0 INTRODUCTION
1.1 LYNAS COMPANY BACKGROUND

In the 1983, Yilgangi Gold NL was founded by Nicholas Curtis in Sydney, Australia. The company took the name Lynas on 1985 and become publicly listed on Australian Securities Exchange (ASX) on 1986. On the year 2001, Lynas sold off its gold division and become more focused on rare earth. Nicholas Curtis were former executive director at Mcquarie Ltd (company involve in banking and finance and also an Australia company). Lynas main headquarter is situated in Sydney, Australia and its mining plant concentrated at Mount Weld located at western Australia. Lynas also have refining facility under constructions in Kuantan, Pahang, Malaysia. Lynas also own a rare earth deposit in Malawi in Africa. Although, now the deposit ownership is being fought between Michael Saner and Malawi Government.

1.2 RARE EARTHS DIRECT (RED)

Lynas RED Brand Lynas have established and registered internationally their own RED brand (Rare Earths Direct). All Rare Earths product marketed by the company will be sold through this brand and the aim is to make the brand a global benchmark for quality and demonstrated continuity of supply. Lynas RED brand presents three key value propositions: Building a fully integrated supply system from mine to customer; Producing Rare Earths that meet the worlds environmental standards; and Marketing an international brand of guaranteed quality. Lynas development of the RED model ensures maximum profitability across the value chain through the entire business cycle, and creates a robust and enduring enterprise with the ability for further expansion.

1.3 LYNAS ADVANCED MATERIAL PLANT (LAMP)

The LAMP is being built in Gebeng, Kuantan Pahang, Malaysia due to the readily available industrial infrastructure, including industrial land, sources of gas, water and electricity, re-agents from local suppliers and a port that can manage container, chemical and bulk shipments. The area where the plant is being built also offers much knowledge infrastructure, such as technical and trade skills and chemical industry experience. The government infrastructure is in place and provides accountable regulators, clear legal frameworks and FDI incentives.

Once the Lynas Advanced Material Plant (LAMP) is operational it is expected to meet over 30% of the global demand for rare earth materials outside of China. The refinery will be the worlds largest rare earth refinery and the first in nearly three decades to be finished outside China, where barely regulated factories have left vast toxic and radioactive waste sites.

1.4 RARE EARTHS

Rare earth The rare earths are a moderately abundant group of 15 metallic elements known as the Lanthanide series (atomic numbers 57 through to 71) plus Yttrium (39). Although Scandium (atomic number 21) is not a Rare Earth element, it is commonly included with the Lanthanides because of its similar properties. The 15 lanthanides are represented by the single square of lanthanum in the main part of the periodic table and listed in a separate sub group below the main groupings. In the periodic table:-

Periodic Table They range in crustal abundance from cerium, the most abundant, at 60 parts per million, which is in fact more abundant than nickel or copper, to thulium and lutetium, the least abundant Rare Earth element at about 0.5 parts per million. Rare Earths are not found as free metals in the earths crust, rather within a mixed cocktail of Rare Earth elements that need to be separated for their individual or combined

commercial use. Despite their name, Rare Earths are relatively abundant in the earths crust, however are often of low quality and rarely presented in economic concentration. The first point to note about Rare Earths prices is that there is significant variance in the relative market value for selected Rare Earths oxides. Secondly, the price of Rare Earths depends on the purity level, which is largely set by the specifications for each application.

1.5 USES OF RARE EARTHS

Electronic devices Rare Earth is widely used in electronic processing. In many applications, the use of Rare Earth is profitable because of their low toxicity rate. For example, most common batteries contain cadmium (Cd) or lead.

HYBRID CAR BATTERIES

Every hybrid-electric and electric vehicle has a large battery. Each battery is made using several pounds of rare earth compounds. The use of electric vehicles is expected to increase rapidly, making them an important source of growth for rare earths.

MAGNETS Rare earth magnets are widely used in wind turbines. Some large turbines require around two tonnes of rare earth magnets. These magnets are very strong and make the turbines highly efficient. Rare earth magnets are used in turbines and generators in many alternative energy applications.

