 General pattern of preamble:

 Product by Process Claims
 Article is claimed through the process by
which it is made
 Covers the claim only when made by that
process.
 General Preamble:
▪ An <article name> produced according to the
process, comprising:
▪ The process elements contain steps of performing
the method usually beginning with gerund verb
form.
▪ E.g. extracting metal from ore
 Introduce each element separately
using articles
 Show interconnectivity between articles
 Use the/said to show antecedent basis
for referring to the elements already
introduced earlier in a claim
 Refer
the same element by the same
name all throughout.
 Negative claiming
 E.g. Rod is not placed on the bottom
portion of the base.
 Word around to make an assertive/positive
statement.
 Claiming holes/empty space
 Never claim a hole
 Claim the surface area containing the hole
 Avoidusing comparative words in the
claims unless absolutely necessary.

 Writefunctional language only when a


suitable structural alternative is not
found.

 Avoidnumbering the steps in a


process. E.g. firstly, then etc.

1. An apparatus for locking a stand of a two
wheeled vehicle, the apparatus, comprising:

supporting the vehicle.
