Ohio cable parks offer wakeboarding without boats

By AMY SAUNDERS The Columbus Dispatch MARYSVILLE For an avid wakeboarder, Nicole Stanley has little need for a key piece of equipment: a boat. She hasnt ridden behind one in two years, preferring instead to be pulled across the lake and over ramps and rails by electric cables 30 feet overhead. On a weekly basis, she and her husband, Kele, visit one of two cable wakeboarding parks in Ohio: Wake Nation outside Cincinnati and Wakeopolis, which opened last month in Marysville. The Springfield couple, both 29, even spent part of their honeymoon driving to four parks in Texas, Oklahoma and Kansas. Cable parks are where its at now, Kele Stanley said during a recent visit to Wakeopolis. Low power consumption, infinite pull, obstacles in the water who needs a boat? Wakeopolis owner Tyler Dunham also sees the sport moving increasingly toward facilities such as his park, which features a 4-acre, manmade lake between a field and the traffic on Rt. 33. Cable parks are popular overseas, with leading manufacturer Rixen Cableways of Germany having built 200 systems in 40 countries since 1966. But the idea is newer in the United States, whose dozen parks have opened predominantly in the past several years. On a recent evening at Wakeopolis, reggae and rock music blared from a small shack where employees manned the controls of the cable, which runs between two towers positioned at opposite ends of the lake. The Stanleys took turns riding back and forth on the cable, reaching speeds of about 18 mph as they practiced tricks and jumps off three obstacles anchored in the lake. You were in orbit, man! Dunham shouted as Kele Stanley landed a huge jump off a 3 1/2-foot ramp. A mechanical engineer, patent lawyer and longtime wakeboarder, Dunham saw opportunity in cable systems after visiting Wake Nation in 2009 when it opened in Fairfield. He has since worked on opening his facility, buying the cable equipment for $32,000 and modifying the lake, which had been dug for a nearby highway overpass. Given the prohibitive costs of owning and maintaining a boat, Dunham hopes that cable parks can introduce more people to wakeboarding including the thousands of snowboarders and skateboarders he sees as potential customers. If you look at the people who wakeboard, which is very similar, its a fraction of that, said Dunham, 32, an associate lawyer at Standley Law Group in Dublin. The real reason is that people dont have access to a boat. Picking up wakeboarding at a park, he said, can be less intimidating than trying it behind a boat. The overhead cable helps beginners stay on their feet; operators immediately stop the cable when they fall. An annual membership to Wakeopolis, which costs $50 through July 4, provides the opportunity to reserve the lake in one-hour increments ($70 on weekdays and $110

Ohio VA hospital records found at private home

DAYTON (AP) The Dayton Veterans Affairs Medical Center is notifying 16 people that medical records containing their personal information were found at the former home of a now-deceased employee, drawing more attention to a hospital recently scrutinized amid allegations of poor hygiene at a dental clinic and improper conduct by an anesthesia unit employee. The homes current owner found the boxed records in an attic and contacted police about two months ago, the Dayton Daily News reported. The police report indicated no one at the hospital knew why or how someone removed the records, which included birth dates and Social Security numbers. Former Marine Angelo Arnold of Centerville said he learned about the problem this week in a letter from medical center Director Glenn Costie. This is a grievous injustice to veterans, the 51-yearold Arnold told the newspaper. Someone has to be accountable at the Dayton VA. This sends a message that certain VA staffers are very careless and reckless with our files. The directors letter to Arnold said he could file a privacy complaint and take steps to avoid identity theft. VA takes our obligation to honor and serve Americas veterans very seriously, Costie wrote. We believe it is important for you to be fully informed

on weekends and holidays). The park also offers open sessions three days a week, during which nonmembers can ride the cable, receive instruction and borrow equipment for $14. Tyler Wiant is the type of member Dunham had in mind: A snowboarder, Wiant has long been interested in trying his skills on the water but hasnt been on a boat in a decade. Im not looking to do anything other than have fun but, for me, fun is kind of pushing the limit, said Wiant, 27, of Marysville. I would have never had the opportunity to enjoy this if not for a place like this. Even people with access to boats see benefits to cable parks: Instead of waiting for a turn on friends boats, the Stanleys visit parks on their own schedule and spend downtime barbecuing onshore.

of any potential risk to you, and apologize for any inconvenience or concern this situation may cause. Costie vowed last year to build confidence in the Dayton center when he took over after it was rocked by allegations of improper hygiene practices by a dental clinic dentist who has denied those claims. More than 500 veterans who had undergone invasive procedures in the clinic had their blood tested as a result, and hospital officials said three tested positive for hepatitis, though they werent certain how the clients contracted it. The center this year also began investigating allegations that a doctor drew blood from patients under anesthesia without their knowledge or consent. In a statement to the newspaper, the VA indicated it couldnt fully explain what happened with the records found in the attic and described the situation as an unfortunate and isolated event. Unfortunately, the only party who truly knows is the deceased individual, the hospital said. It declined to identify the former employee and did not say what job that person held. Arnold said he gets partial disability payments from the VA because an accident at a Marine base injured his spine in 1979. He said he wonders whether his denied requests for more disability compensation would have been affected by the recently found records. Hes appealing the denials.

Delphos native expecting handful of babies

By Stacy Taff staff@delphosherald.com MEDINA When Leann Alferio and her husband Jacob started talking about adding to their family, there were differences of opinion regarding the number of children they wanted. I have a 9-year-old daughter, Lexi, who I had before we were married. When we talked about how many children we wanted to have together, he always said hed be fine with one or two more but Ive always wanted a large family, Leann said. After a year of trying, they went to their first ultrasound appointment and were shocked to find the decision had been taken out of their hands. Alferio was pregnant with quintuplets. I remember Jacob saying to me, you always manage to get your way, she laughed. Quintuplets can be conceived naturally but more often than not, they are the result of fertility treatments. In the Alferios case, it appears to have been a little of both. We were married a year ago but we had actually started trying to get pregnant before that because we knew we wanted to start right away, she said. We were having difficulty, so we were seeing a fertility doctor for about a year. We did the injections of Follistim, which increases egg production. We tried the insemination. We did that for about three months but it just got too expensive and it was getting way too stressful for both of us. We decided to take a break and just relax. One month after taking a break from insemination, the Alferios learned they were finally pregnant. We knew I had five eggs from the injections but we never expected them all to take naturally, she said. While that moment shouldve been one of joy and celebration, the doctor began informing the couple of the numerous risks and complications that could ensue if they proceeded. They were told that a womans body is not meant to carry five babies and one or more of the children could possibly be born with anything from mental retardation to cerebral palsy. The worst of it came when they were told to seriously consider what the doctor called fetal reduction, or

