1. Introduction
Withtheincreasingglobalisationoflegalfirms,todayslawyersoftenfindthatbeing qualifiedacrossseveraljurisdictionsenhancesboththeirownpracticeandtheir internationalmarketability.Manybarristersalsoderivegreaterbenefitsfrombeingdual qualified.

TheQualifiedLawyersTransferTest(theQLTT,orsimplytheTest)enableseligible overseaslawyers,ScottishsolicitorsandUKbarristerstopractiseassolicitorsinEnglandand Wales.FollowingadmissionbytheSolicitorsRegulationAuthority(theindependent regulatorybodyoftheLawSocietyofEnglandandWales),asolicitorqualifiedthroughthe QLTThasthesamerighttopractiseasanyothersolicitorinEnglandandWales.

TheTestcoversfoursubjectareas,knownasHeads.TheseHeads,andthewaysinwhich eachisassessed,areasfollows:

HeadI Property:athreehourwrittenexamination* HeadII Litigation(CivilorCriminal):athreehourwrittenexamination* HeadIII ProfessionalConductandAccounts:athreehourwrittenexamination HeadIV PrinciplesofCommonLaw:anoralexamination AtTheCollegeofLaw,weofferarangeofdifferentwaystopreparefortheTest, includingfacetofacetuitionsessionsandrevisionsessions.Youcanalsochooseto studyatyourownpaceathomewithourdistancelearningmaterials.

2. AbouttheTest
2.1 THEFOURHEADS

TheTestcoversfourheads(subjectareas):

2.1.1 Property(HeadI) ThePropertyTestisthreehourslong,andyoumaytakeanybook,documentor otherwrittenmaterialintotheTest(ietheexamination).Thequestionpaper coverstworelatedsubjects:Conveyancing,andWills,Probateand Administration.Thepassmarkis50%.

ThePropertyTestrequiresyoutocommenton,orextractinformationfrom, documentsgiventoyouattheTestsitting.Candidatesaregivenanadditional 30minutesatthestartoftheTesttoreadthesedocuments.

BroadTopicAreaswillalsobemadeavailabletocandidatesapproximately10 dayspriortotheTest.

2.1.2 Litigation(HeadII)
IfyouarerequiredtosittheLitigationHead,theSolicitorsRegulationAuthoritywill requireyoutositeitheraCivilLitigationoraCriminalLitigationexamination.TheCivil Litigationtestisheldateachsitting,buttheCriminalLitigationtestisheldonlytwicea year,inAprilandOctober.

TheLitigationTest(whetherCivilorCriminal)isthreehourslong,andyoumay takeanybook,documentorotherwrittenmaterialintotheTest.TheTest requiresyoutocommenton,orextractinformationfrom,documentsgivento youattheTestsitting.Candidateswillbegivenanadditional30minutesatthe startoftheTesttoreadthesedocuments. TheTest(whetherCivilorCriminalLitigation)testsbothevidenceand procedure.Nofewerthan15%ofmarksfortheCriminalpartareattributableto evidenceissues. ThepassmarkforbothCivilandCriminalLitigationis50%.

InAprilandOctober,whenbothCivilandCriminalLitigationarebeingexamined, thequestionpaperisdividedintotwoparts:CivilLitigationandCriminal Litigation.

Atthesesittings,youmustansweronepartofthequestionpaperonly(i.e. eitherCriminalLitigationorCivilLitigation).

BroadTopicAreaswillbemadeavailabletocandidatesapproximately10days priortotheTest.

2.1.3 ProfessionalConduct&Accounts(HeadIII)

TheProfessionalConduct&AccountsTestisthreehourslong,andyoumaytake anybook,documentorotherwrittenmaterialintotheTest.Youmayalsotake inacalculatorprovidedthatitissilentandnonprogrammable.

ThequestionpaperinHeadIIIisdividedintotwoparts:
(a) Accounts(40%) (b) ProfessionalConduct,FinancialServicesandMoneyLaundering(60%) FinancialServicescarriesatleast15%ofthemarks.

TopassHeadIII,youmustobtainatleast50%ofthemarksavailableinBOTH partsofthepaper(ieyoumustpassbothAccountsandProfessionalConduct).

2.1.4 PrinciplesofCommonLawTheOralHead(HeadIV) TheOralHeadisdesignedtotestbothknowledgeandunderstandingofthe principlesofCommonLawandcompetenceintheEnglishlanguage.IntheOral Head,youwillbeaskedquestionsabouttheEnglishLegalSystemandthe principalstatutesandsubstantivelawofContractandTort(formoredetails,see theGeneralInstructionstoCandidatesinSection4ofthisHandbook).

