En la Gaceta Oficial N 39.945 de fecha 15 de junio de 2012, fue publicado el Decreto N 9.

041 mediante el cual se dicta el Decreto con Rango, Valor y Fuerza de Ley Orgnica de Bienes Pblicos. El objeto de la presente ley es establecer las normas que regulan el mbito, organizacin, atribuciones y funcionamiento del Sistema de Bienes Pblicos, como parte integrante del Sistema de Administracin Financiera del Estado. Las normas previstas en este Decreto con las normas reglamentarias y aquellas que emita la Superintendencia de Bienes Pblicos, son de estricto cumplimiento por las entidades que conforman el Sistema Nacional de Bienes Pblicos, as como para las personas naturales o jurdicas que custodien o ejerzan algn derecho sobre un Bien Pblico, con las excepciones de Ley, dejando a salvo las competencias y autonoma atribuidas en la materia por la Constitucin de la Repblica y las leyes correspondientes. Establece el Decreto que constituyen bienes pblicos los siguientes bienes: 1. Los bienes muebles e inmuebles, ttulos valor, acciones, cuotas o participaciones en sociedades y dems derechos, de dominio pblico o de dominio privado, que hayan adquirido o adquieran los rganos y entes que conforman el Sector Pblico, independientemente del nivel de gobierno al que pertenezcan. Los bienes, mercancas o efectos, que se encuentran en el territorio de la Repblica y que no tienen dueo. Los bienes muebles o inmuebles, ttulos valores, acciones, cuotas o participaciones en sociedades y dems derechos provenientes de las herencias yacentes. Las mercancas que se declaren abandonadas. Los bienes, mercancas o efectos que sean objeto de una medida de comiso firme mediante sentencia firme o procedimiento de Ley sean puestos a la orden del Tesoro Nacional.

Decree No.9,041, which provides for the Decree with Rank, Value and Force of Law of Public Property, was published in In Official Gazette No.39,945 of June 15, 2012. The purpose of this Law is to establish the rules governing the realm, organization, powers and operations of the Public Property System, as part of the States Financial Management System. The norms provided in this Decree, jointly with the regulations, and those issued by the Office of the Superintendent of Public Goods, are imposed on the entities ascribed to the National System of Public Goods, as well as on individuals and bodies corporate that keep legal custody or exercise any right on Public Property, with the exceptions specified by law, and those related to the competence and autonomy vested by the Constitution and applicable laws. Pursuant to this Decree, the following are deemed public property: 1. Movable and immovable property, securities, stocks, quotas or shares in companies and other rights, of either private or public interest, that have been or shall be acquired by public sector agencies and entities, regardless of the government level to which they belong. Property, goods or effects located in the Venezuelan territory with no owner. Real estate or personal property, securities, stocks, quotas or shares in companies and other rights from unsettled estates. Property declared abandoned by customs. Property, goods or effects subject to seizure through final judgment or legal proceeding, and made available to the National Treasury.
