ANTI-WIRE TAPPING ACT

WHAT ARE THE PROHIBITED ACTS PUNISHED UNDER THE ACT?

To overhear, intercept or record any PRIVATE COMMUNICATION by tapping any wire or cable or using a device without being authorized by all the parties to the same

WHAT ARE THE PROHIBITED ACTS PUNISHED UNDER THE ACT?

To knowingly possess any tape, record, wire record, disc record, or any other such record of any communication secured by tapping any wire or cable without authority

WHAT ARE THE PROHIBITED ACTS PUNISHED UNDER THE ACT?

To replay the same for other persons


To communicate the contents thereof To furnish transcriptions thereof

WHAT IS THE PENALTY FOR THE VIOLATION OF THE RA 4200?


Imprisonment for not less than 6 months to not more than 6 years. If he is a public official, there is an accessory penalty of perpetual absolute disqualification.

ARE THERE EXCEPTIONS TO THE ANTI-WIRE TAPPING LAW?


Yes. If all parties to the private communication authorized the tapping; and If there is written order of the Court

Note:

There must be written application and the examination under oath or affirmation of applicant and witnesses

EFFECT OF THE ILLEGALLY OBTAINED INFORMATION FROM UNAUTHORIZED WIRETAPPING ACTIVITIES?

It shall not be admissible in evidence in any judicial, quasi-judicial, legislative or administrative hearing or investigation.
