereafter,onlythetitlingsystemshallprevailinthenotified area. (2) EverynotificationmadeunderthissectionshallbepublishedintheOfficial

Gazette,andinatleastthreedailynewspapers,twoofwhichshallbeinthelocal vernacular,havingcirculationinthenotifiedarea,andalsobyaffixingacopyof

notificationonthenoticeboardoftheconcernedgrampanchayatsormunicipalities andotherprominentplaceorplacesinthenotifiedarea,orbyanyothermethod,as maybeprescribedinthisregard. 65. Liabilityforvoidtransfers If any title or right or interest in immovable property is retransferred, re granted or recreated because of a failure to comply with the requirements of registration,thetransfereeorgranteeor,asthecasemaybe,themortgagorwillbe liableto: (a) the other party for all the proper costs of, and incidental to, the

retransfer, regrantorrecreationofthetitleorright or interestintheimmovable property, (b) indemnify the other party in respect of any other liability reasonably incurredbyitbecauseofthefailuretocomplywiththerequirementofregistration. 66.Furnishingofreports (1)TheAuthorityshallprepareonceineveryyear,insuchformandatsuchtimeas maybeprescribed,anannualreportgivingatrueandfullaccountofitsactivities during the previous year and copies of the report shall be forwarded to the Government. (2)Acopyofthereportreceivedundersubsection1shallbelaid,assoonasmaybe afteritisreceivedbytheGovernment,beforetheParliament(ortheStateorUnion territorylegislature). 67.ActsofAuthoritynottobecalledinquestion NoactdonebytheAuthorityshallbecalledintoquestiononthegroundonlyofany defectintheconstitutionof,ortheexistenceofanyvacancyintheAuthority.

68.Penalties (1)AnypersonresponsibleforprovidinganyinformationunderthisActshallbe personallyliableforfailuretofurnishtheinformationwithintheperiodspecified therein,andthepenaltythereofshallbeasmaybeprescribed. (2) In caseofwillfulconcealmentofinformationordeliberate furnishingoffalse informationtotheAuthority,thepersonorpersonsresponsibleshallbepunished withfineasmaybeprescribed. (3) The Authority shall impose penalties, as may be prescribed, for any willful violationofthisAct,includingpenaltiesonitsownofficersandstaff. (4)TheAuthoritymayrecoverfromitsownofficersandthestaffsumspaidoutof thetitleguaranteefundif,afterdueinquiry,itcomestotheconclusionthatsuch sumshadtobepaidduetotheirwillfulnegligenceormalafideactions. 69.Removalofdifficulties (1) If any difficulty arises in giving effect to the provisions of this Act, the Governmentmay,bynotification,makesuchprovisionsnotinconsistentwiththe provisionsofthisActasappeartoit,tobenecessaryorexpedientforremovalof difficulties. (2) Everynotificationissuedunderthissectionshallbelaid,assoonasmaybe

afteritismade,beforetheParliamentortheStateorUnionterritoryLegislature,as thecasemaybe. 70.AccesstoRegisters (1)AllrecordsandtheRegistersoftheAuthorityshallbeamatterofpublicrecord.

(2) Any interested person may approach the Authority for an extract of any informationcontainedintheRegistersmaintainedunderthisAct.Allsuchextracts andcopiesissuedshallbearthesealoftheAuthorityandthesignatureofanofficer authorizedinthisbehalf,andwillbeissuedonpaymentofsuchfees asmaybe prescribedbytheAuthority: ProvidedthattheAuthoritymaywithholdinformationif,initsopinion,the information soughtmay endanger nationalsecurity.Thereasonsforwithholding information must be recorded in writing and the person requesting for the informationshallbedulyinformed. (3) A copy or extract from the Registers given by the Authority or an officer authorized in this behalf, under its seal, shall be admissible as evidence for the purposeofprovingthetitletoanimmovablepropertyorcontentsofatransaction relatingtotheimmovablepropertycomprisedintheextract. 71.Immunityforactsdoneingoodfaith No legal proceedings or any other claim or action shall lie against an employeeoftheAuthority foranythingdoneingoodfaithunderthisActorthe Rulesandregulationsmadethereunder. 72.PowerofGovernmenttomakeRules (1) TheGovernmentmay,bynotification,makeRulestocarryouttheprovisions

ofthisAct. (2) Inparticular,andwithoutprejudicetothegeneralityoftheforegoingpowers,

suchRulesmayprovideforthe:
i.

TheorganizationalsetupoftheAuthority;

ThemannerofappointmentoftheChairperson,Membersandofficersand staffoftheLandTitlingAuthorityandtheLandTitlingTribunal;

iii.

The fixation of salary, allowances and other terms and conditions of serviceoftheChairperson,Members,andvariousofficersoftheAuthority andtheTribunal;

iv.

