RIGHTS AND OBLIGATIONS
BETWEEN HUSBAND AND
WIFE
Art. 68. The husband and wife are
obliged to:
• live together
• observe mutual love, respect and fidelity;
• and render mutual help and support.

Legal Basis

Art. 69. The husband and wife shall fix


the family domicile. In case of
disagreement, the court shall decide.
Nota Bene
• The court may exempt one spouse
from living with the other if the latter
should live abroad or there are other
valid and compelling reasons for the
exemption.

household shall be the right and the

conjugal union or commits acts which
tend to bring danger, dishonor or

the aggrieved party may apply to the
court for relief.

To protect the rights of the family and
its members particularly women and
children from violence and threats to
their personal safety and security.

children"
• any act or a series of acts which result in
or is likely to result in physical, sexual,
psychological harm or suffering, or
economic abuse including threats of such
acts, battery, assault, coercion,
harassment or arbitrary deprivation of
liberty.

or a woman with whom the person has
or had a dating or sexual relationship,
or with whom he has a common child,
or against her child whether legitimate
or illegitimate.