Youarequestionedbyapanelofassessors,andyourassessmentisrecordedon aDVDincaseitisnecessarytoreviewyourperformancelater.

PartofthequestioningwhichyouwillreceiveinHeadIVwillbeontheAdvance Topic;thiswillrequireyoutoprepareonepartofthesyllabusinmoredetail.You willbenotifiedoftheAdvanceTopicapproximatelytwoweeksbeforetheTest.

ImmediatelybeforethestartoftheTest,youaregivenadocumentcontaininga lawreport,anextractfromalawreportorsomestatutoryprovisionrelatingto theAdvanceTopic.Youaregiven30minutestostudythedocumentandmake notesonpaperprovidedbytheCollege,andmayuseanybook,documentor otherwrittenmaterialyouhaveasreference.Youmustnotcommunicatewith anyoneduringthistime.YoumayonlybringintotheTestthenotesyouhave madeduringthereadingtimeandthematerialprovidedtoyoubytheCollege atthestartofthereadingtime.

YouareaskedquestionsonboththeAdvanceTopicandthedocumentduring theTest.Thequestionsaredesignedtoshowthatyoucanstudyandassimilate anareaofcommonlawanddealwithanyproblemsinthatareaofthelaw. 2.1.5 Moreinformationaboutthewrittenheads

TheQLTTisatestofaptituderatherthanmemory,andsoforthethreewritten heads(I,IIandIII)youare(asnotedabove)allowedtotakeintothe examinationroomanybook,documentorotherwrittenmaterial.Youwillbe examinedonthelawasitisinforceonthedayoftheTest,soyouwillneedto ensurethatyourknowledgeandstudymaterialsareuptodate.Youarenot requiredtodraftletters,statementsofcaseorotherdocumentsinanyofthe Heads.

2.1.6 DeterminingwhichHeadstosit

InordertoestablishhowmanyoftheHeadsoftheQLTTyoumustsit,youwill needtohavefromtheSolicitorsRegulationAuthorityaCertificateofEligibility (see2.1.3belowformoreinformation).Dependingonyourprimary professionalqualificationandyourjurisdiction,theSolicitorsRegulation AuthoritydeterminestheQLTTHead(s)thatyoumustsuccessfullycomplete. NBIMPORTANT:In2010,theSolicitorsRegulationAuthorityintroducedthe QualifiedLawyersTransferScheme(QLTS),whichwillgraduallyreplacethe QLTT.IfyoudonotcurrentlyhaveaCertificateofEligibility,youwillneedto applyforacertificateofeligibilityfortheQLTS;nonewCertificatesofEligibility tosittheQLTTarenowissued. 2.2 SYLLABUSANDREGULATIONS TheCollegeofLawstrictlyadherestotheQLTTsyllabusandQLTTAssessment Regulations.Theseareaccessiblefromourwebsiteatwww.collegeoflaw.co.uk;the QLTTAssessmentRegulationscanalsobefoundattheendofthishandbook. 2.3 CERTIFICATEOFELIGIBILITY

3. PreparationfortheTest
AtTheCollegeofLaw,weofferarangeofdifferentwaystopreparefortheTest,including facetofacetuitionsessionsandrevisionsessions(sessionsaremostlyheldattheweekend, andareheldinLondononly).Youcanalsochoosetostudyatyourownpaceathomewith ourdistancelearningmaterials. 3.1 DISTANCELEARNING

TheDistanceLearningstudypackscontain: specificstudymanualsdesignedbyexperiencedCollegeofLawtutors.These manualshighlightthemostimportanttopicsandgiveyouastructuredframeworkto yourstudy.TheyalsocontainadviceonstudyandTesttechniques testyourknowledgequestionstoaidprogress assignmentsmarkedbyanexpertinthesubjectandreturnedwithcomments.We suggestthatyouattempttheassignmentunderexaminationconditions(i.e.within thetimeallowedandinaquietenvironmentonyourown.)Ifyouthenreturnyour answerstous,wewillhavethemmarkedandreturnthemtoyouwiththemarkers commentsandpointstonotewhichwillgiveyouanindicationofyourprogresswith yourstudies.Submissionoftheassignmentisnotcompulsoryandformsnopartof theExaminationitself. specimenTestpapers answerstospecificsubjectacademicqueries. TheProbateandTrustspartofthesessionprimarilytakestheformofthetutor lecturingtodelegates,butalsoincludesaboutfiveexercisesforthedelegatesto workonatvariouspointsthroughouttheday,theanswerstowhichare discussedinplenary.Asfaraspossible,thecoursetakesthedelegatesthrough themainareasonthesyllabuse.g.Trusts,Intestacy,InheritanceTax(delegates gettoworkonseveralcalculations),CapitalGainsTax,Inheritance(Provisionfor FamilyandDependents)Act1975,Wills,obtainingagrantofprobateand administeringanestate.