selection. In other words, they were urged to pick and choose which babies to keep. We didnt really say too much at that point, Alferio said. She told us that we should do the selection, carry just two or maybe three. Selection is abortion. For whatever reason, we got all five. We didnt feel it was our place to make that decision. If we arent meant to have all five, something will happen. Due to obvious reasons, they sought another doctor. At Fairview Hospital in Cleveland, they found a specialist who fit their needs. We ended up going to Dr. Shah and we feel really fortunate to have found him, she said. Obviously, he brought See QUINTS page 10

poem, which was later put to the tune of an old British drinking song and eventually became The Star Spangled Banner. While all this was going on, some of the troops back in Fort Jennings were getting bored for lack of activity. So Col. Jennings, in October of 1812 sent a foraging expedition, under Captain William B. Jones, to the Indian towns of Upper and Lower Tawa on the Blanchard River. Capt. Jones and members of his Ohio Militia Company, finding the towns deserted, feasted on the Indian food supplies for about a week. They then burned the Indian towns and all the remaining foodstuffs before returning to Fort Jennings. The War of 1812 ended with The Treaty A map of the forts. of Ghent (Belgium) on 24 December 1814 but word didnt reach back in the states until much later. So the Battle of New Orleans was still fought on January 8. The Americans did not win the war but they did not lose it either. The Native Americans were the biggest losers. Tecumseh was a great Native American who spoke English. White settlers who encountered him were struck by his strong features and innate dignity. His brother, often called the Prophet believed he had visions. His teachings were not always in the best interest of their people. Tecumseh, the great chief of the Shawnees had been trying to unite the Indian tribes. He was killed in the battle of The Thames River in October 1813. The War of 1812 played a big part in the formation of west central and northwestern Ohio. Several soldiers who served in the War of 1812 returned to live or purchase land in the Fort Jennings area Andrew Russell served under Col. Jennings. He later lived with his family in the block house in the S/E corner of the fort. They later settled at Fort Amanda. He died at Fort Amanda and his widow married Samuel Washburn. Several veterans of the war later lived

(Part II)

Did you know a president of the United States once slept in Fort Jennings? He was Pres. William Henry Harrison, the ninth president of our USA. He was General William Henry Harrison at the time. Harrison was on his way to assist Gen. Winchester at Fort Defiance, when he stopped for overnight at Fort Jennings on the banks of the Auglaize. He was said to have 3000 troops with him. How they all spent the night at that fort is rather puzzling. Most of them had to camp in the low flat beech bottom. The famous historian, Knapp, described the camp-over in his writings. It was October, 1812. Troops marched as long as there was light. The ground of the encampment (Ft. Jennings) was on the side of the Auglaize River, in a flat beech bottom, which was nearly covered by the water from the rain, which fell in torrents during the whole night. The troops had no axes and the tomahawks could not affect the green beech trees. Those who could find a dry log were lucky; the others were obliged to content themselves with sitting on their saddles at the roots of the trees. Being separated from the baggage, they had nothing to eat or drink. The men were peevish and the General (William Henry Harrison) seated by a small fire in the rain directed one of his officers to sing an Irish glee. The lyrics of the song and the conduct of the officers soon produced good humor and cheerfulness in the camp. Lt. Col. William Jennings was from Kentucky. He came from a long line of military men. Jennings had served under Gen. Harrison at the battle of Tippicanoe in Indiana Territory. After that battle Col. Jennings returned home, only to be called back to duty in 1812. He was to command the Second Regiment of the Kentucky Volunteer Militia. After they were mustered in at Frankfort, Kentucky, the troops rendezvoused at Cincinnati before joining Harrisons army at Ft. Saint Marys. On 21 September 1812 Lt. Col. Jennings was ordered to proceed down the Auglaize toward Ft. Defiance, to build an intermediate supply post and escort provisions to Gen. James Winchester on the Maumee River. After advancing about 30 miles, Jennings saw signs of Indians, and his spies reported the enemy was at Ft. Defiance. He then halted on the banks of the Auglaize and began building block houses. During the building of the fort, the men slept in tents. Some of the correspondence sent from one militia commander to another describes how tough things were, traveling through the Great Black Swamp. Some are as follows: 22 October 1812..Harrison to the War

Department. I am not able to fix any period for advance of troops to Detroit. It is pretty evident, that it cannot be done on proper principles until frost shall become so severe, as to enable us to use rivers and margin of lake, for transportation of baggage on ice. To get supplies forward through a swampy wilderness of near 200 miles in wagons or on packhorses, which are to carry their own provisions, is absolutely impossible. While Col. Jennings was ordered to build the fort. (On about an acre of land), Harrison ordered Pogue to construct a road between the Jennings camp and Ft. Defiance. The logs for the walls of the fort were laid horizontally, there being an abundance of beech, elm and other trees nearby. A spring inside the fort enclosure assured water in case of attack and a further provision was a covered passageway to the rivers edge. This was a rather unique feature, and one not noted in other stockades. The War of 1812 was fought on many fronts, including at sea. Already in August 1812, the Constitution (Old Ironsides) defeated the British ship, the Guerriere. The Constitution now rests in a place of honor in the bay at Boston. Almost everyone is aware of Commander Oliver Hazard Perry and his command of the victories against the British on Lake Erie. Then there was the River Raisin Massacre. This was near what is now Monroe, Michigan. The first battle of the River Raisin was a victory for the Americans. Then a second battle ensued. The British attacked again. Some men were taken prisoners by the British, while others were taken captive by the Indians. This ended in a massacre of many Americans, including one company of the Kentucky militia, originally stationed at Fort Jennings. Then there was the time when the Americans, invaded Canada. Some said it was to free the Canadians from the British rule. At any rate the Americans sacked York (present day Toronto) and burned the government buildings. The British swore to get even by later burning our United States Capitol and The White House. in August of 1814. The red glow of the burning capital was visible as far as Baltimore, 40 miles away. The British fleets next target was Baltimore, the fourth largest city in the United States. The British Admiral Cockburn was trying to force Fort McHenry into surrendering. The battle waged for 25 hours. Francis Scott Key was on a ship in harbor and watched the sight of the mortar bombs and the rockets red glare. When they saw the American flag still waving over Fort McHenry, Key was inspired to write a

on what is now Road 22-S near Road T. They were Thaddeus Harris (6 in household), James Thatcher (3 in household), William Cochran (7 in household) and Jim Cochran (3 in household). Judy (Feathers) Schroeder discovered that her ancestor, Elias Wallen became a land owner in this part of Putnam County. He acquired 69.5 acres of land on 9 August 1924 and 33.15 acres on 15 August 1927. Wallen was sometimes spelled Walden/ Waldron/Walling and Wallan. He had served in the War of 1812 as a corporal in the New York Militia. Jennifer (Laldd) Klir discovered her ancestor, Ellison Ladd was also a War of 1812 veteran. He was a private in Ross County Roll of Ensign Amaziah Morgans Company. He came to Jennings Township with his son Edward, in 1834 or 1835. Judy Schroeder wrote a fictional account of the feelings of Meema, a Native American Woman. This story gives her feelings of all the happenings in the area before lndians were relocated out west. This story can be found on page 6 of the recently published, Bicentennial History of Fort Jennings, 1812 2012. This book can be found in the Delphos Public Library and the Putnam County District Library in Ottawa.

