THE PRACTICE OF CIVIL ENGINEERING

PROFESSIONAL RESPONSIBILITY
-the standard of practice is for Civil Engineers to be given responsibility for studying,
conceiving, designing, observing construction, and assisting in the programming for
operating and maintaining engineering works.
-Civil Engineers shall conduct themselves in a highly Professional Manner and Serve
as Faithful Trustees or Agents of their client or employers.
-Care and protection of the environment is paramount in the Civil Engineers work
engagement.
-Civil Engineers must always strive to maintain the highest standard of Ethical
Professional Practice in their dealing with Client employers, employees, competitors
and the community.

CLIENT-CIVIL ENGINEERING RELATIONSHIPS


Engineering projects come to fruition through the efforts of civil engineering firms
engaged for a specific project or program by public agencies or private clients.
Many public and private entities of necessity rely on Civil Engineers as their
employees.

CLIENT-CIVIL ENGINEERING RELATIONSHIPS


OBLIGATIONS OF THE CIVIL ENGINEER
The obligations of the Civil Engineer include:
1. The Civil Engineer shall exercise reasonable skill, care and diligence in the
performance of his obligations.
2. The Civil Engineer shall act independently and as required by the contract, perform
with the necessary skills and professionals judgement, when require to certify,
decide or exercise discretion between the Client and a Third party with whom the
Client has a contract.
3. The Civil Engineer shall notify the Client of any interest the Civil Engineer has
which may significantly conflict with the interest of the Client under their Contract.

OBLIGATIONS OF THE CLIENT
The Client has the following obligations.
1. The Clients shall pay the Civil Engineer for his Services, the amount of fees and expenses
set out in or determined in their Agreement.
2. The Client shall provide the Civil Engineer within reasonable time (that does not result in
delay to the provision of the Services), all information required by the Civil Engineer in the
performance of his services and a decision in writing on all matters properly referred to
the Client in writing.
3. The Client shall cooperate with the Civil Engineer and shall not interfere with or obstruct
the proper performance of the Services.
4. The Client shall, as soon as practicable, make arrangements to enable the Civil Engineer
to enter the site and inspect facilities needed in the performance of his services.

LIABILITY OF THE CIVIL ENGINEER AND THE CLIENT
The Civil Engineer shall only be liable to pay damages to the Client arising out or in
connection with their Agreement if a breach of duty of care is established against the
Civil Engineer.

The Client shall only be liable to pay damages to the Civil Engineer if a breach of the
Clients duty to the Civil Engineer is established against the Client .

SETTLEMENT OF DISPUTES
If a dispute arises on either party, then that party shall by notice in writing served on
the other party of the details of the dispute and request that the dispute be resolved by
conciliation. If the matter in dispute is not resolved in conciliation between the
parties within the prescribed time then the matter in dispute hall be referred to
arbitration.

CLIENT-CIVIL ENGINEERING RELATIONSHIPS


OWNERSHIP OF DATA, DESIGNS AND DOCUMENTS
The design analysis, drawings, specifications and reproduction thereof are
instruments of service owned by the Professional Engineer and shall be used only for
the specific project covered by the agreement between the client and Engineer.

Feasibility studies
Field investigations and engineering data collection
Environmental assessment, impact statements or Engineering
reports
Opinions of probable construction cost
Preliminary and final designs, drawings, specifications and
construction bidding documents
Assistance in securing bids and in awarding contracts

SPECIALIZATION IN CIVIL ENGINEERING


A Civil Engineer who has demonstrated his knowledge, experience,
education and training in accordance with the requirements of the
concerned Specialty Committee of the PICE is awarded a certificate of
specialization by the PICE.

SELECTION OF A CIVIL ENGINEER


It is usually advantageous for the client to select a Civil Engineer who
can support the project from conception through design, construction,
and project start-up. The Civil Engineers competence in specialty fields,
performance on other projects of similar nature, interrelationship with
the design team members, personnel assignments, provision for
independent review, and costs, insurance and other annual charges
and the resulting life-cycle cost of the project.

EMPLOYMENT
Civil Engineers employed by professional consulting firms,
government agencies, educational institutions, construction firms,
manufacturing and commercial entities and other entities.

DESIGN COMPETITION
Design competition is a process through which a Civil Engineer is
selected above other competitors based on proposal or an innovative
approach to solving a clients needs.

CONTINGENCY BASIS OF EMPLOYMENT


PICE Code of ethics provides that Engineers may request, propose or
accept professional commission on a contingency basis only under
circumstances in which their professional judgment would not be
compromised.

PROFESSIONAL PRACTICE OF FOREIGN CIVIL ENGINEERS


1. The laws of the foreigners state or country allow the citizens of the
Philippines to practice civil engineering on the same basis and grant
the same privileges as those enjoyed by the subjects or citizens of such
foreign state or country.
2. Consultants to be engaged in foreign-funded, joint venture or foreignassisted projects of the government.
3. Civil engineers who were former citizens of the Philippines, who had
been registered and issued a certificate of registration and a
professional identification card prior to their naturalization as foreign
citizens, and who, while in the country on a visit, sojourn or
permanent residence, desire to practice their profession.

BILL OF DUTIES OF ENGINEER TO THE CLIENTS


Duties to his employer or client
1. Duty to observe devotion and fidelity to clients interest.
2. Duty to refrain from accepting commission or allowances.
3. Duty to be candid regarding his financial interest with the vendors and
contractors.
4. Duty to inform the client on the adverse consequences if his engineering decision
or judgement is overruled.
5. Duty to preserve clients secrets. The Engineer is duty-bound to preserve the
secrets of his client.

BILL OF DUTIES OF ENGINEER TO HIS EMPLOYEES


The duties include:
1. Duty to promote their welfare.
2. Duty to commend good work and suggestion.
3. Duty to pleasant and courteous.
4. Duty to be fair in giving promotions.
5. Duty to refrain from firing an employee.

IMPLIED CODE OF ETHICS FOR CLIENTS


Client Implied Ethics
1. The client should select the engineers on the basis of merit in accordance with
accepted practices.
2. The client should pay adequate and equitable fees to the consulting engineer for
his services.
3. The client should accept the consulting engineer as a professional adviser and
extended to him the respect and confidence warranted in such a relationship.
4. The client should accept the responsibility for the consequences to be expected
from variations or deviations from consulting engineers recommendation, which
he decides to make.

IMPLIED CODE OF ETHICS FOR CLIENTS


Clients Responsibilities
1. The client should inform the engineer of his previous involvement with particular
aspects of the industry.
2. The client should request any information that is lacking to him for a complete
understanding of the work, at any stage of the implementation of a project.
3. The client should ensure that he has qualified staff who can completely evaluate
the presentations of the consulting engineer and strike a balance between
technical suitability and eventual cost.
4. The client should properly make important decisions on matters that could
unduly impede the project if they were not made on time.
