CITIZENSHIP

ARTICLE IV

The following are citizens of


the Philippines:

Section
[1] Those who are citizens of the

Philippines at the time of the adoption


of this Constitution;
[2] Those whose fathers or mothers are
citizens of the Philippines;
[3] Those born before January 17, 1973,
of Filipino mothers, who elect Philippine
citizenship upon reaching the age of
majority; and
[4] Those who are naturalized in

Section 2. Natural-born citizens are those


who are citizens of the Philippines from birth
without having to perform any act to acquire or
perfect their Philippine citizenship. Those who
elect Philippine citizenship in accordance
with paragraph (3), Section 1 hereof shall be
deemed natural-born citizens.

Section 3. Philippine citizenship may be lost or


reacquired in the manner provided by law.

Section 4. Citizens of the Philippines who


marry aliens shall retain their citizenship, unless
by their act or omission, they are deemed, under
the law, to have renounced it.

Section 5. Dual allegiance of citizens is

ARTICLE V

Section 1. Suffrage may be


exercised by all citizens of the Philippines
not otherwise disqualified by law, who
are:
at least eighteen years of age
have resided in the Philippines for at
least one year
at least 6 months in the place wherein
they propose to vote,
No literacy, property, or other
substantive requirement.

Section 2.
The Congress shall provide a
system for securing the secrecy
and sanctity of the ballot as well
as a system for absentee voting by
qualified Filipinos abroad.
The Congress shall also design a
procedure for the disabled and
the illiterates to vote without the
assistance of other persons

power shall be vested in the
Congress of the Philippines
which shall consist of:

House of Representatives
(Lower House)

Unless otherwise
provided by law, the
regular election of the
Senators and the Members
of the House of
Representatives shall be
held on the second
Monday of May.

In Case of Vacancy:
Vacancy can be filled through
regular election
Special Elections can be called
for the purpose of filling the
Vacancy
In either circumstance, the one
elected may merely sits for the
unexpired term

Salaries

of Senators and Members Of


House of Representatives shall be
determined by law.

No

increase in said compensation


shall take effect until after the
expiration of the full term of all
the Members of the Senate and the
House of Representatives approving
such increase.

Congressmen have two parliamentary


privileges while Congress is in
Session:
Privilege from Arrest
Immunity from offenses punishable for not
more the
six years Imprisonment.

Privilege

of Speech and Debate

Immunity from libel and slander.

Elected Congressmen must:


Fully disclose their financial and
business interest.
Disclose potential conflicts of
interests that arise in the course of
legislation
Keep from any other office or
employment (appointed or otherwise),
forfeit His/her to do so.

REGULAR SESSIONS:
1. Congress convene once every year on the
fourth Monday of July .
2. Continues Session for as long as it sees fit,
until 30 days before the opening of its
next regular session, excluding
Saturdays, Sundays, and legal holidays.

SPECIAL SESSIONS:
1. Called by he President at any time when
Congress is it in session.

Senate

President and House


Speaker elected by majority.
Other officers, procedures and the
discipline of its members is at the
discretion of each house.
Each House maintains a journal
and record of proceedings
Neither house can adjourn without
the others consent.

Electoral Tribunal is the sole


judge of all contests relating
to the election, returns, and
qualifications of their
respective Members

The Senate and the House shall each


have an Electrical Tribunal which
shall be composed of:
1.3 Supreme Court Justices to be
designated by the Chief of Justice
2.6 Members of the Senate or House
The senior Justice in the Electrical
Tribunal shall be its Chairman.

COMPOSITION:

2. 12 Senators
3. 12 members of the House

Note: The 12 Senators and 12


Representatives are elected on the basis
of proportional representation from the
political parties and party-list organizations.

Voting/Action:
1. The Chairman should only Vote
in case of tie.
2. The CA act on all appointment
within 30 days from their
submission to Congress.
3. The Commission shall Rule by a
majority vote of all members.

The

Electoral Tribunals and the


Commission on Appointments shall be
constituted within thirty days after the
Senate and the House of Representatives
shall have been organized with the
election of the President and the Speaker.

The

Commission on Appointments shall


meet only while the Congress is in
session.

The

records and books of


accounts of the Congress shall be
preserved and be open to the
public in accordance with law

Such

books shall be audited by the


Commission on Audit which shall
publish annually

Ratify the countrys international
treaties ( Senate)
Authorize limited Emergency power
for the President
Approve The government budget

Undertake Project under the CDF


Propose, review and adopt bills for

enactment into law


Overturn a Presidential Veta with the
respect to proposed legislation
Allow for referanda
Propose amendments to the
constitution and call for
constitutional convention.

Congress may not:


Increase appropriation recommended
by the executive branch
Pass tax exemptions without the
concurrence of a majority of its
members
Grant titles of nobility
Pass ex post facto bills
Pass Bills of Attainder