Orioles rally past Indians 9-8

BY DAVID GINSBURG The Associated Press BALTIMORE Given their play of late, the Baltimore Orioles couldnt possibly have expected to come out on the winning end of a high-scoring, back-andforth duel. With some late-inning heroics, the Orioles did just that. Ryan Flaherty singled in the tiebreaking run in the seventh, Matt Wieters hit a three-run homer, and the Orioles broke out of their offensive funk with a 9-8 victory over the Cleveland Indians on Friday night. On a steamy night in which temperatures reached 100 degrees, both teams worked up a sweat circling the bases. Cleveland had a season-high 16 hits, but the Orioles scored just enough runs to secure their third win in 10 games. It was a battle, Wieters said. We havent been able to come out on top of those, and we really worked to get that win. The defeat was costly for the Indians, and not just because they fell behind first-place Chicago in the AL Central. Cleveland lost third baseman Lonnie Chisenhall for 4-6 weeks with a broken bone in his right forearm. The injury occurred when he was hit by a pitch by Baltimore reliever Troy Patton. I had a bad feeling about it, manager Manny Acta said. Its bad news for us, especially a young kid like him. Its always tough seeing a young guy getting his feet wet, getting better and then all of a sudden, an injury like that. Chris Davis started the Orioles seventh-inning uprising with a two-out single off Joe Smith (5-2). After Wieters walked, Flaherty delivered an RBI single to right. Xavier Avery hit his first major league homer in the eighth to make it 9-7. When I looked up and I saw it go out, I just started smiling, he said. The Orioles went 3 for 12 with runners in scoring position after going 3 for 52 in that situation over their previous 10 games. It was the first time in 11 games that Baltimore scored more than three runs. I was so proud of the guys tonight. They just kept grinding, Orioles manager Buck Showalter said. They were not going to be denied. Matt Lindstrom (1-0) got the last out in the top of the seventh, Pedro Strop worked a perfect eighth and Jim Johnson earned his 23rd save despite giving up a ninthinning run. Wieters and Asdrubal Cabrera of the Indians both homered onto Eutaw Street, located in front of the B&O Warehouse and far beyond the right-field wall. It was only the second time in the 21-year history of Camden Yards that two balls landed on Eutaw Street in the same game; Rafael Palmeiro did it twice on April 11, 1997. The Orioles trailed 5-4 before Wieters connected against Derek Lowe in the sixth inning. The lead vanished in the seventh, when the Indians pulled even on an RBI double by Shelley Duncan and a run-scoring double play. Duncan entered in the fifth as a pinch runner for Chisenhall. Orioles starter Jake Arrieta gave up five runs and eight hits in 3 2-3 innings, but Baltimores comeback enabled him to avoid becoming the first 10-game loser in the majors this season. Lowe allowed seven runs, four earned, in 5 1-3 innings. The right-hander has allowed seven runs in three of his past five starts and is 0-3 in that span. Three of the first four Cleveland batters got hits in the first inning, including an RBI single by Michael Brantley. After going six straight games without an error, Cleveland made two in the bottom half that led to

SAN FRANCISCO The pitcher with the perfect game ended the franchiserecord run of shutouts. Matt Cain took the mound for his first home start since tossing his gem June 13, and with one pitch his chances of throwing the Giants fifth consecutive shutout were gone. Mike Leake pitched a nine-hitter for his first career complete game and homered off Cain, and the Cincinnati Reds beat San Francisco 5-1 on Friday night. Zack Cozart hit the first pitch of the game from Cain over the wall in left-center and, just like that, San Franciscos franchise-best shutouts streak ended at four. First pitch, I was trying to go away and it was middle, Cain said. While Cain has the perfecto to his name, it was everybody else in the rotation Barry Zito, Ryan Vogelsong, Tim Lincecum and Madison Bumgarner, in that order involved in the remarkable string of shutouts. San Francisco also was the first team in major league history to blank four clubs when the

opponent had begun the day in first place. It was great. It was a good run and Im just sad I didnt keep it going, Cain said. The guys had done a huge job over the (week) against the Dodgers and last night with Bumgarners performance. I wanted to follow that up, and I didnt do that. Jay Bruce added a two-run double in the first among his four hits to stake Leake (3-5) to a quick cushion as the Reds got to Cain early to snap a four-game road skid. Leake homered with two outs in the sixth, his second of the year. Cain (9-3), pitching at home in sold-out AT&T Park for the first time since tossing the 22nd perfect game June 13 against the Astros, had his career-best eight-game winning streak snapped. The right-hander allowed three runs in the first inning for the first time since June 24, 2010, at Houston. Every time he goes out there he has no-hitter stuff and right away we jumped him in the first inning and we chipped on a couple more runs after that, Reds manager Dusty Baker said. When you can score like this, especially when youre the visiting team, it takes a lot of

pressure off your pitcher. San Franciscos pitching staff went 36 innings without allowing a run, beginning after Cains start at Oakland last Sunday and lasting until his next outing. It was the longest scoreless innings streak in San Francisco history and second-longest to the franchise mark of 38 accomplished by the New York Giants in 1903 and 33. Bruce also hit an RBI double in the seventh that chased Cain, matching his career high with four hits for the fifth time he has done it. Cains 11 hits in 6 2-3 innings matched his most given up this year and the right-hander lost for the first time in 11 starts since a defeat to Miami on May 1. He allowed five runs, struck out seven and walked one. Leake came out for the ninth and allowed Pablo Sandovals one-out home run before retiring Brandon Belt on a deep fly to center and striking out Brandon Crawford to end his impressive 111-pitch performance. Im not huge on complete games but it was nice to get one finally, he said. Couldnt happen without the defense we had today and the early start that we got in the

first inning. Leake escaped the fourth on an inning-ending double play on which Sandoval, trying to break it up, reached his right hand around shortstop Cozarts left leg to trip him up and keep him from turning it. Belt was initially called safe, then Baker raced out to argue. The umpiring crew visited and overturned the call to interference, ending the inning. Manager Bruce Bochy said it was the right call. Sandoval made a legal slide, but the mistake was grabbing Cozarts leg. I did it, Sandoval admitted with a smile. Brandon Phillips returned to the Reds lineup after he was scratched before Thursday nights series opener because of continuing effects from the blow to the head he received during Wednesdays 8-4 loss to the Milwaukee Brewers. Baker said Phillips passed all concussion tests Friday. Phillips went 1 for 5 with a seventh-inning single and stolen base before scoring on Bruces second double. He was trying hard to lobby to get back in the lineup, Baker said. Leake singled in the second ahead of his homer.