MOBILE PHONES, LAPTOPS

Rechargeable batteries used in mobile phone and portable computers require rare earths. Rare earths were the key to smaller, more efficient battery technology.

2.0 CURRENT ISSUES CONCERNING LYNAS ADVANCED MATERIAL PLANT (LAMP) AT GEBENG KUANTAN, PAHANG
2.1 Advantage of lynas advanced material plant (LAMP)

2.1.1 Good in environment and efficient of energy Back in September 11 we were shocked about a mining-related project in Malaysia being proposed by the Australian rare-earths miner, Lynas Corporation Ltd. Although we already know that the technology that we have in our country still not at high level yet. Beside that not only technology that we have we also lack of an exporter in this field. But what we must do is ,weve been following events since then and there continues to be a very well organised community (and political) effort to oppose the Lynas Advanced Materials Plant (LAMP). Actually when some observation that were made by some exporter , they are say that the LAMP is being built in Malaysia due to the readily available industrial infrastructure, including industrial land, sources of gas, water and electricity, re-agents from local suppliers and a port that can manage container, chemical and bulk shipments. The area where the plant is being built also offers much knowledge infrastructure, such as technical and trade skills and chemical industry experience. The government infrastructure is in place and provides accountable regulators, clear legal frameworks and Foreign Direct Investment FDI incentives. This corporation choose Malaysia as an area to build this factory because Malaysia has an advantage in attracting downstream activities in the rare earth industry, compared with China because it has a legal system and intellectual property are excellent, according to Executive Vice President Corporate Communications Strategy and Lynas Corporation Ltd Dr Matthew James. Beside that when he make a comparison with a China we can see ,at the same time, the cost advantages in laborcost, energy and chemicals that have made Chinano longer applicable and Malaysiais seen as a highly competitive location due to high cost increases that occurred in China over the past decade. From this statement we can conclude that Malaysia still have an expert that can confidently handle this project. This project already make an operation since year 2008 and what we can see it do not faced any problem until now , 2012 but when they are already know about the project then the project has come up against opposition from local groups. The first thing that they are worry if quality and condition of this factory is in good condition so they accuse Lynas of cost cutting

practices in building the refinery. The accusations are predominantly based on a report by the New York Times which claims that there are cracks in the containment tanks and Lynas is using lesser quality materials such as plain steel instead of stainless for its piping, (Bradsher, 2011). Local residents are concerned that radioactive waste from the facility will put them at risk and potentially leave a costly legacy. Locals fear a repeat of the toxic wasteland left behind by the Mitsubishi Chemical plant in Bukit Merah which is now blamed for birth defects and cancers such as leukaemia. Lynas claims that the radioactive thorium content of their rare earths oxide (REO) is very low and that the plant wont pose a risk. Despite this, a recent review by the International Atomic Energy Agency recommended that Lynas develop a more thorough waste management plan. The plan was due by August 2011 and as far as were aware, has not yet been released. In addition the plant that worth RM700 million is reportedly struggling with the controversy, which was triggered by allegations that it will produce harmful radiation that leads people to visit the International Atomic Energy Agency (IAEA) from 29 May to 3 June. Said Bernama in his report, the IAEA confirmed that the plant, when completed later this year, to secure and fully compliant with international standards, but the license pre-operation still subject to approval from regulators. This is proved that the assumption of local citizen about Lynas plant is totally wrong, which is they are think LAMP is a nuclear plant. So what we can say is this factory is safe and not only that it also can contribute many advantage for our country. Talk about advantage, although the local citizen keep talk about the danger of the this plant but actually this plant is secured properly so there is no problem to environment. Firstly, about the material that was processed in this plant. Rare Earths support the uptake of energy efficient initiatives through their unique physical and chemical properties. This allows them to protect the environment by lowering energy consumption and improve lifestyles through energy efficient applications that save money, without sacrificing comfort and reliability. Beside that Rare Earths are playing a pivotal role in greenhouse gas reduction through their unique application in automotive catalytic converters, hybrid vehicles, wind turbines and energy efficient compact fluorescent light bulbs. In addition Rare earth is needed to produce electronic equipment components. As a result of the use of rare earth, we are able to enjoy a thin electronic equipment, small and light like the iPad 2 as components resulting from the use of rare earth is a better and efficient than components manufactured using synthetic materials. From this evidence there is no reason that we can make to show that this plan can contribute to big problem. In addition it has a high level characteristic that can overdue the assumption that had made by local citizen and for other side that not agree with this project. First of all, Lynas is not a nuclear plant but a simple chemical processing plant operating at atmospheric pressure and ambient temperature. Therefore, there will be no fire or explosion that

