WHEREAS: Inaccordancewitharticle18.5eofthePanamaCanalAuthorityOrganicLaw,theBoardof Directorsisresponsibleforapprovingtheregulationsregardingnavigation,marinetraffic control,pilotage,andmattersconcerningnavigationintheCanal. ThedraftregulationsontheforegoingsubjectshavebeensubmittedbytheAdministrator,in exerciseoftheauthoritygrantedtohimbyarticle25.6oftheabovementionedlaw.

AGREES:

ThefollowingregulationsonnavigationinCanalwatersareadopted:

REGULATIONSONNAVIGATIONINPANAMACANALWATERS

ChapterI GeneralProvisions SectionOne Generalprovisionsanddefinitions Article1: AllactivitiesrelatedtonavigationofvesselsinwatersthatarewithintheCanal OperationCompatibilityArea,asdescribedintheAnnexofthePanamaCanalAuthorityOrganic Law,shallbecontrolledbythisregulation. TheAdministrator,PanamaCanalAuthority,shallapplythisregulationthroughthe administrativeunitsdesignatedforsuchpurpose. Article2: VesselsshallkeepaboardacopyoftheregulationsregardingnavigationinCanal waters.

1 Article 3: The Canal Authority shall establish the requirements and conditions of stability, list, trim, draft, cargo, hull, machinery, and of any other nature, including boardingandsanitationfacilities,toallowtransitofthevesselandtoensureitssafety,as wellasthatofCanalpersonnelandstructures.

TheAuthoritymaydenyavesselstransitifanyoftheestablishedrequirementsisnotmet. However,inthosecasesinwhichtheAuthoritydeterminesthattheshipmaytransitsafelyusing additionalresourcesprovidedbytheAuthority,itmayauthorizethetransit,providedthevessel assumesandpaysthecorrespondingadditionalcharges. Article4: Anyvesselthatfailstomeettherequirementsforanormaltransit,mayonlytransit withtheAuthoritysexpressauthorization,providedthemasterofthevesselsignsadocument undertakingtoreleasefromallliabilityandtoindemnifythePanamaCanalAuthorityandthe RepublicofPanamaforanydamagessustained.Thevesselisalsoliableforanydamages sustainedbythirdparties,arisingasaresultoftheabove. Failuretocomplywiththeaboverequirementshallnotrelievethevessel,herowners,orany otherpersonhavinganinterestinher,fromliabilityincurredasaresultofanydamages sustained.
2 Article4.A: TheAuthoritymaydenythedepartureofanyvesselwhichhascauseddamagesto theCanal,itspersonnel,equipment,propertyorfacilities,orwhichviolatesanyCanalnavigation safetyrule,untilsuchtimeasshehaspostedasuitablepaymentwarranty,totheCanal Administrationssatisfaction.

Toensureenforcementofthisrule,theAuthoritymayrequiretheassistanceofthePublicForce. Thecostofthisassistanceshallbechargedtothevessel,andshallbeincludedinthewarranty. Article5: EmbarkingordisembarkingavesselinCanalwaterswithouttheauthorizationofthe Authority,isarisktonavigationsafety.Theseactsshallbepunishedinaccordancewitharticle 127oftheOrganicLaw,andtheAuthorityshallnotbeliableforanyresultingpersonalinjuries, ordamagestovesselsorproperty. Article6: Failuretocomplywithanyoftherequirementsorconditionsestablishedbythis regulation,shallbereasontodenyanyclaimsfordelaysinnavigation. Article7: Vesselsaresubjecttoinspection,toensurecompliancewithandapplicationofthis regulationandtheregulationspertainingtoSafety,AdmeasurementandSanitationand PreventionofCommunicableDiseases. Article8: Thewords,expressions,andabbreviationsusedinthisRegulationshallhavethe followingmeaningandscope: PanamaCanalWaters. ReferstoallwaterswithintheCanalOperationCompatibilityArea.

CanalOperationCompatibilityArea. Thegeographicareadescribedinitem aoftheAnnex, includingitslandsandwaters,whereonlyactivitiescompatiblewiththeoperationoftheCanal maybecarriedout. Vessel.Everydescriptionofwatercraft,includingnondisplacementcraftandseaplanes,usedor capableofbeingusedasameansoftransportationonwater. Powerdrivenvessel.Anyvesselpropelledbymachinery. SailingVessel. Anyvesselundersail,providedthatpropellingmachinery,iffitted,isnotbeing used. Vesselengagedinfishing. Anyvesselfishingwith nets,lines,trawlsorotherfishingapparatus, whichrestrictmaneuverability,butdoesnotincludeavesselfishingwithtrollinglinesorother fishingapparatuswhichdonotrestrictmaneuverability. Seaplane.Anyaircraftdesignedtomaneuveronthewater. Vesselnotundercommand. Avesselwhich,throughsomeexceptionalcircumstance,isunable tomaneuverasrequired,andisunabletokeepoutofthewayofanothervessel. Vesselrestrictedinherabilitytomaneuver.Avesselwhichfromthenatureofherworkis restrictedinherabilitytomaneuverasrequired,andisunabletokeepoutofthewayofanother vessel.(Seeitem boftheAnnex.) Underway. Avesselwhosecharacterorconditionofthecargo,hull,ormachineryis suchastoendangertheenvironment,thequalityofthewater,orthestructurespertainingtothe

Canal,orwhichmightrenderthevesselliabletoobstructtheCanal,orwhosedraft,atanypart ofthevessel,exceedsthemaximumallowabledraftintheCanal,asdesignatedbytheAuthority. RulesforthePreventionofCollisionsinthePanamaCanal. Theprovisionspertainingtothis matter,ofwhichthescopeofapplicationisdefinedinRule1ofArticle108oftheAnnex. RulesoftheInternationalRegulationsforPreventingCollisionsatSea,1972(72COLREGS). Internationalregulationspertainingtothismatter,thatshallapplyinPanamaCanalWaters outsideoftheboundarylinesdescribedabove. Bookedfortransit. CertificateofFitness. Acertificateissuedbyoronbehalfofanationalgovernment,in accordancewiththeBulkChemicalCodeortheGasCarrierCode,ortheInternationalGas CarrierCode,certifyingthattheconstructionandequipmentofthevesselareadequateforsafe transportationofthespecifieddangeroussubstancesinthevessel. IOPPCertificate. AnIMOInternationalOilPollutionPreventionCertificate,certifyingthatthe shiphasbeensurveyedinaccordancewithregulationsofMARPOL73/78. Packageddangerousgoods. Anydangerouscargocontainedinareceptacle,portabletank, container,orvehicle.Thetermincludesanemptyreceptacle,portabletankortankvehicle whichhasbeenpreviouslyusedforthecarriageofadangeroussubstance,unlesssuchreceptacle ortankhasbeencleanedanddried,orwhenthenatureoftheformercontentspermitstransport withsafety. NavigationBridge. Thehighestclosedspaceofthevesselssuperstructures,whichallowsfor completevisibilityallaroundthevesselwiththeleastinterference,andwhichcontainsallthe instrumentsrequiredfornavigation,aswellasthemachineryandsteeringcontrols,andfrom whichthecrewandthepilotscontrolthevessel. Marpol73/78. TheIMOInternationalConventionforthePreventionofPollutionFromShips, 1973,asmodifiedbytheProtocolof1978.AnyannextheretoappliestovesselsinPanama CanalWatersbeginningonthedateonwhichtheannexentersintoforce. SectionTwo Riskpreventionandcontrol Article9: TheAuthorityshallhavetheauthorityandresponsibilityforcoordinatingthe preventionandcontrolofanydangerousevents,acts,andaccidentswhichmayoccurduring navigationinCanalwaters,forthepurposeofsafeguardingCanaloperations,includingthe following: 1. Disasters,principallyspillsofoilandothernoxioussubstances. 2. Eliminationofwaste. 3. Jettison,principallyoftheindustrialtype 4. Transitofdangerousgoods 5. Ballastmanagement. Article10: TheAuthorityshallhavetheauthoritytotakechargeofandrespondtoallvessel emergenciesinCanalwaters,aswellastoadoptthepertinentdecisionsincaseanyeventofthis natureoccursinthearea. Itshallalsoberesponsibleformaintainingcommunicationsandnotifyingthepertinent authorities,andofcoordinatingtheworkofanypublicorprivateorganizationsthatmay participateintheoperations. Article11: Vesselsshallinformofanyincidentthatinterferesorhinderssafenavigationin Canalwaters.

SectionThree Scheduling,booking,order,andpreferenceintransit Article12: TheAuthorityshalladoptavesseltransitschedulewhichshallincludeatransit reservationsystemtoreservetransitslotsbeforearrivingtotheCanalandtostarttransitona datepreviouslyestablished,providedthevesselhascompliedwiththeestablishedrequirements. Article13: Thetransitscheduleandorderofpreferenceestablishedinaccordancewiththe reservationsystemshallnotaffecttheprovisionsofArticleVIoftheTreatyConcerningthe PermanentNeutralityandOperationofthePanamaCanal,inrelationtotherightofvesselsof warorauxiliaryvesselsoftheRepublicofPanamaortheUnitedStatesofAmericatotransitthe PanamaCanalexpeditiously,underthetermsandlimitationsagreedtherein.

Article14: Thespecificorderoftransitsshallbeestablisheddailyforall typesofvessels, whetherbookedorregulartransits. Article15: Canalusersshallhaveatotalof21reservedtransitslotsavailabledaily,distributed amongthebookingperiodsestablishedbytheAuthority.Thetotalnumberofavailablereserved transitslotsmaybeadjustedcommensuratewiththesafeandefficientoperationoftheCanal. Article16: 3Transitslotreservationsshallbemadeonthebasisofalistofchargespublishedby theAuthorityandrequestsforslotreservationsshallbemadeattheperiodsestablishedbythe Administration consonantwiththesafe,efficientandprofitableoperationoftheCanal. Article17: AvesselbookedfortransitwillbedeemedtohavetransitedtheCanalonits reservedtransitdateifthevessel complieswiththeconditionsestablishedintheAnnex. Article18: RegulartransitshallbeonthedateandintheorderdeterminedbytheAuthority, andwillequalorexceedonehalfofthetotalnumberofdailyvesseltransits. Article19: Commercialpassengervesselsshallbegivenpreferenceoverothervesselsin transiting,providedtheyhavebeenbooked,andtotheextentthatsuchtreatmentdoesnotimpair safeandefficientoperationoftheCanal. SectionSeven Signalsystem Article66: Allvesselsshallhaveasignalsystemingoodoperatingconditionsbetweenthe navigationbridgeandtheengineroom. Failuretocomplywiththeabovemaycausedelayintransiting.