See FISHING page 7

three unearned runs. Brian Roberts reached on a poor throw by first baseman Casey Kotchman and scored when shortstop Cabrera mishandled an RBI grounder by J.J. Hardy. Wilson Betemit followed with a run-scoring double. Cabrera hit his 11th home run, the second in two games, to make it 3-2 in the third. A fielding gaffe by the Orioles fueled a three-run fourth that put Cleveland up 5-3. After Kotchman hit a leadoff single, Flaherty backed away from a fly ball to right-center hit by Chisenhall, thinking center fielder Adam Jones would make the catch. The ball dropped between the two for a single, setting the stage for a bases-loaded walk to Shin-Soo Choo and a tworun single by Jason Kipnis that ended Arrietas night. I got our starter knocked out in the fourth inning because of that, Flaherty said. Fortunately, we were able to rally around it and come back from it, but still thats not winning baseball. Baltimore closed to 5-4 in the fifth when Robert Andino walked, stole second and scored on a groundout by Avery. NOTES: Roberts snapped a 0-for-16 skid with a secondinning single. He also scored for the first time in 12 games.

BY HOWARD FENDRICH The Associated Press WIMBLEDON, England A day after Rafael Nadals stunning exit at Wimbledon, the only other men who have won the tournament since 2003 sixtime champion Roger Federer and defending champion Novak Djokovic found themselves trailing far-less-accomplished opponents, too. Here we go again? Not quite. Federer sure came close to following Nadal out the door, though. of France, then was two points away from losing six times, before coming all the way back Friday to pull out a 4-6, 6-7 (3), 6-2, 7-6 (6), 6-1 victory in the third round. Oh, my God, it was brutal, Federer said. The thing, when youre down two sets to love, is to stay calm, even though its hard, because people are freaking out, people are worried for you. ... You dont have, obviously, many lives left out there. You just try to play tough and focus point for point. Sounds so boring, but its the right thing to do out there. He should know. This was the eighth time in Federers illustrious career that he overcame a two-set hole, including against 2009 U.S. Open champion Juan Martin del Potro in the French Open quarterfinals 3 1/2 weeks ago. Mentally, hes a rock. Hes two sets down and he doesnt show anything. And after that, if your level is a little bit lower right here, right now, he takes the opportunity, said Benneteau, whose cramping thighs were massaged by a trainer during two final-set changeovers. At the beginning of the third set, I was not as good as I was in the first two sets, and in 5 minutes, its 4-0.

from the ponds. Call Wildlife District Three at (330) 644-2293 for details. Edgewater Park to Eastlake CEI Seawall (Cuyahoga/Lake counties) White bass are biting in good numbers from Edgewater Park (Cleveland Lakefront State Park, Edgewater exit, N of SR 2) to Eastlake Seawall (Erie Road off of SR 283) on shiners, jigs, twisters, small crankbaits and small spoons for best results. Both locations are shoreline access points but anglers will find several additional points between these two public areas. Read more in the Lake Erie Fishing Guide which can be obtained by visiting a DOW office or by calling 1-800-WILDLIFE. Places to launch a boat are also listed in the publication. Anglers should also check out the Lake Erie Access Guide and interactive map viewer at www.dnr.state. oh.us/coastal. SOUTHEAST OHIO Lake Alma (Vinton County) Good catches of bluegill can be reeled using live bait, including wax worms and night crawlers. Largemouth bass can be caught using artificial baits, including jigs with twister tails and rattletraps; try the back side of this 74-acre lake and under the bridge. Electric motors only. Hocking River (Hocking/Athens counties) - Smallmouth bass fishing is usually popular this time of year; the best areas tend to be in pools and near submerged structure, rocks or root systems using minnows, roostertails, soft craws and twisters, especially from canoes or the shoreline. Channel catfish can also be found throughout; try cut bait, bluegill and minnows. SOUTHWEST OHIO Acton Lake (Preble County) Channel catfish are biting on chicken liver fished along the bottom anywhere in the lake. Saugeye on the Butler County side are being caught using minnows or artificial bait between 10-12 feet deep for the best results. Crappies are hitting on minnows fished 6-8 feet under bobber near downed trees and brush. Whitewater River/Lake (Hamilton County) - Anglers are catching bass and bluegill. For bass, try jigging, crankbaits and soft plastics. The bluegill are easy to catch provided you rent a boat; fish along the woods with wax worms and a bobber, as well as smaller inline spinner baits. Good size catfish in the 10-pound range have been reported; use goldfish, shiners and suckers that can be purchased at the marina. Now, try the pool where the river meets US 50. Anglers have caught saugers, whitebass, channel catfish, smallmouth and largemouth bass; they report good success when the water is a little higher than the normal and clear. Summer fishing is also good here if you fish early in the morning or at dusk; try a jighead with a plain white grub. Spoons and rattletraps are also recommended. Rocky Fork Lake (Highland County) - Good catches of saugeye are coming from 6- to 15-foot depths near the island area at the east end; cast jigs with plastic curly tails or jigs tipped with a nightcrawler or troll shad-pattern crankbaits over underwater humps or along shoreline points. Bluegill are being taken from 2-4 feet deep using red and wax worms or small jigs. Anglers are catching crappie by live minnows or wax worms throughout the lake but look for areas with woody debris or submerged trees and brush to be more productive using a slip bobber at greater than 8 feet deep. Channel catfish are being caught by shore anglers using nightcrawlers, shrimp and chicken liver tight-lined along the bottom in 3- to 6-foot depths. Sycamore State Park (Montgomery County)/Caesar Creek State Park (Warren County) Both are sponsoring a Youth Fishing Day 9 a.m.-3 p.m. today (and on Aug. 25) for anglers 15 years old and younger; bait and assistance from volunteers will be provided at no charge on these dates. Youth are encouraged to bring their fishing poles; however, poles will be available during these events. All young anglers must be accompanied by a parent or guardian while at the youth events; parents cannot fish but may assist their youngsters. Picnic tables and restroom facilities are available and young anglers are encouraged to wear hats and sunglasses to protect themselves while casting their lines. State park ponds were/will be stocked with catchable channel catfish and hybrid bluegill just prior to each event and will be open daily. OHIO RIVER Belleville Dam/Tailwaters Hybrid-striped bass fishing was slow this past week; some, mostly 3-4 pounds, were being caught at the dam with spoons and plastics or live bait fished beneath agitators. The earlier and later parts of the day seem the best. Catfish are being caught on a regular basis with both nightcrawlers and cut bait anywhere along the shoreline or at the walkways. Sauger and walleye fishing has slowed, expected for this time of the year. Racine Dam area - Live bait has been the hot choice this week for catching both hybrid-striped and smallmouth bass; try creek chubs, shiners or your favorite variety of live bait near the dam. Meldahl Dam (Clermont County) - Anglers are reporting steady fishing with catches of gar, catfish and a few white bass; try fishing close to the dam. Daylight hours until dusk have been producing good numbers but early evening until dawn have been good for catfish; try chicken liver or cut shad. LAKE ERIE Daily Bag Limit per Angler Regulations to Remember: Walleye (Ohio waters) - 6 fish (minimum size

