Art. 1189 Rules to be observed when suspending the efficacy
of an obligation
1. If the thing is lost without the fault of the debtor, the
obligation is extinguished;
2. If the thing is lost through the fault of the debtor, he is
obliged to pay damages;
3. If it deteriorates w/o the fault of the debtor, the impairment
is to borne by the creditor ;