SectionEight Engineorderstoberecorded Article67: Allvesselsarerequiredtohaveasystemtorecordeveryengineordertransmittedto theengineroom,andanotherrecordoftheordersreceivedintheengineroom,asindicatedinthe Annex.

SectionNine Provisionofmeals Article68: VesselsshallfurnishmealswithoutchargetoAuthoritypersonnelwhoseassignment willrequirethemtobeaboardthevesselforfourormorehours. Ifavesselisunabletoprovidemeals,orifsuchmealsareunsuitable,theymaybefurnishedby theAuthorityattheexpenseofthevessel.

SectionTen Sanitaryfacilities Article69: VesselsshouldhavesuitablesanitaryfacilitiesforAuthoritypersonnelaboard. Ifatransitingshipdoesnothaveadequatesanitaryfacilities,theintervalforwhicheachpilotis assignedwillbeshortened,withtheconsequentialdelay,particularlyinthecaseofvessels whoseprogressisslow.

SectionEleven Disablingofengines Article70: NovesselatanyAuthoritydockormooringshallhaveitsenginesdisabledor otherwiserenderedinoperative,exceptwhenexpresslyauthorizedbytheAuthority.

SectionTwelve Emissionofsparks,smoke,ornoxiousgases Article71: VesselsinCanalwatersshalltakeallnecessaryprecautionstoavoidtheissuanceof sparks,excessivesmoke,ornoxiousgases.Vesselsthatdonotcomplywiththisprovisionmay bemooredoranchoreduntilthesituationisundercontrol.

Vesselsshallbeheldliableforanydamagessustainedbecauseoffailuretocomplywiththe above.

SectionThirteen Deckloadcargo Article72: Avesselcarryingadeckloadshallhaveitstowedsafely,arrangedastopreventany shiftingordisplacement,andsufficientlycleartopermitsafeaccesstoworkingspacesby personnel,inaccordancewiththeprovisionssetforthintheannex. Article73: Vesselsmaytransitwithdeckcargoprotrudingoveronesideattheirownriskin accordancewiththeprovisionsofarticle4,if: 1. Deckcargodoesnotexceed4.57meters(15feet)and 2.Ifthemaximumbeam,includingprotrusions,doesnotexceed25.9meters(85feet).

Article77: Nofishingnetsorotherobstructionsshallbeplacedinnavigablewatersofthe Canal. Article78: Fishingboatsandsmallcraftshallnotanchorforthepurposeoffishing,norhaul netsortrawlsintheanchoragesornavigablechannelsoftheCanal. Article79: Nolines,pipes,orothertypeofobjectsshallbepassedacrossanychannelor anchorage,soastoobstructthepassageofvessels,exceptunderpreviousauthorization.

SectionSixteen Nonselfpropelledvessels Article80: Nonselfpropelledvessels(deadtows),otherthancompositeunits,shallrequire advancepermissionforinitialtransit.Thispermissionshallbegrantedonacasebycasebasis. Article140: ThevesselsreferredtointheforegoingarticlemustfurnishtheAuthoritycopyof thecargoradiationsafetyinspection,incompliancewiththeClass7IMDGCoderequirements, assoonastheinspectioniscompleted,andbeforetheradioactiveshipmentisloaded. Article141: Vesselscarryinglowspecificactivityorlowlevelsolidradioactivesubstances,as wellasradioactivesubstancescarriedinlimitedquantities,shall providenolessthan48hour advanceinformation,asrequiredunderarticle30oftheannex,includingthespecificsrequired bytheIMDGCodesetforthintheannex. ThePCSOPEPshallbeprovidednolessthan96hoursinadvanceofthevesselsarrivalinCanal watersforitsinitialreview,andshallbepreparedasspecifiedintheannex. TheAuthoritymayinformthevesselconcerningitscommentsonthePCSOPEPpriortoorupon arrivalofthevesselinCanalwaters. Article 141 B: Inthe event of an oil spill in Canal waters,the vessel involved shall have the primaryresponsibilityofimplementingitsPCSOPEPimmediately,asspecifiedintheannex. Notwithstandingtheabove,theAuthoritymayintervenetomitigatetheaccidentattheexpense ofthevessel,itsowner,operator,orpartythatgeneratedthespilledcargoorsubstanceand,atits discretion, shall instruct the vessel, through its master or officer aboard, or the representative whohasidentifiedhimselfassuch,tonotifytheoilspillresponseorganization(OSRO)hiredby the vessel, owner, or operator of the spilled cargo or substance, to intervene immediately to mitigatetheemergencyandconductthenecessarycleanuptasks. Article 141 D: Failure to comply with the rules herein shall constitute an administrative violationofCanalnavigationsafetyrules,punishableundertheprovisionsoftheOrganicLawof thePanamaCanalAuthorityandChapterXofthisregulation. ChapterX Offenses,Sanctions,andSanctioningProceedings SectionOne Generalprovisions Article142: Anegligentactoromissioninviolationoftheprovisionsonthesafetyof navigationinCanalwatersoftheOrganiclawandtheAuthorityregulations,relatingtotheuse oftheCanalanditsfacilities,trafficadministration,andpollutionpreventioninCanalwaters, shallbeconsideredanadministrativeoffense. Theprovisionsreferredtointheforegoingparagraphincludeanyadditionalregulations, proceduremanuals,prohibitions,orders,instructions,andauthorizationsissuedbytheAuthority, withthepurposeofenforcingorapplyingtheregulations.

Article143: LiabilityforviolationstothesafetyofnavigationinCanalWatersarisesfrom failuretocomply,bytheowners,operators,masters,mates,crewmembers,andpassengersofa vessel,withAuthorityprovisions,rules,orders,orauthorizations. Inthesecases,themasterorofficerincommandofthevesselshallbeliableinsolidumforany offenseswiththevesselownerandoperator. Article144: Naturalorjuridical persons,nationalorforeignnotdirectlyinvolvedwiththe vesselsoperationandtransit,shallbeequallyliablefortheconductsdescribedintheforegoing article. Inthesecases,whenmembersorrepresentativesofajuridicalpersoncommitoffenses attributabletothatjuridicalperson,thememberorrepresentativeandthejuridicalpersonshall beliableinsolidumforanyoffensescommitted. Article145: SanctionsshallbeimposedbytheAdministratoroftheAuthorityorhisdesignee. Offenses Article148: Offensesareclassifiedasnotserious,serious,andveryserious,accordingtothe magnitudeofthedamage,risk,ordangercaused,orothercircumstancessurroundingthefacts. Article149: Offensesrelatedtomaritimesafetyandpollutionareconsideredviolationsofthe provisionsonsafetyofnavigationinCanalWaters. MaritimeSafetyOffenses 1. AnyparticularactivitynotauthorizedbytheAuthority,whichinanywayimpairs, delays,stops,obstructsorpreventsnavigationoroperationofvesselsinCanalwaters,or theoperationofthelocks,orwhichbyanymeansthreatenssuchactivities. Failuretocomplywiththeregulations,orders,orinstructionsissuedbytheAuthorityin relationtomaritimeoperationsinCanalareas. Failuretocomplywiththeregulationsoncargoloadingandunloading,orembarkingor disembarkingofpassengers. Failuretocomplywithanyprovisionsorinstructionsonshipping,handling,orstowage ofdangerouscargoconcealmentofdangerouscargoorconcealmentofthecargos dangerousnature. Article154: Iftheallegedoffenderdoesnotjustifyhisactions,confessestohavingcommitted theoffense,andstatesthatheagreestoabidebythepunishment,theAuthorityshallimmediately assesstheappropriatefine,reducingitbyonethird.

SectionFour Openingoftheproceedings Article155: ThesanctioningproceedingshallbeinitiatedbytheAdministrationsuasponte,asa resultofasuperiororder,atthejustifiedrequestofanothergovernmentagency,orinresponseto adenunciation. Thesuperiororder,thejustifiedrequest,ordenunciationshallspecify,totheextentpossible,the personorpersonspresumablyresponsibleforcommittingtheoffensetheconductorfactsthat constitutetheoffenseanditslegaltypificationandtheplace,date,orperiodoftimeinwhichthe factstookplace. Article156: Preliminaryinquiriesmaybecarriedoutpriortoformalinitiationofthe proceedings,todetermineifthecircumstanceswarranttheproceedings. Iftheoffenseiscommittedbyanaturalpersonwhoisamemberorarepresentativeofajuridical person,andtheoffenseisattributabletothatjuridicalperson,thechargesshallbemadeagainst andnotifiedtoboth. Article160: TheAdministrationshallbeginatitsowninitiativealltheproceedingsaccordingto theprinciplesofpromptnessandtransparency,throughitsconclusion.Failuretocomplywith thisprovisionshallresultindisciplinaryactionagainstthetransgressingpersonnel.

SectionFive Investigation Article161: Therequiredinvestigationsforthedetermination,knowledge,andverificationof thefactsorthedataonwhichthedecisionshallbebased,sothattheAdministrationmayarrive ataninformeddecision,shallbecarriedoutwithoutprejudicetotherightofthealleged offenderstorequestanyactionsthatmayrequiretheinterventionoftheAdministration. SectionThree Scheduling,booking,order,andpreferenceintransit Article16: 9Repealed Article17: AvesselbookedfortransitwillbedeemedtohavetransitedtheCanalonits reservedtransitdateifthevesselarrivesatthefirstsetoflocksineitheroftheCanalterminals before2400hoursthatsamedayanditsintranstittime(ITT)is18hoursorless.ITTstarts whenthevesselentersthefirstsetoflocksineitheroftheterminalsoftheCanalandendswhen thevesselexitsthelastsetoflocksattheoppositeterminal.Bookingfeesshallnotbeappliedif, throughnofaultofthevessel,andasdeterminedbyCanalauthorities,ITTexceeds18hours, exceptthatthisprovisionshallnotapplyinthecaseofturnaroundtransits,wherethevessel entersandexitsthesamesetoflocks,ineitheroftheCanalterminals.