limit is 15); Yellow perch (Ohio waters) - 30 fish); Trout/salmon 5 fish through Aug. 31 (minimum size 12): Black bass (largemouth and smallmouth) (Ohio waters) - Starting today, 5 fish (minimum size 14). Western Basin: Walleye fishing has been fair; fish have been caught by trolling or drifting/casting N of West Sister Island, at the turnaround buoy of the Toledo shipping channel, on the reef complex in the Camp Perry firing range and W of Green and Rattlesnake islands. Trollers have been using worm harnesses with inline weights or divers and also divers with spoons. ... Yellow perch fishing has been best around the Toledo water intake, E of the Kelleys Island airport and SE of Kelleys Island. Perchspreaders with shiners fished near the bottom produce the most. Central Basin: Walleye fishing has been good; fish have been caught at the weather buoy near the Canadian line N of Vermilion, in 60 of water N of Gordon Park and in 67-77 of water NE of Chagrin River. There has been excellent fishing in 72-73 of water N-NE of Geneva and in 69-72 of water NW of Ashtabula; trollers are using divers with green, yellow, black, blue, pink and purple spoons and worm harnesses. ... Yellow perch fishing has been excellent, especially in 35 of water NE of Wildwood State Park, in 40 N Chagrin River, in 30-38 NE and NW of Fairport Harbor and in 40-47 NE of Conneaut; perch-spreaders with shiners fished near the bottom produce the most. Shore anglers are catching fish off the Cleveland Piers and at Headlands Beach Pier in Mentor out at the lighthouse using spreaders with shiners; the mornings and evenings have been best. Shore anglers are also catching rock bass off the Piers. ... Smallmouth bass fishing has been very good in 15-25 around harbor areas in Cleveland, Fairport Harbor, Geneva, Ashtabula and Conneaut using dropshot rigs with rubber worms, softcraws, leeches, tube jigs and crank baits. East of Fairport Harbor, anglers are trolling crank baits in 17-22 with good success. ... White bass anglers are catching them along the shoreline. Look for gulls feeding on schools of shiners at the surface; these will be below the shiners. Shore anglers are also catching them off the Eastlake CEI breakwall using agitators with jigs tipped with twister tails or = small spoons. ... Catfishing continues to be very good in the Grand River around the Grand River Landing; anglers are catching large fish using nightcrawlers. ... The water temperature is 71 degrees off of Toledo and 68 degrees off of Cleveland, according to the nearshore marine forecast. ... Anglers are encouraged to always wear a U.S. Coast Guard-approved personal flotation device while boating. ----Help protect Ohios great fishing resources Report fishing violations to the Turn In a Poacher hotline COLUMBUS Anglers throughout the state can do their part to protect Ohios high-quality fishing by reporting fishing violations they observe to the Turn In a Poacher (TIP) hotline, according to the ODNR Division of Wildlife. Each year, the TIP hotline receives approximately 4,800 calls from concerned citizens reporting violations involving the poaching, or illegal taking, of fish and game, trespassing, commercialization of wildlife and the over-harvesting of fish and game. Since its inception in 1982, more than 3,000 convictions have been made using information from the hotline. While the majority of TIP reports are received during the hunting seasons, anglers should remember that the TIP hotline is available year-round. Double-tripping, keeping fish over the daily bag limit and snagging walleye and other species of game fish are serious violations of the law, said Ron Ollis, law enforcement program administrator for the DOW. Ohios state wildlife officers rely on law-abiding anglers to be our eyes on the water and we request that people report any suspicious activity that they observe. Anglers are reminded not to approach anyone committing a wildlife violation. Instead, take note of the violation, date, time, location and the license plates of any vehicles in the vicinity. Call 800-POACHER or go online to www.ohiotip.com to report the information. All reports are confidential and can remain anonymous. Callers may be eligible for a cash reward. The TIP hotline is staffed 24 hours a day, seven days a week, including holidays. Ohios fishing regulations are available at all hunting and fishing license agents by calling 800-WILDLIFE or online at www. wildohio.com. ---Apply online for Controlled Deer and Waterfowl Hunts All applicants must possess a current hunting license in order to apply for controlled hunts. The Divisions new license system will automatically detect whether or not an individual meets this prerequisite. This change successfully identifies those applicants who truly intend to participate in the hunting event should they be drawn for a permit. Applicants can check the status of their lottery applications by visiting wildohio.com and clicking on the Wild Ohio Customer Center. Select Manage Your Customer Account and view your lottery results. If you are selected, you will be able to print your hunting permit directly from your customer account. Application deadline is July 31. Call 1-800-WILDLIFE (1-800-9453543) with questions.

