Issue This item presents for Board of Governors approval the Carl D. Perkins Career and Technical Education Improvement Act proposed Expenditure Plan for fiscal year 2012-13.

Background The Carl D. Perkins Vocational and Technical Education Improvement Act was first authorized by the federal government in 1984 and reauthorized in 1998 as the Carl D. Perkins Career and Technical Education Improvement Act of 2006 (Perkins Act). The law extends through 2012-13. The Perkins Act provides an increased focus on the academic achievement of career and technical education students, strengthens the connections between secondary and postsecondary education, and includes requirements for programs of study that link academic and technical content across secondary and postsecondary education. The Perkins Act also improves state and local accountability provisions to ensure continuous program improvement. The United States Department of Education (USDE) determines Californias share of Perkins IV funds, and will provide California an estimated $119 million in fiscal year 2012-13. Federal funds under the Perkins Act flow to the sole state agency, currently the California Department of Education, and are divided between secondary and postsecondary education through a Memorandum of Understanding jointly agreed to by the State Board of Education and the Board of Governors. The Board of Governors approved the state five-year plan in March 2008, and has subsequently approved annual expenditure plans, such as this one being presented. Appendix I shows the proposed 2012-13 allocation for California which is based upon the estimated allocation from the USDE. The proposed budget allocation process of the California Community Colleges requires implementation of the annual Carl D. Perkins Vocational and Technical Education Improvement Act Expenditure Plan by July of each fiscal year, and approval of the award of Perkins IV local assistance funds prior to district receipt of their apportionment. Any individual grant or contract that exceeds

$100,000, or is longer than three years in duration, will be brought to the Board for separate approval.

Recommended Action
That the Board of Governors approves the Carl D. Perkins Career and Technical Education Improvement Act proposed Expenditure Plan for fiscal year 2012-13. It is recommended that the Board of Governors approval permit the Chancellors office to adjust funding levels according to the final allocation amount from the USDE while maintaining compliance with the requirements of the approved California State Plan for the federal Carl D. Perkins Career and Technical Education Improvement Act proposed Expenditure Plan.
