of certain crimes by the Courts of the Philippine Islands; To create a Board of Indeterminate Sentence and to provide funds therefore; and for other Purposes

What is indeterminate Sentence Law


It is the Law which modified the imposition of penalties of the Revised Penal Code and Special Laws. The courts are mandated in imposing a sentence to fix a minimum and maximum period of penalty. -The minimum period must be served and a convict becomes eligible for parole. -It applies for both violations of RPC and special Laws. Application is mandatory and only to divisible penalties.

-Person convicted of offenses punished by death


penalty or life imprisonment -Those convicted of treason, conspiracy or proposal to commit treason, convicted of misprision of treason, rebellion, sedition or espionage -Those convicted of Piracy -Those who are habitual delinquents -Those who have escaped from confinement or evaded sentence -Those who were granted conditional Pardon by the Chief Executive who violated the terms of the same -Those whose maximum term of imprisonment does not exceed one year -Those who are already sentenced by final judgment at the time of approval of Indeterminate Sentence Law -Those offenses or crimes not punishable by imprisonment such as Destierro and suspension

Purposes of Indeterminate Sentence


1. To prevent the unnecessary and excessive deprivation of liberty. 2. To enhance the economic usefulness of the accused since he maybe exempted from serving the entire sentence depending upon his behavior and his physical, mental and moral record. 3. When the convict has served the maximum penalty he can be released on by the bureau of pardons and parole 4. When the paroled convict violated any of the condition of parole, he can be arrested to serve the maximum sentence

Call upon bureau, office, branch, subdivision agency or instrumentality of the Government for assistance They constitute quorum Examine the records and status of prisoners who shall have been convicted of any offense other than those mentioned.

Board of Indeterminate Sentence To look into the physical, mental and moral record of the prisoner who are eligible for parole and determine the proper time of release Examine the records and status of the prisoners who shall have been convicted of any offense. Make recommendations to the governor-general

Conditions when granted parole


Report personally to parole officer appointed by the board of indeterminate sentence Show himself to be law abiding citizen and shall not violate any law in the Philippines * When the paroled prisoner violated any conditions, the Board of indeterminate Sentence may issue order re-arrest, and served the maximum penalty imposed upon
