Section 146.

On what days
presentment may be made.

A negotiable bill may be presented for


acceptance on any day on which
instruments may be presented for payment
under the provisions of sections 72 and 85
of this act. When Saturday is not otherwise
a holiday , presentment for acceptance
may be made before twelve o’clock noon
that day.
Section 72. What constitutes sufficient
presentment.
• Presentment for payment ,to be sufficient, must be
made:
• A. By the holder,or by some person authorized to
recieve payment on his behalf.
• B. At a reasonable hour on business day.
• C. At a proper place herein defined.
• D. To the person primarily liable on the instrument, or
if he is absent or inaccessible, to any person found at
the place where the presentment was made.
Section 85. Time of maturity.

• Every negotiable instrument is payable at the time fixed therein without grace.
When the day of maturity falls upon Sunday or a holiday, the instrument is
payable on the next succeeding business day. Instruments falling due or
becoming payable on Saturday are to be presented for payment on the next
succeeding business day., except that instruments payable on demand may, at
the option of the holder, be presented for payment before twelve o’clock noon
on Saturday when that entire day is not a holiday.
• or under section 85.thre is a distinction between instrument
payable on demand and instruments payable at a fixed
determinable future time.
• Where the instrument is not payable on demand and falls due on Saturday it
must be presented for payment on the next succeeding business day.
• When presentment is for acceptance only, it may be made for all kinds of bills
of exchange before 12 0’clock noon on Saturday , provided that day is not a
holiday.
Section 147. presentment where time
is insufficient.
• Under section 147,the delay in making the presentment for
payment is excused and does not discharged the drawer and
indorsers from their liabilities.
• See section 81. when delay in making presentment is excused.
• It is excused when the delay is caused by circumstances beyond the
control of the holder and not imputable to his default , misconduct
or negligence.

• B. Where the bill expressly stipulates
• C. Where the bill is drawn payable elsewhere than at residence or
the place of business of the drawee .
• Presentment for acceptance is the production or exhibition of the a
bill of exchange to the drawee for his acceptance or payment.
• Section 146 on the days presentment may be
made.

presentment for payment caused by
presenting the bill for acceptance.
• Section 148 excuses non presentment for
acceptance

• Presentment for acceptance is excused
• A. When the drawee is dead, or have absconded,
or is afictitious person or a person not having
capacity to contract the bill.
• B. Where, after the excercise of reasonable
diligence , presentment cannot be made.
• C. Where presentment has been irregular,
acceptance has been refused on some other
ground.

acceptance
