•The burden of proof rests on who asserts, not on
who denies.
Information Gathered for the decision making by
setting up Enquiry:
•CCTV images usage in detecting theft and the
gathering of evidence.
• Enquiring employees statements and validation of it in
relation with the theft (eg. Time of Ram being in the
place of crime should match with the time the theft took
place).
• Pay attention to Ram’s actions and keep an eye on his
behavior in the workplace. Thoroughly check any
receipts and track all of his contact with money.
Mr. Kumar can request Ram to submit to a random search
of his belongings.
• include an express term in the contract of employment
to the effect that by taking the job the employee is
consenting to the carrying out of random searches
