IN RE: EXPARTE PETITION TO INCORPORATE THE VILLAGE OF BROWNSBORO

The undersigned, through counsel, being property owners within the territory herein proposed for incorporation, hereby petition the above-styled Court to enter an order incorporating the Village of Brownsboro as a municipal corporation of the sixth class within the Commonwealth of Kentucky, pursuant to the provisions of KRS 81.050. I. JURISDICTION 1. The proposed territory lies within the physical boundaries of Oldham County, Kentucky. 2. Oldham Circuit Court has jurisdiction to entertain this statutory cause of action. II. SIGNATURES AND ADDRESSESES 1. This petition contains the signatures and addresses of a number of real property owners who own property with a value exceeding two-thirds (2/3) of the assessed value of all real property in the area to be incorporated. 2. The signatures and addresses are attached hereto as Exhibit A. III. BOUNDARIES PROPOSED AND NUMBER OF RESIDENTS 1. A description of the territory to be incorporated and boundaries thereof is set out in Exhibit B. 2. There are 433 residents in the proposed territory. See Exhibit C. IV. MAP OF PROPOSED TERRITORY 1. An accurate map of the area to be incorporated is attached hereto as Exhibit D.

REASONS FOR INCORPORATION AND SERVICES SOUGHT 1. Petitioners seek incorporation in furtherance of a validly recognized public policy of self-governance. 2. Incorporation provides the community with increased freedoms to shape its own destiny. 3. Incorporation places local policy decisions within the competent hands of the local citizenry. 4. Incorporation will increase local control and self determination over pressing issues facing the proposed area. 5. Upon incorporation the City will provide or enhance the following services: snow removal, road maintenance, public recreation activities, police protection, and trash collection.

EXISTING FACILITIES AND SERVICES WITHIN THE PROPOSED TERRITORY 1. The following facilities and services presently exist within the proposed territory: road maintenance, police protection, and fire protection.

FORM OF GOVERNMENT 1. The city of Brownsboro, upon incorporation will operate under the commission plan of government as set out in KRS 83A.140. The government will be composed of five (5) elected officials: a mayor, and four (4) commissioners. 2. The elected officials will have duties pursuant to the laws of the Commonwealth of Kentucky.

WHEREFORE, the Petitioners pray that: 1. The Village of Brownsboro be established to include the territory described herein. 2. The Court, upon recommendation of the Petitioners, appoint persons to serve as officers of the newly formed municipality. 3. The Court designate the Village of Brownsboro as a City of the Sixth (6th) population class. 4. The Court docket this case for hearing not less than 20 days from the filing of this Petition. 5. The Court direct the Clerk of the Court to certify a copy of the judgment entered herein to the Secretary of State of the Commonwealth of Kentucky, not later than ten (10) days after the entry of such judgment.
