Step 1: COMPLETE the Plaintiffs Claim form. Be sure to get the defendants name right. Explain what happened in detail. Include dates and places. State how much money you want or what goods you want returned. Attach copies of any documents that help your case. Examples are contracts, repair bills and photographs of damaged goods. If you want interest on money you are claiming, ask for it on the claim form. You and the defendant may have a contract that sets an annual interest rate. If so, use that rate. If not, claim the Courts of Justice Act interest rate posted on the Ministry of the Attorney General website at www.attorneygeneral.jus.gov.on.ca. If there is more than one plaintiff or defendant, complete an Additional Parties form (Form 1A) and put it right behind page one of your plaintiff's claim form. You can get the additional parties form from the court office or at the following website: www.ontariocourtforms.on.ca. Step 2: FILE the plaintiffs claim and related documents by taking it or mailing it to the Small Claims Court office. You must also file a copy for every defendant. There is a fee. Cheques or money orders are payable to the Minister of Finance. The fees are listed at the court office and online at: www.attorneygeneral.jus.gov.on.ca. The clerk will return stamped copies of the plaintiff's claim to you. Step 3 SERVE. You must deliver a copy of the filed claim and your documents to each defendant. This is called serving the defendants. There are rules about how this must be done. See the Small Claims Court Guide to Serving Documents at the court office or online at www.attorneygeneral.jus.gov.on.ca. Is it worth it? It is important to consider whether the person or company you are claiming from is likely to be able to pay. If they:

What happened? Where? When? Que sest-il pass? O? Quand? The Plaintiff is the Owner of a 2007 Nissan Versa, which was leased to the Defendant East West Car Rental operating as 2269607 Ontario Ltd. 2. The Plaintiff vehicle was involved in a car accident, and the car rental client had his Insurance Company cover the damages, as well as pay out the remainder of the $15000.00 cost of the vehicle to the Defendant. The amount was $8491.66, paid to East West Car Rental. The Insurance company involved in this transaction was T.D. Insurance. The Claim Number was #6087175. 3. When the Plaintiff contacted the Defendant T.D. Insurance, he was informed that a cheque was made out for $8491.66 to East West Car Rental, and was given to Defendant Number 2, Jagraj Sewnarine, owner of East West Car Rental. The Plaintiff was also told that to try to grieve this payment to T.D. Insurance, and go through the complaint and investigation of the Claim had past the one month time limit to start an Investigation into the Matter. 4. The Plaintiff East West Car and Truck Rental, wants the $8491.66 paid to East West Car Rental and Jagraj Sewnarine, defendants, returned to the Plaintiff. The Plaintiff is the owner of the vehicle. The defendant presented a copy of the ownership to T.D. Insurance, and was given the sum of the value of the vehicle. This is an alleged fraud as well, to the Plaintiff, and rightful owner of the Nissan Versa, leased to the defendant. 5. T.D. Insurance had no authority to release the amount of $8491.66 to the defendant East West Car Rental, nor to give a cheque to them with East West Car Rental on the face of the cheque, as the Owner of the vehicles company name is East West Car and Truck Rental. T.D. should not have released the monies to Jagraj Sewnarine, owner of East West Car Rental as he is the one who leased the Nissan Versa from Dinesh Gathani, owner of the Nissan Versa. T.D. is liable also for the $8491.66 owed to the rightful owner of the Nissan Versa, Dinesh Gathani, owner of East West Car and Truck Rental. 6. The Plaintiff seeks $8491.66 and court costs, legal fees, pre and post interest and any and all other from the defendants, through this Honorable Court, which seems just.