3.2.2 HeadIITuitionsession:Litigation

Thesixhourtuitionsessionisbasedupontwocasestudies(onefasttrack,the othermultitrack)andtakesdelegatesthroughthefivestagesofthelitigation process.Delegatesundertakeanumberofrelevantexercises,andreceive feedbackonthem.

3.2.3 HeadIIITuitionsession:ProfessionalConduct&Accounts

Thedaysareveryfull,andthetutorsliketogetthroughasmuchaspossibleon eachdaytofullyequipdelegatesfortheTest.IntheProfessionalConductand Accountsrevisionsession,thetutorfullycoverstheFSMAelementofthepaper duringtheConductsection.ThesectioncoveringAccountsisalsointensive,and delegatesareencouragedtoreadthemanualbeforehandtogetthemostfrom thesession.

3.2.4 HeadIVTuitionSession:Tort,ContractandtheEnglishLegalSystem

Thetuitionsessionisafulldaycourse.Thetutorlecturesonthemainareasof thetortandcontractsyllabusbutthisisinterspersedwithactivitieswhere delegatesaregiventheopportunitytoconsidervariousrelevantscenarios. Thesescenariosarethendiscussedinplenarysessions.Delegatesreceivefull handoutscoveringthesepresentations.Thecoursealsoexploresthelikely subjectmatterandphrasingoftheexamquestions,aswellasgoodexam technique.Additionally,itaffordsdelegatestheopportunitytoaskthetutor questionsaboutwhattoexpectfromtheexamtoensurethattheyarefully prepared.

Theconveyancingpartoftherevisionsessionismadeaspracticalaspossible. Delegatesaregivenawrittencasestructuretofollowforeachtypeofquestion andthenspendagooddealofthesessiongoingthroughthepaper,identifying theissuestheyneedtoadviseon,explainingwhyit'saproblemorpotential problemfortheclientinthecasebyreferencetotheclient'sspecificfactsand thenadvisingonavailableoptions.Thetutorcanthenidentifyspecificareas wherefurthertuitionisneededandadviseonhowtocorrectlyassessthepaper inpreparationfortheactualTest.

Therevisioncourseincludestwohourrevisionclassesforeachpartofthe paper.ThetutoraimstofullypreparedelegatesfortheTestandwilladviseon areaswhicharelikelytoariseintheTest.

3.3.4 HeadIVRevisionSession:Tort,ContractandtheEnglishLegalSystem

Therevisionsessionisafourhourcoursethatcoversexamtechniqueand themaintopicsofthesyllabus.Itispractical,interactiveandspecifically aimedatpreparingcandidatestopasstheoralexam.Delegatesreceivetwo handoutscontainingadviceonexamtechnique,knowledgebased questions,scenariosandspecimenextractsandquestionswhichtheywork throughduringthecourse.Therearetutorledplenarydiscussionsofthese questionsandscenarios.Delegatesaregivenafurtherhandoutcontaining pointstonoteintortlaw.Thereisplentyofopportunityfordelegatestoask thetutoranyquestionsthatwillhelpthemprepareforandpasstheoral exam.