will cause radioactive dispersion and contamination into the environment. If they are compared with what happen at Mitsubishi factory that have been close for more than 20 years but cleanses work still operate and costly about 300 million, they are totally wrong because Asian Rare Earth (ARE) uses monazite as raw material and Lynas do not use monazite. While Lynass raw material radioactivity is 37 times less than Asian Rare Earth (ARE). Lynas residue is 60 time less radioactive than are. We also can say that this operation is green to environment and never will pollute the water because Lynas original site is about 2 m above the water table. Then the site has been prepared by replacing with 1.4 m local fill making the site 3.4 M. above water table. The Residue Storage Facility (RSF) is built on top (not excavated) of the new site. The base of the temporary storage facility is 0.75 M. thick making the base now 4.15 M above water table. The wall of the storage facility is 9 m high. With this precaution , to occur an accident is less, unless the worker is not carefully while operating this project. Beside that to ensure there is zero radiation Lynas Corporation also take Radioactive Exposure Prevention measures: Thorium is not soluble in water and thus can be precipitated and separated out. High Density Polyethylene (HDPE) liner will prevent leaching Clay (layer below HDPE) has very low permeability to water and that will further prevent any possible leaching. Thorium has strong affinity (stick strongly) for clay, thereby further reducing leaching. An under liner leak detection system (ULLDS) monitors and detects any possible leak.

Another measure also taken to ensure that there is no pollution to the soil. It is proved when all process areas are built on bunded containment concrete structure. Any acid spill will be contained in the bund and will not come into contact with the ground. So directly no soil pollution will occurred. If they were say that Lynas can make a huge radiation that can induce cancer and caused deformed newborns actually is just an postulate because there are fact that statistic from Ministry of Health 2007 shows that cancer prevalence is 720 cases per million. Before Lynas the, estimated fatal cancer from background radiation at Lynas site is 35 cases per million. With Lynas in operation, based on the 0.002 mSv/y, the estimated fatal cancer is 0.1 case per million. So from the statistic there are no difference and in other word Lynas operation do not effect too much to people health. The radiation that from Lynas operation is just 10 time less than radiation come from when u watch television. There are no radiation is safe because radiation is all around us. Some areas in Perak, Selangor and Langkawi have higher than the average Malaysias level of

radiation but posed no hazardous on sequences. Radiation is also used in the medical field and it is perfectly safe. If we look the radiation that can emit by Lynas operation, it is less than radiation that can emit by X-ray or gamma ray that was used in medical field. Finally to strengthen the point is, by proving that there is no radiation exposure like executive chairman Nicholas Curtis of Lynas Corporation said that the amount of thorium - the radioactive element found in virtually all rare earth deposits that will be released from the factory would result in zero public exposure due to specialised storage dams it is constructing onsite. Studies say radiation is linked to diseases such as to cancer and congenital birth defects, fears of which has led environmentalists and local residents to protest against the project. This is was added with Hulu Langat MP Dr Che Rosli Che Mat reiterated that the LAMP was safe and should be allowed to operate as long as Lynas adhered to strict safety standards and regulations.