ThemannerinwhichtheChairpersonoraMemberoftheAuthorityorthe Tribunalmayresignhis/heroffice;

v.

The powers andfunctions of the Land Titling Authority andthe Land TitlingTribunalandtheirofficers;

vi.

ThemannerofsubmissionoftheannualbudgetsoftheAuthorityforthe approvaloftheGovernment;

vii.

The manner in which the accounts of receipts and expenditure of the Authorityshallbemaintainedandaudited;

viii.

TheperiodicityofreportingtotheAuthoritybytheDirector,TitleRegistry regardingtheapplicationswhichhavebeenfoundtobeinadequate;

ix.

The manner of preparation, compilation, maintenance, rectification of errors, updation, safeguards and amendment of the Registers in both paperandelectronicforms,andprescribingtheformsinwhichtheyareto becompiledormaintained,theplacesatwhich,andtheofficerbywhom Registershavetobemaintained,andtheofficerbywhomthesaidentries aretobeverifiedandamended;

x.

Maintenanceofotherrecords,registers,accounts,mapsandplansforthe purpose of this Act and the manner and forms in which they shall be preparedandmaintained;

Themannerinwhichtheuniqueidentificationnumbershallbegivento eachimmovablepropertywithinthenotifiedarea;

xii.

Themannerinwhichthesystemofindicativemapsshallbedeveloped andmaintainedinthepublicdomain;

xiii.

Puttinginplacepropersystemsforidentificationoftheconcernedparties, suchas,photographs,biometricauthenticationoranyothermethod,and issuingguidelinesinthisregard;

xiv.

ThemannerofsubmissionofcompliancereporttotheAuthoritybyits Directorsandotherofficers;

xv.

The norms and standards that the Authority shall adopt for cadastral surveyingandmappinginrespectoftheimmovablepropertiessituatedin thenotifiedarea;

xvi.

Themannerofcreating,maintainingandcontinuouslyupdatingtheLand InformationSystem;

xvii.

The manner of putting in place a system of survey through private licensedsurveyors;

xviii.

ThemannerinwhichtheAuthorityshallundertakeproperty valuation andthemannerinwhich thevaluationdetails shall beprovidedupon request.

xix. xx. xxi.

Inspectionoftherecords,registersanddocumentstobemaintained; Publicationofnoticesandnotifications; Themannerinwhichalltherequiredinformation,includingtheindicative maps,shallbemaintainedinthepublicdomain;

The procedure to be followed in making enquiries and hearing claims, objectionsandappealsunderthisAct;

All Rules made by the Government under this section and any orders

relatingtothedelegationofpowerstotheAuthorityshallbelaid,assoonasmaybe after they are made, before the Parliament (or the State or Union territory legislature). 73.PowersofAuthoritytodelegateandissueexecutiveinstructions (1)TheAuthoritymaydelegatesuchofitspowerstoitsMembersorofficersasit mayconsidernecessary. (2) The Authority may issue executive instructions in furtherance of various provisionsofthisActandRulesmadethereunderinordertoachievetheaimsand objectivesofthisAct,solongastheyarenotinconsistentwithsuchprovisions. (3) With prior approval of the Government, the Authority may decentralize its functionsbydelegatingsuchofitsfunctionstootherstatutoryorganizationsasit considersnecessary. Explanation: The statutory organizations may be panchyati raj institutions, urban local bodies or development authorities, offices of the Revenue administration established under the relevant laws, and the Registration officesestablishedundertheRegistrationAct,1908. 74.Repealandsavings Fortheremovalofdoubts,itisherebystatedthat,incaseofanyinconsistency betweentheprovisionsofthisActandanyotherAct,theprovisionsofthisActshall prevail.

STATEMENTOFOBJECTSANDREASONS Thepeaceandprosperityofthecitizensandgoodgovernanceofacountry requireaccurateandupdatedimmovablepropertyrecords.Thecurrentsystemof maintenanceofpropertyrecordsinthecountryhasseveraldrawbacks.Thereare numerous agencies involved in their maintenance, leading to a multiplicity of inharmoniouspropertyrecords;lackofinterconnectivityamongtheseagencies,their inefficiency and differing processes of updation of property records lead to inaccuracies intheserecords.Theprocesses forupdationofproperty records are cumbersome and timeconsuming which lead to backlogs in the maintenance of property records. The system of transferring immovable property through registrationofdeedsanddocumentsandpresumptivetitlesleadstoirregularities andlitigation.IntroducingthesystemofConclusiveTitleswithtitleguaranteeand indemnification against loss due to inaccuracies in property titles, will create an environment conducive to facilitating easier access to capital and, therefore, enhancedagriculturalproductivityperunitofland,efficientpropertytransactions andsecurityoftenureandpropertyrights.
