14. MAIN RECOMMENDATIONS

Policy mix instead of a one-size-fitsall solution


Both carrot and Stick are necessary,
although:
Strict enforcement requires Court decisions or
risks becoming a violation of privacy, or
freedom of expression;
Graduated approach seems to be loosing
ground on account of costs;
Cultural Flat-rate too dangerous for developing
business models and not easily accepted by
consumers;

CONCLUSION: is Copyright still fit


for the digital age?
YES, but the focus must change: ISPs and searchengines must take the responsibility of obtaining
blanket licenses for clearing all contents which their
subscribers may find , upload or download;
The rationale for that lies with the fact that they provide
access do content, and their business model relies upon
the availability of content;
ISPs and search engines have the power to negotiate
blanket licenses with rightholders, as much as the
operators of content distribution platforms negociate
with content producers and then sell packaged content.
