Number 38 Volume IX A. STATUTORY NUMBERS
1. This bulletin summarizes the availability of immigrant numbers during November. Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; U.S. Citizenship and Immigration Services in the Department of Homeland Security reports applicants for adjustment of status. Allocations were made, to the extent possible, in chronological order of reported priority dates, for demand received by October 5th. If not all demand could be satisfied, the category or foreign state in which demand was excessive was deemed oversubscribed. The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. Only applicants who have a priority date earlier than the cut-off date may be allotted a number. If it becomes necessary during the monthly allocation process to retrogress a cut-off date, supplemental requests for numbers will be honored only if the priority date falls within the new cut-off date announced in this bulletin. 2. Section 201 of the Immigration and Nationality Act (INA) sets an annual minimum family-sponsored preference limit of 226,000. The worldwide level for annual employment-based preference immigrants is at least 140,000. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320. 3. INA Section 203(e) provides that family-sponsored and employment-based preference visas be issued to eligible immigrants in the order in which a petition in

behalf of each has been filed. Section 203(d) provides that spouses and children of preference immigrants are entitled to the same status, and the same order of consideration, if accompanying or following to join the principal. The visa prorating provisions of Section 202(e) apply to allocations for a foreign state or dependent area when visa demand exceeds the per-country limit. These provisions apply at present to the following oversubscribed chargeability areas: CHINA-mainland born, INDIA, MEXICO, and PHILIPPINES. 4. Section 203(a) of the INA prescribes preference classes for allotment of Family-sponsored immigrant visas as follows:

(F2B) Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents: 23% of the overall second preference limitation.

Fourth:(F4) Brothers and Sisters of Adult U.S. Citizens: 65,000, plus any numbers not required by first three preferences. On the chart below, the listing of a date for any class indicates that the class is oversubscribed (see paragraph 1); C means current, i.e., numbers are available for all qualified applicants; and U means unavailable, i.e., no numbers are available. (NOTE: Numbers are available only for applicants whose priority date is earlier than the cut-off date listed below.)

Attorney Famuyide Wins Stokes Appeal Before the Board of Immigration Appeals
expected a perfect score. The attorney was infuriated by the outcome of the interview. The beneficiary was supposed to report back to the Court with the outcome of the interview. If the decision of the Immigration Service Officer prevailed, the beneficiary would be deported. The expectation of the Officer was far and above what was reasonable. The Stokes interview came about as a result of the age long District Court case of Stokes v. INS. It is designed as a fact finding interview to prove the veracity of an alleged marriage. It is also meant to assist the petitioner and the beneficiary to show that their marriage is legitimate. It is not designed as a test of English or the test of intelligence of the couple because you are not required by law to speak good English or be intelligent to be married. Some of these officers really expect the immigrant or the U.S. citizen spouse to be an A student to pass the Stokes interview. Some reasonable officers will even factor the differences in culture into their evaluation of the case and give benefits of doubt where necessary. For example, there was a case Attorney Famuyide handled some years ago whereby the American citizen said at the Stokes interview that they went to their wedding venue in a Limo while the immigrant said they went in a taxi. They were denied. Attorney Famuyide was later retained to rescue the couple. The attorney explained in the Appeal brief that they were both saying the same thing. It was a clash of culture. He explained further that in Africa where the beneficiary came from, every rented car is a taxi whether large or small. To the African, the Limo is a taxi. Immediately, the officer that denied the case got the explanation, he quickly approved the case instead of sending it to the Board of Immigration Appeals. After about two years since the appeal was filed, the Board of Immigration finally Appeals entered a decision in favor of Mr. Famuyides clients and the case was remanded to the U.S. Citizenship & Immigration Service for further action.