Article23: TheAuthorityshallcancelthereservedtransitslotandassessapenaltyfee equivalenttothebookingfee,ortotheamountestablishedintheScheduleofTariffs,whichever isgreater,inthefollowingcases: 1. Whenavesselwithtransitrestrictions(i.e.,onewaytransitin theCut,daylighttransitinthe Cut)arrivesataCanalterminalafter0200hoursonthedaythevesselisscheduledfortransit. 2. WhenavesselwithouttransitrestrictionsarrivesataCanalterminalafter1400hoursonthe daythevesselisscheduledfortransit. 3. Whenavesselarrivesontime,butcannot,orbydecisionofheroperator,doesnottransitas scheduled,notwithstandingtheAuthorityswillingnesstoproceedwiththetransit. FailuretoprovidetheaccurateandcompleteinformationrequiredbytheAuthoritywhena transitreservationisrequested,shallbecausefordenialoftherequestorcancellationofthe transitslot. Exemptingcircumstances: Acceptableproofthatthelatearrivalwasduetoamedicalorhumanitarianemergencywhich occurredduringthevoyage,anactofGod,extraordinaryphenomenon,oramayorevent,which couldnotreasonablyhavebeenanticipated. Article24: Aregularorreservedtransitmayberescheduledifthetransitslotiscancelled,in thefollowingcases: 1. IfforanyreasontheAuthoritycancelsthetransitofavesselwithatransitreservationthatis otherwisereadytoproceedasscheduled,or 2. IfforanyreasontheAuthoritydelaysthetransitofavesselwithatransitreservation,tothe pointwhereitmaypreventthevesselsarrivalontimeforasecondtransitonalaterdate,that hasbeenreservedbeforethedelayofthefirsttransitoccurred.

ChapterII RadioCommunications Article29: Thefollowingvesselsshallcomplywiththeradioequipmentrequirementsofthis Chapter: 1. Powerdrivenvesselsof300grosstonsorover. 2. Powerdrivenvesselsof100grosstonsorover,carryingoneormorepassengersforhire. 3. Powerdrivenvesselsof100grosstonsorover,carryingdangerouscargo.

4. Commercialtowingvesselsof8meters(26feet)inlengthorover. Avesselofanyofthetypesdescribedaboveshallbeequippedwitharadiosystemwhichcanbe operatedfromthenavigationbridge,andwhichcanbeusedtocommunicateonthefollowing channelsinthe156162MHzfrequencyband: 1. Channel12,156.600MHz 2. Channel13,156.650MHz 3. Channel16,156.800MHz Further,vesselswhichhavenotifiedtheAuthoritythattheyarereadytotransitorotherwise navigateinCanalwatersandrequireaCanalpilot,shall,untilapilotboardsthevessel,maintain acontinuouswatchonChannel12,andawaitinstructions.Channel12shallbeusedfor notificationtovesselsoftheirtransittime,andforadvisoryharborcontrolcommunicationin LimonBayandFlamencoIsland. WhileinCanalwaters,suchvesselsshalluseChannel13forbridgetobridgenavigational communicationsonly.Channel13shalluseaonewattmaximumpower,exceptthatin emergenciesmorepowermaybeused.WhensuchvesselshaveaCanalpilotaboard,Channel 13maybeusedonlybythepilotorathisdirection,fornavigationalcommunications.The signalstationsonFlamencoIslandandinCristobalmaybecalledonChannel12or16.Channel 16,however,isreservedforcasesofdistress,urgency,safety,andcallingonly.Onceradio contactisestablishedonChannel16,anotherchannelshallbeselectedforroutine communications. Article36: Coordinationforvesselanchorage: AtlanticEntrance: 1. Communications: VesselsapproachingtheAtlanticentranceshallmaintainacontinuouswatchonChannel12 VHFuntilanAuthoritypilotassumescontrolofthevesselsnavigation,andshallcommunicate withtheCristobalsignalstationatleastsixmilesbeforeenteringthebreakwater.Channel12 willbeusedtonotifyvesselsoftheirtransittimeandforharbortrafficcoordinationwithin LimonBay.Channel13willbeusedwhenvesselsareunderwayinCanalwaters,exclusively forbridgetobridgecommunication. 2. Article43: AnyvesselprovisionallyadmittedtotheCanalmustcomplywiththefollowing requirements,priortoitsdeparturetherefrom: 1.Provideallrequireddocumentsandstatisticaldataontheshipandtheshipscargo. 2.Payorsecurepaymentoftollsandotherchargesforrelatedservicesand/orcomplementary activities. ShouldthevesseldepartCanalWaterswithoutcomplyingwiththeaboveprovisions,thevessel maybesubjecttodelayordenialforfuturetransitrequests. Article45: Embarkingordisembarkingavesselunderwayshallbedoneunderthefollowing conditions: 1.PersonsauthorizedtouseAuthoritylauncheswillonlybepermittedtoembarkordisembark fromtransitingvesselsatpointsthathavebeendesignatedforsuchpurpose.Pilots,linehandlers, andotheremployeesshallbegovernedbyoperationalrequirementswhenperformingtheir officialduties. 2.Whennecessary,andunderpriorauthorizationbytheAuthority,exceptionstotheabove provisionsmaybemadeonacasebycasebasis,includingembarkingordisembarkingatthe locks.Authorizationmustbeobtainedpriortoembarkingapersononashipwiththeintentto disembarkatsomepointotherthanthosedesignatedbytheAuthorityforsuchpurpose.

3.FortDavisandParaisoLandingfacilitiesarenottobeusedbynonAuthoritypersonnelfor embarking/disembarking.ExceptionstothisrulemustbeapprovedbytheAuthority. EmbarkingandDisembarkingbyAuthorityemployeesintheseareasisdiscouraged,withthe exceptionoflinehandlersandpilotsgoingtoandfromtheParaisoTieupStation.

SectionThree Precautionarymeasuresandattachmentofvessels Article49: TheAuthorityhasestablishedthefollowingoperatingguidelineswithregardto attachmentofvessels: 1.TheAuthorityshallassistbyprovidingservices,suchaslaunchservicefortheprocessserver, onacostreimbursablebasis.Further,theAuthorityshallpermittheserviceofthewritof attachmentatanytimeafterthevesselhasclearedthelastlockinthecourseofitstransit.Ifthe vesselistobedockedsubjecttotheattachment,unlessoperationallyfeasibletodootherwise,the AuthorityshallpermitalterationofthevesselsintendedcourseonlyafterithaspassedBuoys1 and2,inthecaseofasouthboundvessel,andtheMoleBuoyatCristobal,inthecaseofa northboundvessel.Arrangementsmaybemadefortheservicesofapilottoreturnthevesselto thedockpriortoreachingthosepoints,onacostreimbursablebasis. 2.IfawritofattachmentofavesselthatisatanchorispresentedtotheAuthority,suchvessel shallnottransit.Inthesecasesthewritofattachmentmustbereceivedintimetonotifythepilot priortothevesselsweighinganchor. 3.IfawritofattachmentofavesselthatisdockedispresentedtotheAuthority,andthepilot assignedtomoveithasnotcastoffthelines,thepilotwillbeinstructednottodoso.Ifthepilot hasalreadyorderedthelinescastoff,andthedockworkershavenotdoneso,thepilotwillnot makeanyfurtherattempttogetunderway.Ifthelineshavebeencastoff,thepilotshallassume controlofthevesselsmovements,intheinterestofsafety.Theguidelinescontainedinitem1 aboveshallapplyhereinafter. 4.OnceadulyexecutedwritofattachmenthasbeenpresentedtotheAuthority,thevesselwill notberescheduledfortransitorprovidedwithpilotservices,untilsuchmeasureisliftedbya courtorderfromthecompetentmaritimecourt.

ChapterIV GeneralandSpecificProvisionsRegardingVessels SectionOne Dangerousvessels

Heightmaybepermittedto62.48meters(205feet),subjecttoapprovaloftheAuthorityona casebycasebasis,withpassageatlowwater(MLWS)beneaththebridgeatBalboa. 5.Protrusions: a.Anythingwhichextendsbeyondavesselshullshallbeconsideredaprotrusion,andshallbe subjecttotherespectiverulesandlimitations. b.TheAuthorityisnotresponsiblefordamagestoprotrusions,whetherpermanentor temporary. c.Vesselswithprotrusionsmaybepermittedtotransit,providedthatsuchprotrusionswillnot interferewiththesafetransitofthevesselorpresentahazardtoCanalstructures,asdetermined bytheAuthority. d.Vesselswithpermanentprotrusionsmustfurnishdetailedinformationabouttheprotrusions, includingplans,andrequestauthorizationfortransitbeforeproceedingtotheCanal.Advance informationwillminimizethepossibilitythattransitmaybedelayednordenied. e.Thesevesselsmaybepermittedtransit,priorapprovaloftheAuthority,andonacasebycase basis,providedthatprotrusionsdonotrepresentahazardorinterferewithlockstructures, equipment,and/oroperation. f.Forasaferelaylockageoperation,allnewlyconstructedvesselsmustmaintainaminimum clearanceofonemeter(3.30feet)betweenanylocksequipmentandanyprotrusionsextending beyondtheverticalplaneofthevesselshullshellplating.Additionally,anyvesselswith windows,portlights,sideports,orotherappurtenancesbelowalevelof12.90meters(42.20feet) abovethewaterlineattransitdraftmusttakemeasurestoensuretheirprotection,shouldthe vesselcontactthelockwall. Forreasonablesafetyconsiderations,additionalrestrictionsmaybeimposedonvesselswhose length,trim,ormaneuverabilitycharacteristicspresentahazardtothevessel,thirdparties,or Canalfacilities. Article56: Beforetransiting,themasterof thevesselshallberequiredtoreleasefromliability andindemnifyagainstanydamagesresultingfromanaccident,when: 1. Avesselhasadraftoflessthantheminimumtransitdraft,alistofover3degrees,orisso trimmedorotherwisesoloadedastodangerouslyaffectherstabilityormaneuverability. 2. Avesselhasprotrusions.

