LEGAL BASES for the

LGUs to Appropriate
Funds for the PNP
1. RA 7160 (Local Government Code of 1991)

a. Section 16.
Every local government unit shall exercise the
powers expressly granted, those necessarily
implied therefrom, as well as powers necessary,
appropriate or incidental for its efficient and
effective governance, and those which are
essential to the promotion of the general welfare.
Within their territorial jurisdictions, local
government units shall ensure and support x x x
maintain peace and order, and preserve the
convenience of their inhabitant”
b. Sec. 447
(2) Generate and maximize the use of resources
and revenues for the development plans, program
objectives and priorities of the municipality as
provided for under section 18 of this Code with
particular attention to agro-industrial development
and countryside growth and progress, and relative
thereto, shall:
(i) Approve the annual and supplemental
budgets of the municipal government and
appropriate funds for specific programs, projects,
services and activities of the municipality, or for
other purposes not contrary to law, in order to
promote the general welfare of the municipality
and its inhabitants;
c. Sec. 458
(2) Generate and maximize the use of resources

under Section 18 of this Code, with particular attention
to agro-industrial development and city-wide growth
and progress, and relative thereto, shall:

d. Sec. 468

(i) Enact the annual and supplemental


appropriations of the provincial government and
appropriate funds for specific programs, projects,
services and activities of the province, or for other
purposes not contrary to law, in order to promote the
general welfare of the province and its inhabitants;

5. Peace and Order – an LGU that shows considerable efforts
in maintaining peace and order in the community by
adopting a Local Anti-Criminality Action Plan or Peace and
Order Council Action Plan, providing logistical or financial
support to the local police station, convening the local peace
and order council, and establishing a community-oriented
policing mechanism.