Rickey Stenhouse embraces promotion to Sprint Cup in 2013

The Associated Press SPARTA, Ky. Ricky Stenhouse Jr. was shocked it was such a big deal. When it was revealed last week that Roush Fenway Racing would promote him into Sprint Cup points leader Matt Kenseths spot when Kenseth leaves after the season, the 24-year-old Mississippian was overwhelmed by the response. I guess I didnt really realize it was going to be that big when they announced it, he said, grinning. It was pretty cool, seeing everything on Twitter and everybody texting me. It was like I won a race. Stenhouse had been told about the move but had been sworn to secrecy. He couldnt keep the news to himself. So he told his parents. But they didnt really grasp the immensity of what had just happened for their son until the word spread officially the next day. They were very excited, he said from underneath a wide, white cowboy hat. It was really cool to see the reaction. It was huge news throughout NASCAR that Stenhouse, the defending Nationwide Series champion, would be moving up to the Sprint Cup Series. Not to mention that Kenseth was moving elsewhere. A week after first being told by Roush Fenway owner Jack Roush, Stenhouse still isnt exactly certain what to make of all the hubbub. Early in the year we were talking about running some Cup races toward the end of the year to get ready for next year, said Stenhouse, who rode up for this weeks race at Kentucky Speedway with his parents in their motorhome. I think Jack had the idea we were going to do that, no matter what. Im not sure what all happened. I just got a call that said that we were going to run and that Matt was not coming back. I have no idea how it went down but I just got the phone call and never would have expected that. Others arent surprised at all. Stenhouse has shown a steady hand in his four years in the Nationwide Series, sort of the Triple-A to the majorleague Sprint Cup. He won two races a year ago while winning the series title and has three wins and stands in third place this year. If you win the championship at the second or third tier, I think thats obviously a glowing endorsement that youre ready to enter the Sprint Cup Series, said Sprint Cup driver Brad Keselowski. That speaks for itself. That shows right there that hes ready for the opportunity. Making such a dramatic move can sometimes backfire on a team, turning its focus to inner turmoils instead of winning races. But another top driver, Kevin Harvick, felt it can sometimes have the opposite effect. Sometimes it makes them better because everybody wants to prove everybody else wrong, he added. So while everyone keeps an eye on where Kenseth winds up he has yet to announce where hell end up although rumors are it will be Joe Gibbs Racing Stenhouse looks forward to the challenges ahead. He says he will sit down soon and discuss his schedule with his bosses. No, he doesnt know what number car he will drive next year: the No. 17 vacated by Kenseth, or possibly Roushs flagship No. 6 in the Cup Series. Thats also been his car number in Nationwide. All he knows for certain is hed love to go out with a second straight series title. We can go into this with a little more confidence, a little more pep in our step, he added. Our teams pumped up about it, excited for me. Im excited about it. It puts a lot of confidence in me that Jack Roush and everybody at Roush Fenway has the belief in me to go out there and run that car next year. It gives us a little bit of an extra edge going into the rest of the season and to finish it off on a strong note. Thats the only way we can go out, to win a championship.
races and FedEx is right behind at 36 with a visually uncluttered paint scheme that suits Hamlins personality. The company has been with him since his 2005 debut in a tryout role with Gibbs and Hamlin has no reason to believe FedEx doesnt want to continue its sponsorship role. DuPont has been with 4-time champion Jeff Gordon since his 1993 debut and although the company has taken a lesser role the past two seasons, its the longest driversponsor relationship in NASCAR. That ranks Hamlin and FedEx third, behind 5-time champion Jimmie Johnson, who has been with Lowes since his 2001 debut with Hendrick Motorsports. Hamlins latest excursion with his sponsor took Hamlin to Anchorage on Monday, where he visited the main shipping hub and its employees. The event was open to FedEx employees all over Alaska and Hamlin realized the importance of being sent to visit with the associates many of whom took the day off and traveled across the state to meet their driver. When his appearance was over, he met 2012 Iditarod champion Dallas Seavey, who gave him a lesson in driving a dog sled. Then Seavey brought out his dogs, set up the sleds and raced through the parking lot against Hamlin. Hamlin, who will race tonight at Kentucky in temperatures expected to hit triple digits, was wowed by Seaveys tales from the Iditarod. Waltrip embraces his old Kentucky home team SPARTA, Ky. Even as he traveled the world racing cars, Michael Waltrip always had a soft spot for his old Kentucky home. The 2-time Daytona 500 winner unveiled a car honoring his favorite college team. Waltrip was at Kentucky Speedway, site of this weeks NASCAR races, to reveal a new paint motif on the Michael Waltrip Racing No. 55 Toyota that pays homage to the University of Kentucky national champion basketball team. When I was a kid growing up, I used to sit in my home in Owensboro, Ky., and watch the replays of the Kentucky games after the 10 oclock news, Waltrip said. Mom and Dad would let me stay up late on those nights so I could watch my team play. Theyve been my team my whole life; Ive never cheered for another team. To be able to race this car and honor the program is a real blessing. UKs mascot and athletic director Mitch Barnhart were on hand as a black cover was pulled off the blue-and-white car to reveal several national championship logos. Like at a movie premiere, dozens of photographers snapped photos. Waltrip is driving the car this week. He shares the ride with Mark Martin and Brian Vickers. At Talladega, MWR driver Clint Bowyers car featured a University of Alabama national football championship paint scheme. But because of Waltrips lifelong allegiance to the Wildcats, it was clear that he was thrilled to be behind the wheel of the Kentuckythemed car. After F1 scandal, Piquet making progress in NASCAR ELKHART LAKE, Wis. Nelson Piquet Jr.s famous family name doesnt quite have the same kind of clout in NASCAR as it does in the rest of the auto racing world. Some of the baggage might have made its way here from overseas, though. The son of a 3-time Formula One

champion, the Brazilian achieved his dream when he got an F1 ride of his own in 2008. But it ended in scandal after Piquet deliberately crashed in a race to help his teammate, following orders from his team. Now Piquet is trying to work his way up the ladder in NASCAR and hopes his victory in Saturdays Nationwide Series race at Road America will get him a second look from team owners. There has been no shortage of open-wheel racers trying to make the transition to NASCAR in recent years but few have been willing to start near the bottom and work their way up. That isnt the case with Piquet, who competes full time in the Camping World Truck Series NASCARs equivalent to Double-A baseball, two rungs below the marquee Sprint Cup Series. Piquet knows he wont be able to work his way up to a full-time Nationwide ride unless he shows he can run consistently well on oval tracks. He hopes to run Nationwide fulltime next season, the next step in a career path that seemed unlikely when Piquet followed in his famous fathers footsteps to Formula One only to take a bad turn. Piquet intentionally crashed his car at the 2008 Singapore Grand Prix to help teammate Fernando Alonso win the race. Piquet, who was fired during the 2009 season, eventually was cleared of wrongdoing while team officials were punished after an investigation by racings governing body determined Piquet had been ordered to crash. Guerrieri finding a home in Indy Lights DES MOINES, Iowa For drivers on the Indy Lights development circuit, being overlooked is a fact of life. The brave souls who stuck around until Sunday morning after a late start due to storms saw yet another dazzling performance by Argentine Esteban Guerrieri. The charismatic Guerrieri took advantage of a blocking penalty on leader Tristan Vautier and hung on for his third win in five starts. In victory lane Guerrieri pulled out an imaginary machine gun and sprayed the crowd as though he was mowing down the competition. Guerrieri always seems ready to put on a show. Guerrieri, 27, clearly has enough personality for a ride in IndyCar in 2013. But charm is nothing without talent and Guerrieri appears to have the chops necessary to compete in Americas top open-wheel series. He earned a spot with the European Formula Renault in 2001 and hoped to work his way up to Formula 1, only to find the way blocked. So he signed with Sam Schmidt Motorsports before the 2011 season and quickly took to Indy Lights. Guerrieri did say that if the Argentine government would throw its support behind him to get an F1 ride, hed certainly listen. But his goal now is IndyCar and he may not have to wait much longer. Guerrieri won six poles in 14 races in 2011 and took three of

