THE TAMIL NADU PAYMENT OF

SUBSISTENCE ALLOWANCES ACT 1981

INTRODUCTION

To provide for the payment of subsistence allowances to employees during the period of suspension. It extends to the whole of the state of TN

Any place where any industry, trade, business, manufacturing or service is carried on.

PAYMENT OF SUBSISTENCE ALLOWANCE

To be entitled to receive payment from the employer an amount equal to fifty percent of the wage which the employee is drawing. The period of suspension exceeds ninety days equal to seventy five percent of the wage which the employee is drawing.

During the period of suspension if employee accepts an employment he/she not allowed to receive any substance allowances.

RECOVERY OF MONEY DUE FROM AN EMPLOYEE

Any money is due to an employee from an employer. In case of the employees death his reprehensive on his behalf can recovery to the government. Government is satisfied that any money is so due from the employer the collector shall recover the same manner as an arrear of land revenue.

SAVING OF CERTAIN RIGHTS & PRIVILEGES

Act does not affect any rights and privilege of the employees. Under any law for the time being in force, custom or usage which is more favorable to him/her than any right or privilege conferred upon him by this act

POWER TO GRANT

The government shall in public interest by notification exempt subject to such condition if any as may be given in such notification from the operation of all or any of the provision of this act. Any class or classes of establishment for such a periods and for such a reasons as may be specified in the said notification.

DELEGATION OF POWER OF THE GOVERNMENT

The government may by notification, authorize any authority or officer subordinates to them to exercise all.

Any of the power given to them by this act and may in like manner withdraw such authority.

PROTECTION OF ACTION TAKEN IN GOOD FAITH

Any other legal proceeding shall lie against any person for anything which is in good faith done or intended to be done in pursuance of this act

PENALTIES

Under this act any rule made there under shall be punishable with imprisonment for a term which may extend to three months

Under this act with fine which shall not be less than one thousand rupees or with both.

EXEMPTION OF OCCUPIER OR MANGER FROM LIABILITY IN CERTAIN CASE

The court shall proceed to hear the charge against the occupier or manager and shall if the offence be proved or convict the occupier or manager.

POWER & NOTIFICATION TO BE PLACED BEFORE THE LEGISLATURE


All the rules made under this act shall be published in the TNG and unless they are expressed to come into force on a particular day.
Shall come into force on the day on which they are so published.

FORMS OF TNSAA

Form :1 register of employee placed under suspension Form:2 half yearly return for the year ending on the 30th day of June/31st day of December. Form:3 application for payment of subsistence allowances by an employee. Form:4 application for payment of subsistence allowances by a person authorized by the employee
