Petition U/S 39 of the CR.P.C. the humble petition on behalf of the petitioner above named most respectfully begs to state as follows :-

That the petitioner is a chartered accountant running his individual business of accountancy at bistupur in the name and style of akash & associates. That O.P members having fallen in need of some job relating to the account matter entrusted the petitioner for the same That due to some obvious reasons the job entrusted upon the petitioner could not be materialized and ultimately the petitioner made himself agree to refund the entire amount already received by him from the opp. Party members. That accordingly, by way of security of repayment of the money, the O.P members obtained a blank cheque duly signed by the petitioner with the assuerence that the said cheque will be returned immediately when the petitioner will repay the entire amount taken by him from the O.P Members. That accordingly,the petitioner went on making repayment of the money to the O.P members in easy installments and ultimately the entire amount has been liquidated in full and final satisfaction of the dues repayable by him to the O.P members. That as agreed and assured by the O.P members the petitioner asked the O.P members to return back the cheque already kept with them by way of security with blank signature of the petitioner but the O.P members

with their ulterior motive look adopted illatory practice and on one pretext or either they used to difer the matter for one day to other and ultimately the O.P members became annoyed for no reason started misbehaving with the petitioner. The O.P members, in course of their aforesaid evil act are now regularly giving out threats that they will implicate the petitioner in certain false criminal cases of heinous nature. They also openly gave out that they will avail of the advantage of having possession of the signed blank cheque of the petitioner with them and by filling the same with arbitrary amount they will put the petitioner in unnecessary harassment.

That therefore, petitioner has got every apprehension of the fact that the O.P members by their evil acts may implicate the petitioner in certain false criminal cases. Hence this petition by way of prior intimation to this honorable court for future reference.

It is therefore prayed that this Petition may kindly be registered And the same may kindly be kept on record for future reference.

For this act of kindness the petitioner shall ever pray.