It was shocking to Attorney Famuyide to say the least because other clients who did not perform as well before other officers were approved. The Officer

As a teacher in a local public high school, I fret everyday when I see the sexual behaviors amongst students as they travel the hallways. These behaviors include but are not limited to groping, kissing, hugging and grinding. I dont think many parents realize how much their children know and are doing concerning sex. This is especially true during the time that school is out and parents are not home! What can parents do? A. These are challenging times that we all live in. It used to be that parents worried about teen pregnancy. However, today the worries include pregnancy at earlier ages, sexually transmitted diseases, sexual bullying, and significant peer pressure to engage in sex, emotional and psychological injuries, sexting and sexual harassment at school and online within social networks! The age of peeking at sex has also come down so that it is not uncom-

mon to hear of 10 year old children engaging in sexual behavior or becoming pregnant. The increase is most likely due to a combination of different influences ranging from the changing of social norms, more relaxed and liberal attitudes toward sex, the prevalence of sex in the media, the decreasing importance of religion in society, the fact that people are getting married when older and the increasingly easy access to various methods of birth control. Influenza is commonly referred to as the Flu, it occurs when the influenza virus affects the respiratory tract (breathing path-nose, throat, wind pipe, lungs). The infection is of particular challenge because of the peculiar changing nature of the virus on a regular basis and because the disease is contagious. According to the Centers for Disease Control, the Flu kills about 36,000 people in the United States every year and is responsible for the hospitalization of another 200,000 people yearly. Anyone can be infected with the Flu virus though some people are more prone to the infection than others. A vaccine is available for prevention and people should take advantage of it. What are the signs and symptoms of the Flu? The Flu is contagious. Infected persons can pass the infection one day before becoming sick and up to five days after becoming sick. It may be difficult to differentiate it from the common cold, however, the peculiarity of the Flu is the sud-

done. When does the Flu occur and when should you be vaccinated? In the United States the Flu occurs in the winter months but can extend as late as early Spring. Typically from November through March, but it can also occur up till May. So when you have symptoms that appear like cold in the peak of the Flu season, contact your doctor. What has gotten me so inflamed are just the real life stories that I hear sometimes about the treatment that some women mete out to their husbands just because they have an upper hand financially, emotionally and socially. Before you get all riled up, let me just say that I know that men are mostly the culprits in this area but I find out that there are women who match them blow for blow. What does the word of God say? I love women and I love being a woman but boy oh boy, some women deserve the whip when it comes to the way they deal with their spouse. What has gotten me so inflamed are just the real life stories that I hear sometimes about the treatment that some women give to their husbands just because they have an upper hand financially, emotionally and socially. Before you get riled, let me just say that I know that men are mostly the culprits in this area but I find out that there are women who match them blow for blow. What does the word of God say? In Genesis chapter 2 verse 20 of the Bible, when Adam had given names to all cattle, birds of the air and every beast of the field, it is recorded thus, But for Adam, there was not found a helper comparable to him (NKJV). Our God is interested in our well being and so He will not give

favor with God and her husband and never had a child. Wives must always remember the vows that they made before God either privately or publicly. Many of these weddings are accompanied with a lot of celebration but turn sour after about a year or two. This is sometimes because a lot of expectations are not met. A couple desiring to be married must have a high level of understanding of each other and the issues that they will be confronting on a daily basis. The directives from the word of God as written in Ephesians 5:22 says, Wives submit to your own husband, as unto the Lord. Now, if situations do arise where the man is not meeting the standard expected of him, there are ways to resolve issues instead of resorting to insults and demeaning behavior. The same scripture in verse 33 emphasizes this, let the wife see that she respects her husband Some women are vocal in the way they disrespect their husbands while others give him the silent treatment, turning the atmosphere into that of a cold war. There are some key things that each wife must know: Do not let your mother dictate the pace of your relationship with your

husband. Godly advise is welcome from mothers but there those who want to control and dictate how you run your home. You have to have control of your own situation. What is required of each woman mother or wife is prayer and conformity with the word of God! Learn to have private discussions with your spouse instead of airing your dirty linen in public. I am sure that what transpired between David and Michal would not have deteriorated into her getting such a curse from her husband. Caution: Removal Proceedings Notices Still Being Issued to Immigrants