SectionThree Boardingfacilities Article57: Vesselsmusthavethefollowingboardingfacilitiesavailableforusebypilotsand linehandlers: 1. PilotsLadder: a. Theladdershallbeefficientforthepurposeofembarkinganddisembarkingsafely.Itshall bekeptcleanandingoodorder,andmaybeusedbyofficialsandotherpersonswhenaship arrivesatorleavesaport. b. Theladdershallbesecuredinapositionsothatitisclearofanypossibledischargesfromthe ship,thateachsteprestsfirmlyagainsttheshipsside,andthatitisclearsofaraspracticableof thefinerlinesoftheship,sothatthepilotcangainsafeandconvenientaccesstotheshipafter climbingnotlessthan1.5meters(5feet)andnotmorethan9meters(30feet).Asinglelength ofladdershallbeused,capableofreachingthewaterfromthepointofaccesstotheshipAll necessarystepsshallbetakentoobservethisconditionunderanysituationofloadortrim affectingthevessel,andforalisttotheoppositesideof15.Whenthedistancefromsealevel tothepointofaccesstotheshipismorethan9meters(30feet),accessfromthepilotladderto theshipshallbebymeansofanaccommodationladderorotherequallysafeandconvenient means. c. Thestepsofthepilotladdershallhavethefollowingcharacteristics: c.1Shallbeconstructedofhardwoodorothermaterialofequivalentproperties,madeinone piecefreeofknots,havinganonslipsurfacethefourloweststepsmaybemadeofrubberof sufficientstrengthandstiffness,orofothersuitablematerialofequivalentcharacteristics. c.2Shallnotbepaintedanopaquecolor,norwithhighglosspaint. c.3Shallhavethegrainandcharacterofthewoodvisible,sothatanycracksordefectscanbe readilyvisibletothepersonusingtheladder.

c.4Shallnotbelessthan480millimeters(19inches)long,115millimeters(4inches)wide, and25millimeters(1inch)indepth,excludinganynonslipdevice. c.5Shallbeequallyspaced,notlessthan300millimeters(12inches),normorethan380 millimeters(15inches)apart,andsecuredinsuchamannerthattheyremainhorizontal. d. Nopilotladdershallhavemorethantworeplacementstepssecuredinpositionbyamethod differentfromthatusedintheoriginalconstructionoftheladder.Anystepsosecuredshallbe replacedassoonaspracticablebystepssecuredinpositionbythemethodusedintheoriginal constructionoftheladder.Whenanyreplacementstepissecuredtothesideropesoftheladder bymeansofgroovesinthesidesofthestep,suchgroovesshallbeinthelongersidesofthestep. e. Thesideropesoftheladdershallconsistofuncoveredmanilaropes,notlessthan60 millimeters(2inches)incircumferenceoneachside.Eachropeshallbecontinuous,withnot jointsbelowthetopstep.Twomanropesproperlysecuredtotheship,andnotlessthan65 millimeters(2inches)incircumference,andasafetylineshallbekeptathand,readyforuseif required. f. Battensmadeofhardwood,orothermaterialofequivalentproperties,inonepiece,andnot lessthan1.80meters(6feet)longshallbeprovided,atsuchintervalsaswillpreventthepilot ladderfromtwisting.Thelowestbattenshallbeonthefifthstepfromthebottomoftheladder, andtheintervalbetweenanybattenandthenextshallnotexceed9steps. g. Meansshallbeprovidedtoensuresafeandconvenientpassageontoandofftheshipbetween theheadofthepilotladderorofanyaccommodationladderorotherapplianceprovided,andthe ship.Wheresuchpassageisbymeansofagatewayintherailsorbulwark,adequatehandholds shallbeprovided.Wheresuchpassageisbymeansofabulwarkladder,suchladdershallbe securelyattachedtothebulwarkrailorplatform,andtwohandholdstanchionsshallbefittedat thepointofboardingorleavingtheship,notlessthan0.7meters(2feet3inches)apart,andno morethan0.8meters(2feet7inches)apart.Eachstanchionshallberigidlysecuredtotheship structureatornearitsbase,andalsoatahigherpoint,andshallnotbelessthan40millimeters(1 inch)indiameter,andshallextendnotlessthan1.2meters(3feet11inches)abovethetopof thebulwark. h. Lightingshallbeprovidedatnight,sothatboththepilotladderoverside,andtheposition wherethepilotboardstheshipshallbeadequatelylit.Alifebuoy,equippedwithanigniting lightandaheavingline,shall bekeptathandreadyforuse. i. Meansshallbeprovidedtoenablethepilotladdertobeusedoneithersideoftheship. j. Theplacementoftheladder,andtheembarkationanddisembarkationofapilot,shallbe supervisedbyaresponsibleofficeroftheship. k. Whereonanyshipconstructionfeaturessuchasrubbingbandswouldpreventthe implementationofanyoftheseprovisions,specialarrangementsshallbemadetothesatisfaction oftheAuthority,toensurethatpersonsareabletoembarkanddisembarksafely.

2. MechanicalPilotHoists: a. Amechanicalpilothoistanditsancillaryequipment,ifprovided,shallbeofatypeapproved bytheAuthority.Itshallbeofsuchdesignandconstructionastoensurethatthepilotcanbe embarkedanddisembarkedin asafemanner,includingasafeaccessfromthehoisttothedeck, andviceversa. b. Apilotladdershallbekeptondeckadjacenttothehoist,andavailableforimmediateuse. 3. AccommodationLadder: a. Accommodationladdersshallleadaft,thatis,withthelowerplatformattheafterend. Accommodationladderswhichleadforward,orwhichdonotrestfirmlyagainstthevesselside, arenotconsideredsafeforusebyAuthorityemployees,.Thelowerendoftheaccommodation laddermustbewithintheparallelmidbodyofthevessel,notneartheboworstern.Safety stanchionsandrailsorlinesshallbeproperlyrigged.Thelowerplatformoftheaccommodation laddershallbekeptinahorizontalposition,withverticalstanchionsinstalled,anditshouldbe heldatadistanceabovethewaterequaltothedeckoftheboardinglaunch.Theboatsparshall beextended.Theupperplatformshallalsohaveverticalstanchionsandasafetylineinplace. b. Anaccommodationladderusedincombinationwithapilotladdershouldhaveamaximum slopeof55degrees.Thepilotladderandtheaccommodationladdermustbeclosetogether,and securedtogetherattheedgeofthelowerplatform,withthepilotladderhangingvertically.The lowerplatformmustbeheldataleveltoallowfortheheightofthelaunchdeck,plustheheight ofapersonstandingonthedeck,plustheriseandfallduetoswellnormally,7meters(23feet) abovethewaterissufficient. c. Whenusinganaccommodationladder,theprovisionsofitem1.hofthisarticleonsafety equipmentandpersonnelmustbeobserved. d. Anaccommodationladderthatisnotappropriatemayrequiretheuseoftugstomakethe vesselcometoacompletestopwhileembarkingordisembarkingpersonnel.Thisisconsidered adeficiency,andtugsshallbeprovidedattheexpenseofthevessel. 4. SidePorts: Whensideportsareusedforboarding,theminimumverticaldistancebetweenthewaterlineand thebottomofthesideportatanydraftshallbe1.80meters(6feet).

Thebridgebellbookshallconsistofacontemporaneousrecordofeachengineorder,andthe timeitistransmittedfromthebridgetotheengineroom,unlessitisequippedwithanautomatic devicewhichproducesapermanent,legiblerecordofeveryengineordertransmittedfromthe bridge.Also,therecordofordersreceivedintheengineroomshallcontaineachorderreceived, andthetimeitwasreceived. SectionThirteen Deckloadcargo Article72: Generalcargoandlumbershallbestowedasindicatedbelow: 1.Itshallbestowedsoastobesufficientlycleartoprovidesafeworkingspacearoundall chocks,bitts,andothergearusedintransiting,andsoarrangedastonotobstructanydirectlead fromchockstobitts. 2.Ifaccesstoworkingspacesisnecessaryoveradeckload,aswithlumber,acatwalkwill normallyberequired,unlessalevel,continuoussurfacefreeofencumbrancesisalready provided.Whencatwalksarerequired,theyshallbeatleast0.9meters(3feet)inwidth,and providedwithadequateguardrails.Wherethedeckcargoissufficientlylevelforgangway purposeswithoutacatwalk,guardrailsorlifelines,spacednotmorethan30centimeters(12 inches)apart,mustbeprovidedoneachsideofthedeckcargo,toaheightofatleast1.20meters (4feet)abovethecargo. 3.Ifdeckaccessisprovidedondeckadjacenttodeckcargo,alevelcontinuouspassageatleast 0.90meters(3feet)inwidthshallbeprovided.Thisaccessshallbeunencumberedbyobstacles deemedhazardoustonormalpassage. 4.Whenpersonnelarerequiredtotraverseoverdeckcargo,laddersadequateforsafeaccess mustbeprovidedbetweenthedeckandtopofdeckcargo.Suchladdersmustbeprovidedwith guardrailsorsafetylines,aspreviouslydescribedforcatwalks. 5.Anadequatebulwarkorrailingshallbeprovidedbetweendeckcargoandtheshipssides. 6.Allsharpedgesandprojectionsadjacenttonormalaccessshallbeadequatelyprotectedto preventinjurytopersonnel. 7.Sufficientlightingshallbeprovidedbythevesseltoilluminatedeckaccessesandworking spacesduringhoursofdarkness.

