RULE II
Prohibited Types of Firecrackers and
Pyrotechnic Devices
Categories of Prohibited Firecrackers

1. OVERWEIGHT – firecrackers with more than 1/3


teaspoon or more than 0.2 gram of net explosive
ingredient

2. OVERSIZED, like super lolo, giant whistle bomb, etc.

3. FUSE should not burn less than 3 seconds but not


more than 6 seconds.

4. IMPORTED finished product.

5. MIXTURE of Phosphorous or Sulphur with that of


Chlorates

 Authority to possess explosive/s ingredients


 MUST have at least one (1) licensed
pyrotechnician with training, expertise and
completion of manufacturer’s training
course.

Sec. 2. Dealer’s License

• Authority to possess authorized and


allowable firecrackers and pyrotechnic
devices;
• More than 50 kg of FC and 1000kg of PD
shall be kept in the store
• Stocks must be kept in a warehouse located
in a safe distance away from the store

Sec. 3. Retailer’s Permit

For individuals selling firecrackers of not more than


fifty (50) kilograms of finished products and
pyrotechnic devices of not more than five (500)
kilograms of finished products.

Regions 1, 2, 3, 4, 5, NCR, PRO COR – C, FEO


Regions 6,7,8,9,10,11,12, ARMM and CARAGA-
RCSUs which shall submit their monthly reports to C,
EMD, FEO for accounting and recording purposes.

STORAGE

Rule XII Storage

 General – Warehouse
(bodegas) for storage of
explosive ingredients and
finished firecrackers and
pyrotechnic devices shall
be located, constructed and
managed so as to guard
against pilferage and
accidental explosion of their
contents and to prevent
injury to person or damage
to property in case an
explosion may occur.

Rule XII Storage

Location – For manufacturers, the warehouse


(bodega) and the manufacturing complex shall be
located in accordance with specifications stated
in Section IX hereof. For dealers, the warehouse
(bodega) shall be located at a safe distance away
from their stores/establishments and from
inhabited buildings.

Construction – The warehouse (bodega) shall be


constructed of strong materials, with proper
ventilation, securely locked or otherwise
protected against theft and located away from fire
hazards and slum areas to minimize pilferage
and possible explosion

Rule XIV Confiscation and Depository of Prohibited Firecrackers
and Pyrotechnic Devices
SEC. 1. The FEO, CSG or the NCRPO shall
course the confiscation, investigation and
depository of prohibited importation of
finished firecrackers and pyrotechnic devices.
If, intercepted by the Bureau of Customs
(BOC), Manila, the same shall be turned over
to the FEO, CSG for the filing of the case
while those intercepted by the PNP and BOC
outside Metro Manila shall be handled by the
Police Provincial Office (PPO) that has
jurisdiction over the area. The investigating
unit outside Metro Manila will be responsible
in the disposition of the confiscated prohibited
firecrackers and pyrotechnic devices such as
atomic big “triangulo” and “super lolo” and

Sec. 2. The PNP shall be primarily responsible for the
administration and enforcement of this Implementing
Rules and Regulations.

Sec. 3. All reports pertaining to the confiscation and


investigation of prohibited firecrackers and pyrotechnic
devices shall be copy furnished to C, FEO, CSG (Attn: C,
EMD) for reference.

Rule XVI Penalties
Any person who manufactures, sells,
distributes, or uses firecrackers and
pyrotechnic devices in violation of the
provisions of Republic Act 7183 shall be
punished by a fine of not less than Twenty
Thousand Pesos (P20,000.00) nor more
than Thirty Thousand Pesos (P30,000.00)
or imprisonment of not less than six (6)
months nor more than one (1) year, or both
such fine and imprisonment, at the
discretion of the court in addition to the
cancellation of his license and business
permit, and confiscation by the Government
of his inventory or stock.

Providing for the Regulation and
Control of the Use of Firecrackers and
other Pyrotechnic Devices
Sec. 1. Community Fireworks Display

To minimize the risk of injuries and


casualties, the use of firecrackers shall
henceforth be confined to community fireworks
displays.

Sec. 1. Community Fireworks Display
A display of fireworks qualifies as a community
fireworks display if it complies with ALL of the following
conditions:
a. It is conducted in the occasion or as a part of a
celebration, competition, or similar event held in a
venue other than a place of residence;
b. It is conducted under the supervision of a trained
person duly licensed by the PNP;
c. It is allowed by the municipality/city concerned
through a permit specifying the date and time of
the fireworks display and the specific area in which
the display will be conducted, in conformity with
national standards, rules and regulations.

Sec. 2. Other Pyrotechnic Devices

Pyrotechnic devices other than firecrackers may


be used outside community fireworks display subject
to existing laws, rules and regulations

Sec. 3. Prohibited Firecrackers and Pyrotechnic Devices

PNP is directed to promulgate criteria for what


constitutes prohibited firecrackers and pyrotechnic
devices within 30 days from effectivity of this EO, and
to provide list of them for guidance of the public.

All fireworks falling under this criteria may not be


manufactured, sold, distributed or used, EVEN AS
PART of a community fireworks display.

Sec. 5. Administration and Enforcement

The PNP, in coordination with other concerned


agencies and the LGUs, shall be primarily responsible
for the enforcement of RA 7183 and this EO, which
shall include the conduct of inspections, and the
confiscation and destruction of prohibited firecrackers
and pyrotechnic devices in accordance with law.
