The right of hadinah(custody) to the custody of the

child terminates upon the child attaining the age of
seven, in the case of a male, and the age of nine years
in the case of female, but the Court may upon the
application of hadinah, allows her to retain the
custody of the child until the attainment of the age of
nine years, in the case of a male, and the age of
eleven years in the case of a female.
After termination of the right of hadinah, the custody
devolves upon the father, and if the child has reached
the age of discernment (mumayyiz), he or she shall
have a choice of living with either of the parents,
unless the Court otherwise orders.

Within the Islamic education system, there are principally
three fundamental stages in the manner in which
education should be imparted to children. Between birth
until six a child must be showered with utmost care and
affection so much so that by the time he reaches the age
of seven, he is convinced and secured of his parents love
and affection. Between the ages of seven till ten,
discipline must be introduced for this is the period when
he reaches the age of discretion/discerning (mumaiyyiz)
during which he should be encouraged to perform the
basic rites of Islam namely performance of prayers and
fasting during the Ramadhan. When he reaches ten
disciplinary measures ought to be imposed upon non-
compliance.