U.S. Immigration News would like to warn all immigrants not to be fooled by some of the report in the news that the current administration is slowing down in their aggression to pursue non-criminal illegal immigrants in the United States. What is happening in immigrant communities suggest that this is still a fallacy until we begin to see the implementation of the June 16, 2011 memo on favorable exercise of prosecutorial discretion. At the moment, the officers of the U.S. Citizenship & Immigration Services and the U.S. Immigration and Customs Enforcement are doing exactly the opposite of what the Memo suggested. Some immigrants have approached me with the suggestion to turn themselves in to the agents of Immigration & Customs Enforcement (ICE) since they are not criminals with the hope that they will be released immediately and be granted the promised employment authorization cards. Let me encourage any immigrant contemplating this to hold off on the plan. Please wait to see if the memo will ever be implemented. According to the Janet Napolitano, the Secretary of Homeland Security, some cases are being reviewed and the implementation will begin very soon. It is important because of the current administrations record of not keeping promises that we all wait to see if they will actually do something to implement the Memo. Few days ago, some new clients brought some Notices to Appear before the court to my office. One of the immigrants was a 17year old. They do not have any criminal record. It is misleading to suggest that only criminals are being issued with these notices to appear before immigration courts for removal proceedings. The part that seem utterly unfair to the immigrant is when you get thrown into removal proceedings during the pendency of your appeal. Some of the unreasonable officers that cannot feel the pain of immigrants send out Notice to Appear without checking to see whether there is any pending appeal. Recently I received two cases in this category. The two clients appealed the decision of the U.S. Citizenship & Immigration Services, but during the pendency of the appeal, they received notices to appear before the court for removal proceedings. Even though the removal proceedings could be terminated by a motion as a result of the appeal, the USCIS simply will engineer the denial of the appeal to cover their error. By so doing, these immigrants will end up having to retain attorneys at a huge cost for legal representation before the immigration courts. President Obama could do something about this. All he needs to do is to call Janet Napolitano and her surrogates to order. Now, if you are an immigrant and you find yourself in removal proceedings, please tell your lawyer not to apply for voluntary departure. It is a shame that some lawyers get paid for serious legal representation, but short-circuit the process without the consent of their clients by applying for voluntary departure. I was in court the other day, I saw a lawyer representing this poor old woman who could barely speak English. When the Judge questioned the lawyer about the relief he was seeking, this unprepared lawyer ended up taking the suggestion of the judge by asking for voluntary departure. The old woman had no clue what was going on. How can you apply for voluntary departure for a client who wont be going anywhere? Most immigrants who accept voluntary departure end up not leaving the United States. The implication of accepting voluntary departure is that if you fail to go as ordered, you will be subject to a 10year bar from obtaining any relief. Deliberations on a bill seeking an amendment to the 2010 Electoral Act to make it possible for Nigerians living abroad to vote during the countrys general elections, suffered a setback in the House of Representatives as it was stepped down abruptly. The bill was sponsored by the head of the House Committee on Diaspora, Abike Dabiri-Erewa, Seeking an amendment to three sections of the Act pursuant to granting the Independent National Electoral Commission(INEC) powers to conduct elections beyond the shores of Nigeria, as well as allow Nigerians living outside the country to vote in all general elections. Indications that the bill would suffer a setback emerged immediately after Dabiri-Erewa concluded her lead debate on the general principles of the proposed amendment Bill. The Deputy Leader of the House, Leo Ogor raised concerns that Nigeria was not ripe for such an exercise, citing the cost implication as one of the reasons. Dabiri- Erewa had in her submissions argued that the amendment was necessary to give the over eight million Nigerians living abroad, who, according to her repatriate over twenty billion dollars yearly into the nations economy, a sense of belonging. She argued that about 115 countries in the world, 28 of them African countries, allow their citizens abroad to vote in their foreign locations, so Nigeria should not be an exception.

