What Is A Lawyer?
The Origin.

▣ Abogado - Lawyer:
Those two words have as historical precedent the Word
“Advocatus” (Who speak for someone or Who attends the
call) which come from Roman Law.
What is A Lawyer?

▣ Lawyer:
A lawyer, is a person who professionally exercises the
judicial defense of the parts in a trial, his main mission is to
defend Justice, avoid conflicts and seek conciliation.

American and Mexican Law.
Common Law
America, England, Canada and Australia.
American System.

▣ Common Law.
“Common Law” Common law refers to the legal
system created in England to resolve lawsuits or
legal conflicts .

This system is based on the decisions of the courts.


American System.

▣ Conflicts Solutions:
The judge gives judgment referring to the previous
resolution of a specific case similar to the case that he
resolves. This referendum is known as "precedent“.
Civil Law
Mexico, Latin America, Spain, France, Germany.
Mexican System.

▣ Civil Law-Napoleonic Law:


Or Neo-Romanist system: refers to the fusion of the
Germanic legal system and the French legal system created
to resolve legal conflicts.

This System is based on positive and valid laws and rights


and are applied to solve specific cases.

To solve, the judge must apply a rule to a


specific case.
