Sale Deed

THIS Deed of SALE made at Jaipur on this day of April in the Christian Year Two Thousand Nine BETWEEN Smt. Vidhatri Gupta Wife of Shri Deepesh Gupta, By caste- Mahajan, Resident of Ward No. 1 (53), Haveli Samrat, Tehsil Amer, District Jaipur hereinafter called THE VENDOR (Which expression shall unless repugnant to the context or meaning thereof be deemed to include his heirs, executors and administrators, agents and Assignees) of the One Part; AND Lt. Col. Siddhartha Sen, Son of Late Brig. Sandip Sen, Resident of 304, Akshat Tower, D-217, Bhaskar Marg, Banipark, Jaipur hereinafter called THE PURCHASERS (which expression shall unless repugnant to the context or meaning thereof mean and include the survivors and the heirs, executors, assignees and administrators ) of the Other Part;

Whereas a flat numbered as 204, situated at First Floor, Akshat Tower, D-217, Bhaskar Marg, Banipark, Jaipur having built up area of 1220 Sq. Feet (Super Built up area 1372 Sq. Ft. ) description of which is given in schedule-1, with reserve car parking space bearing no. 19 in stilts, was initially developed by M/s Akshat Builders, 8, Park House, In front of All India Radio, Jaipur. Whereas the above mentioned flat was initially purchased by Late Shri Govind Sharma S/o Shri Gautam Sharma, R/o- House No. 40, Revenhill, Crescent, Markham Ontario, Canada L-3S2T9 from M/s Akshat Builders, 8, Park House, In Front of All India Radio, Jaipur through its proprietor Shri Sunil Jain S/o Shri N.K. Jain R/o-A-27/4, Kanti Chandra Road, Banipark, Jaipur and Smt. Mukulika Sen & Anothers, through their Power of Attorney Shri Sunil Jain through a registered sale deed which was registered with Deputy Registrar, Jaipur-II, at Sr. No. 1231, Book No. 1, Volume No. 266 at

Page No. 31 on dated 12.01.2001 which is additionally pasted at Additional Book No. 1, Volume No. 1049 at Page No. 173 to 185. Whereas the owner of the above mentioned flat Shri Govind Sharma S/o Shri Gautam Sharma has died on 11.01.2003 and the legal heirs of Shri Govind Sharma i.e. Smt. Shivani Sharma Wife of Shri Govind Sharma, Shri Amit Sharma Son of Shri Govind Sharma, Miss Sushmita Sharma Daughter of Shri Govind Sharma executed a registered deed of power of attorney and appointed Shri Deepesh Gupta S/o Shri Prakash Chand Gupta, Aged about 41 years, R/o-1, (53) Haveli Samrat, Tehsil Amer, District Jaipur, their registered power of attorney holder to execute a sale deed or to do any work, transfer, deed in favour of any other person thereof. The power of attorney dated 27.12.2006 is registered with Office of Sub Registrar, JaipurIV on 29.12.2006 at Book No. 4, Volume No. 14, Page No. 15, Serial No. 2006398000800. Whereas the power of attorney holder Shri Deepesh Gupta sold the above mentioned flat to Smt. Vidhatri Gupta aged about 38 yrs. Wife of Shri Deepesh Gupta, Resident of Ward No. 1 (53), Haveli Samrat, Tehsil Amer, District Jaipur for a total consideration of Rs. 11,51,000/- (In Words Rs : Eleven Lac, Fifty One Thousand Only) and executed a registered sale deed dated 12.11.2008 which was subsequently registered with Sub-Registrar, Amer, Jaipur on 12.11.2008 at Sr. No. 2008064003778 at Book No. 1, Volume No. 383 at Page No. 181 which was additionally pasted at Additional Book No. 1, Volume No. 1038, Paper No. 232 to 245. Whereas the vendor is the sole owner of the above mentioned flat fully described in scheduled annexed herewith,
The Purchasers have agreed to purchase and acquire from the Vendors the said flat and all their right, title and interest therein, free from all encumbrances and reasonable doubts of whatsoever nature to which the Vendors have agreed upon the terms and conditions recorded hereinafter;

Whereas the Vendor has agreed to sell and the Purchasers have

agreed

to

purchase

the

said

property

at

or

for

the

price

of

Rs.25,00,000/- (Rupees twenty five lacs only) upon the terms and subject to the conditions hereinafter appearing. Whereas the purchaser has paid Rs. 100,000/- Rs. One lac Only vide cheque no. 272514 drawn at Central Bank of India, M I Road, Jaipur. Dated 12-2-09 as the ernest money. And the balance of the agreed sale price will be paid at the time of registration of the sale deed.
