AN ACT TO PROHIBIT THE CUTTING OF


TINDALO, AKLE OR MOLAVE TREES, UNDER
CERTAIN CONDITIONS, AND TO PENALIZE
VIOLATIONS THEREOF
Prohibited
The cutting in the public forests of

Tindalo,
Akle, or
Molave trees

Condition:

Less than sixty centimeters in diameters measured at a height of


four feet from the ground (breast high)
Penalty
1. Fine of not more than fifty pesos

2. Imprisonment for not more than fifteen days

3. To Pay two times the amount of the tax on the timber cut

Provided, That in the case of a company or corporation, the


president or manager shall be directly responsible for the
acts of his employees or laborers if it proven that the latter
acted with his knowledge; other wise the responsibility will
extend only as far as fine is concerned:

Provided, Further, That all tindalo, akle, or molave timber


cut in violation of this Act shall be forfeited to the
Government.

4. Who may be liable - any person, company or corporation

Provided that for a corporation and a company, the president


and manager shall be directly responsible for the acts of his
employees or laborers if proven that the latter acted with his
knowledge; otherwise, the responsibility will extend only as far
as fine is concerned

Provided further that the tindalo, akle or molave timber cut


shall be forfeited in favor of the Government

REVISING PRESIDENTIAL DECREE NO. 389, OTHERWISE


KNOWN AS THE FORESTRY REFORM CODE OF THE
PHILIPPINES

The Forestry Reform Code codifies, updates and raises forestry laws
in the country. It emphasizes the sustainable utilization of forest
resources
Policies
The State hereby adopts the following policies:

a) The multiple uses of forest lands shall be oriented to the


development and progress requirements of the country, the
advancement of science and technology, and the public
welfare;

b) Land classification and survey shall be systematized and


hastened;

c) The establishment of wood-processing plants shall be


encouraged and rationalized; and

d) The protection, development and rehabilitation of forest lands


shall be emphasized so as to ensure their continuity in
productive condition.

The Bureau shall have jurisdiction and authority

a) over all forest land,

b) grazing lands,

c) all forest reservations including watershed reservations

All actions and decisions of the Director are subject
to review by the Department Head whose decision
shall be final and executory after the lapse of thirty
(30) days from receipt by the aggrieved party of said
decision, unless appealed to the President

The Decision of the Department Head may not be


reviewed bythe courts except through a special civil
action for certiorari or prohibition

A
The maximum period of any privilege to harvest timber is twenty-five
(25) years, renewable for a period, not exceeding twenty-five (25)

years, necessary to utilize all the remaining commercial quantity or
harvestable timber either from the unlogged or logged-over area.

No new processing plant shall be established unless adequate raw
material is available on a sustained-yield basis in the area where the

raw materials will come from.

C Unless otherwise decreed by the President, upon recommendation of


the National Economic Development Authority, the entire production
of logs by all licensees shall, beginning January 1, 1976, be processed

E. SPECIAL USES
A
No forest land 50% in slope or over may be utilized for pasture
purposes.

Wildlife may be destroyed, killed, consumed, eaten or otherwise
C disposed of, without the necessity of permit, for the protection of
life, health, safety and property, and the convenience of the people.

D Forest lands may be leased for

the establishment of sawmills, lumber yards, timber depots,

F. QUALIFICATIONS
A
Citizenship. 60% and more Filipino equity and participation shall be
preferred

Transfers. No transfer is permitted. The transferor shall forever be
C barred from acquiring another license agreement, license, lease or
permit.