2.1.2 Job opportunity In other side of view this project also can help Malaysian government in served the employment opportunity. This is we can see clearly because when new operation are operate then it will need a labors and experts in order to manage this plant system. So undirectly it will open a job opportunity. It is become more clear when a non government organization leader, Ngah Ismail said in Sinar Harian that We support the Lynas since it proved to be able to provide thousands of employment opportunities for local people,. Beside that Curtis also said in the The Malaysian Insider, that of the 350 skilled workers the plant would hire, only a handful of R&D staff would be non-Malaysian, who will be given the best knowledge in the world on the processing of rare earths and the potential to modify those processes to meet special application needs. When he was asked if there was the right skills in Malaysia to fill those positions, he replied, We advertised for 30 positions last week and received 10 Malaysian applicants per position. This can make all the assumption that many local people do not agree with this plant is totally wrong. It is because what we can see is there are many Malaysian applicant already apply to fill the position or in other word they are support the Lynas operation. The labor that it need is not only when the plant start to operate but also before it operate which is when the construction. In construction phase employment of worker to makeup the construction labor force project will be necessary and sure the priority will be given to local resident working in this sector but employment of foreign labor may be expected in the event of local labor shortage. If the labor is housed on site, proper accommodation facilities will have t be provided with basic amenities such as portable water supply, electricity, solid waste and sanitary treatment facilities. What can make the proved of job opportunity for local people will priority is when the employment of

foreign labor may result in the import of communicable diseases not indigenous to the area for example malaria, dysentery and cholera which could spread to the local resident. Therefore there are no reasons that our local resident cannot get a job in this plant construction and also in this plant operation. Moreover all the financial that Lynas Corporation spent for this construction and the value of job vacancy have is prepared to show that all the statement from their corporation is truth:

This is based from the construction impact. (Lynas, 2010) (p.56) states that AUD $62.154 million was spent across 2009 and 2010 on leasehold land and for Malaysia, it includes two leases expiring in 2099 and 2106 respectively. It is unclear how much of the AUD $62.154 million is for land purchased in Australia or whether this is all for the site in Gebeng, Malaysia. While during the operational impact is :

2.1.3 Aspect of Economic and diplomatic relationship After that the job opportunity, we will see in the aspect of the sosio economic and diplomatic relationship that will occur between this two country , Malaysia and Australia. benefit to the next generation of Malaysians,. Beside that adding that the multiplier effect could result in double or triple the money flow from its initial investment. This is because the whole momentum, the workshops we use, the equipment that needs to be built, maintenance contracts. The economic impact is far in excess of our own investment. Before this China already operation this rare earth material and at present, China's supply up to 97% of world demand for rare earth processed for industrial use. With great power like that, they can restrict supply and thus the prices of electronic products worldwide but China plans to reduce exports of rare earths have been processed on the ground for use in their country even though we all know that they deliberately to exploitation to their monopoly in world markets so that prices would increase. More advantage to the Malaysian is when demand for this material will not be reduced because of the electronic manufacturing industry needs this material. Therefore, the opening of the rare earth processing plant in Malaysia, is a good move to increase the national income. The factory opened in Gebeng, Pahang will be able to produce an export value of RM8 billion per year and is expected to increase from year to year. This could provide a lucrative regular income to our country as factories not many countries have rare earth processing plant. Based on this statement we can see there is a very profit in this investment. Beside the profit that we can get , like what it say before Lynas also prepared a job opportunity with a good salary. So there are not only development in country economic, but also local resident economic by the work that Lyans Corporation offered. In other to strength our relationship diplomatic there are many way that we took, such as exemption from tax in 12 years. Perhaps the biggest surprise to us when we looked at this project was the 12 year tax exemption granted to Lynas in Malaysia. Corporate tax revenue is one of the clear benefits of increased private sector activity in a country. By granting a tax holiday to Lynas, the Malaysian government has given up significant revenue. But the way that ministry take to exmption of tax is not unfair decision. It is because Lynas Malaysia Sdn Bhd has been granted a 12-year tax exemption for pioneer status, (Lynas, 2011a) or in other word it can called win to win situation, where both side will get advantage from this decision. The Ministry of Finance Malaysia lists five different categories for Pioneer Status (PS): 1. 2. 3. 4. 5. Promoted product/activity of national and strategic importance including the MSC status companies and product/activity in the approved linkage programme which achieve world class status. 6. Contract Research and Development company (R&D) This indicates that the Malaysian Government views the Lynas project as one of national and strategic importance. Another reason for the tax exemption may be due to the creation in 2009 of a Special Economic Zone (SEZ) in the East Coast Economic Region (ECER) of Malaysia. Pahang is included in this region and resource-based downstream manufacturing is a focus area for the State, along with Infrastructure & Transport, Tourism, Agriculture and Education, (East Cost Economic Region Development Council, 2011). It is unclear where the two additional years of tax exemption (above and beyond the 10 year maximum for the pioneer status) come from but it may be related to the plant being in the SEZ. From this statement we can see there are many advantage that Malaysia can get from this cooperation with Lynas Corporation and clearly that the decision to build the Lynas Plant is not big mistake in order to maintaining the right of the resident to get what they should get like job opportunity, development in economic and the environment that are clean and also the efficient source so the energy can be save. As a conclusion in economic aspect ,in a global market for rare earths, there seems little reason why locating the LAMP in Malaysia confers any benefits to downstream industries. Industry agglomeration could be achieved through supporting policy measures or through government investment in rare earths projects, in return for guaranteed supply. The latter strategy is exactly what Japan has chosen to do, (Winning, 2011). As Malaysia strives to escape the middle income trap, (Schuman, 2010), it needs to reduce its reliance on investment and job creation based on low cost and low regulation advantages. Malaysia also needs to increase the economic scrutiny of projects that are simply assumed to have economic benefits, when actual benefits may be more rare. For the environmental aspect there are many high precaution have been take to ensure there is no problem and environmental pollution that can effect local resident. Moreover from then job vacancy that is served we can see the person that are eligible to fill the position not just ordinary worker. At least they must be expert in this field and more important they have many years of experienced to ensure that they are really efficient and expert to operate this plant. Most important is we must carefully operate this plant because we do not want waste any money , like happened to Mitsubishi factory that are still in cleanses process and it expenses about 300 million. Science, Technology and Innovation Minister Datuk Seri Maximus Johnity Ongkili also told Parliament last month that RM300 million has already been poured in for two factories in Gebeng that will produce the hydrochloric and sulphuric acid needed to extract the rare earth metals. This project is good as long as many precaution can be taken to ensure it safety all the time.