SectionSixteen Nonselfpropelledvessels Article80: Requirementsfornonselfpropelledvessels: 1.Displacementofthesevesselsislimitedto35,000tons,andthedraftrequirementsofarticle 52.1ofthisannexshallapply. 2.Thedraftofnonselfpropelledbarges167.65meters(550feet)ormoreinlengthmaybe limited,whenintheopinionoftheAuthority,suchlimitationisnecessarytoensurereasonable safety. 3.Uponarrival,thetugwillbreakupthetowandsecurethebridle,sothatnopartofitextends belowthesurfaceofthewater. 4.Towsshallhavethecapabilityofanchoring. 5.Towswillbeinspectedbeforebeingscheduledfortransit. 6.Agents,operators,andownerswillberesponsibleformakinganyrequiredalterationsor additionstoequipmentorstowage. 7.BoardingfacilitiesshallcomplywiththeInternational ConventionforSafetyofLifeatSea, 1974/78SOLAS.Theremustbeaclearpassage,freeofobstructions,fromtheboarding facilitytoallworkingareasotherwise,catwalkswithhandrailsandstepsmustbeprovided. 8.Theworkingareanearchocksandbittsonallshipsandbargesmustbeclearofobstructions, andfittedwithsafetyrailsorlinesatthevesselssides. 9.Shipsandbargesmustprovideapilotshelter,approximatelymidwaybetweenthebowand stern,withaclearviewforward,on thecenterline.Thissheltermaybepermanentorportable, butmustprotectthepilotfromtheelements.Ifneeded,extrasheltersmayberequired.In additiontothecenterlineshelter,towswithabeaminexcessof24.35meters(79.9feet),shall providepilotsheltersattheextremebeams,fromwhichthepilotscanreadilyseethevessels sides. 10.Allshipsorbargesmustbeequippedwiththechocksandbittssetforthinarticle59ofthis annex. 11.Towedshipsandbargesmustprovidemooringandheavinglines,aswellasbittsorcleats forsecuringtugs,thatdonotinterferewiththosechocksandbittsrequiredforlocomotivewires. 12.Allbargesmustbefittedsothatapushertugcanbesecuredwithitsstemheldfirmlytothe centerline.Pushingtugsaretobeequippedwithwirecablesnubbersandsprings.Commercial tugspushingabargewithpoorvisibilityforwardwillnotbeallowedtopushinnotchorina

blindposition.Inthesecases,thetugmusttowwithabridle,usinganothertugasterntoassist withcontrol. 13.Ridingcrewsmustbeprovidedinsufficientnumberstosafelyhandletowboatlinesand boardingladders,andtoassistinmooring.WhilethetowisunderwayinCanalwaters,anchors shallbemannedandreadytobedroppedincaseofemergency. 14.Allbargesmusthaveportabletoiletsonboardpriortodeparturefortransit. 15.TheAuthorityshalldecide,onacasebycasebasis,whetherthecommercialtugmaybe usedtoassistduringtransit.Acompositeunitthathasbridgewingstoextremebeamoftow withrequiredvisibilityforward,andthatmeetsallotherAuthorityrequirements,maybe scheduledfortransitasanormalship. Agents,operators,andownersofdeadtowsshouldcontacttheAuthority asearlyaspossible,but nolaterthan48hourspriortoETA,sothatparticularrequirementsessentialtoplannedtransits canbemetwithoutdelay.

SectionSeventeen Smallcraft,yachts,andotherhandlines Article82: Smallcraft,yachts,andotherhandlinesmustcomplywiththefollowing requirements: 1.ThosearrivingatBalboaorCristobalmustcontactthesignalstationtoreceiveinstructions. 2.TheymayentertheCanalchannelandproceedtotheappropriateanchorageonlyafter receivingpermissionfromthesignalstationonVHFChannel12. a.Thesignalstationshallberesponsibleforcoordinatingthemovementofthesecraft,toavoid conflictwithtransitingvessels. b.Thesignalstationshallnotifyallcraftoftheselimitstomovement. 3.Handlinesarrivingfortransit,andwhoseagentshavemadearrangementsfortransit,shallbe boardedbytheinspectionofficeronarrival. 4.Ifahandlinehasnoagent,themastershallcontactthesignalstationtomakearrangementsfor admeasurementandtobereceivedbytheAuthority.AfteradmeasurementandAuthority clearance,themastermustmakearrangementsforCanaltransit,andpaytherequiredtolls.The Authoritywillprovideinformationontheequipmentandproceduresfortransiting. 5.Ifahandlinevesselisoperatedfromanopencockpit,anawningshouldbeinstalled,if possible,tokeepthepilotandthecrewoutofthesunandrainduringtransit.Avesselmust

maintainitsschedule,regardlessofweatherconditions. Also,adequatesanitaryfacilitiesshall beprovidedaboard,otherwisethetransitmaybesubjecttodelay. 6.Handlinesmoortothelockwallorinthecenterofthechamber.Somevesselsover38.1 meters(125feet)maytransitashandlineswhenapprovedbytheAuthority. 7.Allhandlinesmusthaveananchor,adequatefendering,andatleastfour(4)mooringlinesnot lessthan38.1meters(125feet)long,capableofresistingitsweightundertension,andmustbe sufficientlymanned,inadditiontothemaster,tohandlethem.

SectionNineteen Gearfortransiting Article88: BeforebeginningtransitoftheCanal,avesselshallhavehawsers,lines,andfenders readyforpassingthroughthelocks,fortowingormooring,asthecasemaybeandshallhave bothanchorsreadyforlettinggo.Themastershallverifythatengines,steeringgear,engine roomtelegraphs,whistle,rudderangleandenginerevolutionindicators,anchors,andanyother navigationequipmentisoperatingcorrectly. Duringthetransit,atalltimeswhileavesselisunderwayormooredagainstthelockwalls,her deckwinches,capstans,andotherhydraulicequipmentforhandlinglines,aswellashermooring bitts,chocks,cleats,hawsepipes,etc.,shallbereadyforhandlingthevessel,totheexclusionof allotherwork.

SectionTwenty Flagsandpennants Article89: Alltransitingvesselsshalldisplayflagsignalsasfollows: 1.Whenapilotisassignedtoavesselfortransit,heisgivenaschedulenumberandthe expectedtimeofarrivalatthelocks.Thevesselshalldisplaytheflagorflagsdesignatingthe assignedschedulenumber.Thisnumberwillbethevesselsidentificationwhileintransit. 2.Northboundvesselsshallbeassignedoddnumbers,andsouthboundvesselsshallbeassigned evennumbers. 3.TheH(Hotel)flagshallbedisplayedbelowthenumber,fornorthboundtransits,andabove thenumber,forsouthboundtransits. AllvesselsmaneuveringinCanalwatersandnottransitingshalldisplaytheH(Hotel)flags whenapilotisonboard. Inaddition,vesselsshalldisplaythefollowingsignalflags,asthecasemaybe:

1.PreferencevesselsshalldisplaytheZ(Zulu)flagandabluelightatnight.Vesselswhich havebeenimposedarestrictionduetocargoshalldisplayaflag. 2.TheflagB(Bravo):indicatesflammablesorexplosivesaboard.Aredlightistobe displayedatnight. 3.TheflagT(Tango):indicatestoxicorradioactivematerialsaboard.Aredlightistobe displayedatnight. 4.TheflagX(XRay):Whentwo(2)vesselsaredispatchedintandemonthesameschedule, theleadingvesselshalldisplaytheassignedschedulenumber.Thesecondvesselshalldisplay, inadditiontotheassignedschedulenumber,theflagXandshallbedesignatedasextra. 5.TheflagA(Alfa):Vesselsdelayedafterhavingcommencedtransitbybeingtiedupat Gamboamoorings,ParaisoTieupStation,oranchoredinGatunLakeuntilafterthenextdays traffichascommenced,shalldisplaythisflagundertheschedulenumber.

ChapterV Pilotage SectionOne Compulsorypilotage Article90: PilotageiscompulsoryattheAtlanticentrancefromalinestartingattheCristobal Mole,270truewest,passingby LightedBeacon1 (Mole),andLightedBuoy2(92021N),to thelinepassingby Buoys1and2atthePacificentrancetotheCanal,extendingfrom Lighted BuoyX toSanJoseRock,eastofthechannel. Article94: Whenavesselrequirestheservicesofapilotbeforeenteringthebreakwater,she shallwaitoutside,andcontacttheCristobalsignalstationtorequestthepilot.

SectionTwo Exemptionsfromcompulsorypilotageintheports Article99: Operationrequirementsforpilotexemptedvessels: 1. LicensedMasterorOperatorExperience: Themasteroroperatormustbelicensedto operatethevesselinvolved,issuedbytherespectiveauthorityoftheRepublicofPanama,andbe certifiedbytheBoardofInspectorsoftheAuthority.Thiscertificationshallbevalidforone year,andmayberenewedifrenewalisrequestedonemonthpriortoitsexpirationitshallbe keptonboard,andbepresenteduponrequest.

Inaddition,localsmallcraftmastersandoperatorsmustpurchaseacopyofthePanamaCanal WatersTechnicalOperationsManual,attheirownexpense,andshallkeepitonboard. 2. Permissiontomove: VesselsmustobtainpermissionfromtheAuthoritypriortoany movementinoroutoftheharbor,includingarrivalordeparture,orwhenshiftingberths.They shallfollowinstructions,andmaintainawatchonVHFchannel12(156.000MHz)toreceive anyfurtherinstructionswhilemaneuvering. 3. CrossingCanalChannel: Pilotnotrequired.However,thevesselshallestablish communicationsonChannel12withtheappropriatecommunicationsstation,andmaintain watchthroughoutcrossing. 4. HarborMovementsorMovementsNotInvolvingtheCanalChannel: Pilotsnormallynot required.Intheseinstances,thevesselshallestablishcommunicationsonchannel12withthe appropriatecommunicationsstation,andshallmaintainwatchthroughoutmovement.However, pilotsarerequiredforbunkeringoperationsintheharbor,orformovingdeadtowsinoroutand withintheharbor. 5. Boardingforinspection: Inordertocomplywiththeserules,pilotexemptedvesselsare subjecttoinspectionbytheAuthorityatleastonceayear.Anyvesselowner/operatorwhodoes notcomplywiththerulesshallhavetheexemptionrevoked,andwillnotbereconsideredfora periodofoneyearafterthenoncompliancewasdiscovered.

ChapterVI RequirementsConcerningtheCrew SectionOne Vesselstobefullymanned Article103:Thecrewshallkeepwatchasfollows: 1. Avesselshallhavesufficientseamenforwardandaft,ifsorequestedbythepilot,tohandle linesexpeditiouslywhenapproachingalock,mooringtemporarilytoalockwallorinalock chamber,orwhendocking,undocking,mooring,orshiftingberth. 2. Inadditiontotheregularengineerofficerofthewatch,thechiefengineerofavesselshall remainondutyintheengineroomduringtheapproachto,andwhilepassingthrough,thelocks, anduntilthevesselisclearofthelockwalls.Thechiefengineershallalsobeondutyinthe engineroomwhilethevesselispassingthroughCulebraCut,dockingorundocking,getting underway,anchoring,mooring,orshiftingberth. 3. AnofficershallstandbyontheforecastlewhenavesselisunderwayinCulebraCut,or whendocking,undocking,gettingunderway,anchoring,mooring,orwhensorequestedbythe pilot.