FedEx ships Hamlin to Alaska for a sponsor event CHARLOTTE, N.C. Denny Hamlin has sorted packages at FedEx headquarters on the busiest day of the year, been sent to the Super Bowl, the Orange Bowl and has done cross-promotions with golfer Davis Love III and Cowboys tight end Jason Witten. But his latest sponsor outing may have been the most unique yet: FedEx sent him to Alaska to learn how to drive a dog sled with the reigning Iditarod champion. I get to do a lot of things I wouldnt normally get to do if I was not with FedEx, Hamlin said. For me, its good to have a sponsor that shows you in such a great light. I get so much credit for doing all these things but they are the ones who are helping out the communities everywhere I go. That relationship is one of the reasons Hamlin is currently negotiating a contract extension with Joe Gibbs Racing, more than a year before his current deal even expires. He looks around the garage and cant find many rides he believes are as competitive as his No. 11 Toyota. He understands hes got a very good thing going and how fortunate he is with FedEx backing him and JGR. There are only four sponsors in NASCAR Lowes, Menards, Miller and NAPA that pay for the primary sponsorship of a full 38-race schedule. 5-Hour Energy does 37

the races, finishing as the runner-up in Indy Lights points standings. This season hes already matched his win total from 2011 while taking over the points lead with his win in Iowa. That, combined with the personality and marketability, would seem to put him in prime position for a fulltime IndyCar ride in 2013.

The Herald 9

Tomorrows Horoscope
By Bernice Bede Osol
SUNDAY, JULY 1, 2012 The possibility to increase your earnings in the year ahead looks exceptionally good. If you put your mind to it, you should do extremely well in financial areas, whether you are working for another or are selfemployed. CANCER (June 21-July 22) -- Youre someone who must have purpose to your life. In order to feel gratified, get involved in meaningful objectives that make you feel youve done something worthwhile. LEO (July 23-Aug. 22) -- Its not surprising that you need some variety in life at times, and it might be one of those days. If you find yourself bored, initiate doing something different with friends. VIRGO (Aug. 23-Sept. 22) -- Although it may be up to you to design the blueprint for finalizing a matter that meets everyones desires, youll have all the know-how to do so right at your fingertips. LIBRA (Sept. 23-Oct. 23) -Ideas and concepts that are significant to you are also relevant to persons with whom you are involved, so consult each and every party before putting anything into action. SCORPIO (Oct. 24-Nov. 22) -If your financial picture looks secure at this moment in time, its OK to go ahead and do something worthwhile that makes you happy. In fact, make it a priority. SAGITTARIUS (Nov. 23-Dec. 21) -- Independence is always of utmost importance to you, so dont allow anybody to plan an agenda for you if you can help it. Do what you want when you want to do it. CAPRICORN (Dec. 22-Jan. 19) -- Be party to events, but dont try to manipulate everything. You would be so much happier allowing matters to unfold as they will, letting things take their own course. AQUARIUS (Jan. 20-Feb. 19) -- If youve had a yen lately to touch base with two friends in particular, it would be nice if you could make this possible. Try to do what you can to arrange things. PISCES (Feb. 20-March 20) -If someone throws down the gauntlet, youre not likely to ignore the challenge. Your competitive spirit is more easily aroused than usual today and youll take the bait. ARIES (March 21-April 19) -In order to satisfy both your mental and physical restlessness, some type of rigorous activity will be required. Do something fun, such as swimming or hitting the tennis court. TAURUS (April 20-May 20) -- Although you rather enjoy being a loner at times, you might do yourself some good if you get involved in a few joint endeavors. Operate where you feel the most fulfilled. GEMINI (May 21-June 20) -Try to bring better balance into your life if you can, by taking stock of your recent affairs or activities, for example. If youve been working too hard, get out and have some fun. MONDAY, JULY 2, 2012 Of your own volition, you might choose to undertake a very demanding and serious endeavor in the year ahead. Although the route may not be an easy one, youll want to travel it anyway because the rewards will be so outstanding. CANCER (June 21-July 22) -Theres a strong chance you might have to deal with someone whom you feel wronged you in the past, but dont treat this as an opportunity for payback. Just be alert that it doesnt happen again. LEO (July 23-Aug. 22) -- Be extremely selective to whom you turn for counsel if you find yourself in need of financial advice. Go only to someone who has had a lot of success in dealing with money matters. VIRGO (Aug. 23-Sept. 22) -- You know how awful you felt in the past when someone treated you in a deceitful manner, so dont do anything that would cause you to be accused of this type of behavior. LIBRA (Sept. 23-Oct. 23) -Youre likely to be quite imaginative, which is all well and good, as long as you dont view lifes developments more negatively than positively. Focus only on winning. SCORPIO (Oct. 24-Nov. 22) -- If you find yourself feeling a trifle envious or jealous of a close friend, make that energy into a motivator, no matter how painful it is to do so. Itll pay off in spades. SAGITTARIUS (Nov. 23Dec. 21) -- You could get everyone frustrated with you if you vacillate too much on an important issue and fail to take a stance. In order to command respect, be decisive. CAPRICORN (Dec. 22-Jan. 19) -- Usually you have a great understanding of life, and allow for the frailties in others. Today, however, youre likely to be hypercritical and do nothing but find fault with everyone. Loosen up. AQUARIUS (Jan. 20-Feb. 19) -- Although its not normal, you could be far too gullible and impulsively involve yourself in something thats way over your head, motivated purely by wishful thinking. Keep your feet on the ground. PISCES (Feb. 20-March 20) -- The major reason you and your mate could end up in opposition is likely because neither one of you is able to effectively articulate your true feelings. Voice your love. ARIES (March 21-April 19) -- When working with unfamiliar materials or tools, you had better make it a point to keep your concentration from wandering. Too many bad things could happen if you dont. TAURUS (April 20-May 20) -- Although its not normal for you, youre not beyond taking a calculated risk when you think the circumstances call for it. Just make sure what you do is well thought out in advance. GEMINI (May 21-June 20) -Dont be surprised if people emulate the example you set, especially if youre abrasive and difficult to get along with. Others usually give back what we give out, one way or another. COPYRIGHT 2012 United Feature Syndicate, Inc.