2.2 Disadvantages of lynas advanced material plant (LAMP)


2.2.1 Environment And Health As we knows that Lynas is the industry that processing the earth rare like thorium. Thorium is one of the radioactive atom that give out ionizing rays. First of all everything involving radioactive metal are very dangerous to human. It can cause cancer to human. One of the cancer is leukemia cancer. This will happen if the factory have problem like leakage and the radioactive materials will spread out and effect the environment around. According to the SMSL(Save Malaysia Stop Lynas) vice chairperson Ismail Abdul Bakar warned that locals could have their livelihoods affected if the dump site destroys their environment. The transportation of huge amount of radioactive waste through the highway, passing kampungs and towns will further spread Lynas toxic waste around, he said. It is unacceptable and totally unjust to expect ordinary citizens to pay such a high price while a foreign company gets to pollute our rivers, our seas and now our water supply and community tourism all tax free! he said. He added that SgLembing was a water catchment area for Kuantan, and its ground water owing to the regions limestone geology risks being contaminated by the radioactive waste dump.

A part from that according to the vice president of Democratic Action Party (DAP) Jenice, when the Lynas factory operate it will produce wastes that cannot be recycle and the effect of its radioactive cannot be measured. She also give an example about the Bukit Merah Asian Rare Earth processing factory have been closed in 1992 because of the death of several people cause by leukemia cancer and abortion. According to her, the death caused cannot be explained but they live near the factory.The factory also does not give any benefit to the citizen but will make them suffer because of the environment is polluted and the water will contaminated and the citizen need to pay for theirs healthy and the environment that have being pollute. The fact that said Lynas is not safe for Malaysia is Akzo Nobel one of the firm that located in Holland that are refuse to supply important resin for Lynas Corporation because of the safety anxiety. According to the New York Times, an engineer that works for the Australia miner at the Gebeng Pahang Industrial through his email, he wrote that Akzo Nobel was withdraw after they have been informed that their resin will be use and equip together with the layer of fiberglass at the wall of the concrete furnace which have a problem involving humidity increases at the floor and the

cracking of wall. News have been reported that resin will be used as glue together with several layer of concrete fiberglass with size like double story where hundreds tones of rare earth with low radiation mix with acid where its able to corrodes more than 93 degree celcius. The firm also reported in past year, they will supply the resin to the Lynas Malaysia if they believe the Lynas is safe. According to the Parti Rakyat Malaysia (PRM) president Dr Rohana Ariffin (pic) said the party supports the anti-Lynas protest as it does not want the same incident that happened in Bukit Merah to happen in Gebeng, Kuantan as well.

