MANDATE
• The Civil Service Commission was conferred the status of a department by
Republic Act No. 2260 (AN ACT TO AMEND AND REVISE THE LAWS
RELATIVE TO PHILIPPINE CIVIL SERVICE, 1959) as amended and elevated
to a constitutional body by the 1973 Constitution;
• It was reorganized under PD No. 181 dated September 24, 1972; and again
reorganized under Executive Order no. 181 dated November 21, 1986;
• With the new Administrative Code of 1987 (EO 292), the Commission is
constitutionally mandated to promote morale, efficiency, integrity, responsiveness,
progressiveness, and courtesy in the Civil Service.

Mandated Functions
• Administer and enforce the constitutional and statutory provisions on the merit
system for all levels and ranks in the Civil Service;
• Prescribe, amend and enforce rules and regulations for carrying into effect the
provisions of the Civil Service Laws and other pertinent laws;
• Formulate policies and regulations for the administration, maintenance and
implementation of position classification and compensation and set standards for
the establishment, allocation and reallocation of pay scales, classes and positions;
• Appoint and discipline its officials and employees in accordance with law and
exercise control and supervision over the activities of the Commission;

MANDATED FUNCTIONS
• Hear and decide administrative cases instituted by or brought before it directly
or on appeal, including contested appointments, and review decisions and action of
its offices and of the agencies attached to it. Officials and employees who fail to
comply with such decisions, orders, or rulings shall be liable for contempt of the
Commission. Its decisions, orders or rulings shall be final and executory. Such
decisions, orders, or rulings may be brought to Supreme Court on certiorari by the
aggrieved party within thirty (30) days from receipt of the copy thereof;
• Issues subpoena and subpoena duces tecum for the production of documents
and records pertinent to investigations and inquiries conducted by it in accordance
with its authority conferred by the Constitution and pertinent laws;

Mandated Functions
• Advise the President on all matters involving personnel management in the
government service and submit to the President an annual report on the personnel
programs;
• Inspect and audit the personnel actions and programs of the departments, agencies,
bureaus, offices, local government including government-owned or controlled corporations;
• Conduct periodic review of the decisions and actions of offices or officials to whom
authority has been delegated by the Commission as well as the conduct of the officials and
the employees in these offices and apply appropriate sanctions whenever necessary;
• Perform all functions properly belonging to a central personnel agency such as other
functions as may be provided by law.

Coverage
• Apply to all disciplinary and non-disciplinary administrative cases or matters
brought before the CSC.
• It is aimed at ensuring consistency, predictability and stability –values which
are integral in upholding the rule of law. It affords government workers fair
treatment and protects them from being victimized by political biases,
persecution and personal whims.

• Mercedita Reyes, Administrative Officer V of the Local Government Unit of Cavite was
formally charged with the administrative offenses of Serious Dishonesty, Falsification of
Official Documents, Grave misconduct and Conduct Prejudicial to the Best Interest
of the Service;
• That the CSC Field Office (CSCFO)- Cavite requested for verification and confirmation
with the CSC-National Capital Region (NCR, the authenticity of the Career Service (CS)
Professional Eligibility of Lydia L. Austria;
• That when verified, it was found out that the picture and signature in Austria’s Personal Data
Sheet (PDS) are different from the picture and signature in the Picture Seat Plan (PSP)
accomplished during the CS Professional Examination held on June 23, 1996 at Juan
Sumulong High School, Quezon City;

• That further verification revealed that the identity of the person appearing in the
PSP belongs to Mercedita Reyes;
• That Reyes impersonated Austria by applying, taking and passing the CS
professional examination held on June 23, 1996 for and in behalf of Austria; and
• That as a result thereof, the records of the Commission now bears the name of
Lydia L. Austria as a Civil Service eligible for having garnered 85.41% in the said
examination and she was correspondingly issued a certificate of eligibility.

• The CSC issued an ORDER directing Reyes to submit her Counter-Affidavit/
Comment under oath and other relevant documents in support of her defenses on
the allegation that she took the aforementioned examination in behalf of Austria;
• 29 days after receipt of the ORDER, the CSC received Reyes’s Counter-
Affidavit/Comment, vehemently denying the allegations raised against her. She
manifested that she was in and out of the Medical and Lying in Clinic of Dra.
Resureccion Sanding located in Trece Martires City during the the last two (2) weeks
of June of 1996;
• She further declared that it was impossible for her to take the exam for somebody
else on June 23, 1996 considering her medical condition at that time.

ISSUE: WHETHER MERCEDITA V. REYES IS LIABLE FOR
SERIOUS DISHONESTY, FALSIFICATION OF OFFICIAL
DOCUMENTS, GRAVE MISCODUCT AND CONDUCT
PREJUDICIAL TO THE BEST INTEREST OF THE
SERVICE.

• After thorough evaluation and fact finding investigation, the Office formally
charged Reyes with Serious Dishonesty, Falsification of Official Documents,
Grave Misconduct and Conduct Prejudicial to the Best Interest of the
Service. Reyes was particularly directed to file her answer within 72 Hours
from receipt thereof.
• On February 23, 2018, the CSC received Reyes’s answer through her counsel
Atty. C.R. Agdon. She reiterated her manifestations in her Counter-
Affidavit/Comment and further stated that she elected to waive formal
investigation in relation to the instant case.

• After a careful evaluation of the records, the CSC finds that Reyes failed to
overcome the prima facie findings against her in the Formal Charge.
