Dear Judge Whyte:

This letter follows up on my letter of December 17,2008 and provides further detail
regarding the ways in which the testimony of Robert Murphy could be affected by the Court's
refinement of its construction of the term "memory device."

As noted in my earlier letter, Mr. Murphy has previously opined that certain references
relied on by the Manufacturers do not disclose "memory devices," even under the Court's prior
construction. Mr. Murphy may, of course, testify to the opinions he has disclosed in his validity
report. However, the Court's revised construction makes it even more clear that prior art
memory boards and processing devices (such as memory controllers) are excluded from the
category of "memory devices," and Mr. Murphy may point to the revised construction as support
for this proposition. In particular, Mr. Murphy is of the opinion that the revised construction of
"memory device" expressly excludes prior art memory boards (since it notes that a "memory
device" is smaller) and expressly excludes processing devices (since it distinguishes "memory
devices" from them).

Of the alleged prior art that Mr. McAlexander has opined anticipates or renders obvious
the asserted Rambus patent claims, the particular art to which the Court's revised construction of

memory device appears to be relevant is listed below. As also noted in my earlier letter, the
extent to which Mr. Murphy may need to testify regarding this art is dependent on the outcome
of Rambus's Motion in Limine No. 10 to Exclude Evidence or Argument Contrary to the Court's
Construction of "Memory Device." As discussed in that motion, the Manufacturers' invalidity
expert, Mr. McAlexander should not be permitted to testify that certain memory boards
containing multiple memory chips constitute memory devices or that separate memory
controllers constitute all or part of memory devices. If that motion is granted, Mr. Murphy will
not need to respond on the topics raised in that motion.

To the extent that the Manufacturers do introduce testimony that the references listed
below describe memory devices, Mr. Murphy will express the opinion that they do not and may
rely in part on the revised construction of "memory device" in responding as follows:

• the MCV (memory control unit) in the iAPX references, either alone or in combination
with separate memory chips, does not constitute a "memory device" because the MCV is
a memory controller and it works with memory chips that are contained on prior art
memory boards;

• an SCI "node," alone or in combination with other chips, could not constitute a "memory
device" because, as described in the SCI references, a node contains processing devices
and/or prior art memory boards;

• the memories referred to in the Bennett patent do not constitute memory devices because
they are prior art memory boards:

• the CVAX memory controller, alone or in combination with separate memory chips, does
not constitute a "memory device" because it is a memory controller and the memory
chips that work with the CVAX memory controller are included in up to four separate
prior art memory boards;

• the Bowater memory controller, alone or in combination with separate memory chips,
does not constitute a "memory device" because it is a memory controller and the memory
chips of Bowater are included in prior art memory boards;

Finally, there are three other references that Mr. Murphy had previously distinguished in
part based on the fact that they involve processors rather than memory - Deering, which Mr.
Murphy opines is directed to a graphics processor; and Stewart and Johnson, which Mr. Murphy
opines are directed to CPVs. Mr. Murphy could point to the Court's express exclusion of
processing devices from the category of memory devices in support of these opinions also.

Rambus reserves the right to supplement this letter if any of the opinions expressed in the
anticipated supplemental report from Mr. McAlexander relating to the construction of "memory
device" requires a further response from Mr. Murphy.