"We go for a more constructive, and clean industry. For a more secure future," she said when contacted by Malaysian Digest. She said the reason of the protest is because people are not certain what will happen at the Lynas plant. Besides, she said Australia is such a big country and it is better to build the plant there rather than here. Commenting about incident in Bukit Merah, Rohana told that PRM is one of the first to get lawyers to represent the people there, which took themeight years of court sessions. She said the Bukit Merah plant had to close down in 1994 because of the high cancer rate there."So we don't want such thing to happen in Gebeng as well... and prevention is better than cure," said Rohana. She said during that time, not many young people and people outside of Perak were involved during the protest, and they were also not that aware unlike nowadays. "I don't know why some younger generations were not aware at that time... but now they are more concern," said Rohana. She added that PRM certainly support the anti-Lynas group for the sake of a safer Malaysia and it is good to see young people participating in protesting to determine the future of the country, and their concern for other Malaysians. The incident in Bukit Merah saw a case where the Asian Rare Earth SdnBhd (ARE) plant was built in Bukit Merah, Perak despite being extremely hazardous towards health where series of protests were held only to be fell on deaf ears. The workers and the people in that area started having health problems where they suffered bouts of coughs and colds, and sharp rise in leukaemia, infant deaths, congenital disease and lead poisoning cases. Experts also found the site unsuitable in terms of design and not meeting international standards. The villagers and people, including PRM tried to stop its operations through legal grounds and marches only to end up being blocked by FRU personnels and detained under the Internal Security Act (ISA). In 1994, the plant eventually stopped its operations succumbing to public pressure from both national and international. Besides that the bad effect of Lynas is can cause the radioactive rain. Radioactive rain will happen if only the radionuclide with high concentration is release to the air from the lynas factory.

2.2.2 Political Views The opposition hardly force the government to stop the lynas construction because they have well known that every project under the government always have problem and there will be a corruption. For example in the construction of computers laboratory for primary and secondary school most of the laboratory have a problem and some of the lab was collapse even the lab is new. According to the Dato Seri Tuan Guru Haji Abdul Hadi Awang president of PAS (Parti Islam Se-Malaysia) parliament in Terengganu said that there is a collapse computer laboratory in the Rhu Rendang. A part from that, the destruction of Sultan Mizan Zainal Abidin Stadium in Terengganu proves that the government does not do properly in handling the project.

So the opposition have made a conclusion that even the simple and safe construction handled by the government face many problem and collapse even its new, how about the Lynas, a very complex and need properly handling, because once accident happen, the affect is worse and a big problem will be face by the public around the plant. Many people will be suffer because of the spreading of radioactive from Lynas plant and long time is needed recover because the half-life of the material process in the Lynas plant like thorium is 7340 years. So when accident happen the area around the plant need to be evacuate for along time. So to avoid the high risk from happen, the opposition hardly disagreed with the construction of Lynas.

2.2.3 Citizen Affordable Today our prime minister said that after the Lynas plant completely finish and operate, the citizen that are sick or have a leukemia cancer can get a treatment from hospital. The cost for the cancer treatment is too expensive and mostly people cannot be affordable to pay for the treatment. It is because according to the International Monetary Fund in 2010 the GDP of Malaysia is at 14744.36 US dollar and change to Ringgit Malaysia it become RM44675.41

So to get the average income of Malaysian, per capita means the population per square kilometer, means that the value of GDP is divided by the population per square kilometer. The population per square kilometer in Malaysia according to the U.S Global Health Policy is about 88. So from the calculation we can get income of Malaysian is about RM507.68 it too low and our country still categorized as poor country. So with this income how the citizen can afford to pay the cost of treatment and with the high rate of inflation it is impossible for them to pay the cost. People will be suffering so better Lynas is stop from operating.
