Abstract
Sexual harassment can be seen at work, or work related events, or between
people sharing the same place or between colleagues outside of work.
The trigger behind choosing this topic is that Sexual Harassment in India is
considered to be a social stigma because of which such cases remain unnoticed,
unanswered and unreported.
Despite of the Laws made, committees like POSH (Prevention of Sexual
Harassment) at workplace, and still these issues are likely to happen.
The unpleasant facts which we as human beings stare at it every day yet look
away from it because somebody close to us is not being affected. This kind of
thought process has to change in order to control and report such cases faced by
men and women equally.
Sexual Harassment is not just a physical harm, but also creates severe mental
trauma, which may lead to depression, being mentally unstable and even death.

What is Sexual Harassment??


Is a form of gender-based discrimination
Involves unwelcome sexual advances, requests for sexual
favors, or other unwanted verbal or physical conduct of a
sexual nature
Is illegal if it:
1. becomes a condition of employment,
2. affects decisions about a persons job or career,
3. interferes with work performance, or
4. creates a hostile work environment

Need for Research

The biggest issue faced by the victims is registering sexual


harassment to the concerned authorities as it is still being considered
as social stigma.
Laws have been made to restrain these sexual harassment issues at
work but sadly they have not been followed, not only this but research
statistics show that more than 25% of the MNCs are still not
compliant against the sexual harassment act which have been put
into place and more over more than 36% of the Indian companies
dont have any compliance against sexual harassment at workplace.
Socially, we all have assumed that only women are facing sexual
harassment issues at workplace, home, society etc., but to add to the
surprise even men are facing issues of sexual harassment at

Sexual harassment faced by women is still reported to an extent,
whereas cases pertaining to men are still unregistered.
Many cases are not highlighted so much because they are still
considered taboo in the Indian society, even after laws being created to
help the MNCs and victims of such acts still there are many cases which
remain unanswered.
To look for answers of below Questions haunting us day in day out:
What is the reason for the non-reporting of such acts ????????
And if they are reported why does it take so much of time for our Indian
Judiciary to take action against the culprit ????????
What do the MNCs do to tackle such kind of problems towards both the
genders ????????

25% of the MNCs are still not compliant against
the sexual harassment act and work places which we
think are safe for all of us as workers.
In India, 36% of the Indian companies dont have any compliance
against sexual harassment at workplace these are not even MNC, the
data for MNCs was even a higher where 34% of the MNCs are not
compliant against sexual Harassment.

Of-late people have become bold and have started to report and majority of
cases (78.4 %) were female complaints against males whereas Women were
accused of sexually harassing men in 5 per cent of cases and men accused
other men in 11% of cases.
Sexual harassment is not just limited to work places but also adolescent
children in schools and colleges as well, and the stats show that 50% of
middle and high school students were sexually harassed, but girls were more
likely than boys to be harassed by a significant margin (56% vs. 40%), but
Only 12% of girls reported the harassment at school.
65% of the females said they had encountered "intimidation, threats, or
abuse" in relation to their work, and 32% said they were harassed by male
colleagues at their workplaces.

In India only 27% of the accused people are convicted for rape in India until
2013.
Sexual harassment is not just limited to work, it can happen anywhere, one
of the most unthought-of places which people call home have seen a
massive 70% of women living in India endure domestic abuse.
In India an overwhelming majority of women (90%) who experience sexual
harassment do not register a police complaint. Most of the women
respondents (77%) alleged that they did not report incidents of sexual
harassment as they did not think it would serve any purpose.
Reason behind: Out of the complaints which have been registered by people,
95% of people said they were not satisfied with the law enforcements
response.

In India, most of the sectors sexual harassment is being done, the stats
reveal that,
1. 88% women subjected to sexual harassment at workplace,
2. 80% of these in information technology (IT) and banking firms.
During the course of the review, it was also found that the 16% to 90% of
working women experience sexual harassment at least once in their lifetime.

Recommendations
18% people agrees that the delinquent should be suspended from the job to
send a strong message to other workers, be it men or women, that the
company will not tolerate such behaviour.
It is seen on televisions and newspapers that these kind of reports every day,
the only thing which we can do is feel bad, what we feel is if we have to do
social work, lets start at home, lets make people aware about their rights
and what they can prevent themselves from being a victim of sexual
harassment, and also make them aware and social responsible to do the
same when any one is being sexually harassed.
Sexual Harassment is a disease which has set in , and it would take more
than one hand to eradicate this disease from out community.

Conclusion
As a responsible citizen our duty is not only to prevent sexual harassment at
workplace, but standing against it even if it is not happening to the nearest
kin of ours.
If required one should be proactive and open minded enough to hear the
victim out and guide him/her to take the right steps against the people who
have caused physical/mental harassment to them.
By doing this we are not only helping the person to come out of depression
but also setting an example for the people behind us not to turn a blind eye
against people who are mentally, physically or sexually harassed.