4. GeneralInstructionstoCandidates
4.1 PROCEDUREINTHETESTVENUE
4.1.1 ProofofIdentity

Candidatesarerequiredtobringphotographicproofofidentity(e.g.passportor driving licence) with them to the Test. This ID will be checked during the examinationbyaninvigilator. 4.1.2 ProcedureforHeadsI(Property),II(Litigation),andIII(ProfessionalConduct andAccounts)theWrittenHeads (a) Youmayberequired,beforeenteringtheTestHall(ietheexamination room),todepositoutdoorclothing/othermaterialsnotspecificallylistedin (b)belowinthecloakroomorotherareasetasideforthepurpose.Articles areleftatyourownrisk,andnoresponsibilityorliabilityisacceptedbythe Collegeforloss. (b) (i) YoumaybringintotheTestHallforuseduringtheWrittenHead(s) copiesofanyrelevantbook,documentorotherwrittenmaterial.Itis yourresponsibilitytoprovideatthecommencementoftheexamination writingmaterials(pensetc)andanybook,documentorotherwritten materialyouintendtouseduringtheexamination.Attheendofthe examination,youmaytakeawaywithyouonlythosematerialswhich youhavebroughtin.Thequestionpaper,thebookinwhichyouhave writtenyouranswer(theanswerbook)andtheadvancereadingbooklet (forHeadIandHeadII)mustbeleftonthedeskforcollectionbyan invigilator. (ii) Youmustnotobstructthegangwaysorinconvenienceothercandidates inanywaywiththebooks,documentsorotherwrittenmaterialswhich youhavebroughtintotheTestHall.Youmaynotleaveyourdeskforthe purposeofreferringtosuchbooks,documentsorotherwrittenmaterial. Youshouldbeawarethatspaceforeachindividualinthehallislimited, andyouwillnormallybeassignedoneexaminationdeskonly. (iii) Youmaynotborrowanybook,documentorotherwrittenmaterialfrom anyothercandidateduringthecourseoftheexamination. (iv) These provisions do not restrict the right of the College itself to issue otherbooks,documentsormaterialtocandidatesintheTestHall. (v) Onlyanswerswrittenintheanswerbookitselforonthesupplementary pagessuppliedbytheCollege/theCollegesinvigilatorswillbemarked.

(vi) Mobiletelephonesandotherelectronicdevicesmustbeswitchedoffon entry to the Test Hall. If you fail to turn off your telephone or other

device,and,intheviewoftheinvigilator,disturbothercandidatesduring theexamination,youwillbeaskedtoleavetheTestHallandwillnotbe readmitted. (c) YoumayentertheTestHallupto30minutesafterthestartofaWritten Head,butnocompensatorytimewillbegivenatthecloseoftheexamination inthatHead.After30minutesfromthestartoftheexamination,youcannot entertheTestHallexceptwiththeexpressauthorisationoftheChief Invigilator. (d) InHeadI&HeadII:YouwillnotbeallowedtoleavetheTestHallbefore90 minuteshavepassedfromthestartoftheexamination. InHeadIII:youwillnotbeallowedtoleavetheTestHallbefore60minutes havepassedfromthestartoftheexamination. (e) Ifyoufinishandwishtoleavebeforethecloseofanexamination,youmust leavethecompletedanswerbookandquestionpaperonyourdeskbefore leavingtheTestHall.Ifyouleaveinsuchcircumstances,youmaynot subsequentlyreturnduringtheremainderofthatexamination.Youmaynot leaveduringthelasttenminutesofanexamination.

AppealagainstadecisionoftheBoardofExaminers 22. SubjecttoRegulations2324acandidatemayappealagainstadecisionoftheBoard ofExaminersundertheseRegulations. 23. (a) NoappealagainstadecisionoftheBoardofExaminersmaybesubmittedifit relatestotheacademicjudgementoftheBoardofExaminersorofan ExternalExaminer (b) NoappealagainstadecisionoftheBoardofExaminersmaybesubmitted unless: (i) therearenewcircumstancesorcircumstancesnotpreviouslymade knowntotheBoardofExaminersandthecandidatecanshowgood reasonwhyheorshecouldnothavemadetherelevant circumstancesknownbeforethedecisionwhichissubjecttoappeal; or (ii) theBoardofExaminershasmisappliedtheRegulations. 24. UnsatisfactoryBehaviour 26. CandidatesmaybeexcludedfromtheAssessmentonthegroundsofviolent, disruptiveorunfairbehaviour. Cheating 27. Acandidatewhocheatsorhasknowinglyhelpedanothercandidatetocheatinany AssessmentfailstheAssessment.Cheatingincludescopyingorplagiarisingthework ofanyothercandidateandtakingorattemptingtotakeanyothersteplikelyto affordthecandidateanunfairadvantageoverothercandidates,whetherbeforeor aftertheAssessmentpoint. 28. TheChairmanmustinformtheSolicitorsRegulationAuthorityofanyfindingof cheatingbyacandidateinanyAssessment. Interpretation 29. TheRegulationshavebeenpreparedinaccordancewiththeSolicitorsRegulation Authoritysassessmentrequirements(theRequirements).Intheeventofany conflictbetweentheseRegulationsandtheRequirements,theRequirementsshall prevail.
