CHAPTER 1

Declaration of Policy

To conserve countrys wildlife resources


and habitats for sustainability

Objectives:
1. To CONSERVE and PROTECT wildlife species and

habitat to PROMOTE ecological balance and


ENHANCE biological diversity

International conventions & scientific studies

2. REGULATE collection and trade of wildlife

Scope of Application

ALL wildlife species in the country


Includes
Protected Areas under RA 7586 (NIPAS Act)
Critical Habitats
Exotic Species (subject to trade; captivity)

Jurisdiction of DENR & DA

REVIEW, REVISE, REGULARLY UPDATE list of species under their


jurisdiction

DENR
All terrestrial plant and animal species
All turtles and tortoises and wetland species

Dep. of Agriculture
All declared aquatic critical habitats
All aquatic resources; all marine mammals except dugong

CHAPTER 2

Definition of Terms

Wildlife
All forms & varieties of flora and fauna in

captivity, bred or propagated

Conservation
Preservation and sustainable utilization of wildlife

& habitat

Habitat
Place where species naturally occur or

established its population

Definiton of Terms

Endemic Species
Species which are naturally-occuring
Found only within specific areas of the

country

Exotic Species
Species which do not naturally occur in the

country

Definition of Terms

Threatened Species
Species that are critically endangered
Population is at risk of extinction

Vulnerable Species
Species that are not critically endangered

nor endangered
But under threat from adverse threat; likely
to move to endangered category

Wildlife Collectors Permit


Permit to take or collect certain wildlife

species for commercial purposes

CHAPTER 3

Art. 1: General Provision


Section 6
Secretary shall authorize all activities provided:
Not detrimental to survival of species / habitat

Section 7 Collection of Wildlife


Allows collection of wildlife in acc. with sec.6
provided:
Requires Wildlife collection techniques with LEAST or NO

detrimental effects to existing wildlife populations and


habitat
Indigenous people MAY collect for traditional use
Shall not cover threatened species (Sec.23)

Section 8 Possession of Wildlife


No person or entity shall possess wildlife
XPN: if such can prove Financial and Technical

Capability and Facility to maintain such wildlife

Section 11 Exportation / Importation of


Wildlife
Allows exportation/importation of wildlife as

authorized by Secretary
Provided, recipient is technically and financially
capable

Section 12 Introduction of
Endemic/Indigenous Wildlife
Allowed only for population enhancement of recovery

purposes subject to clearance from Secretary

Section 13 Introduction of Exotic Wildlife


No exotic species shall be introduced into the country
XPN: obtain clearance from Secretary or authorized

representative
If allowed, subject to Environmental Impact Study

Section 15 Scientific Researches on Wildlfie


Allowed upon execution of an undertaking/agreement

and issuance of gratuitous permit

Section 17 Commercial Breeding or


Propagation of Wildlife Resources
Shall be allowed by Secretary or authorized

representative through issuance of wildlife farm culture


permit
Provided, only progenies and unproductive parent stock shall
be utilized for trade
Provided, commercial breeding operations are subject to
Environmental Impact Study

Art 2 Protection of Threatened


Species

Section 22
Criteria:
Present or Threatened destruction of habitat
Overutilization
Inadequacy of existing regulatory mechanism

Section 23
The collection of Threatened Wildlife
shall be allowed ONLY for scientific, or
breeding, or propagation purposes

Section 25
Critical Habitat
Outside protected areas under RA 7586

where threatened species are found based


on
Species endemicity and/or richness
Presence of man-made pressures/threats to wildlife
survival

Shall be protected from any exploitation or

destruction

Article 3 Registration of
Threatened and Exotic Species

Section 26
No person or entity shall be allowed
possesion of wildlife UNLESS such person
prove financial and technical capability
and facility to maintain said wildlife
Possession without Certificate of
Registration shall be confiscated in favor
of Government + penalties

CHAPTER IV.
ILLEGAL ACTS

SEC. 27. Illegal Acts


a.

killingand
destroying
wildlifespecies,
except
in
the
following instances:
(i) done as part of thereligious
rituals of established tribal groups
or indigenous cultural communities;
(ii) the wildlife is afflicted with
aincurable communicable disease;

(iii)deemed necessary to putanend


to the misery suffered by the wildlife;
(iv)done to prevent an imminent
danger to the life or limb of a human
being; and
(v) the wildlife is killed or destroyed
after it has been used in authorized
research or experiments.

b.

inflictinginjury which cripples


and/or impairs the reproductive
system of wildlife species;

c. effectingany of the following acts in


critical habitat(s):
(i)

dumpingof
waste
detrimental to wildlife;

products

(ii)
squattingor
otherwise
occupyingany portion of thecritical
habitat;

(iii)
mineral
extraction;

exploration

and/or

(iv)burning;
(v)logging; and
(vi)quarrying
d.introduction,
reintroduction
restocking of wildlife resources;
e. trading of wildlife;

or

f.collecting, hunting or possessing


wildlife,
their
by-productsand
derivatives;
g. gathering or destroying of active
nests, nest trees, host plantsand the
like;
h. maltreatingand/or inflicting other
injuries not covered by thepreceding
paragraph; and
i.transporting of wildlife

What if the offender is an alien?


He shall be deported after service of
sentence and payment of fines,
without any further proceedings.

MISCELLANEOUS

FUND- fines imposed and damages


awarded, fees, charges, donations,
endowments, administrative fees or
grants in the form of contributions
CONTRIBUTIONS - exempted from
donor taxes and all other taxes,
charges or fees imposed by the
government

Programme (UNEP) helps countries
use the ecosystem approach to
enhance human well-being.

Humans do not rule the natural world. We


are part of the natural world. Nature existed
before humans did and will continue to do so
when we are gone.