They claim the duo connive with the Thai police to arrest, detain, torture and imprison Nigerians on trumped-upcharges, they maintain that the ambassador is usually indifferent to the plight of his countrymen in Thai prisons, unlike his predecessor, Mr. Henry Offor. Furthermore, they allege that the ambassador consistently refuse to get involved when a Nigerian dies, pending the arrival of the deceased family. Another issue raised is the way money raised by the community for Nigerian prisoners and given to the ambassador is managed. The letter specifically calls on President Jonathan to stop Azores from further submission of Nigerian passports to the Thai authorities and subsequent ordering of their arrest by the police. There are evolving customs and traditions relating to celebration of marriages in every human society, regardless of their relative primitiveness. Celebration of marriages or marriage ceremonies is to most ethnics and races, a customary rite of passage which every young man and woman must of necessity undergo as a prerequisite to becoming full-fledged adults. It is one of the areas where the uniqueness of a people and diversity of cultures come to fore. In some cultures, marriage ceremony is a one-day affair, in some, it is week-long, while in some, especially in Africa, marriage is celebrated in a series of ceremonies spread over several months or even in some cases, years The rites to be performed, the pre-requirements, activities and the duration of the ceremonies vary from one culture to another. There are more than 1,000 cultural units in Africa and each culture, each tribe, has its own wedding and marriage traditions, many of which can trace their origins back hundreds or even thou-