up the risks and the option for reduction but he said if you want to carry all five, well have five babies. Everyone around here says only good things about him. If Alferios pregnancy is a normal one, her due date would be Dec. 18. With quintuplets, it was recommended they not wait until full gestation. Hes scheduled my due date at around 30-32 weeks, which will put us somewhere in October, she explained. Then the babies will remain at the hospital until the actual due date in December. Hes recommending I start bed rest at the hospital in two months. Apart from the considerable risks involved, Alferio says they also have to contend with the inevitable financial and time-management concerns. Both of us are teachers at Brunswick City Schools, I teach 7th- and 8th-grade special education and he teaches 8th-grade language arts, she continued. I did some research on how much it costs to support five babies and it said somewhere around $5,000 a month. Thats just not possible for us. Well be doing a lot of things our-

selves to save money; well need people we trust to help out. Our families have been phenomenal throughout all of this, even from the very first ultrasound when we told them we werent going to go with selection and planned to keep all five. Every one of them said that if anyone could do this, we could. We really hope that support system doesnt go away once theyre born. Were excited but at the same time, were scared. Its going to be hard, health-wise and financially. My mom is planning on moving in with us for the first year, which should help a lot. Im expecting to go back to work sometime in February, since we cant do this on just one paycheck. Alferio is currently at 15 weeks, a milestone which has brought full realization of what their decision means. Its funny because people see me and they say you look like youre ready to deliver soon, she said. The pregnancy itself is exhausting and Im just taking it day by day. Even just talking or going up the stairs Im out of breath. Ive always been very fit and active, so its frustrating for me to feel this way. We keep saying itll be a relief when theyre born and

we get to take them home but even then, well still be on edge waiting to see if something happens. If they had opted for fetal reduction, the procedure wouldve taken place at 14 weeks. That wouldve been last week. At this point, you can see their facial features and their arms and legs, Alferio added. Were Internet freaks, so we looked up what happens during selective reduction and what they do is inject potassium into the babys heart and the heart stops. Its unreal to me that someone could actually bring themselves to do that. It just breaks my heart. At this point, the Alferios know they are having three girls and two boys. Visit their blog and web site http:// thealferio5.weebly.com to view appointment updates as well as individual ultrasound pictures matched with the babies names. Vancrest Healthcare Center residents wished farewell to the Rev. Jacob Gordon earlier this month. Vancrest held an ice cream social and card party in his honor. Entertainment was provided, however, Rev. Gordon felt it was more appropriate to play a few games of bingo, which was gladly accepted by the residents. Welcome the association of

NEW YORK The younger brother and business partner of disgraced financier Bernard Madoff pleaded guilty Friday to charges he doctored documents, but insisted he knew nothing about his brothers historic Ponzi scheme and was in total shock when he found out about it. An emotional Peter Madoff, 66, entered the plea in a deal that permits him to remain free on $5 million bail pending his Oct. 4 sentencing. He agreed not to contest a 10-year prison sentence. My family was torn apart as a result of my brothers atrocious conduct, he said. I was reviled by strangers as well as friends who assumed that I knew about the Ponzi scheme. The plea to charges of con-

spiracy and falsifying records came in the same Manhattan courthouse where Bernard Madoff was led away in handcuffs in 2009 to serve a 150-year sentence. Peter Madoff told the judge he was deeply ashamed and terribly sorry but that he didnt know about the scam until his brother revealed it in December 2008. I was in total shock, he said, adding he had persuaded his wife, daughter, granddaughter and sister to invest millions of dollars that they lost in the fraud. My world was destroyed. I lost everything I worked for. Assistant U.S. Attorney Lisa A. Baroni portrayed the younger Madoff as a criminally incompetent chief compliance officer who purposefully deceived the Securities and Exchange Commission. He even signed many weeks of compliance reports in one sitting, intentionally changing pens and ink col-

ors to disguise the fact that he had done them at once, she told U.S. District Judge Laura Taylor Swain. Madoff became choked up near the end of his statement after he described how he and his brother decided which favored friends, clients and family members should receive the $300 million that remained in the investment companys accounts. Only weeks before, the clients had been told their roughly $20 billion investment had grown to more than $65 billion. He said he was shocked and devastated by his brothers admission that it was all a fraud, but nevertheless I did as my brother had said, as I had consistently done for decades. I knew that the conduct was wrong and I am deeply ashamed. The checks never went out. The plea was consistent with Bernard Madoffs own claims that his brother and

two sons were in the dark about his misdeeds. The FBI nevertheless had been suspicious from the start about the role of Peter Madoff, who had worked side by side with his scheming brother for more than 40 years. FBI Assistant Director Janice K. Fedarcyk said Peter Madoff played an essential enabling role in the scam by certifying fabricated investment results. The Madoff investment empire, built on a foundation of deceit, was a house of cards that grew to skyscraper proportions, she said. As Peter Madoff has admitted today, he was one of the chief architects. Peter Madoff was released on $5 million bail, secured by $1 million in cash or property, pending sentencing. Prosecutors said Peter Madoff agreed to surrender all his assets.

Fort Hood shooting suspect trial wont be delayed

By ANGELA K. BROWN The Associated Press FORT HOOD, Texas A military judge ruled Friday against delaying the trial of the Fort Hood shooting suspect, an Army psychiatrist who remains banned from the courtroom because his beard violates Army regulations. Maj. Nidal Hasans trial will proceed as scheduled, beginning on Aug. 20. Defense attorneys wanted the trial moved to December, saying they needed more time to prepare. But the judge, Col. Gregory Gross, said the defense already had plenty of time. Prosecutors had indicated they were ready for trial last fall, but the court-martial was set for March and postponed first to June and then August all at the request of the defense team. Hasan faces the death penalty if convicted of 13 counts of premeditated murder and 32 counts of attempted premeditated murder in the 2009 attack on the Texas Army post. Gross said Friday that top Army officials had rejected Hasans request for a religious exemption due to his Islamic faith to the rule banning beards. An appeals court also denied a defense request to overturn the judges decision last week to bar Hasan from the courtroom unless he shaves. Hasan watched Fridays hearing from a closed-circuit television in a nearby room, as he did during last weeks hearing.

I could have him held down and have someone shave him, but Im not prepared to do that at this time, Gross said. Gross also denied a defense request to step down as the trial judge, disputing allegations that he was biased against Hasan. Lead defense attorney Lt. Col. Kris Poppe said the judge had asked defense attorneys to clean up a court restroom after Gross found a medical waste bag, adult diaper and what appeared to be feces on the floor after a hearing earlier this month. Hasan, who is paralyzed from the waist down after being shot by police the day of the rampage, has to wear adult diapers but the mess in the restroom that day was mud from a guards boots, Poppe said. Poppe also said that Hasan often gets cold because of his paralysis and had been allowed to wear a knit cap in court. But when Hasan showed up with a beard June 8, the judge ordered the cap removed because defense attorneys didnt have a doctors note specifying why Hasan needed it, Poppe said. Gross said that he always makes sure his courtroom and nearby areas are tidy and has the right to ask those responsible for messes to clean them. He said he has accommodated the defense team regarding scheduling and requests.