4. Anofficershallbestationedontheforecastle,andanotheronthestern,fromthetimea vesselentersuntilitleavesalock,whiledocking,undocking,mooring,orshiftingberth,orwhen sorequestedbythepilot. 5. Inadditiontomeetingtherequirementsof1and2above,everyvesselwithaCanalpiloton boardshallhaveaseamanstationedontheforecastlewitheffectivecommunicationwiththe navigationbridge,whoiscapableofandreadytooperatethegroundtacklethroughoutthe transit. 6. Inadditiontomeetingtherequirementsof1,2,and3above,everyvesselwithatugmade fastonthesternshallhaveanofficerorqualifiedseamanstandbyonthestern.Aneffective communicationwiththebridgeshallbemaintained.Thisrequirementisfortugsafetyinthe vicinityofthevesselspropelleraction. 7. Whenanchored,moored,orlyingataPanamaCanalpier,avesselshallhaveonboardat leastonequalifieddeckofficer,onequalifiedengineerofficer,andsufficientcrewtoprovidefor thesafetyofthevessel. 8. Avesselshallhaveitsenginesoperatingatfullcapacityatalltimesmentionedinthisarticle.

SectionTwo Masterandofficers Article105: Themasteroraqualifiedofficershallbeonthebridge,asindicatedbelow: 1. Themastershallbeonthebridgewhenavesselisenteringorleavingalock,dockingor undocking,gettingunderway,anchoring,mooring,orshiftingberth,isunderwayinCulebra Cut,orwhensorequestedbythepilot. 2. Atallothertimesthemasterorhisqualifiedrepresentativeshallbeonthebridgeandshall keepthepilotinformedconcerningthehandlingofthevessel,sothatthepilotmaybebetterable tocontrolthenavigationandmovementofthevessel.Allotherofficersshallbeattheirregular stationsthroughoutthemaneuversdescribedherein. 3. Themasterandhisqualifiedrepresentativeshallensurethatthepilotsordersarepromptly andproperlycarriedoutbythecrewatalltimes,andmusthaveaworkingknowledgeofthe Englishlanguage.

ChapterVII EnteringandPassingThroughtheLocks Article107: Whenenteringandpassingthroughthelocks,vesselsmustcomplywiththe following:

1. PassengersandCrew: Themasterandofficersofavesselshallrequireallpassengersandpersonnelnotdirectly engagedinthevesselsmaneuverstokeepwellclearofcables,lines,chocks,bitts,capstans,and otherequipmentandgearusedinconnectionwiththelockage. 2.EmbarkingorDisembarkingatlocks: a. Nocrewmemberorpassengershallembarkordisembarkfromavesselwhileitisinalock, withoutpriorauthorizationfromtheAuthority.Exceptinanemergency,embarkingor disembarkingatthelocksisrestrictedtoGatunandMiraflores. b. TheAuthorityshallnotberesponsibleforanyinjuriestopersonsorproperty,orfordamage tovessels,whichmayresultfromthegrantingofsuchspecialpermission. c. Thecarryingoffirearmsintheareaofthelocksisprohibited,exceptinthecaseoflaw enforcementofficialsorAuthorityemployeeswhoareauthorizedtocarryweaponsinthe performanceoftheirofficialduties. d. Personnelonboardavesselareprohibitedfromusingladdersorboatswainschairswhilethe vesselisinthelockchamber.Draftreadingsaretobeobtainedthroughthepilot.Further, personnelareprohibitedfromdisembarkingontothelockwallsforanypurpose. e. CrewmembersoranypersonjumpingfromatransitingshipintoCanalwaters,thelocks,or anyotherAuthoritystructureorequipment,shallbereportedimmediatelyafternoticed.The personshallbeputunderthecustodyoftheAuthority,whichshallberesponsibleforcontacting thevesselsagent.Thevesselsagentshallturntheindividualbacktotheship,orturnhimover tothecompetentauthority. 3.UseofLocomotivesandLinehandlers: TheAuthorityshalldetermine: a. Thenumberoflocomotivesandtowingwiresrequiredinthelocksbyatransitingvessel, dependinguponherlength,beam,displacement,andspecialconditionsand b. ThenumberofCanallinehandlerstobeplacedonboardatransitingvesseltoassisthercrew inhandlingtowingwiresinthelocks. 4.ArrowSignals: TheAuthorityshallchoosebetweeneastandwestchambers.Vesselsshallstandtowardthe chamberindicatedandshallcomplywiththearrowsignal,unlessitisunsafetodoso.The arrowsignalsindicatethefollowing:

5.UseofTowingLocomotives: a.Avesselpassingthroughthelocksshallbeassistedbytowinglocomotivesusingsteeltowingwires. b.Aftertowingwiresfromthetowinglocomotiveshavebeensecuredonboard,thepilotshalldecide whetherornottousethevesselsenginesinthelocks. 6.Handlines: Whentowinglocomotivesarenotused,vesselsorsmallcraftmaybepermittedtopassthroughthelocks undertheirownpower,inthefollowingcases: a.Asmallvesselupto38.1meters(125feet)inlength,andatowboatupto45.72meters(150feet)in length,maybehandledwiththeirownmanila,hemp,orsyntheticlines,alongthewall,iftheirstructure andfenderingwillpermittheircontactwiththewall. b.Asmallvesselnotover30.48meters(100feet)inlength,havinggoodmaneuveringcharacteristics, maybehandledwithherown manila,hemp,orsyntheticfiberlinesinthecenterofthechamber. Inthecasesindicatedina.andb.above,largercraftmaybepermittedonacasebycasebasisbythe Authority. 7.RequiredLines: 1.Todock,mooratalockapproachwall,orsecureinalockchamber,itshallbethevessels responsibilitytohaveondeckandreadyforimmediateusesix(6)manilaorsyntheticmooringlines forward,andsix(6)aft,ofappropriatesizeandstrength,priortocommencingtransit.Themastershall informtheboardingofficialwhetherornotthevesselcomplieswiththeabove,sothathemayadvisethe Authority. 2.Eachlineshallbeatleast75meters(250feet)inlength,andshallhaveaneyeofatleast1.50meters (5feet)splicedinoneend. Theyshallbeingoodcondition.Wireropes,andropescomposedofboth wireandfiberorfilamentarenotacceptableforCanaloperations.Noncompliancewiththisrequirement couldresultintransitdelay.

ChapterVIII PreventionofCollisions SectionOne Generalprovisions Article108: VesselsandseaplanesnavigatingthewatersoftheCanalshallcomplywiththefollowing: Rule1:Application. 1.TheprovisionsofthispartshallapplytonavigablewatersbetweenalineconnectingtheEast BreakwaterLightandtheWestBreakwaterLightattheAtlanticentrancetotheCanal,andalinepassing through Buoys1and2 andSanJoseRockatthePacificentrancetotheCanal,joiningstations72 (85249.60latitude793225.50longitude),and86(85419.71latitude793109.91longitude)at theCanaloperationcompatibilityareaboundaryline. 2.TheRulesoftheInternationalRegulationsforPreventingCollisionsatSea,1972(72COLREGS) shallapplyinCanalwaterstoseawardoftheseboundarylines. Rule2:GeneralDefinitions. Forthepurposeofthisarticle,exceptwherethecontextotherwiserequires,theexpressionsusedherein shallhavethefollowingmeaning: Vessel. Meansavesselwhich,throughsomeexceptionalcircumstance,isunable tomaneuverasrequiredbythischapter,andisthereforeunabletokeepoutofthewayofanothervessel. VesselRestrictedinHerAbilitytoManeuver. Meansavesselwhichfromthenatureofherworkis restrictedinherabilitytomaneuverasrequiredbythischapter,andisthereforeunabletokeepoutofthe wayofanothervessel.Thistermincludes,butisnotlimitedto: a.Avesselengagedinlaying,servicing,orpickingupanavigationmark,submarinecable,orpipeline.

SectionTwo Steeringandsailingrules Conductofvesselsinanyconditionofvisibility Rule3:Application. Therulesofthissectionapplyinanyconditionofvisibility. Rule4:Lookout. EveryvesselshallatalltimeswhileunderwayintheCanalandadjacentwaters,maintainaproper lookoutbysightandhearing,aswellasbyallavailablemeansappropriateintheprevailingcircumstances andconditions,soastomakeafullappraisalofthesituation,andoftheriskofcollision.Theperson actingaslookoutshallhavenootherassignedduties,andshallreportimmediatelyallrelevantand materialinformationtothepersoninchargeofthenavigationofthevessel. Rule5:SafeSpeed. Everyvesselshallatalltimesproceedatasafespeed,sothatshecantakeproperandeffectiveactionto avoidcollision,andbestoppedwithinadistanceappropriatetotheprevailingcircumstancesand conditions.Indeterminingasafespeed,thefollowingfactors,amongothers,shallbetakenintoaccount:

Onallvessels: a.Thestateofvisibility. b.Thetrafficdensity,includingconcentrationsofsmallcraftsoranyothervessels. c.Themaneuverabilityofthevessel,withspecialreferencetostoppingdistance,andturningabilityin theprevailingconditions. d.Atnight,thepresenceofbackgroundlight,suchasfromshorelights,orfrombackscatterofherown lights. e.Thestateofwind,sea,andcurrent,andtheproximityofhazardstonavigation. f.Thedraft,inrelationtotheavailabledepthofwater. 2.Additionally,onvesselswithoperationalradar: a.Thecharacteristics,efficiency,andlimitationsoftheradarequipment. b.Anyconstraintsimposedbytheradarrangescaleinuse. c.Theeffectonradardetectionoftheseastate,weather,andothersourcesofinterference. d.Thepossibilitythatsmallvesselsandotherfloatingobjectsmaynotbedetectedbyradaratan adequaterange. e.Thenumber,location,andmovementofvesselsdetectedbyradar. 3.Themoreexactassessmentofthevisibilitythatmaybepossiblewhenradarisusedtodeterminethe rangeofothervesselsorotherobjects. 4.TheGPSsystemshallbeusedtodeterminethepositionandspeed,whenavailable. 5.TheAuthorityshallestablishthespeedlimitsforvesselsinthedifferentCanalareas.Speedlimits mayvaryinaccordancewithdifferentcircumstancesandsafetyconditions,andsuchvariationsthereto shallbepublished. 6.AvesseltransitinginCanalwatersatlocationsotherthanthoseforwhichspeedlimitshavebeen specified,includingGatunAnchorage,BohioBend,MameyCurve,MirafloresLake,andinornearthe locks,shallnotexceedaspeedthatissafeundertheexistingcircumstancesandconditions,exceptinan emergency.

