Tractor-Trailer GHG Regulation: Who Does This Rule Apply To?


53-foot or longer box-type trailers (including those equipped with

TRUs) and heavy duty tractors that pull them.

Motor carriers, Drivers, California-based brokers, and California-

based shippers that use/dispatch such equipment. Disclosure and recordkeeping requirement for dealers. DOES NOT apply to drop-frame, chassis, curtain-side, or box-type less than 53 feet in length.

How Do I Comply? Tractors Pulling 53ft Trailers


By 1/1/2010 2011-newer sleepers must be EPA SmartWay Approved. All 2011-newer tractors must be equipped with EPA Approved SmartWay tires. By 1/1/2013 All model year tractors must install EPA Approved SmartWay tires.

How Do I Comply? 53ft+ Trailers


By 1/1/2010 2011-newer trailers must be:

SmartWay Approved; or Have SmartWay tires and a combination of SmartWay approved technology that achieves:
5% fuel savings for dry vans 4% fuel savings for refers

53ft+ Trailers (cont.)


By 1/1/2013 All trailers must be either

EPA SmartWay trailer; Have aerodynamic technology that is SmartWay verified and achieves:

5% fuel savings for dry vans 4% fuel savings for refers (except 2003-2009)

By 1/1/2017 All trailers must install US EPA SmartWay verified tires.

Exemptions
Short Haul Tractor

Limit 50,000 miles/year 53ft trailer is exempt if pulled by short haul tractor

Local Haul Tractor/Trailer


100 land-mile radius of local haul base Exempt from aerodynamic requirements, but must install tires.

Drayage Tractor/Trailer Exemption


Exempt if operated within 100 land miles of port or intermodal railyard Trailer must originate or be destined for ocean-going vessel or rail car

03-09 MY Refer Trailers w/ 03 or newer MY TRUs must have SmartWay tires and meet 4% aerodynamic requirement by:

Tips For Making CA Compliance Easier


Start Early! Last second reporting/planning leaves no room for error Truck and Bus Rule requires you to order equipment by Sept. 1 of prior year to qualify for delay in case of manufacturer delay Redundancy Ensure staff in charge of reporting and compliance/purchasing plans have backups Write down and circulate registration info/passwords Lean on Industry Resources Trust but Verify Rules complex/open for interpretation Get decision-making information in hands of decision-makers

Enforcement
Fines Vary $300 for ECL, $500 for PSIP, $1000 for Truck and Bus Fleet Audit Model Field citations trigger fleet audits for all rules Compounding fines reduced in settlement process

Bang for the Buck Because of enforcement structure, ARB staff incentivized to pursue cases against larger carriers

Future CA Environmental Regulation?

Background Toxics: Cumulative Impacts, community group pressure for zero emissions GHG: Prop 23 Defeated in 2010 (60/40 no vote); AB32 legally requires California to reach 1990 carbon emissions by 2020, authorizes further reductions beyond 2020. Criteria Pollutants: Continued, severe Clean Air Act NAAQS non-attainment in San Joaquin Valley and South Coast Air Basins (Heavy Duty Trucks expected to contribute 25% of all NOx in SJ by 2020)
