IP KEY POINTS FROM THE PARTNERSHIP AGREEMENT GENERAL POINT IBIS is a publicly funded research consortium (of the

e 3 partner organisations LA, QUB, UoG). The topics of the studentship projects are public-interest. So the eventual outputs of the project will be made public. It is expected that as the research projects develop, information / data will be exchanged among the partners. (from clause 12) 1. Info generated by any IBIS project can be used by anyone in IBIS unless marked CONFIDENTIAL. Some information exchange inside the consortium can be marked by the originating partner as confidential to the consortium but ONLY if it (the methods, know how, files or any other type of document) is marked CONFIDENTIAL TO IBIS PARTNERS. Such marked info must not be disseminated, passed it on to third parties or used for further development without prior written consent of the partner that provided the information The CONFIDENTIALITY restriction ceases in 2017 (2 years after project end) (from clause 15) 2. Any partner intending to publish results must send the Coordinator (who will inform the other two partners) copies of the proposed publication or presentation at least 30 days in advance of the submission of the proposed publication. There will be 30 days for any objection. Grounds for objection are that legitimate interests in relation to own intellectual property rights could suffer disproportionately. The 30-day timeframe may be shortened by mutual agreement. If an objection is made, the relevant Parties will cooperate to edit the publication to remove the confidential or objectionable material. No partner will have a right of veto on publication. Any written comments by any Partner will be considered in good faith. The final decision on the content of the publication will remain with the IBIS Management Board. (from clause 18) 3. Background IP ownership stays with the originator. Only IBIS participants have a nonexclusive, royalty-free licence to use others Background solely for the purpose of completion of the Project. No other rights or licenses are granted in respect of such Background. Foreground IP belongs to its creator. Where Foreground is generated jointly then it is jointly owned. None of the joint owners must do anything that harms the rights of the other joint owners. They must discuss together any commercial exploitation possibility and record any steps to be taken among themselves and with the Coordinator. Each IBIS partner gives the others a non-exclusive, royalty-free licence to use its Foreground for the others IBIS partners own non-commercial academic and non-commercial research purposes, subject to the confidentiality obligation.
