Inthecaseofanaudiovisualrecording,theproduceroftherecording,iethenatural personorlegalentitythattakestheinitiativeandassumeresponsibilityforthefixings ofaplaneorasequenceofimages,withorwithoutsound. vi. Inthecaseofabroadcastoratransmission,thebroadcaster. vii.Inthecaseandamerephotograph,thepersonwhohasmakeit. viii.Inthecaseofotherprotectedbyintellectualpropertylegislation,thepersonwho broughtit. e. Shallbeconsideredderivativeworksofthoseworkscreatedfromthelicensed,suchas translationsandadaptations,revisions,updatesandannotations,thecompilations,

summariesandexcerpts,musicalarrangementand,ingeneral,anytransformationsofa literarywork,Artisticorscientificwork.Foravoidanceofdoubt,iftheworkisamusical compositionorsoundrecording,thetimesynchronizationoftheworkwithamovingimage (synching)willberegardedasaderivativeworkforthepurposesofthislicense. f. Willbeconsideredascollectionsofworksoutsidethecompilationofdataorothermaterials suchasanthologiesanddatabasesfortheselectionandarrangementoftheircontents constituteintellectualcreations.Themereincorporationofaworkinacollectionwillnot resultinaderivativeforthepurposesofthislicense. g. Theelementsofthelicensearethemainfeaturesofthelicenseasselectedbythelicensor andindicatedinthetitleofthislicense:Attribution,NonComercial,ShareAlike. o. Anequivalentlicenseist: i. Ifyoureproduce,distributeorpubliclyannouncedtheplayorperformance,acollectionthat incorporatesoranyderivativework,mustkeepintactallnoticesonintellectualpropertyand indicate,inareasonablemanneraccordingtothemediumormeansthatyouareusing: i. Theauthor'soriginalname,orpseudonymifapplicable,aswellastheoriginal holder,ifitisprovided. ii. Thenamesofthoseparties(eginstitution,publishing,magazine)thattheoriginal holderand/orlicensordesignatedtoberecognizedinthelegalnotice,termsofuse, oranyotherreasonableway. iii. Thisrecognitionmustbedoneinareasonablemanner.Inthecaseofaderivativeworkor incorporationintoacollectionofthesecreditsmustappearinatleastoneplacewherethey areforotherauthorsorownersandcomparabletothem.Foravoidanceofdoubt,thecredits requiredinthissectionshallbeusedonlyforpurposesofattributionoftheworkorthe provisioninthemannerspecifiedabove.Withoutpriorwrittenpermission,youcannotsay, nortoimplyanyconnectionimplicitlyorexplicitly,sponsorshiporapprovalbytheoriginal holder,thelicensorand/orthepartiesrecognizedtoyouortoyouruseoftheworkorthe provision. e. Theexclusiverighttocollect,bothindividuallyandthroughacollectingrights,any compensationarisingfromactsofexploitationoftheworkoryoumakethatarenot subjecttothislicenseassetoutinparagraph4.c. 5.Representations,WarrantiesandDisclaimer UNLESSOTHERWISEMUTUALLYAGREEDTOBYTHEPARTIESINWRITINGANDTO THEFULLESTEXTENTPERMITTEDBYAPPLICABLELAW,LICENSOROFFERSTHE WORKORPROVISIONASISANDMAKESNOREPRESENTATIONSORWARRANTIES OFANYKINDCONCERNINGTHEWORK,EXPRESS,IMPLIED,STATUTORYOR OTHERWISE,INCLUDING,WITHOUTLIMITATION,WARRANTIESOFTITLE, MERCHANTABILITY,FITNESSFORAPARTICULARPURPOSE,NONINFRINGEMENT,OR THEABSENCEOFLATENTOROTHERDEFECTS,ACCURACY,ORTHEPRESENCEOF ABSENCEOFERRORS,WHETHERORNOTDISCOVERABLE.SOMEJURISDICTIONSDO NOTALLOWTHEEXCLUSIONOFIMPLIEDWARRANTIES,SOTHISEXCLUSIONMAY NOTAPPLYTOYOU. 6.LimitationonLiability.EXCEPTTOTHEEXTENTREQUIREDBYAPPLICABLELAW,IN

Thislicenseandthegrantingofrightscontainingterminateautomaticallyintheeventofany breachofthetermsofthesame.Individualsorentitieswhohavereceivedfromyouor collectionsderivativeworksunderthislicense,however,willnotseetheirlicenses terminatedprovidedsuchindividualsorentitiesremaininfullcompliancewiththislicense. Sections1,2,5,6,7and8remainvaliddespiteanyterminationofthislicense. b.
