NAME OF THE PRESIDING JUDGE: HON. ESTER M. VELOSO PLACE WHERE THE HEARING IS HELD: REGIONAL COURT 7TH JUDICIAL REGION BRANCH 6 CEBU,CITY PARTIES INVOLVE IN THE CASE: PP VS SPO3 ADONIS DUMPIT

The case all started with a robbery that happened within the vicinity of Villagonzalo Dos, Brgy. Tejero, Cebu City which also happens to be the baranggay residence of the parties involvedGo Family versus SPO3 Adonis Dumpit last December 14, 2004. Kimberly Corro, the victim of the said robbery goes for a help after the said incident.

SUMMARY OF THE CASE

She went to her mother and told everything that had happened including the physical appearance of the two men who robbed her. Mrs. Elizabeth Go, the mother, seek help from her KUMPARE SPO3 Dumpit (Kimberly, as a witness affirmed the Kumpare relationship of her mother and SPO3 Dumpit but Mrs. Go denied the alleged Kumpare relationship during her turn to witness) who used to be the bone-chiller of their place because of his socalled prominence of being an officer.

Mrs. Corro claimed that SPO3 Dumpit rescued immediately criminals and arrest them without hesitant. Hoping to have the justice she wants for her daughter, she passed the authority to SPO3 Dumpit. SPO3 Dumpit, drunk during that time, rescued immediately. For the meantime, the place was disturbed by the said Robbery. Mrs. Go and her family were inside their house and were waiting for the coming home of her son Ron-Ron Go (the suspected Robber) to eat dinner.

The family was shocked when they heard three consecutive gunshots. Too late to found out that it was their Ron-Ron who was shot dead. SPO3 Dumpit was accused by the eyewitnesses. Ron-Ron, just a by-passer, was shot behind. One shot hits his spinal cord and just after a second, another shot was released. SPO3 Dumpit, according to the witnesses, went near to the pavement where Ron-Ron was back lying, released the third shot unjustly and unmercifully before Ron-Ron could finish to utter the word mama.

SPO3 Dumpits defense was it was Ron-Ron who robbed Kimberly. After years of investigation, the two Robber was capturedJun2x and Edgar. The family of Ron-Ron Go never ceases to seek justice. Kimberly Corro must have been the one who could tell the truth because she was the victim but the case now turned to be futile. SPO3 Dumpit was put behind bars only on 2010 and was suspected to be in and out of the jail and was able to receive his salary albeit he still has pending case.

The alleged issue today also is that SPO3 Dumpits party filed an appeal to change a presiding judge because Hon. Ester Veloso (the incumbent presiding judge of this case) was known to be a fair one. During our interview with Mrs. Go, she never claimed her son to be innocent of the said robbery but what she is fighting until now is the justice of his sons death.

If SPO3 Dumpit suspected Ron-Ron to be responsible of the robbery, he could have invited Ron-Ron to the precinct and let the authority judged for the proper imposition of the law not that the law will be put by ones own hands.

REFLECTIONS:
On how the hearing is conducted / administrative

proceedings:

The hearing started upon the appearance of the presiding judge. The officer-in-charge requested the group to stand to pray. Afterwhich, he did the roll call of the scheduled cases of that day. In every absences of any party, a lawyer will stand in behalf of his client to convey the reason of the delay or absence of the attendance. The hearing continues and the witnesses present during the court hearing were requested to pledge in front of the people prior to the proper question and answer segment.

On physical set up of the court:

The moment we entered in the 7th Regional Trial Court Branch 6, we knew that some of our expectations about the place were not met. Well, we shouldnt have hoped much either because our expectations were all based to the ones we saw from movies and mostly American movies. Though we also have seen some of the courts of the Philippines in some Filipino movies, it wasnt bad at all, maybe depending on the place and the space of where it is located.

We have to say that the space in each branch were small; the place is hot, because they only have one big electric fan and it was directed to the secretary and the judge, and the noise is really a disturbing, because the jeepneys and the cars sounds of the engine are really loud, well not really that loud but loud enough for us not to be able to hear the conversations inside the court.

On peoples interactions / reactions ( including

yourself):
There were a number of people there, maybe more than 30, and all of them, except us, were exactly the very people that have a case, the families of the accused and of the victims, some policemen or army , the lawyers, secretary and the judge. Everyone rose to their feet as the judge entered the court and prayed the courts prayer. The officer-in-charge did the roll call of the parties involved in every case. A lawyer will stand in behalf or his client whenever his client is not yet around and sometimes the lawyer will convey to the judge in behalf of his client the reason why he cant be around during the court hearing.

Everyone was listening to the conversation of every lawyer with judge while waiting for the result or judgment of the court. But there are really those people who talked too much and so the judge made her common act of silencing the court. There were some families of the detained or accused that brought food with them to give them to their loved ones detained. And the scene that really caught our attention was when someone from the detained persons was asked by his lawyer to sign something then cried after signing it.

Medias and Journalists were waiting outside the court ready at any instance to capture moments that will surely be a great help to their reporting.

RECOMMENDATIONS
After we spent half the day in the court, we are strongly recommending these to the court: A much bigger space, where many people can be accommodated well. At least one air conditioner or another electric fan inside the court, for the convenience of the people. The voices of the people directly involved in the case should be louder, for everyone to hear. Or they could have a microphone inside. The language barrier of the people involved in the case. (Maybe it is required by the court to speak English but there are witnesses that dont speak English so the questions of the lawyers might be misinterpreted by them though there is a translator, who, sometimes, is lost of words for translation.)

There should at least be a separate bench for the people involved in the case and the officers, the front row maybe. Because they were all mixed up with the people only listening to the trial. The atmosphere of the court should be serious but we happen to saw one officer bringing inside a detained or imprisoned person and yet, he was smiling. We are not saying that smiling inside the court should not be allowed, our point is that people, especially officers who bring the persons from the jail to the court, should respect the feelings of those involved in the case.