7.Wheneveravesselisunderwayinareaswherespeedislimitedtosixknots,andthevesselsspeedat deadslowaheadexceeds6knots,sheispermittedtoproceedattheslowestspeedpossiblerequiredto safelymaintainmaneuverability. 8. TheAuthoritymayauthorizedeparturesfromthemaximumspeedsestablished,inthecaseof particularvesselswhosehandlingcharacteristicsaresuchastoindicatethatahigherspeedorspeedscan beprudentlyallowed. 9.Paragraph5ofthisruledoesnotapplytomotorboatsortovesselsoftheAuthority.Nevertheless, motorboatsandvesselsoftheAuthoritywhenunderwayshallproceedataspeedwhichisreasonable undertheprevailingcircumstancesandconditions,andwhichdoesnotcreateahazard tolifeorproperty. Rule6:RiskofCollision. 1.Everyvesselshalluseallavailablemeansappropriatetotheprevailingcircumstancesandconditions, todetermineifriskofcollisionexists.Ifthereisanydoubt,suchriskshallbedeemedtoexist. 2.Properuseshallbemadeofradarequipment,iffittedandoperational. 3.Assumptionsshallnotbemadeonthebasisofscantyinformation,especiallyscantyradarinformation. 4.Indeterminingifriskofcollisionexists,thefollowingconsiderationsshallbeamongthosetakeninto account: a.Itshallbedeemedthatthereisariskofcollisionifthecompassbearingofanapproachingvesseldoes notappreciablychange. b.Insomecases,suchriskmayexistevenwhenanappreciablebearingchangeisevident,particularly whenapproachingaverylargevesseloratow,orwhenapproachingavesselatcloserange. Rule7:ManeuverstoAvoidCollision. 1.Ifpermittedbythecircumstancesofthecase,anymaneuvertoavoidcollisionshallbeclear,madein ampletime,andwithdueregardtotheobservanceofgoodseamanship. 2.Ifpermittedbythecircumstancesofthecase,anyalterationofcourseand/orspeedtoavoidcollision shallbelargeenoughtobereadilyapparenttoanothervesselobservingvisuallyorbyradar.A successionofsmallalterationsofcourseand/orspeedshallbeavoided. 3.Ifthereissufficientsearoom,alterationofcoursealonemaybethemosteffectiveactiontoavoida closequarterssituation,providedthatitismadeingoodtime,issubstantial,anddoesnotresultinanother closequarterssituation. 4.Anymaneuverstoavoidcollisionwithanothervesselshallbesuchastoresultinpassingatasafe distance.Theeffectivenessofthemaneuvershallbecarefullycheckeduntiltheothervesselisfinally pastandclear.

5.Ifnecessarytoavoidcollision,orallowmoretimetoassessthesituation,avesselshallslackenher speed,ortakeallwayoffbystoppingorreversinghermeansofpropulsion. 6.Whentwovesselsareproceedinginsuchdirectionsastoinvolveriskofcollision,apowerdriven vessel,motorboat,orsailingvesselthatisenteringorpreparingtoenterthemainchanneloftheCanal fromeitherside,shallnotcrossthebowofavesselproceedingineitherdirectionalongtheCanalaxis, andshallkeepclearuntilthevesselproceedingalongtheCanalaxishaspassed. Rule8:NarrowChannels. 1.Avesselproceedingalongthecourseofanarrowchannelorfairwayshall keepasneartotheouter limitofthechannelorfairwaywhichliesonherstarboardside,providedthiscanbedonesafely. 2.Avessellessthan20meters(65feet)inlength,orasailingvessel,shallnotimpedethepassageofa vesselwhichcansafelynavigateonlywithinanarrowchannelorfairway. 3.Avesselengagedinfishingshallnotimpedethepassageofanyothervesselnavigatingwithina narrowchannelorfairway. 4.Avesselshallnotcrossanarrowchannelorfairwayifsuchcrossingimpedesthepassageofavessel whichcansafelynavigateonlywithinsuchchannelorfairway.Thelattervesselshallusetheacoustic signalprescribedinRule31.4,ifindoubtastotheintentionofthecrossingvessel. 5.a.Whenovertakinginanarrowchannelorfairway,thevesselintendingtoovertakeshallindicateher intentionbysoundingtheappropriateacousticsignalprescribedinRule31.3.Theovertakenvessel,ifin agreement,shallsoundtheappropriatesignal.Ifindoubt,sheshall soundtheacousticsignalprescribed inRule31.4. b.TheprovisionsofthisruledonotrelievetheovertakingvesselofherobligationsunderRule11. 6.Avesselnearingabend,oranareaofanarrowchannelorfairway,whereothervesselsmaybe obscuredbyaninterveningobstruction,shallnavigatewithalertnessandcaution. 7.Vesselsshallavoidanchoringinanarrowchannel,ifpermittedbythecircumstancesofthecase. 8.Whentwopowerdrivenvesselsaremeetingendon,ornearlyendonintheCanal,andinthevicinity ofanobstruction,e.g.,adredge,drillbarge,slide,etc.,thevesselwhosesideoftheCanalisclearshall havetherightofway,andtheothervesselshallholdbackandkeepoutoftheway,untiltheprivileged vesselisclear. Rule10:SailingVessels. 1.Whentwosailingvesselsareapproachingoneanother,soastoinvolveriskofcollision,oneofthem shallkeepoutofthewayoftheotherasfollows: a.Wheneachhasthewindonadifferentside,thevesselwhichhasthewindontheportsideshallkeep outofthewayoftheother. b.Whenbothhavethewindonthesameside,thevesselwhichistowindwardshallkeepoutoftheway ofthevesselwhichistoleeward. c.Ifavesselwiththewindontheportsideseesavesseltowindward,andcannotdeterminewith certaintywhethertheothervesselhasthewindon theportoronthestarboardside,sheshallkeepoutof thewayoftheother. 2.Forthepurposeofthisrule,thewindwardsideshallbedeemedtobethesideoppositetothatonwhich themainsailiscarriedor,inthecaseofasquareriggedvessel,thesideoppositetothatonwhichthe largestforeandaftsailiscarried. Rule11:Overtaking. 1. Notwithstandingtheprovisionscontainedintherulesofthissection,anyvesselovertakinganyother shallkeepoutofthewayoftheovertakenvessel,exceptthatwithintheCanalchannel,allpleasure vesselsandcrafts,eventhoughtheyareanovertakenvessel,shallkeepoutofthewayoftransiting vessels,andPanamaCanalAuthorityfloatingequipment. 2. Avesselshallbedeemedtobeovertaking,whencomingupwithanothervesselfromadirectionmore than22.5degreesabaftherbeam,thatis,insuchapositionwithreferencetothevesselsheisovertaking, thatatnightshewouldbeabletoseeonlythesternlightofthatvessel,butneitherofhersidelights. 3. Whenavesselisinanydoubtastowhethersheisovertakinganother,sheshallassumethatthisisthe case,andactaccordingly. 4. Anysubsequentalterationofthebearingbetweenthetwovesselsshallnotmaketheovertakingvessel acrossingvesselwithinthemeaningofthischapter,norrelieveherofthedutyofkeepingclearofthe overtakenvessel,untilsheisfinallypastandclear. 5. ExceptasspeciallyauthorizedbytheAuthority,apowerdrivenvesselshallnotovertakeandpass anotherpowerdrivenvessel,inCulebraCut,MameyCurve,orBohioBend,between Buoys38and40A, orinanychannelunder215meters(700feet)inwidth(Pacificentrancechannel,betweenBridgeofthe AmericasandMirafloresLocks,ChagresCrossing,GamboaReach,andtheAtlanticChannelfromGatun LockstoBuoyNo.6).Thisparagraphdoesnotapplywhereeithertheovertakingortheovertakenvessel islessthan45.8meters(150feet)inlengthorisanAuthorityvessel.

Rule12:HeadonSituation. 1. Whentwopowerdrivenvesselsaremeetingonreciprocalornearlyreciprocalcourses,soasto involveriskofcollision,eachshallalterhercoursetostarboard,sothateachshallpassontheportsideof theother. 2. Suchasituationshallbedeemedtoexistwhenavesselseestheotherahead,ornearlyahead,andby nightshecouldseethemastheadlightsoftheotherinalineornearlyinaline,and/orbothsidelights,and bydaysheobservesthecorrespondingaspectoftheothervessel. 3. Whenavesselisindoubtastowhethersuchasituationexists,sheshallassumethatitdoesexist,and actaccordingly. 4. IntheCanalchannel,everypowerdrivenvesselencounteringanothervesselwhileproceedingalong thelineofthechannel,shallkeeptothatsideofthefairwayormidchannelwhichliesonitsstarboard side.Whentwosuchvesselssoproceedingareboundinoppositedirections,theyshall,whenitissafe andpracticable,begovernedbytheprovisionsof1.above,evenwhen,byreasonofanintervening bendinthechannel,theirheadingsarenotsubstantiallyoppositewhentheyfirstsighteachotherand neitherofthemshallaltercoursetoportacrossthecourseoftheother.Tugsandmotorboatsshall, wheneverpracticable,keepwellovertothatsideoftheCanalwhichistotheirstarboardwhenlarge vesselsarepassing. Rule13:CrossingSituation. Whentwopowerdrivenvesselsarecrossingsoastoinvolveriskofcollision,thevesselwhichhasthe otheronherownstarboardsideshallkeepoutofthewayandshall,ifthecircumstancesofthecase permit,avoidcrossingaheadoftheothervessel. Rule14:ManeuveringbyGiveWayVessel. Everyvesselwhichisdirectedtokeepoutofthewayofanothervesselshall,sofaraspossible,takeearly andsubstantialactiontokeepwellclear. Rule15:ManeuveringbyStandOnVessel. 1.a.Whenoneofthevesselsistokeepoutofthewayoftheother,thelattershallkeephercourseand speed. b. However,thelattervesselmaytakeactiontoavoidcollisionbyhermaneuveralone,assoonasit becomesapparenttoherthatthevesselrequiredtokeepoutofthewayisnottakingappropriateactionto complywiththisrule. 2. Rule17:ConductofVesselsinRestrictedVisibility. 1. Thisruleappliestovesselsnotinsightofoneanotherwhennavigatinginornearanareaofrestricted visibility. 2. Vesselsshallproceedatasafespeedadaptedtotheprevailingcircumstances,andconditionsof restrictedvisibility.Apowerdrivenvesselshallhaveherenginesreadyforimmediatemaneuver. 3.Vesselsshallhavedueregardtotheprevailingcircumstancesandconditionsofrestrictedvisibility whencomplyingwithrules3through8.