sands of years. Rich African values and traditions find expression in the manner in which marriage is celebrated. African traditional societies attach much significance to marriage as a form of social contract binding not just on the two individuals who are directly involved but also their families and in most cases their respective communities. Marriage is not just the creation of a new branch in a family tree but also the creation of a family bond between two independent families. Marriage in the traditional African society serves more than its primary purpose of procreation and companionship; it serves both political as well as socio-economic ends. It is not unusual for families to give out their beautiful daughters to the monarchs and the rich as a way of maintaining social relevance. Weaker communities encourage or force their daughters to marry into stronger communities as a way of fostering peaceful co-existence. Marriage also serves commercial purposes as there are localities where women are given out in marriage to the family creditor or his nominee as part of debt settlement arrangement. All customary requirements had to be met as any leniency or indulgence on the part of the womans family may affect the value that would be placed on her by her husbands family and the observing members of the society. A woman married with all traditional requirements fully met has a higher social rank than one married through a defective process. While children from such cheaply married woman may not be tagged illegitimate out rightly, where the husband marries another woman properly (polygamy is more of a tradition) the children of the properly married woman would be able to lay a more legitimate claim to their fathers property and family titles. Because section 246(a) of the Immigration and Nationality Act, 8 U.S.C. 1256(a) (2006), relates only to proceedings to rescind lawful permanent resident status acquired through adjustment of status, the 5-year statute of limitations in that section is not applicable to bar the removal of an alien who was admitted to the United States with an immigrant visa. Garcia v. Attorney General of the United States, 553 F.3d 724 (3d Cir. 2009), distinguished. PAULEY, Board Member: In a decision dated June 4, 2010, an Immigration Judge terminated the removal proceedings against the respondent, finding that she was not removable because her lawful permanent resident status had not been rescinded pursuant to section 246(a) of the Immigration and Nationality Act, 8 U.S.C. 1256(a) (2006), within 5 years of her admission. convicted in the United States District Court for the District of Puerto Rico of using an altered passport to gain entry into the United States in violation of 18 U.S.C. 1543 (1988). In a decision dated November 14, 1989, an Immigration Judge ordered the respondent excluded from the United States, and she was deported the same day. Subsequently, the respondent was admitted to the United States as a conditional lawful permanent resident when she arrived in Newark, New Jersey, on February 9, 1995. The conditional basis of her residence was removed on December 30, 1996, upon the approval of her Petition to Remove Conditions on Residence (Form I-751). On June 27, 2009, the DHS issued a Notice to Appear (Form I-862) charging that the respondent was removable under section 237(a)(1)(A) of the Act, 8 U.S.C. 1227(a)(1) (A) (2006), as an alien who was inadmissible at the time of entry under sections 212(a)(2)(A)(i)(I), (6)(C)(i), and (7)(A)(i)(I) of the Act, 8 U.S.C. 1182(a)(2)(A)(i)(I), (6)(C) (i), and (7)(A)(i)(I) (2006). According to the Notice to Appear, the respondent was inadmissible when she was admitted in 1995 because she had been convicted of a crime involving moral turpitude, she procured her admission as a conditional lawful permanent resident by fraud or willful misrepresentation by failing to disclose her attempted unlawful entry charges in the Notice to Appear. According to Mike Ahlers of the CNN while reporting on what the DHS Chief, Janet Napolitano told the Congress on October 19, 2011, The Obama administration soon will begin its systematic review of the approximately 300,000 pending deportation cases, separating high priority cases involving criminals it wants to deport from low priority cases it will drop, Homeland Security Secretary Janet Napolitano told Congress Wednesday. The effort marks another point in an evolution of immigration enforcement away contd from pg 26 pened over the past century to rid African societies of some of its obnoxious traditions and discriminatory practices, but much more, a lot has also happened to erode some of the rich cultural values that set the continent apart and trivialized what use to be regarded as significant. Largely responsible for this change is the advent of western education/civilization and religion. The celebration of marriage in the contemporary African society is now a blend of African customs, western traditions and religion. Although most of the ethnic groups still retain some of their peculiar customary practices, there appears to be a general mode of celebrating marriage that cuts across the various societies / cultures. Introduction: This occasion is the first formal meeting between the intending couples family where the marriage proposal is made by the mans family and all issues pertaining to the bride price and other requirements are discussed. At some point in the course of the ceremony, the principal members of both families may agree on a date for the main traditional wedding. Although, this meeting has become some sort of extra ordinary ceremony which is now being celebrated extravagantly, it is not the traditional wedding, but a mere pre wedding gathering to mark the formal engagement of the couple. The introduction ceremony does not confer a married status on the intending couple. It is not unusual for an intending couple to break up after the introduction ceremony. When this happens, neither of the two families owe any obligation to the other as there had been no marriage between the estranged lovers. In some cultures, gifts already exchanged between the parties may be returned and in modern times, an aggrieved party may approach the court for a breach of promise to marry. Traditional Wedding: As earlier mentioned the families of the intending couple may at the introduction ceremony or afterwards choose a date for the traditional wedding. There are several traditions observed in the celebration of customary marriage in several parts of the African Continent. However, one of the essential requirements for the celebration of a valid customary marriage, which is common to most cultures, is the payment of the bride price by the grooms family. Customary marriage is a legally recognized marriage that confers a married status on the couple. Religious wedding/Statutory marriage: After the traditional weddings, most couple also celebrates their marriage in accordance with their religions tenets. There are different religions represented in Africa. Many northern Africans, especially, have been influenced by Muslim traditions, while further south there are more Christian, Hindu, and even Jewish traditions interspersed with more ancient traditions. The Christian marriage is tagged white wedding as same was gotten from the white missionary that brought the Christian faith and western education to the African Continent. This form of celebration is often merged with the celebration of the statutory marriage, provided the church has obtained the necessary accreditation from government as a recognized place of worship and the couple had prior to the wedding obtained the requisite license and approvals from the local marriage registry. Other organized religions too are able to conduct weddings in accordance with religious rites and at the same time confer the statutory marriage status on the couple. But critics have blasted the policy, saying that by administratively closing cases, the Obama administration is giving amnesty to illegal immigrants. The policy is alarming, especially for those of us who firmly believe in the rule of law, Sen. Charles Grassley, R-Iowa, said. Grassley said much is unknown about the policy, and wondered if illegal immigrants with criminal convictions will be eligible to stay in the country, and what will happen to undocumented immigrants whose cases are closed. We want answers. We want transparency and accountability. We want to be part of the process, Grassley added. In a recent speech, Napolitano said critics ignore the fact the number of deportations has increased during the Obama administration, and that the composition of that number has fundamentally changed. The ranks of deported people consist of more convicted criminals, recent border crossers, egregious immigration law violators and immigration fugitives than ever before, she said. Of the 396,906 individuals removed from the U.S. in fiscal 2011, nearly 55 percent had been convicted of felonies or misdemeanors. Thats an 89 percent increase of criminals from three years ago, the DHS said. Napolitano said DHS has eliminated worksite raids, saying they did nothing to enhance public safety. Instead, the Obama administration has focused on prosecuting employers who violate employment laws, she said. She also said the departments focus on criminal illegal immigrants is better than the ad hoc approach where non-criminal aliens are more likely to be removed than criminals.
