FBE Statement on the Burma/Myanmar Armys war on the ethnic people and grave human rights violations in the

ethnic areas in Burma

The wars and human rights violations in the ethnic areas committed by the Burma/Myanmar Army have been going on for years. With the initiative of the new Burmese/Myanmar Government in 2011, peace talks had been conducted with some ethnic armed groups with least successful results, however, after the appointment of the new Army Chief of Staff Gen. Min Aung Hlaing. The Army violated the peace deals and started attacking the KIA frontline bases on the 9 th of June 2011. Later, the army had committed and still committing grave human rights violations continuously in the Kachin State. According to the daily news from (http://www.kachinnews.com/ ) : 1. Burma/Myanmar Armys buildup in the Kachin areas and started attacks on KIA 2. Sending arms and ammunitions and food supplies,attacking the people by war planes to the war torn areas, 3. Use of chemical weapons on the people 4. Forced the civilians as slave porters 5. Recruitment of child soldiers 6. Use rape as weapon and as relaxation for the soldiers on the Kachin women and girls 7. Confiscation without any compensation of land, agricultural fields, natural resources, burning of villages and etc. The above mentioned atrocities are committed repeatedly and continuously in the Kachin areas. In discussion with the ILO, the General promised to end these atrocities by 2015, in other words, the Army is allowed to commit the atrocities till 2015 and beyond. General Min Aung Hlaing has the authority on the soldiers and if he is willing, he can stop the atrocities immediately without delay. FBE therefore demands to General Min Aung Hlaing to stop the atrocities in the ethnic areas immediately as soon as possible. If our demands are not met within 60 days, legal actions will follow in the European courts against General Min Aung Hlaing and responsible persons. Although the EU visa ban has been suspended, the crimes against humanity and war crimes committed in Myanmar can be taken action in Europe in accordance with the European Laws. Such cases had be done in European courts, for examples, dictator Augusto Pinnochet was indicted by Spanish magistrate in 1998, atrocities committed by French Oil giant TOTAL in Burma faced legal action in Brussels/Belgium according to Universal Capability Law about 3 years ago. UN Commission of Inquiry has been recommended by UN Human Rights Special Envoy Prof Quintana to investigate crimes against humanity and war crimes committed by the Burma Army.