SectionThree Lightsandshapes Rule18:Application. 1. RecreationalskindivinginwatersoftheCanal,includingCulebraCutandthechannelthroughGatun andMirafloreslakes,andinthewatersofallshipsanchorages,isprohibitedunlessauthorizedinwriting bytheAuthority.Authorizationshallnotbegivenforskindivingatnightoratanytime,within450 meters(500yards)oftheCanalaxis.WhenrecreationalskindivingactivitiesareunderwayintheCanal, orwatersadjacentthereto,aflagofthetypedescribedinparagraph1ofthisruleshallbedisplayedfrom thecraftservingtheskindiver,inamannerwhichallowsallroundvisibility.However,theflag displayedforrecreationaldivingshallnotbelessthan30centimeters(12inches)inheight,andshallbeof standardproportions. 3. Vesselsapproachingorpassinganareawheredivingactivitiesareunderway,shallreducespeed sufficientlytoavoidcreatingadangerouswashorwake. Rule36:RegulationsonSmallCraftsNotTransitingtheCanal. 1. Forthepurposeofthisrule,asmallcraftisdefinedasanyvesselforrecreationalpurposesupto20 meters(65feet)inlength,operatinginnavigablewatersoftheCanalOperationCompatibilityArea.Such craftmustbeoperatedbyapersonofmorethan18yearsofage,holdingaSmallCraftOperatorLicense, issuedbythePanamaCanalAuthority. 2. OperatorRestrictions: Novesselshallbeoperatedifheroperator: a. Isintoxicatedorundertheinfluenceofanydrug,or b. Isincapableofsafelyoperatingthevessel,becauseheisundertheinfluenceofanydrug,whetheror notthedrugislegal.Thefactthatonelawfullyisorhasbeenusinganydrug,shallnotconstitutea defenseagainstachargeofviolatingthisrule. 5. Safety: Nopersonshalloperateasmallcraftsoclosetoatransitingorothervessel,soastohamperthesafe operationofeithervesselnorshallanypersonoperateasmallcraftsoastoendangerlifeorproperty.A violationofthisruleisconsideredaseriousoffense,andshallresultinthecancellationoftheoffenders operatorlicense. 6. Surveillance: TheAuthorityshallcoordinatethesurveillanceoftheCanalOperationCompatibilityAreawiththe respectivegovernmentauthorities,toensuremaximumsafetyofsmallcrafts,andtopreventunlawful activitiesornoncompliancewiththeseregulations. 7. Penalties: ViolationsofanyoftheserulesshallbepenalizedinaccordancewiththeprovisionsofChapterX. Rule37:LightsMarkingofPipelineLaidinNavigableWaters. Wheneverapipelineislaidinnavigablewaters,itshallbemarkedatnightbyamberlights,atintervalsof 60meters(200feet).Thelightsmarkingthelimitsofthegateshallbeaverticaldisplayofawhiteanda redlight, thewhitelighttobeatleast122centimeters(4feet)abovetheredlight.Theselightsshallbeso constructedastoshowallaroundthehorizon,andbevisiblefromadistanceofatleast1mile. Vesselsshallbepreparedtokeepthetanktopdeckseffectivelycoveredwithafilmofwaterthroughout thetransit,whensuchactionisrequiredbytheAuthority.

SectionTwo Dangerouscargoinbulk Article120: 1. AnchoringRequirements: a. VesselsshallcommunicatewiththesignalstationsatFlamencoIslandorCristobalpriortoarrival, andawaitinstructionsbeforeanchoring. b. Suchvesselswillbeinstructedtoanchorinoneoftheanchorageareasdesignatedforvesselscarrying explosivesattheAtlanticorPacificentrance,asthecasemaybe,asdescribedinarticle37ofthisannex.

VesselssubjecttothissectionshallcomplywithMARPOL73/78. b. VesselscarryingdangerouschemicalsinbulkshallcomplywiththeBulkChemicalCode. c. BulkliquefiedgascarriersshallcomplywiththeGasCarriercodes. 3. SolidbulkcarriersshallcomplywiththeSolidBulkCode. Article121: Suchvesselsshallsubmitthefollowingdocumentation: 1. Aloadingplan,asdescribedinarticle41.5ofthisannex. 2. Suchvesselsshallhavereadyforexamination,asprescribedbyarticle41,thefollowingcertificates: a. AvalidMARPOL73/78Certificate(sameasInternationalOilPollutionPreventionCertificate). b. AvalidSOLASCertificate. c. AvalidCertificateofFitness(requiredforbulkchemicalandliquefiedgascarriersonly). d. Ifanyoftheabovecertificatesisinvalid,thelatestissueaboardthevesselshallbeexamined,plus informationprovidedonwhenthecertificatewillberenewed. Article126: Vesselscarryingdirectreducedironshallberequiredtoprovidethefollowingdocuments: 1. Copyofcertificationthatdirectreducedironissuitableforloading. 2. CopyofcertificationthatdirectreducedironconformstoIMOrequirements.

3. StatementfromthemasterorshipperthatIMOprecautionsaslistedintheIMOCodeofSafety PracticesforSolidBulkCargoesforcoldorhotmoldedbriquetteshavebeenfollowed. 4. Copyofprocedurestobefollowedbythevesseltoensuresafetyofvesselandcargointheeventthe cargogetswet.

SectionThree Dangerouspackagedgoods Article128: Followingaretherequirementsforvesselscarryingdangerouspackagedgoods: 1. AnchoringRequirements: a. VesselssubjecttotheprovisionsofthisarticleshallcommunicatewiththesignalstationsatFlamenco islandorCristobalpriortoarrival,inaccordancewitharticle35,andawaitinstructionsbefore anchoring. b. Suchvesselswillbeinstructedtoanchorinoneofthedesignatedanchorageareas,asdescribedin article37,paragraphs1and3. c. Vesselscarryingexplosivesorespeciallyreactiveorlargeamountsofdangerousmaterials,as determinedbytheAuthority,maybeinstructedtoanchorinoneoftheexplosiveanchorageareas describedinparagraph1bandc,andparagraph3bofarticle37. 2. RequirementsRelatedtoIMOConventionsandCodes: VesselssubjecttothisarticleshallcomplywiththestandardssetforthinSOLASandIMDGpertainingto theconstruction,maintenance,inspection,certification,andclassificationofthevessel,itssafety equipmentincludingalarms,anditscargostowageandhandlingsystems.

TransitRequirements: Normaloperatingrestrictionsshallgenerallyapply,unlesssuchvesselsaretransportingfivetonsormore ofIMO1.1explosives,orlargeamountsofdangerousgoods,asdeterminedbytheAuthority,inwhich caseadditionaloperatingrestrictionsmaybeimposed. 4. CargoRequirements: Theloading,packing,labeling,marking,handling,stowage,segregation,maintenance,inspection,and certificationofdangerouspackagedgoodsshallbeincompliancewiththeIMDGCode. Article130: Thedangerouscargomanifestthatmustbesubmittedbyvesselscarryingdangerous packagedgoodsmustindicatethecorrecttechnicalnameoftheproduct,thecorrespondingUnited

Nationsclassificationnumber,theOMIclassanddivision,placeofstorage,andtheamountofeach dangerouscommoditycarried. Article132: Vesselscarryingdangerouspackagedgoods(Class1)shallcomplywiththefollowing requirements: 1. RequirementsRelatedtoOMIConventionsandCodes: Vesselscarryingdangerouspackagedgoods(Class1),shallcomplywithSOLASConventionandIMDG Code,pertainingtotheconstruction,maintenance,inspection,certification,andclassificationofthe vessel,itssafetyequipmentincludingalarms,anditscargostowageandhandlingsystems. 2. CargoRequirements: Theloading,packing,labeling,marking,handling,stowage,segregation,maintenance,inspection,and certificationofdangerouspackagedgoodsshallbeincompliancewiththeIMDGCode. Article134: TheAuthority,uponapplication,maypermitthedischargeofexplosivesatitsdocksand otherlocationswithinCanalwatersinanemergencyorwhenthecharacterorpackingoftheexplosives permitstheirsafedischargethere. Article141: Forthefollowingradioactivesubstances,notlessthan48houradvanceinformation requiredunderarticle30ofthisannexshallbeprovided,indicatingthespecificsrequiredbytheIMDG Code: 1. LowspecificactivitysubstancesorlowlevelsolidradioactivesubstancesasspecifiedinClass7, schedules5,6,and7oftheIMDGCode. 2. Vessels whose documentation has been previously reviewed and registered with the Panama Canal AuthorityshallonlyneedtoshowtheirrecordduringtheroutineinspectionbyACPofficialsupontheir arrivalinCanalwaters. Article141B: Emergencyreaction,accordingtothePCSOPEPshall: a. ConformtotherequirementsofthePanamaCanalAuthorityEmergencyReactionPlan(Contingency Plan). b. IdentifytheQualifiedPersonwho,onbehalfofthe vesselsResponsibleParty, has fullauthorityto implementcleanupactions incoordinationwiththe Authority,andtoinitiateormaintain immediate communicationsbetweensaidPersonandtheAuthority.

c. Identifytheoilspillresponseorganization(OSRO)previouslyreviewedbytheAuthorityandhiredby the vessel, which shall have the necessary personnel and equipment to mitigate an emergency and conducttheappropriatecleanuptasks. Article141C: ForthepurposeofensuringtheeffectivenessofthePCSOPEP,vesselsshall: a. SubmittotheAuthority foritsreviewanyupdatesandchangestotheReactionPlan.This includes any changes in designation of the Identified Qualified Person responsible and the oil spill response organization(OSRO). b. MaintainavailableforreviewbytheAuthoritylogsofdrillsandincidents,reactionstorealincidents, andcrewtraining.
