Canteens
Section 16

• The appropriate Government may make rules


requiring that in every establishment –
• This act applies
• Employment period
• 100 or more than 100
– Canteen shall be provided and maintained

• Without prejudice to generality of forgoing


power, such rules may provide for –
• Date
• No. of canteens and standard
• Foodstuffs
Restrooms
Section 17

• In every place wherein contract labor is required


to halt at night in connection with the work of
establishment -
• This act applies
• Employment period
– Provided and maintained by contractor restrooms or
other such alternatives

• The restrooms or the alternatives to be provided


shall be
• Lighted
• Ventilated
• Clean and comfortable
Other facilities
Section 18

• It shall be duty of every contractor employing


contract labor in connection with the work of
an establishment to which this act applies to
provide and maintain –
• Wholesome drinking water
• Sufficient number of latrines and urinals
• Washing facilities

• First aid facilities

Section 20

• Liability of principal employer in certain cases

• Responsibility for payment of wages

• Obstruction

• Contravention of provisions regarding employment of


contract labor

• Offences by companies

• Cognizance of offences

Obstruction
Section 22

• Whoever obstructs an inspector in discharge of its


duties or willfully neglect to afford an inspector shall
be -
• Punishable for imprisonment for term extending to 3 months
• Or fine which may extend to 500 rupees
• Or both

• Whoever willfully refuses to produce register or


document to the inspector or prevent anyone to
appear/examined by the inspector shall be
• Punishable for imprisonment for term extending to 3 months
• Or fine which may extend to 500 rupees
• Or both
Contravention of provisions regarding
employment of contract labor

Section23

• Anyone who contravenes any provisions of this


act or contravenes any condition of a license
granted under this act
• Punishable for imprisonment for term extending to 3
months
• Or fine which may extend to 1000 rupees
• Or both
Other offences
Section 24

• Anyone who contravenes any provisions of


this act or of any rules made there under for
which no penalty is elsewhere provided
• Punishable for imprisonment for term extending to 3
months
• Or fine which may extend to 1000 rupees
• Or both
Offences by companies
Section 25

• If the person committing an offence under this


act is a company, it shall be responsible to the
offence and be deemed to be guilty and liable
to be proceeded against and punished
accordingly
Cognizance of offences
Section 26

• No court shall cognizance of any offence


under this act except on a complaint made by
the inspector
• No court inferior to that of a Presidency
Magistrate or a Magistrate of the first class
shall try any offence punishable under this act
Limitations of Prosecution
Section 27

• No court shall take cognizance of a offence


punishable under this act unless the
complaint thereof may be written within three
months of the date of knowledge of the
inspector
